PUBLIC INTERNET ACCESS TO DOMESTIC RELATIONS CASES: STATUS UPDATE

Pursuant to a Supreme Court directive, Missouri is moving to a paperless court system. As a part of this, the public will have an opportunity to access court documents through the Internet—access which is not available currently. As a part of this brave new world, some documents have already started to be scanned by Greene County Circuit Clerk Steve Helms. In Domestic Relations cases, the only documents scanned thus far are Judgments entered after December 15, 2010, and the attachments to those Judgments. While the attachments were scanned, on most cases they are not able to be viewed and are separate documents. As a general rule, attachments are mostly NOT able to be seen by the public. There are a few that were scanned and “attached” to the Judgment code, which DO make them viewable to the public. Dissolution cases are assigned a Security Level One. Each document has a code. Currently, the Office of State Court Administration (“OSCA”) restricts public access to all document codes in Level One cases except Judgments. Thus, when a member of the public accesses a case via the Internet on Casenet, the only document they are currently able to see is a Judgment (if it has been scanned). At sometime in the near future, ALL documents in domestic relations cases will be scanned. Unless OSCA changes their current policy, those documents will remain unavailable for viewing to the public. These new documents in Level One cases will, however, be able to be viewed by an attorney on Secure Casenet if the attorney has registered for efiling. Paternity cases are assigned a Security Level Two. Again, each document has a code. OSCA restricts the public’s ability to view the documents on Level Two cases, except for Judgments. The Paternity Judgments entered in the Thirty-First Circuit do, however, continue to carry the Level Two designation. Thus, currently the public is unable to see any of the documents on Level Two cases.

It is anticipated that OSCA may (and likely will) make more document codes available for public viewing on the Internet at some point in the future. In other words, unless a special higher security level is assigned to a particular kind of document, then ALL document codes on Level One cases may be available for viewing to the mass public in the future. Many concerns have been raised about the private information contained in Judgments and the attachments accompanying the Judgments in Domestic Relations cases. The law requires certain statutory findings in a Judgment. By law, therefore, the Court must articulate the most private details of not only the litigants, but also those of their children. Judgments submitted by agreement, whether by Affidavit or otherwise, typically contain only the most generic language and do not include private financial information. It is beneficial that those Judgments remain accessible to the public by the Internet. In addition to Judgments containing mandated statutory findings, other privacy concerns arise because certain financial information MUST be included in order for subsequent actions to be taken (e.g. VIN numbers if the other party fails to sign a gift Affidavit). The Court en banc of the Thirty-First Circuit, cognizant of its responsibility to protect the privacy of minors and to maintain the expectation of parties in the privacy of their financial information and also of its obligation, with appropriate limitations, to provide open court records, has sought the most appropriate way to balance these interests. Consequently, the Court en banc in the Thirty-First Circuit has approved an Administrative Order that raises the Security Level to a Level Three only on the following documents: (1) Judgments in contested Domestic Relations cases; and (2) attachments to Judgments in all Domestic Relations cases. Documents that carry a Level Three designation are not currently able to be viewed on the Internet by the public or even by attorneys. The public and attorneys will still, however, be able to access through the Internet the vast majority of Judgments entered

SUMMARY OF THE GREENE COUNTY CIRCUIT COURT EN BANC MEETING HELD ON MARCH 14, 2012

1. Judge Holden—Restitution Payments Referred to Debt Collection. This topic was discussed at the last Court En Banc and he asked for some clarification. Judge Mountjoy will prepare an Administrative Order to document the courts policy on this topic.

2. Judge Fitzsimmons—Report from SMBA Parking Committee. Judge Fitzsimmons reported on the most recent information about planned parking.

3. Judge Cordonnier suggested that a Dismissal Docket be instituted on Circuit Civil cases. The purpose of the Dismissal Docket to remove cases that are no longer being prosecuted and reduce the number of cases needing to be scanned. The Court En Banc approved the plan and directed the Court Administrator to conduct the Dismissal Docket.

4. Judges Powell and Brown reported that they were being assigned to several cases from Division 25 with requests for Jury Trials. A suggestion was made to solicit Judges from counties near to Greene County to hear jury trials for Division 25 cases. Judge Mountjoy tasked the Court Administrator with organizing this process.

5. Jerry Moyer presented a report on the Greene County Municipal Courts showing the disposition of Alcohol Related Traffic cases pursuant to 577.006 RSMo.

6. The Court Administrator presented the Scanning Committee’s Recommendation to expand scanning. The recommendation was reviewed and tabled for future consideration.

7. Closed Session: A motion was made to enter an Administrative Order concerning raising the Case.net security level of contested Judgments of Dissolution and other documents. These documents contain personal and sensitive party information. The motion carried and is approved.

SUMMARY OF THE GREENE COUNTY CIRCUIT COURT EN BANC MEETING HELD ON APRIL 11, 2012

1. Release of Defendant Into Treatment: Judge Holden understands that no transportation is available for to take defendants in jail to treatment facilities. Tim Smith, County Administrator will investigate the situation and report back to the Court En Banc.

