Dear Honorable Mayor, City Council Members and City Staff members;

I have reviewed the staff notes that pertain to the Crestridge Senior Condominiums. My concerns are

with the regulations for foliage height. Here are my questions and requests for your consideration:

1. Will the lined photo simulations taken from the four Mistridge and Seaside Heights residences(with their house numbers omitted) be published in the Crestridge C,C,&R's? If not, how will theirHOA and its members know where the line is drawn so they won't violate it?

2. Would enforcement of this foliage height condition involve anyone gaining access to the fourMistridge and Seaside Heights backyards?For example:(a) Would the City need to access those four backyards if other Mesa property owners complainedabout Crestridge foliage heights impairing their views?(b) What would happen if the Crestridge HOA wanted to verify their foliage height line compliance?

We have raised these "access· issues at past City meetings but without satisfactory resolution. Theowners of the four properties sent letters to the City stating their unWillingness to grant such accessand/or that they reserved the right to refuse access.Therefore, prior to approving the foliage height regulation, we request that the City pleasereach agreements with these four property owners in terms of property-access so as to avoidfuture disputes.

3.The Condition refers to "the line" which landscaping heights shall not exceed.That "line" was drawn across the rooftops of simulated buildings which were added to the four viewphotos.It is important to note that no "line" is common to all four photos.The location of the "the line" varies depending on the viewing perspectives, so technically, there aremultiple lines.We ask that the City please ensure enforcement of "the line(s)" which would create the mostrestrictive landscaping heights relative to the viewing perspective(s).

I appreciate all that the city staff and planning commission has done so far to address my concerns andthe concerns of my neighbors. We are fortunate to live in a city that appreciates that value of itshomeowner's views.

I will forward your letter on to the City Council. In the meantime, I offer the following responses to the issues you raisein your letter.

First point: it is envisioned that the photos will be made part of the CC&Rs, and that no addresses will be used.Second point: the condition does not grant permission to access anyone's property. City staff would call or send a letterto make an appointment. It is important to note that if City Staff receives a complaint from a resident along Oceanridge,Mistridge or Seaside Heights, that the foliage is growing above the rooflines, then we will coordinate with that residentto conduct a site visit to verify and document through photographs. Since it is the City's determination and since wewould document through photos, there would be no need for the Crestridge HOA to independently go out to theresidences along the three aforementioned streets.Third point: the condition (as proposed) provides the flexibility to review view impairing foliage from any residence alongthe three aforementioned streets.

Dmitri's performances have taken him to every continent except Africa. He has appeared at many of the most prestigiousconcert halls including Carnegie Hall, Beijing's National Center for the Performing Arts, the Great Hall of Moscow Conservatory,the Great Hall at the Gulbenkian Foundation in Lisbon, Warsaw Philharmonic Hall and numerous appearances at the MariinskyTheater's Concert Hall in St. Petersburg. He has collaborated with conductors Valery Gergiev, Vladimir Spivakov, and Jahja Ling,and has been featured as soloist with numerous orchestras, among them the Cleveland Orchestra, the Louisiana Philharmonic andthe Utah Symphony; orchestras abroad include the China National Orchestra, the Gulbenkian Orchestra, Portugal, and the NationalSymphony Orchestra of Ukraine.

In 2010 he won First Prize at the China International Piano Competition in Xiamen -China's most prominent piano competition.Since entering competition stage in 2005, he has received thirteen top prizes. His consistency and stamina was evident when in thespace of six weeks he won four International Piano Competitions, giving fifteen performances, three of them with orchestras. Histop prizes include: Jose Iturbi Gold Medal (based in Los Angeles, the competition presents the largest monetary prizes offered byany international piano competition in the world) the Vendome Prize (Lisbon) (out of 1250 pianists), Cleveland (the only pianocompetition in the world that has an orchestra ofa world-class stature for its final rounds), and further top prizes at the ArcangeloSperanza, Bosendorfer, Gina Bachauer International Artists Competition (Salt Lake City), New Orleans, Hilton Head, Thalberg,Viardo and World International Piano Competitions.

Dmitri Levkovich was born into a musical family where both of his parents were concert pianists, in addition to his father beinga well-known composer. He received his first piano lessons at the age of three and continued his education at the Lysenko musicschool for gifted children in Kiev, Ukraine. Following the emigration of his family to Israel and then Canada he resumed hisprofessional education at the Curtis Institute of Music in 1996 (Certificate in Composition in 1999) earning his B.M., M.M. andA.D. degrees at the Cleveland Institute of Music, where for eleven years he studied with renowned pianist Sergei Babayan. Havingfinished his studies, he makes his home in New York City.

