    ORDI.NANCE ESTABLISHING A SEPTAGE AND SE.WAGEMANAGEMENT PROGRAM. OF BALIWAG, BULACAN

    By: Atty. EnrIque V. dela Cruz, Jr.WHEREAS, the Municipal Government of Baliwag is committed

    to the principle of 'sustainable development'in the management of themunicipality's physical and natural resources;

    WHEREAS, an environmental concern of the Municipality issustainable management of waterways to meet the recreational andsafeguard the life-supporting capacity of the water and its aquaticecosyste ms;

    WHEREAS, the Municipality is committed to improving the waterquality of the water source within its territory;

    WHEREAS, the concerns primarily relate to the observeddegradation water quality of the river and Its environment includingeffects such as sewage fungus and algal growths, and the public healthrisk associated with bacterial pollution ;i n the water;

    WHER!EAS, the sources of a large amount of contaminants ordischarges come from untreated domestic sewage discharges andtrade wastes/ or industrial liquid wastes which can cause significanthealth risk to people using the river, and some residential areas duringflooding;

    WHEREAS, residential, commercial, trade and industrialestablishments continue to use septic tanks, and many had not beenproperly-designed, improved or updated through the years, even fordecades which continue to make discharges into the sewers thatfurther degrade many waterways and the river;

    WHiEREAS, Section 20 of the Clean Water Act (RA 9275)imposes the xxx "local government units shall share the responsibiHtyin the manaqement and improvement of water quality within itsterritorial jurtsdtction' xxx;

    WH'E:REAS, existing laws pertaining to wastewater managementand treatment need a more effective framework and enforcementmechanisms for proper implementation in achieving this objective.

    NOW T,H,EREFORE BE IT ORDAINED, AS IT IS HEREBYORDAINED, by the Municipal Council of Ballwaq, Bulacan, in sesslonduly assembled;

    SE.CTION 1. Scope. This Ordinance shall apply to all building'sand structures whether public or private, residential, commercial/mstltutional, industrial, or residential proposed/planned or existing.

    SECTION 2. AUTHORITY. The Ordinance is the enabling act forimplementation of the provisions and spedfications of the followinglaws:

    a. The National Bu'ilding Code of the Philippinesb. The sanltatton Code of the Philippi,nesc. The Plumbing Code of the Philippinesd. The Clean Water Act

    SECTI.ON! 3. 'DEFINITION OF TERMS. As used in thisordinance the terms below shaH be defined as follows;3.1 Baffle- a device (as a wall or screen) to detect, check or regulatethe flow of sewage and septage.3.2. CENRO - City Environment and Natural resources Officer3.3. Condominium - a buIlding or complex in which units of property,such as apartments, are owned by individuals and common parts ofthe property I such as the g'rounds and buil.ding structure, are ownedjointly by the unit owners.3.4.. Contaminant - any substance (including gases, liquids, solidsand micro-organisms) or energy (excluding noise), or heat, that eitherby itself or in combination with the same, similar/ or other substances,enerqv, or heat - when discharged into water, changes or is likely tochange the physical, chemical or biological condition of water

    3.5. Desludging - the process of removing accumulated sludge orseptage from the septic tank3.6 Discharge Permit - a permit to discharge something3.7. Discharge - the act of pilting, leaking, pumping, pourlnq,emitting, capturing, releasing or dumping of any material into a waterbody or onto land which might flow or drain into sald water ..3.8. Effects - positive or negative/temporary-permanent/past-presentor future effect/cumulative average quantity of discharge

    The term "effect" refers to:Any positive or adverse effect;Any temporary or permanent effect;Any past, present or future effect;Any potential effect of high probability;Any potential effect of low probability which has a highpotential impact,

    3.9. Effluent - discharge from known source which is passed into abody of water or land, or waste water flowing out of a manufacturingplant, including domestic, commercial and recreational facilities.3.10. Environme.nt - all of the biotic and abiotic factors that act onan organism, population, or ecol.ogical community and influence itssurvival and development

    Biotic factors - include the organisms themselves their foodand their interactions.

    Abiotic actors -include such items as sunlight, soil, air, water,climate and pollution3..11. Domestic sewage - sewage containing human excrement andliquid household waste3.12 Hazardous Substances - any substances which may impairhuman, plant or animal health or may adversely affect the wealth orsafety of any person or the environment, and whenever or notcontained in or forming part of any other substance or thing3.13. Master ~Plumber - an individual who is licensed and authorizedto install and assume responsibility for contractual agreementspertaining to plumbing and to secure any required perrnlts

    3.14. Objective - desired result, end state, situation or conditionaimed for3.15 P'oint-Source Discharge - discharge from specific or identifiablesource3.16. Sanitary Engineer - a person duly reqlstered with the BoardExaminers for Sanitary Engineer (RA 1363)3.17. Septage- the sludge produced on Ii ndividua I onsite wastewaterdisposal systems, principally septic tank and cesspools3..18. Scum - a slime or filling covering on the surface of the liquid inthe septic tank3.19 Septic Tank - a water-light receptacle which receive thedtscharqe of a plumbing system or part thereof, and is designed toaccompl'ish the partial removal and digestion of the suspended solidmatters in the sewage through a period of detention.3.20 Sewage - water-borne human or animal wastes, excluding oil oroil wastes, removed from residences, buildings, institutions,industrials, and commerclalestabllshrnents together with such groundwater, surface and storm water s may be present3.21. Sewe.rage - any system or network of pipelines, ditches,channels, or conduits including pumping stations, life stations andforce mains, service connections, including other constructions,devices and treatment of sewage to a point disposal3.22. Structure - an edifice or building of any kind, or any piece ofwork artificial both up or composed of parts jolned together in somedefinite manner.3.23 ..Subdivision - an area composed of parcel of land intended fordevelopment for housing purpose.3..24 Townhouse - a residence in a city composed of houses.3.25 Treatment - any method, technique, or process designed toalter the physical" chemical, or biological and radiological character orcomposition of any waste or wastewater to reduce or prevent pollution3.26. Wastewater - waste in liquid state containing pollutants

    3..27. Water Quality - the characteristics of water/ which define itsuse in characteristic by terms of phvsical, chemical, bloloqlcal,bacterioloqical or radiological characteristics by which the acceptabilttvof waste is evaluated.

