Where Are We Now?
• A draft amendment to the Virginia constitution has been passed by the Virginia General Assembly.
• That draft amendment needs to be passed by the General Assembly again during the 2020 legislative session.
• The proposed amendment will then go to the public for approval in Nov 2020.
Implementing LegislationNeeds to contain provisions such as the following:• Criteria for selection of citizen commission members:
– Must be selected to represent all of Virginia– Must represent a balance of political parties and
independents– Must not be a current or former employee of any incumbent
or candidate• Additional criteria for the election districts:
– Must keep local jurisdictions and communities of interest together to the greatest extent practicable
– Must not gerrymander – “No district shall be drawn with the intent to favor or disfavor any party or individual.”
What’s my ASK?
• Keep doing what you’re doing now – Work to elect the best candidates you can!
• Firmly remind them that they need to finish the job of redistricting reform, including strong implementing legislation containing the provisions outlined in this presentation.
• Help OneVirginia2021 by signing our “Action Form” again to keep the message going to members of the General Assembly.
Backup• Republican Redistricting Commission members conspire with
Republican Virginia Supreme Court Justices to enact a Republican gerrymander. -- Can this really happen?– First, if we give up on redistricting reform, we’ll be no better off than if we
leave things as they are now. We’ll just get a gerrymander by whomever is in the majority.
– It would require a wide scale conspiracy involving members of both the legislature and the Virginia Courts (retired), all in full view of the public.
– VA Supreme Court Justices are not elected party officials and historically have not been political.
– We are striving to ensure the implementing legislation contains provisions that would make such a gerrymander illegal.
– If the very unlikely happens and they do it anyway, we file suit and get the redistricting overturned.
– An attempt to do Dan’s Dooms Day scenario would give reformers a clear reason to redo the redistricting reform amendment to completely remove the legislature from the process – with the possible exception of a final up or down vote to accommodate a Robert’s SCOTUS ruling to require that redistricting be done by State Legislatures.