PROGRAM NOTESCONCERTO ARMONICO No.2 in B Flat-Allegro Count Wilhelm van Wassenaer

To open our concert, this delightful, but unknown work, has been chosen because of itssignificance in recent findings on the true sources of Stravinsky's "Pulcinella" Suite.

"PULCINELLA" SUITE Igor Stravinsky

Stravinsky's first major successes were with Serge Diaghilev's "Ballet Russe" in Paris-includingthe scores of "Firebird", "Petroushka", and "The Rite of Spring".

After the notorious premiere of "The Rite", Diaghilev decided something "more accessible" wascalled for, and suggested Stravinsky write a ballet based on some manuscripts by the earlyBaroque composer Giovanni Pergolesi, which he had collected (he believed) in Rome, andknowing that Stravinsky admired him. Stravinsky was taken with the idea, and composed"Pulcinella", now generally regarded as the first work of his "neo-classical" period.

It was premiered in Paris in May, 1920, conducted by Ernest Ansermet, with decor by Picasso,choreography by Massine, and of course music by Stravinsky-what a tribute to Diaghilev's"impresarial" genius! Unknown to Stravinsky, many of scores he worked from were not byPergolesi (including our first work, as will be discussed in tonight's Preview talk). However, mostof the sources Stravinsky used are redone in terms of his own idiom. The orchestral Suite derivedfrom the ballet has become one of Stravinsky's most popular works. The story is based on a

popular 16th century Italian comedy, with its main characters, the pathetic Pierrot, the flirtatiousColumbine, and the deathless Pulcinella ("Punch" to the English-speaking world).

PIANO CONCERTO NO.5 in E Flat Major ("Emperor") Ludwig v. Beethoven

The "Emperor" Concerto, composed in 1809, was only given its first performance in Vienna in1812, due to Napoleon's war with Austria. The soloist was Carl Czerny; Beethoven had beensoloist in his previous four concertos, but at this time he was too deaf to appear in public(probably one reason it was his last piano concerto). It is the longest and most symphonic of hispiano concertos--no one had composed anything like it up to that time. The opening , with itsimpressive solo statements, prior to an extended orchestra introduction, tells us a major work liesahead. Beethoven directed there were to be no improvised cadenzas, and wrote out only a briefcadenza that appears near the end of the first movement. There is no break between the slowand final movements, a practice which Beethoven used with great effect in his Fifth Symphony.There is a famous moment in the transition from the Adagio, where the bassoon holds a long BNatural (the Adagio key), and then descends a semitone to B Flat, setting up the dominant of EFlat, the key of the Rondo.

We really do not know why the concerto has been named "The Emperor"-one story is that aFrench officer attending the first performance, cried out "what an Emperor of a Concerto".But its imposing grandeur seems to justify the label!

CHAMBER ORCHESTRAOF THE

SOUTH BAYThe primary mission of the COSB is to serve as the fully-professional ciassical orchestra in the South Bay

area of Los Angeles. It is now the only such orchestra officially resident in a South Bay venue, and the only oneoffering a full season with national/international-Ievel soloists. The COSB has received four awards from theNational Endowment for the Arts.

The COSB began as a professional orchestra under Conductor Frances Steiner in 1983, with the completionof the Norris Theatre, where it was appointed resident orchestra in 1987. It is now in its 30th Season, giving abasic five-concert season, and its audiences have grown to the point where it has sold-out the Norris for thepast eight years.

The COSB has received good reviews from the Los Angeles Times, and has been recognized as a qualityprofessional orchestra by the California Arts Council and National Endowment for the Arts. Its final concert ofthe 1997-98 season was broadcast by KKGO-FM, probably the first time a performing arts group from the SouthBay areas has been broadcast by a major Los Angeles radio station. In a December 1999 review, LA TimesCritic Daniel Cariaga wrote: "One of the better-kept local secrets, the Chamber Orchestra of the South Baycontinues to uphold high standards in both performance and programming. Under music director FrancesSteiner, the ensemble's final offering of 1999, Sunday night at Norris Theater in Palos Verdes, met and evensurpassed those standards in exciting and admirable ways."

Dr. Steiner made musical history when she became the first woman to conduct a professional orchestra (theGlendale Symphony) from the stage of the Los Angeles Music Center's Dorothy Chandler Pavilion. In additionto the COSB and Carson/Dominguez Symphony, her guest conducting includes appearances with the Bay AreaWomen's Philharmonic, Wisconsin Chamber Orchestra, Long Beach Symphony, Oakland Symphony and theNational Symphony Orchestra of the Dominican Republic.

