GENERAL TERMS AND CONDITIONS OF SALES

I. APPLICABILITY OF GENERAL TERMS AND CONDITIONS1.1. These General Terms and Conditions apply to any and all purchases and sales that are in any described,mentioned, promoted or listed in the Pierre Hermé Paris UK catalogue for the territory of the United Kingdom andthe Republic of Ireland. By placing an order, the Customer accepts these General Terms and Conditions. PierreHermé Paris reserves the right to modify the General Terms and Conditions at any time and, as of the date ofmodification, new transactions entered into Pierre Hermé Paris and its Customers shall be governed by the modifiedTerms and Conditions.1.2. No additional condition sought to be introduced by you shall be deemed applicable unless expressly so indicatedin writing by an authorised officer of Pierre Hermé Paris. In addition, the failure of Pierre Hermé Paris to exerciseone or more of its rights hereunder shall not be deemed a waiver of those or any other rights.

2.2. Each request for product is subject to approval by Pierre Hermé Paris. Pierre Hermé Paris reserves all rights toreject a request for product due to insufficient stock, incomplete customer information, or for any other lawful reason.In order to best respond to your needs, we recommend you place your order at least 48 hours in advance. For largerorders, we recommend placing the order at least 72 hours in advance.

2.3. All cancellations by the Customer less than 24 hours before the scheduled order delivery date will lead to thetotal billing of the order sum (excluding delivery fees).

2.4. All cancellations by Pierre Hermé Paris of the service requested will lead to the reimbursement of the totalamount paid by the Customer excluding all other indemnity.

III. PRICES3.1. Unless otherwise noted, all of our pricing and other charges are stated in Pounds Sterling (£) before tax and aresubject to change. Only prices appearing on the duly accepted order form are definite.

3.2. Shipping charges, which are payable by our customers, are extra, and vary by destination. These are availableupon request from Pierre Hermé Paris.

IV. PAYMENT METHODS4.1. All orders will be subject to a down-payment equal to 50% of the sum total of the order. The balance must besettled upon reception of the invoice. All amounts remaining unpaid by the payability date stipulated on the invoicewill lead to, by right, and following prior formal notice, penalty fees equal to 1.5 times the legal interest rate, towhich will be added the inherent costs of this delay.

4.2. We reserve the right to refuse to deliver any new orders received by a customer who would not have settled allhis outstanding invoices.

V. AVAILABILITY OF PRODUCTSThe catalogue lists all the products that are generally available from Pierre Hermé Paris in the UK. From time totime products may be out of stock or otherwise unavailable. Pierre Hermé Paris reserves the right in the event of the unavailability of an item(s) to substitute an item(s) of equalor greater value with the consent of the customer. There is a possibility that the presentation of the gift items may be modified to insure proper delivery and handling.

VI. DELIVERY OF PRODUCTSAll efforts will be made to assure prompt delivery of your order. Orders are delivered to the address and at the timeagreed upon during order taking. The order will be delivered to the customer for a signature on the delivery form,mentioning the delivery time and invoice settlement, unless otherwise agreed. In the event of a delay of more than2 hours from the scheduled delivery time of the order, the delivery fees will not be charged, except in the case ofabsence, incomplete or incorrect address. Failure to identify properly to the transporter problems upon deliverymay result in your inability to pursue a claim. Once the product is delivered, we cannot be responsible it if is lost ordamaged from the environmental conditions in which it is left or that develop after its delivery.

VII. TRANSFER OF OWNERSHIPThe transfer of ownership does not take effect until payment in full has been received by us. The transfer of risk ofloss or deterioration takes effect when the product is delivered to, and received by, the addressee or its agent.

VIII. COMPLAINTS8.1. Pierre Hermé Paris prides itself on its high level of products and its service. If you have a criticism or a complaint,please contact us at once. We will try our utmost to meet your expectations but need your help in order to do so.Customers receiving a parcel from us should inspect it upon receipt to make sure it is consistent with the order andthat there are no obvious flaws. Damage claims should be clearly recorded, dated and signed on the delivery form.

8.2. All claims must be made within 8 days of the invoice date. Claims received by Pierre Hermé Paris after longerdelays may not be honoured.

8.3. All claims must be motivated and accompanied by a written explanation of the problem, as well as the damagesoccasioned thereby. After an analysis of the situation, Pierre Hermé Paris at its own discretion will determine theappropriate remedy, including a refund of payment or a reshipment of product.

8.4. Pierre Hermé Paris will not be liable for any special, indirect, incidental, punitive, or consequential damages,including, without limit, loss of profits, revenue or other benefits arising from or related to a breach of this agreement,or for claims against you by any third party.

IX. FORCE MAJEUREPierre Hermé Paris will not be liable for any disruptions in its delivery services which are a result of a force majeure,notably protests, transport strikes, blockades, or traffic difficulties of an unusual nature.

X. GOVERNING LAWAll of our transactions shall be governed by the laws of the United Kingdom without regard to its choice of lawsprovision.

XI. NO RESALEWhen you order products from us, if you are a consumer, you agree that it is for personal use (by you or otherindividual(s)) and that they will not be resold by you or other individual(s) unless authorised to do so by PierreHermé Paris.
