TERMS  AND  CONDITIONS  OF  SALE  Payment  Terms  

1.1 Any  bare-­‐root  tree  orders  of  6  to  10  trees  will  receive  a  5%  discount.  Orders  of  11  of  more  trees  will  receive  a  10%  discount.  

1.2 In  order  to  receive  the  discount  in  clause  1.1  a  deposit  of  5%  for  6  to  10  trees  and  10%  for  11  or  more  trees  is  required  by  April  30th  2015.  

Limitation  of  Liability  2.1 Cherry  Lane  Nursery  takes  reasonable  care  to  ensure  that  plants  are  correctly  labeled.  2.2 Any  warranty  in  relation  to  any  defect  concerning  goods  will  not  apply  if  the  defect  is  due  to:  

2.2.1 abnormal  or  extreme  temperatures;  2.2.2 other  abnormal  weather  conditions  including  extreme  rainfall  or  lack  thereof;  2.2.3 damage  during  transportation  of  goods  after  they  leave  the  nursery;  2.2.4 the  Customers  failure  to  ensure  proper  storage  and  maintenance  of  plants;  2.2.5 damage  caused  by  pests,  diseases  and/or  viruses  latent  or  patent.