At the age of eight, Frances Steiner's musical education was launched with a scholarship to study withGregor Piatigorsky at the Curtis Institute of Music. At the Meadowmount School of Music she also studied withLeonard Rose.

After graduating from Curtis with a bachelor degree in music, she went on to study composition with WalterPiston and Randall Thompson at Harvard University where she received an M.A. She studied conducting at theFontainbleau Schooi of Music in Fontainbleau, France, under Nadia BOUlanger, and received a D.M.A. from theUniversity of Southern California where she majored in cello and conducting. Post-graduate studies includemaster classes with Daniel Lewis and Leonard Bernstein.

Her multi-faceted career includes cello solo appearances with the Philadelphia Orchestra and Glendalesymphony; and principal cellist chairs with the California Chamber Symphony, Glendale Symphony,Festival Orchestra (Lincoln Center), and assistant principal chair in the Los Angeles Chamber Orchestra.The conductors of these orchestras included: Leopold Stowkowski, Carmen Dragon, Daniel Lewis, andNeville Marriner.

As stated in the Staff Report and Addendum Number 2, the Trump Organization must obtain permission fromthe Coastal Commission and the Commission Staff before installing New Zealand Christmas trees as a hedge atits driving range. This permission has not been received.

Approval of the applicant's request at this time is NOT a minor adjustment to the Conditional Use Permit. It isa major change in the required procedure that would set a very undesirable precedent.

It seems inconceivable to me that the City Council would not adhere to the Coastal Commission's and the City'srules and regulations in order to satisfy the wishes of any applicant.

Please do not grant the Trump Organization's request.

I agree with the Coastal Commission Staff regarding the value of retaining the Condition of Approval with respect to NewZealand Christmas Trees on the Trump National driving range:

"Retaining the language would ensure that the correct permit process is reflected on the City's permit.That is, the applicant, or his successor in interest, applies for an amendment to the permit from theCommission, unless the Executive Director of the Commission determines that no amendment is legallyrequired. Retention of the language would ensure that there is no confusion over the correct permitprocedure, and that a Coastal Development Permit is approved before development occurs on the site. "

I believe that the lessons we learned, from the process involving the Annenberg Foundation's proposal for development ofLower Pt Vicente, support retaining the COA. We should be moving toward a policy of greater transparency in the publicrecord, in this case retaining very clear documentation and notice of restrictions on development not only for the good ofthe applicant but for the public, as well. We should not move toward facilitating developers' (or anybody else's) disregardof laws or other agencies' requirements, which are, after all, in place to protect the public's interests.

Accordingly, I oppose removal of the Condition of Approval in the last sentence of K-2b.Eva Cicoria

Since reading the staff report, I have some further comments on Revision CCC to add to what I wrote in myprevious letter dated May 14.

Here is the reason expressed in the letter from the Trump Organization to the City for the request Rev.CCC: "In anticipation of several high-profile guests at the Club in the coming weeks and months it is our goalto showcase our practice facility as well as the City of Rancho Palos Verdes in the best light possible.The hedges as approved in Revision ZZ, are an important and critical "piece of the puzzle" in achieving thisgoal." .

Trump Revision "W' states:G. OPERATION OF THE GOLF COURSE AND DRIVING RANGE8. Any changes in the project which results in significant changes in the development characteristics oftheapproved conceptual plan per Condition F. 7 above, shall require that an application for a revision to theConditional Use Permit be filed.

Since this request requires a Revision to the CUP, it is Not a "minor change" as stated in the staff report. It is asignificant change.It is my understanding that if that part of the agreement (which the applicant agreed to in 2012) getscancelled, then the Trump organization would be able to by-pass the Coastal Commission process and plant thehedge plants Now, before the Coastal Permit application is completed and processed for approval ordenial. The "species" is not the issue. Planting a hedge before being granted a Coastal Permit is the issue.

I object to Revision CCC and ask that you do Not approve deleting the sentence in the Condition of ApprovalK2-b. The specific sentence reinforces the authority of the State Coastal Act and of the City of RPV to enforceproper procedure.

Like other applicants, this Applicant should obtain the Coastal Permit before development occurs on thesite, not vice-versa. That's the process everyone else has to follow. While I appreciate the fine amenities thatTrump National provides to the public, I believe that this developer should follow the rules and permit processand wait for Coastal Commission review. Others in the Coastal Zone are not exempt from CA CoastalCommission review prior to planting. Neither should this developer be exempt.

