I. CALL TO ORDER

The City Council Members of the City of South Padre Island, Texas held a Special Emergency Meeting on Monday, April 13, 2020, at the Municipal Complex Building, 2nd

Rodrigo presented an overview of the current budget and highlighted several areas, such as, compliance with required reserves, excess reserves available, funding for infrastructure, budget reductions due to COVID-19 hardships.

Environmental Health Director Victor Baldovinos announced the City winning first place in Category 1 in the 2020 Governor’s Community Achievement Awards. The City will received a $90,000 for a landscaping project.

Director of Operations Wendi Delgado discussed the 2020-2024 Capital Improvement Plan, forms, and instructions that is required by Section 5.09 of the Home Rule Charter. The request forms and instructions will be available on the City’s website and the front lobby on April 16, 2020.

B. UPDATE AND DISCUSSION REGARDING THE 2020 CENSUS. (MCNULTY)

Economic Development Corporation Executive Director Darla Lapeyre gave an updated on the City’s Complete Count Committee and the Island’s response rate with the 2020 Census.

C. APPROVE THE CITY MANAGER TO EXECUTE A CONTRACT WITH HDR ENGINEERING INC. FOR THE ANNUAL BEACH SURVEYS. (BOBURKA)

Council Member Ricco made a motion, seconded by Council Member Schwartz to authorize City Manager Randy Smith to execute a contract with HDR Engineering Inc. for the annual beach surveys. Motion passed on a unanimous vote.

D. DISCUSSION AND ACTION TO APPROVE FIRST READING OF ORDINANCE NO. 20-04, AMENDING CHAPTER 23 OF THE CODE OF ORDINANCES AND

THE CITY'S STANDARDS AND SPECIFICATIONS AS THEY PERTAIN TO SIDEWALK REQUIREMENTS. (SCHWARTZ)

Council Member Ricco made a motion, seconded by Council Member Schwartz to approve the first reading of ordinance No. 20-04, an ordinance of the City of South Padre Island, Texas, amending Chapter 23 of the Code of Ordinances of the city of south padre island by revising section 23.14 (f) to require installation of sidewalks when a new development requires the installation of a new street; and by repealing in its entirety section 23.15 (D)(3)(f) 2 which provided for payment of a sidewalk in-lieu fee; and by amending section 23.15 (d)(3)(f) 1-4, by removing 2 and renumbering to 1-3; and by revising section 2.13(C)(1) of the standards and specifications for the acceptance of public improvements; providing for repeal of conflicting ordinances; providing for a penalty of five hundred dollars for any violation; providing for severability; and authorizing the publication in caption form, which passed on a 5 to 1 vote with Council Member Bagley casting a nay vote.

E. DISCUSSION AND ACTION TO APPROVE A BUDGET ENHANCEMENT IN THE AMOUNT OF $50,000 FROM EXCESS RESERVES TO BE ALLOCATED TOWARDS THE STAGE 1 ENHANCEMENT FIRE HYDRANTS.

Council Member Ricco made a motion, seconded by Council Member Schwartz to approve the budget enhancement in the amount of $50,000 from excess reserves to be allocated towards the stage 1 enhancement of the fire hydrants. Motion carried unanimously.

F. DISCUSSION AND ACTION TO APPROVE BUDGET REDUCTIONS DUE TO COVID-19.

Council Member Ricco made a motion, seconded by Council Member Schwartz to instruct City Manager Randy Smith to work with our finance director to put together a adjusted financial budget budget taken in’s to account all of the budget short falls caused by the covet 19 versus. This plan should take immediate steps to protect our city reserves.And should be based on but not limited to the preliminary guidelines based on the forecast made at this time. Motion passed on a unanimous vote.

Council Member Bagley made a motion to extend the City’s Disaster Declaration to 11:59 p.m. on Sunday, May 3, 2020. Council Member Schwartz seconded, which passed unanimously.

V. DISCUSSION AND POSSIBLE ACTION REGARDING THE REOPENING OF THE BUSINESSES ON THE ISLAND.

Council Member Schwartz made a motion to form a task force with the Mayor McNulty’s direction to establish guidelines that would allow businesses to reopen in a safe manner. Council Member Medders seconded, which passed unanimously.

