The Smog Check Program is an exceptionally important part of California’s plan to help clean the air we breathe. As Chief of the Bureau, one of my responsibilities is to continually evaluate the efficiency and effectiveness of the Smog Check Program.

As you may know, the BAR-97 EIS is over ten years old. In terms of

technology the BAR-97 EIS needs updating. Some of the BAR-97 EIS manufacturers have expressed concern that they will have difficulty maintaining the equipment beyond 2010. Many station owners and Smog Check technicians have expressed concern about BAR-97 and the rising maintenance and operating costs. BAR also needs to update this technology to implement some Smog Check Program improvements.

To address these long-standing issues, BAR is working to replace the BAR-97 EIS with a BAR-2010 EIS. The idea of the BAR-2010 EIS was first presented at the October 2007 BAR Advisory Group meeting.

The concept of BAR-2010 is a departure from the current BAR-97. The BAR-2010 EIS will be a PC-based system with a modular design. The modules can be replaced by the station or a BAR-approved service provider. The target date for implementing the BAR-2010 is late 2010.

As envisioned, some of the existing Smog Check equipment used by stations will be redeployed for the BAR-2010. Updates on Smog Check Inspection Procedures Manual and Reference Guide In June 2008, the Bureau of Automotive Repair (BAR) released a draft update of the Smog Check Inspection Procedures Manual and a final version of the Smog Check Reference Guide. A draft of the manual is available on BAR’s Web site.

The Smog Check Inspection Procedures Manual is expected to be finalized shortly. Stations and technicians will need to follow these Smog Check inspection procedures once the regulations are finalized. Some of the major updates to the manual include:

• Visible Smoke Test Procedures. Previously, the procedure for this test could only be found in BAR regulations. The procedure is now also found in the manual.

• Low Pressure Fuel Evaporative Test (LPFET). Refinements specify that if a visual inspection failure is found on the evaporative system “tank side,” the LPFET should not be performed. “Tank side” means the portion of the evaporative system between the canister seal, or pinch point, and the fuel tank filler neck. Tank side visual failures can affect the LPFET.

• Clarification of the “before test conditions” to verify normal vehicle operating temperature. In the previous manual, technicians were instructed to verify normal operating temperature and to ensure that the ignition switch had not been turned off for at least three minutes before conducting an inspection. The procedures in the new manual clarify that the engine must actually idle for three minutes at normal operating temperature immediately before inspection—rather than just be turned on. The procedures also specify that a vehicle may be idled or driven to achieve normal operating temperature.

The Smog Check Reference Guide contains information pertaining to the operation of a Smog Check station. This includes information on station and technician licensing requirements and the Consumer Assistance Program.

The guide also contains technical information concerning verification of aftermarket parts. The aftermarket parts guidelines include a new catalytic converter identification matrix that technicians can use to verify proper vehicle application.

On-Board Diagnostic Test Functionality for Flexible Fuel VehiclesThe On-Board Diagnostic (OBD) monitoring for Flexible Fuel Vehicles (FFVs) can be uniquely complex and challenging. In particular, OBD systems for FFVs must determine the type and, in many cases, the mix of fuel and employ appropriate management and monitoring strategies. In consideration of these complexities, the United States Environmental Protection Agency (EPA) allowed automobile manufacturers waivers from OBD monitoring during alternate fuel operation until the 2004 model year. As a result, the OBD systems for FFVs may operate and test differently than typical vehicles.

To assist states with their inspection and maintenance programs, the EPA has coordinated with automobile manufacturers to develop a list of flexible fuel vehicles that present OBD test compatibility issues. BAR has added this list of vehicles to the “OBD Technical Reference.” The OBD Technical Reference can be found on BAR’s Web site at www.bar.ca.gov/80_BARResources/ftp/pdfdocs/APPENDIX_J.pdf.

In addition to FFVs, the OBD Technical Reference Guide provides information about other vehicles that may have difficulty completing the OBD II functional test. The guide includes manufacturer-specific information for individual vehicle makes and models, as well as a test exception for all vehicles equipped with a Controller Area Network (CAN) and are currently incompatible with the BAR-97 OBD II functional test. When conducting a Smog Check inspection, technicians must remember that CAN-equipped vehicles cannot currently be OBD tested. To identify a CAN-equipped vehicle, check the OBD Technical Reference Guide matrix.