As for the concern in the staff report about the City incurring expenses if the Condition remains unchanged andthe applicant plants the hedge anyway, there is provision initiated by Mayor Brooks and approved by theCouncil in Jan. 2012 for the developer to reimburse the City for any costs incurred for trimming or removal.

The City of RPV and the Coastal Commission has allowed the "temporary opening" and operation of thisfacility without a permit since June 2005 until now.That's almost 8 years without a Coastal permit!

As an Alternative to this request, I suggest that the developer/applicant be allowed to place (but not install in

the ground) boxed plants on the Driving Range for the tournaments or special "high-profile guests" functionsonly, and then remove the crated plants within a few days after the event.

Please do not give approve Revision CCC as presented.

Dear Mayor Brooks and Council Members,

I am opposed to the revision of the conditions of approval that require Coastal Commission prior approval ofthe planting of the New Zealand Christmas Trees. While we may all understand that CCC approval is ultimatelyrequired, it seems clear that the applicant is intent on planting the trees first, then waiting to see if the CCC actsto interpose an objection. This is not unlike the applicant's would happen, and asking for forgiveness after thefact, rather than approval prior to taking the action.

The language in the condition requiring prior approval provides the City with enforcement powers that can andshould be exercised in the event of breach. Any costs associated with recoupment of costs expended by the Cityin enforcement are recoverable against the property owner, and upon failure by the owner to reimburse the City,the City would have the power, right and authority to impose a lien on the property for the recoupment. Theproposed revision takes away the City's power to enforce the condition and impose a lien. There is nojustification for weakening the City's authority over the matter.

Please leave the condition as written and continue to require PRIOR approval by the CCC before the trees areinstalled.

The Coastal Commission review is a vital, final safeguardprotecting views for the residents of Rancho Palos Verdes and allwho share the Palos Verdes coastal view. It is also a vitalsafeguard to preserve the habitats of native animals which may andoften do include members of endangered species.

Thus the provision requiring Coastal Commission review andapproval, which all others are routinely required to follow, shouldnot be bypassed for anyone, and especially not for the Trumporganization which has in the past repeatedly shown a totaldisregard for the welfare of the residents of Rancho Palos Verdesand the animals which inhabit the Palos Verdes Peninsula. TheTrump organization has made clear on numerous past occasionsits priority to modify its property according to its own wishesregardless of whether the modifications negatively impact the rightsof other residents and regardless of agreements it has previouslyaccepted.

Thus the agreements currently in place are vitally needed tocontain ruthless developers like Trump and should be left intact. I have reviewed the staff notes that pertain to the Crestridge Senior Condominiums. My concerns are

with the regulations for foliage height. Here are my questions and requests for your consideration:

1. Will the lined photo simulations taken from the four Mistridge and Seaside Heights residences(with their house numbers omitted) be published in the Crestridge C,C,&R's? If not, how will theirHOA and its members know where the line is drawn so they won't violate it?

2. Would enforcement of this foliage height condition involve anyone gaining access to the fourMistridge and Seaside Heights backyards?For example:(a) Would the City need to access those four backyards if other Mesa property owners complainedabout Crestridge foliage heights impairingiheirviews?(b) What would happen if the Crestridge HOA wanted to verify their foliage height line compliance?

We have raised these "access" issues at past City meetings but without satisfactory resolution. Theowners of the four properties sent letters to the City stating their unwillingness to grant such accessand/or that they reserved the right to refuse access.Therefore, prior to approving the foliage height regulation, we request that the City pleasereach agreements with these four property owners in terms of property-access so as to avoidfuture disputes.

3.The Condition refers to "the line" which landscaping heights shall not exceed.That "line" was drawn across the rooftops of simulated buildings which were added to the four viewphotos.It is important to note that no "line" is common to all four photos.The location of the "the line" varies depending on the viewing perspectives, so technically, there aremultiple lines.We ask that the City please ensure enforcement of "the line(s)" which would create the mostrestrictive landscaping heights relative to the viewing perspective(s).

I appreciate all that the city staff and planning commission has done so far to address my concerns andthe concerns of my neighbors. We are fortunate to live in a city that appreciates that value of itshomeowner's views.

Whatever happened to the money which was donated before it took a City Council action to accept them? Ihear that The Discovery Room at Ladera Linda is no longer a ghost barn. Why isn't the skunk skin, a livemount? Why doesn't the hummingbird have a flower? Why is the Great Homed Owl's gopher still in afreezer? Those were specific, not General Fund Donations. Easy answer. The City Council took the moneyaway from Parks & Rec and Staff can't remember to ask for it back.