I. CALL TO ORDER

The City Council Members of the City of South Padre Island, Texas held a Special Emergency Meeting on Monday, April 27 2020, at the Municipal Complex Building, 2nd

Floor, 4601 Padre Boulevard, South Padre Island, Texas. Mayor McNulty called the meeting to order at 3:22 p.m. A quorum was present: Mayor Patrick McNulty, Council Members Ken Medders, Jr., Kerry Schwartz, Joe Ricco, Alita Bagley and Eva-Jean Dalton.

City staff members present were City Manager Randy Smith, Chief Financial Officer Rodrigo Gimenez, Chief of Police Claudine O’Carroll, Fire Chief Jim Pigg, Environmental HealthDirector Victor Baldovinos, CVB Director Ed Caum, Shoreline Director Kristina Boburka, Information Technology Director Mark Shellard, and City Secretary Angelique Soto.

II. PLEDGE OF ALLEGIANCE AND TEXAS PLEDGE

Mayor McNulty led the Pledge of Allegiance and the Texas Pledge.

III. PUBLIC COMMENTS AND ANNOUNCEMENTS

Public comments and announcements were given at this time.

V. ADJOURN

There being no further business, Mayor McNulty adjourned the meeting at 3:33 p.m.

IV. DISCUSSION AND POSSIBLE ACTION REGARDING DEEP CLEANING GUIDELINES FOR HOTELS AND VIRTUAL RESORT MANAGER (SHORT TERM RENTALS) AND INSTITUTING A DEEP CLEANING BADGE (STICKER) FOR ALL PARTICIPATING BUSINESSES IN THE PROGRAM. (RICCO)

Council Member Ricco made a motion, seconded by Council Member Medders for the City to adopt the guidelines and allow the City Manager and Environmental Health Director to make amendments parts that relate to the Island’s environment. Motion carried on a 5 to 1 vote with Council Member Dalton casting a nay vote.

AN ORDINANCE OF THE CITY OF SOUTH PADRE ISLAND, TEXAS, AMENDING

CHAPTER 23 OF THE CODE OF ORDINANCES OF THE CITY OF SOUTH PADRE

ISLAND BY REVISING SECTION 23.14 (F) TO REQUIRE INSTALLATION OF

SIDEWALKS WHEN A NEW DEVELOPMENT REQUIRES THE INSTALLATION OF A

NEW STREET; AND BY REPEALING IN ITS ENTIRETY SECTION 23.15 (D)(3)(f) 2

WHICH PROVIDED FOR PAYMENT OF A SIDEWALK IN-LIEU FEE; AND BY

AMENDING SECTION 23.15 (D)(3)(f) 1-4, BY REMOVING 2 AND RENUMBERING TO

1-3; AND BY REVISING SECTION 2.13(C)(1) OF THE STANDARDS AND

SPECIFICATIONS FOR THE ACCEPTANCE OF PUBLIC IMPROVEMENTS;

PROVIDING FOR REPEAL OF CONFLICTING ORDINANCES; PROVIDING FOR A

PENALTY OF FIVE HUNDRED DOLLARS FOR ANY VIOLATION; PROVIDING FOR

SEVERABILITY; AND AUTHORIZING THE PUBLICATION IN CAPTION FORM.

WHEREAS, the City of South Padre Island has heretofore adopted Chapter 23 (Subdivision

Regulations) of the Code of Ordinances and Standards and Specifications For the Acceptance of

Public Improvements;

WHEREAS, the City Council of the City of South Padre Island finds that both Section 23.14

(F) and Section 23.15 (D) (3) (f) 2 of the Code of Ordinances and Section 2.13(C)(1) of the

Standards and Specifications For the Acceptance of Public Improvements should be amended;

WHEREAS, the City Council of the City of South Padre Island desires to only require the

installation of sidewalks when a new development requires the installation of a new street;

WHEREAS, the City Council of the City of South Padre Island desires to simplify the width

requirement for sidewalk installation;

WHEREAS, the City Council of the City of South Padre Island desires to remove the

requirement of a fee in-lieu of installation of a sidewalk;

WHEREAS, the City Council of the City of South Padre Island has determined that the

ordinance sections mentioned herein that are being amended do not fully meet the needs of the public

and are not needed; and

NOW, THEREFORE BE IT ORDAINED BY THE CITY OF SOUTH PADRE ISLAND,

TEXAS:

Section 1. Chapter 23 of the Code of Ordinances of the City of South Padre Island is hereby

amended by replacing in its entirety the existing language in section 23.14(F) with the following

language:

Section 23.14 (F) – Sidewalks – When a new development requires the installation of new

street, public or private, the developer shall install a sidewalk, which is one (1) foot from outside the

front lot line. Sidewalks shall be a minimum of five (5) feet wide. The construction shall conform to

the current edition of Standards and Specifications for the Acceptance of Public Improvements for

the City of South Padre Island.