CAN-Equipped Vehicles Visual Identification UpdateTechnicians should discontinue using the pin six and 14 method as described in a previous ET Blast entitled “Identification of Vehicles with the CAN Communication Protocol.” BAR recently determined that some vehicles will still have pins in the sixth and fourteenth locations of the OBD connector because the automaker installed them for proprietary reasons.

Vehicle Retirement Program Set to ExpandIn 2007, the Legislature passed and Governor Schwarzenegger signed into law Assembly Bill (AB) 118 (Chapter 752). The bill, entitled the California Alternative and Renewable Fuel, Vehicle Technology, Clean Air, and Carbon Reduction Act of 2007, is a significant piece of legislation designed to improve air quality. Among other things, this bill is designed to achieve the low-carbon fuel standard currently under development by the California Air Resources Board (ARB). The bill provides the funding and incentives necessary for the research, development, and deployment of clean alternative fuels.

One element of AB 118 creates the Enhanced Fleet Modernization Program for the voluntary retirement of high polluting vehicles. This retirement program is to be administered by BAR and will complement BAR’s existing vehicle retirement program. The new program is to be funded through an increase in the vehicle registration fee.

AB 118 requires BAR to administer the program pursuant to regulations established by ARB. The regulations must ensure the following:

• Permanently retire vehicles through a BAR-contracted dismantler

• Target areas of the state that would benefit most

• Provide for flexible compensation to consumers based on the age of the vehicle, the emissions reduction benefits, the emissions impact of any replacement vehicle, and the location of vehicles in areas with the poorest air quality

• Consider cost-effectiveness and impacts on disadvantaged and low-income consumers

In May 2008, ARB in cooperation with BAR conducted the first of several workshops to hear public comment on the development of regulations for the program. ARB’s regulations should be adopted by spring 2009, and the program will be operational on January 1, 2010.

Automotive Repair Dealer Registration Prefix ChangeThe Bureau of Automotive Repair (BAR) recently notified Automotive Repair Dealers (ARDs) about changes in registration prefixes due to a conversion in its licensing database. Many ARDs and vendors that produce these forms have sought clarification from BAR regarding these changes.

According to Title 16, California Code of Regulations section 3356, an “invoice shall show the dealer’s registration number and the corresponding business name and address…” Previously, BAR registration numbers included a six-digit number preceded by two alpha-characters. Under the new system, while the six digits will remain the same, the two alpha-characters will change to “ARD.” For example, if your invoice previously listed your registration number as BAR #AB123456, it will now be BAR #ARD123456.

It should be noted that this will not affect your EIS or Low Pressure Fuel Evaporative tester. The change in the license number does not affect the unit’s performance.

BAR is working on regulations to clarify these requirements. These regulations should be adopted some time this year.

At this time, BAR will not take enforcement action against an ARD for using either the former or new registration number on the invoice.

BAR requests that all ARDs use the new registration once your current invoice stock is exhausted.

Smooth Start for Visible Smoke Test On March 26, 2008, the Visible Smoke Test was implemented as part of Smog Check inspection procedures. Overall, implementation of the test has gone very well.

Before implementation, the Bureau of Automotive Repair (BAR) distributed smoke test training DVDs to all Smog Check stations. The video can be viewed on YouTube, or through the the link provided on BAR’s Web site at www.smogcheck.ca.gov/80_BARResources/04_Miscellaneous/Consumers/VisibleSmokeVideo.html.

Smog Check technicians are required to either pass or fail a vehicle for visible smoke by entering the results under the “Other Emission Related Components” category in the Smog Check Emissions Inspection System (EIS).

Because this category is used for other emissions-related failures, there is no way to capture the exact number of vehicles failing their inspection due to the Visible Smoke Test.

Nonetheless, prior to the implementation of the Visible Smoke Test, Smog Check technicians failed an average of 15 vehicles per day under the “Other Emission Related Components” category. After implementation of the Visible Smoke Test, approximately 60 “Other Emission Related” failures per day were reported. This is an increase of approximately 45 vehicle failures per day. When the daily results are used to project the number of failures over a full biennial cycle, an estimated 33,000 vehicles may be expected to fail the Visible Smoke Test.

DragNet Program Crushes Illegal Street Racing CarsThe word is out on the streets: take part in illegal street racing and you could lose your ride.

Two vehicles stopped by DragNet-trained peace officers during an illegal street race in Elk Grove were found to have stolen engines and transmissions and highly modified emission controls. They were subsequently ordered destroyed by the court. Crushing the cars not only removed potential safety threats from the roadways, but it also removed significant emissions from the air as well.

