President’s Perspective

May 2012 I have just returned from the 2012 National USBC Convention. (Full Disclosure: For those who are unaware, I am also this year’s President of the Orange County USBC As-sociation and a national delegate to the convention from Orange County.) It was a privilege and a great honor to be present for the Class of 2012 inductees from California. The world’s best wheelchair bowler, Al Uttecht, was inducted into the USBC Hall of Fame in the Pioneer category; Joan Feinblum, was inducted for Meritorious Ser-vice; and DeDe Davidson was inducted for Superior Performance. Other members of the 2012 class include Dave Husted, Superior Performance, Amleto Monacelli, Superior Performance, Tom Baker, Su-perior Performance, Lennie Boresch, Jr., and Gary Daroszewski for Outstanding USBC Performance and the late Kerm Helmer posthumously for Meritorious Service.

USBC recognizes that it needs to become more relevant to our mutual customers. USBC President Andrew Cain reiterated this to the delegates and attendees several times during his President’s Report at the annual meeting.

Several rule changes passed this year, to take effect August 1, 2012:

- Under proposal LR2, games bowled in ‘separate competitions’ (think playoffs, sweepstakes and other contests that a league bowls that are not part of the final position standings) now count toward individual averages. This will most likely require extra work, as sweepstakes scores will have to be included in your league-end average reports to your local association.

- Under proposal LR3, a league’s board of directors may as of August 1, 2012, by 2/3 vote, adjust a bowler’s average upward during the season. Currently, the only legal way to accomplish this is to vote to dismiss the bowler from the league and then invite him/her back in at a higher average.

- Under proposal LR4, the adoptable rule for calculating position round ties may now permit handicap leagues to break ties based on total handicap pinfall, rather than by scratch pinfall.

- Under proposal TR1, a bowler bowling in a tournament that employs Rule 319 (tournament average verifica-tion rule) is required to submit the highest of his/her previous season’s single-league average based on a minimum of 21 games or a composite previous season’s average of ALL USBC leagues, including those with less than 21 games bowled.

One relevant bylaw change also passed, which becomes essentially operative on March 15, 2013. From that date forward, bowlers who purchase a membership in a summer league will no longer receive the following year’s dues (August 1 – July 31) included in their membership. All cards will expire on July 31 of each year, regardless of when during the fiscal year the card was purchased. Executive Director Report From West to East In a matter of three days, I completed a whirlwind tour of BCSC centers that took me from our most western member (Zodo’s in Goleta) to the far-thest east center in California (Sandy Hills Lanes in 29 Palms).

These two locations could not feel like more different climates. The Central Coast of Cali-fornia was dreary and cold when I stopped to see Steve Davis at Zodo’s, and the high desert was topping out around ninety degrees when I visited with Todd Markov-sky at Sandy Hills. Although my body felt like I was in another world, it was comforting to speak with these two pros of the industry and how they manage their business. While both Steve and Todd shared their successes and struggles, it was clear they strive to keep their customers happy and try new things to grow their business. Staying

on top of the latest trends in getting new bowlers, but also in how to efficiently operate a center hopefully is a top priority for anyone in the bowling business. That is why I strongly encourage everyone to join us for the very important meeting at Fountain Bowl on May 9. Our three expert speakers will help you find new ways to make money on new bowlers, get more money out of your current customers and save money on costly government fees to Cal/OSHA. CA Supreme Court Sides with Businesses on Employee Breaks

Yesterday, the California Supreme Court provided much needed clarity for employers on the ques-tion of meal or rest breaks, ruling that employers are not obligated to ensure that employees take their legally mandated break periods. The Court considered whether California’s law requires employers to merely provide meal and rest breaks to employees or whether employers are responsible for ensur-ing that employees take those breaks at certain times during employee shifts. California is one of a handful of states that imposes a financial penalty on employers who violate meal and rest period laws. Since the Supreme Court ruled that employers must merely provide, rather than ensure breaks, the decision is expected to resolve and reduce many class action lawsuits filed by employees. The origi-nal case was filed in 2004 by restaurant workers at Brinker International. Employees claimed that by not issuing direct orders for employees to take breaks at regular intervals, employers are taking ad-vantage of employees who do not want to take breaks and leave colleagues during busy periods. The business community argued that requiring companies and managers to order employees to take breaks is an unmanageable policy. Decisions about taking breaks should be made by the employees. Under the California law:

• Employers must provide employees with a ten minute break for every four hours worked. That work should be in the middle of the work period when possible. • Employees must be provided with no less than a thirty-minute meal period when the work period is more than five hours. • If an employer does not provide all of the rest or meal periods required in a workday, the employee is entitled to one additional hour of pay for that workday. This addi-tional hour is not counted as hours worked for purposes of overtime calculations.

In addition, the California Supreme Court ruled that a lower court acted properly in certifying a sub-class of workers who claimed rest breaks weren’t provided as required. The Court also sent part of the case back to the lower court to consider the question of whether a subclass should be certified for workers who claimed they weren’t provided a meal break as required. In addition, the Court found the lower court erred in certifying a third subclass of workers who claimed they were forced to work off-the-clock. The Supreme Court’s ruling helps to clarify and direct the lower court’s decision.
