Governing Body Notice of Motion: Council Corporate Membership of PCNZ

Purpose

1. This memorandum provides background information and legal advice relevant to theGoverning Body’s consideration of a Notice of Motion on 31 March 2016. That Motionproposes that the Governing Body terminates Auckland Council’s corporate membership ofthe Property Council New Zealand (PCNZ).

Summary

2. The Notice of Motion proposes that the council’s corporate membership of the PCNZ beterminated. This is stated to be so as to avoid any “appearance of conflict of interest ” giventhe council’s regulatory responsibilities to consider and make decisions on the IndependentHearings Panel’s recommendations for the Proposed Auckland Unitary Plan (PAUP), andgiven that PCNZ is a “major submitter ” on the PAUP.

6. The PCNZ is a not-for-profit organisation with around 700 member companies drawn fromthe commercial, industrial, retail, property funds and multi-unit residential property sectors.PCNZ provides research, seminars, advocacy and networking services.

7. PCNZ consists of a number of local authorities including Auckland Council, ChristchurchCity Council, Dunedin City Council, Hamilton City Council, New Plymouth District Council,Tauranga City Council, Wellington City Council and Western Bay of Plenty District Council.Other public entities include AUT, Housing New Zealand, KiwiRail, Massey University, theMinistry of Business Innovation and Employment, NZ Transport Agency, the Reserve Bank,the University of Auckland and the Waitemata District Health Board.

8. The council inherited its PCNZ corporate membership from the former councils.2 Continued membership was evaluated in March 2013. That evaluation found that thebenefits of PCNZ corporate membership consisted of:

i. The council group has access to market data and analysis. This helps the councilgroup maximise returns on investments, developments and property holdings.Council and its CCOs are large property holders.

ii. Staff use PCNZ events and workshops to increase their skills and knowledge ofproperty management and investment.

iii. Discounts to events, workshops and training events.

iv. PCNZ is a networking group enabling council and stakeholders to engage.

strengthening, the Christchurch rebuild, the provision of infrastructure, housing, RMAreform, local government organisation, district plans and consents, and fees and charges.

13. It is not unusual for the council to belong to a professional organisation or special interestassociation given the breadth of council and CCO activities. Many of the currentmemberships have been inherited from the former councils.

14. Based on advice prepared for councillors in 2013, the council and its CCOs belong toapproximately 250 professional organisations or special interest associations. Theseconsist either of corporate membership or individual membership. Depending on the natureof the membership, benefits can include:

i. Professional accreditation.

ii. Training.

iii. Access to data, analysis and information.

iv. Stakeholder engagement and community of interest.

15. Decisions relating to membership of external organisations reside with managers who havethe appropriate delegated authority from the Chief Executive or line manager.

16. The 2013 stocktake of memberships is attached covering the council and its CCOs. Thisincludes corporate membership or individual employee membership where the councilcovers the cost of fees. The attached list from 2013 was representative of the breadth ofthe council groups operations

19. It is appropriate that councillors and staff are alert to conflict of interest risks during theupcoming PAUP decision-making process. Conflict of interest risks can arise (for example)if there is a real risk that councillors are perceived as not bringing an “open mind” to thePAUP decision-making process, by unfairly favouring one party’s point of view overanother. These matters are discussed in further detail in the attached legal advice. Staffwill also be available to assist with advice on conflicts of interest throughout the PAUPprocess.