The DragNet program is a partnership between the California Office of Traffic Safety, state and local law enforcement and BAR. The program has been very successful in identifying illegal vehicles that put the public in danger and excessively pollute the air.

BAR Chief Sherry Mehl says “It has been a privilege for BAR to participate in the DragNet program. I am very proud of my staff and the effort they have put into this program. BAR has helped train over 8,000 peace officers throughout the State.”

The unnecessary deaths associated with illegal street racing continue to climb, and they have claimed the lives of too many Californians.

The DragNet program demonstrates law enforcement’s commitment to aggressively identify these illegal cars, and judges are increasingly ordering these

vehicles destroyed. The message is this: If you race on the street, law enforcement will find you. And when they do, you face significant civil and criminal penalties all the way up to the loss of your car.

Get on the BAR Mailing ListThe Bureau of Automotive Repair (BAR) maintains several mailing lists of interested parties who have asked to receive information such as notices, bulletins, newsletters, workshop flyers, and other items related to BAR operations.

BAR maintains a Regulatory Actions Notice Interested Parties mailing list. In accordance with Government Code section 14911, BAR is also required to correct, verify, and update this list annually. The list is primarily used to mail regulation hearing notices, regulation workshop invitations, informational meeting invitations, and other miscellaneous information.

The Regulatory Actions Notice list is not used for mailing the Auto Repair & Smog Check News. Requests to be added to the newsletter mailing list are often confused with the Regulatory Actions Notice list. To help BAR staff direct mailing list requests to the correct location, we have provided a form for you to fill out. If you are a licensed Smog Check technician or a registered Automotive Repair Dealer (ARD), you are automatically placed on the list that is used to mail the newsletter and other official notices. We Get Questions on…. Adding a Station to an Auto Repair Dealer RegistrationWhat type of station(s) may I add to an existing Automotive Repair Dealer Registration (ARD)?

• Smog Check station - This includes Test-Only, Test-and-Repair, and Gold Shield stations and all must be equipped to perform Smog Check inspections.

• Lamp station - Official lamp adjusting stations must be equipped to test, inspect, adjust, and repair all lamps and related electrical systems on all vehicles.

• Brake station – Classes of official brake adjusting stations are established as follows:

Class A – Official brake adjusting stations must be equipped to test, inspect, adjust, and repair all brakes and brake systems on all vehicles.

Class B - Official brake adjusting stations must be equipped to test, inspect, adjust, and repair all brakes and brake systems on all buses, trucks, truck tractors, trailers, and semi-trailers.

Class C - Official brake adjusting stations must be equipped to test, inspect, adjust, and repair all brakes and brake systems on all trucks or truck tractors having a manufacturer’s gross vehicle weight rating of less than 10,000 pounds, all trailers and semi-trailers that do not use compressed air or vacuum to actuate the brakes, and all passenger vehicles including motorcycles and motor-driven cycles.

How do I apply for a station license?

In order to add a smog, lamp or brake station to your existing ARD you must submit the correct application along with the applicable fees. The applications can be downloaded by visiting BAR’s Web site at www.smogcheck.ca.gov or by calling the Department of Consumer Affairs at 800.952.5210 or BAR at 916.255.3145.

Licenses will be issued only after a BAR representative performs an on-site inspection of the station to confirm that the applicant meets the qualifications prescribed by regulations.

What are the fees for an initial station license?

If I want to open a Smog Check Test-Only station and a Smog Check Test-and-Repair station, are there any restrictions?

A Smog Check Test-and-Repair station may not have ownership, corporate interest in, nor any financial interest in a Smog Check Test-Only station within a geographical radius of 50 miles of the test-and-repair station.

Can I change my Smog Check station type?

If you wish to change the designation of your Smog Check station (i.e. from Test-and-Repair to Test-Only or vice versa) you will need to submit a new application and SGS forms, and pay the appropriate fees. Also, you will need to specify when you want the change to take effect. Please be aware that there will be some “down time” while BAR processes the change and schedules an inspection. You will be unable to perform Smog Check inspections during this time.

What if I move my station?

A registrant or licensee must notify the Bureau within 14 days of any change in either the mailing or street address. You can obtain a change of address form by visiting BAR’s Web site at www.smogcheck.ca.gov or by calling BAR at 916.255.3145. There is no fee for changing your address. However, if you own a Smog Check and/or a lamp and brake station and file a change of address, a BAR representative must inspect the new location prior to you being able to perform an inspection.