2. Scheduling of Criminal Cases on Friday Mornings: Judge Holden asked about the number of criminal courts in session on Friday mornings. It had been reported to him that attorneys were required in several courts at the same time.

3. Camera’s In the Courtroom: Judge Fitzsimmons reported that there had been a breakdown in communicating a request to allow television camera’s in his courtroom but that the situation had been resolved. Gene Hartley the Media Coordinator was present and reported his concerns about process of seeking permission for camera’s in the courtroom and getting camera’s into the Judicial Court Facility. Jerry Moyer will review this process and report back.

4. Report Of Court Administrator: A. A trip to St. Charles County is planned, if

anyone wants to go or has questions please contact Jerry.

B. The Scanning Project update: 561 new Circuit Civil cases; 1138 old Circuit Civil cases; 862 Traffic cases; 882 Adult Abuse & Child Protection cases; 2324 Non case types; and 3428 Garnishments have been scanned.

C. The Circuit Civil Dismissal Docket has 293 cases and will be completed on June 1, 2012.

D. Report on the Missouri Court Automation committee. A survey on E-Filing was sent to all courts. Information collected in the survey will be used to determine which courts will be selected next for implementing E-Filing.

E. Division 25 Schedule: With the help of Judges Munton, Reaves and Curless additional days have been scheduled. 10 Bench trial days, 12 Regular docket days and 6 Jury trial days.

5. The Court En Banc went into closed session to discuss personnel matters. No votes were taken.

in Domestic Relations cases. The Court estimates that contested Judgments are only approximately five percent of those entered. In addition, the members of the public will continue to have full access to all of the docket entries in Domestic Relations cases (except Paternity cases) through Casenet. Placing a Level Three designation on these documents does not seal the document. It merely limits the ability of someone in Greene County, Redondo Beach, California, McAllen, Texas, and/or Kuala Lampur, Malasia to access from the Internet the private information contained in these documents. The public will still have the same ability as previously to access the paper files in the clerk’s office. Judgments in contested cases will continue to be available to view by the public, as well as any attachments in Domestic Relations cases. Anyone may still view the document at the courthouse, which is the same level of access now existing. The Circuit Clerk will develop a procedure for viewing any increased Security Level documents for both attorneys and the public at large when there is no paper file. We are currently in the process of identifying cases tried to the Court where Judgments have been entered since December 15, 2010. Those Judgments will be given the Level Three security level. We will not be reviewing any old cases for any scanned attachments that may be viewable to the public because we believe most of the attachments, though scanned, were done as separate document codes and not “attached” to the Judgment in Casenet. Our suggestion for all attorneys is to review any cases on which you may have included private information either in a Judgment or on an attachment to ensure that it is not currently available on the Internet. We will address any sensitive information you find on a case by case basis. Bring it to the attention of the Family Court Commissioner assigned to the case. PLEASE REMEMBER THAT IT IS THE RESPONSIBILITY OF COUNSEL TO REDACT PERSONAL INFORMATION CONTAINED IN JUDGMENTS AND ATTACHMENTS. While SOME personal financial information is required to be included in Domestic Relations cases, most is not. Court Operating Rule 2.02 provides that the clerk will NOT review each document to ensure that no personal information is in the document. Careful drafting of your Judgments and the accompanying attachments will result in fewer problems for your clients. • • •

NERSMBA “Legal Services Spotlight”

Every year for the past 27 years, volunteers from the private bar have represented the poor across Southern Missouri. The volunteers are part of the Volunteer Lawyers Project, which started through a grant the Greene County Bar Association, now known as the Springfield Metropolitan Bar Association (SMBA), received from the American Bar Association. The volunteers, who range from newly licensed attorneys to retired attorneys, from solo practitioners to members of large firms, dedicated hundred of hours to public service through this joint project of SMBA and Legal Services of Southern Missouri. In 2006, SMBA Executive Director Crista Hogan and the SMBA Board of Directors made a commitment to expand the Volunteer Lawyers Project by initiating the “Legal Services Spotlight” at the monthly SMBA Meetings. Each month Brian Hamburg, or members of the SMBA Mentorship

Monday class, would present two cases to members of SMBA for placement. Over the past six years, SMBA members accepted 98 cases, helping over 300 people (includes children of each client helped) in resolving their legal problems. Also, during this same timeframe, SMBA and Legal Services recruited 101 new attorneys to the Volunteer Lawyers Project. The hours invested by SMBA members have made a lifetime of difference for our clients. Improving the lives of individuals improves communities. We are grateful to Crista and the Board of Directors who have supported the “Legal Services Spotlight” over the past six years. Their support and generosity has helped expand our services to the poor. We thank all of the SMBA members who have walked the path with us providing direct services to our clients. Together we are improving equal access to justice. We truly appreciate you supporting our never-ending endeavors.