The only reason why it requires a City Council resolution to make and send out Thank You notes is because theCity ofRPV got so poor that they became like parents who had to steal their son's bar mitzvah money to putfood on the table. We are not so poor any more. Take a guilt trip. Please stop abusing less than major donorsand volunteers.

Choose one City wide non-profit organization and support it. Los Serenos or PVPLC. Stop jerking them botharound. It all comes down to the RPV General Plan Update. Where are your ambitions headed? ...S

Just because some money can be saved doesn't mean you have to spend it. But, if you are inclined to, nowwould be a good time to buy the design for a TYPE 4 trail connection across San Ramon Canyon. The actualtrail construction could then be a change order to the work in progress. The bulldozers are already on site.

I favor the route shown on the attached map as from the RPV Conceptual Trails Plan (CTP) because it makes amuch more gradual climb up to Friendship Park. Because of the two very local earthquakes we just had,someone just suggested to me that the connection should be designed as least a TYPE 3 because if somedisaster obstructs the intersection at 25th and Western, emergency vehicles could get to and from the southeastcomer of RPV without putting the whole burden onto PV Drive East and the switchbacks.

According to Ron Dragoo, this trail was not included with the Storm Drain Project design due to a lack offunds. And, this Council approved the Preserve Trails Plan with this trail as somewhere, someday. Somebodyneeds to remember that trails and canyon crossing infrastructure are not just for recreation.

Put that in your STUDY SESSION.

I am writing to you with the disadvantage of not being at my home and having very short computer access, but I want tostate my feelings about matters to be considered by you in the near future (before I am home).

I've just done some quick research which confirmed my suspicions that some very important things happened about 40years ago with respect to our wonderful city and the State of California.

Proposition 20 ... creating the California Coastal Commission ... was passed by the voters of California in 1972 - as anative Californian, I proudly voted for it!

The city of Rancho Palos Verdes was created in January of 1973.

Both the above occurances were specifically to protect California ... the CCC to protect the access and enjoyment of ourspecial coastline for all to enjoy. And RPV to protect our wonderful coast from over-building and thus allow all (not justRPV residents) to enjoy that very special coast.

It is not time to throwaway all that so many have worked so hard to procure for everyone.

The Coastal Commission MUST continue to examine and approve any thing that happens along the coast

And Rancho Palos Verdes MUST protect its city and citizens from any loss of use or view of its coastal accessand views.

I think you are doing a great service to our neighborhood by protecting our views from the highways and other criticallocations on the peninsula. I do not agree with you on this issue. The hedge has been approved by the RPV city staffand they have incorporated height restrictions into the conditional use permit. This is now a part of the landscapingplan for the entire driving range. It seems reasonable that if the city is satisfied with the height of the hedge to screenthe area, the hedge should not be treated any different than the entire driving range. It should be allowed to beincorporated into the current operation of the temporary driving range while the Coastal Commission reviews theapplication.

With respect to contract changes, change orders happen. From my perspective and many of my neighbors that lookonto the driving range, we much prefer the beautiful driving range to another housing development.

The applicant has known from the beginning that thechange from residential use to a Driving Range would require Coastal Commission approval. Range has not been approved by the Coastal Commission.The Coastal Commission needs to review and decide on the issue of the New Zealand hedge on the DrivingRange, which is higher than the agreed to southerly berm in the original agreement. It is a matter of long termcontract compliance.Others in the Coastal Zone are not exempt from CA Coastal Commission review. Neither should this developerbe exempt.No hedge of any kind should be installed there as it would impair the views from the public trail and from thepublic road. (and from neighboring residences).

Just a quick note to thank you for your reconsideration of funding nonprofits serving the residents of Rancho PalosVerdes.

I can assure you that the 50 or so low-income residents of RPV that your funding allows us to serve are equallygrateful. (As you may know, we provide low- and no-cost medical care to families, individuals and children who eitherhave insufficient or no health insurance. Aside from the Harbor-UCLA Emergency Room, these folks do not have a lot oflocal options.)

I know that Rancho Palos Verdes-like all California cities-is wrestling with dwindling allocations from the state andfederal governments, and you have to make difficult financial decisions that have local impact. And I realize that thecity's nonprofit funding program may well be phased out. However, we deeply appreciate your past support and hopethat we will be able to obtain support at least for this upcoming two-year cycle.

That money does make a difference in the lives of the people to whom we provide care.