    SECT10N 4. GENERAL DESIGN, CO NST.RUCTION ANDMAINTENANCE R E . Q U I R E M E N T OF SEPTIC TANKS4..1. The general deslqn, construction and maintenance requirement ofseptic tanks hall be in accordance with the provisions of the PlumbingCode of the Philippines specifically Section 4 of its Implementing Rulesand Regulations, the National Building Code of the Philippines and itsrelated codes.

    4 ..2 The septic tank shall be designed to be the depository of allwastewater generated within the building or structure.SECTION 5. SEPTIC TANK M.AINTENANCESec. 5..1. Desludging of septic tank is mandatory every 3-7 years (incoordination with MWSS concess.ionaire)

    SECTION 6. P E R M I T T I N GSec. 6.1 Septic tanks for industrial/ commercial/ institutional andresidential must be designed by a Sanitary Engineer or Master plumberas the case may be.Sec. 6.2 Upon the completion of the construction of the septic tank, thecovering shall be done only in the presence of abuilding inspectorunder the Septage management Unit. The proof or certificate ofinspection shall be part of the requirements in the issuance of theOccupancy Permit.

    SECTION 7..SLUDGE DIS.POSALSection 7.1. Disposal of sludge must be done by any DOH/DENRaccredited individuals/ companies, private or public in any DOH/D'ENR-approved disposal facility. Sludge materials shall not be in the localwaste collection system,

    Sect.ion7.2. All entities under this Ordinance upon or after lnspectlon,shall present a proof of desludg'ing (Desludging Certificate) to avoidpenalties thereof.SECTIONS. WATER QUALITY STANDARDSSectionS.1 For verification purposes, all wastewater effluents mayundergo actual sampling and must be subjected to the existing Rulesand Regulations of DENRas per DENRAdministrative Orders No. 35, 5of 1990 and DAONo. 34/ 5 of 1990.Section 8,.2. Pretreatment for Commercial Facilities. Wastewater froma commercial or other non residennel facility Is acceptable if the septictank only receives wastewater typical of households (i.e. from toiletand sinks). If the wastewater contains substances of a commercialnature such as oil or fuel residue, metals or high volumes of orgrease an appropriate pretreatment program, approved bv the CENRO,must be in place.SECTION 9. COMMUNAL SYSTEMSection 9'. 1,.Communal septic tanks shall follow the specifications asto the location, design and construction requirements as provided forunder Section 5 of this Ordinance.Sect.ion 9.2 ...Communal effluent system shall be under the guidelinesprovided for by the LLDA/DENR.Section 9.3. Communal septic tank is hereby required in housing areaswhere the Indtvldual lot area is less than fifty (50) square meters.SECTION 10. INDUSTRIAL iE.TABLISH MENTSAll industrial establishments are required to submit or present thelatest Discharge Permit issued by the LLDA. The Environmenta.lCompliance Certificate shall also be required prior the issuance of theirbusiness permit.SECTION 11. SUBDIVISIONSSection 11.1. All subdivisions for development during the effectivityof this Ordinance shall be required to install appropriate seweragefacUities including a wastewater treatment facility.

    Section 11.2.. Prior to the submission of the subdivision plan to theCity Council, the proposed sewage disposal system must be submittedto the Local Building Official for approval.Sect:ion 11.3. The plant shall contain a n pertinent information relativeto the installation of sewaqe disposal systems .. Proper disposal ossewage in subdivisions shall conform with the provisions of thisOrdinance.S,ECTIO:N 12. DESIGN AND CONSTRUCTION STANDARDS OFSEWER SYSTEMS

    All designs, materials, installation requirements of a sanitarysewer must conform wIth the MWSS Designs and Standards forSanitary Sewer.SECTION 13. ADMINIST'RATION AND ENFORCEMENT

    The City Engineer's Office shall desiqnate field inspectors thatwill check on the general design, construction and maintenancerequirements of septic tanks in subdivisions, commercial and businessestablish ments.

    The 'Municipal Environment Management Office shall be in-charge of regulating and monitoring wastewater discharges inidentified pint-sources ..

    The Municipal Health Office shall be in-charge of regulating andmonitoring septage collection, transport and disposal.SE'CTION 14..PENAL PROVISION

    Any person or entity who shall violate any provision of thisOrdinance shall be penalized as follows;

    1. Building /Structures withoutseptic tanks , Php .5,000.00

    2. For buildings/structures withincorrect/improper septic tank Php 5,000.003. For not meeting the standardsset forth by this Ordinance Php 5,000.00

    4. For improper sludgedisposal , Php 5,000.00

    5. For not regularly desliudgingtheir septic tanks , Php 5,000.00

    6. For not complying with theProcedural, requirements Php 5,000.00