Section 2. Chapter 23 of the Code of Ordinances of the City of South Padre Island is hereby

amended by repealing in its entirety the existing language in Section 23.15 (D) (3) (f) 2 and correctly

numbering the remaining paragraphs of Section 23.15 (D) (f ) 1 through 3.

Section 3. The Standards and Specifications for the Acceptance of Public Improvements of

the City of South Padre Island is hereby amended by replacing in its entirety all existing language in

Section 2.13(C)(1) with the following language:

Section 2.13(C)(1) Sidewalks shall be a minimum of five (5) feet wide, and shall be

constructed of Hydraulic Cement concrete conforming to the same specifications as rigid

pavement required by Section 2.08, “Hydraulic Cement Concrete Pavement”.

Section 4. This ordinance repeals all portions of any prior ordinances or parts of ordinances

of the Code of Ordinances in conflict herewith.

Section 5. Any violation of the above mentioned sections of Chapter 23 of the Code of

Ordinances of the City of South Padre Island may be punished by a fine not to exceed Five Hundred

Dollars ($500.00) for each offense or for each day such offense shall continue and the penalty

provisions of Sections of Section 21-1 of the Code of Ordinances is hereby adopted and incorporated

for all purposes.

Section 6. If for any reason any section, paragraph, subdivision, clause, phrase, word or

provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of

competent jurisdiction, it shall not affect any other section, paragraph, subdivision, clause, phrase,

word or provision of this ordinance for it is the definite intent of this City Council that every section,

paragraph, subdivision, clause, phrase, word or provision hereof be given full force and effect for its

purpose.

Section 7. This Ordinance shall become effective when published in caption form.

WHEREAS, the City of South Padre Island finds it in the best interest of the citizens of South Padre Island, that the Coronavirus Emergency Supplement Funding Program be operated for the 2020-2021 fiscal year; and

WHEREAS, the City of South Padre Island agrees to provide applicable matching funds for the said project as required by the grant application; and

WHEREAS, the City of South Padre Island agrees that in the event of loss or misuse of the Office of the Governor funds, the City of South Padre Island assures that the funds will be returned to the Office of the Governor in full; and

WHEREAS, the City of South Padre Island designates the City Manager or their designee, as the grantee’s authorized official. The authorized official is given the power to apply for, accept, reject, alter or terminate the grant on behalf of the City of South Padre Island.

NOW, THEREFORE BE IT RESOLVED by the City Council of the City of South Padre Island, Texas:

WHEREAS, the Mayor and the City Council of the City of South Padre Island, Texas recognize the importance of persons to be able to make public comments and announcements and give input at city council meetings, and encourage persons to do such; and

WHEREAS, the City of South Padre Island, Texas currently allows public comments and announcements at city council meetings; and

WHEREAS, Section 551.007 of the Texas Government Code, as recently amended, now gives the public the legal right to address the Mayor and City Council as a body regarding agenda items; and

WHEREAS, the City of South Padre Island, Texas has always allowed the public to make comments on agenda items and non-agenda items and to also make public announcements; and

WHEREAS, the Mayor and the City Council of the City of South Padre Island, Texas wish to continue to allow the public to make comments and announcements at city council meetings on agenda and non-agenda items; and

WHEREAS, Section 551.007 of the Texas Government Code authorizes the City Council to adopt reasonable rules governing the manner in which the public can make comments and announcements at city council meetings, including time limits and other reasonable rules;

Procedures Regarding Public Comments and Announcements At City Council Meetings

1. Members of the public shall identify themselves and limit their comments or announcements to three minutes.

2. The mayor, at his discretion, may allow an extension of an additional two minutes if the mayor feel such is reasonable or necessary.

3. Members of the public may be allowed to make comments and announcements related to agenda or non-agenda items.

4. Members of the public may be allowed to make comments on an agenda item at the initial time for public comments and announcements near the beginning of the meeting and/or during the discussion of the specific agenda item.

5. All public comments and announcements shall be made and directed to the Mayor and City Council as a whole, and not to individual members.

6. All public comments and announcements shall be made in a respectful, orderly and lawful manner and no profanity, shouting or threateninglanguage will be allowed.

7. The mayor reserves the right to limit the number of persons wanting to make public comments or announcements on a particular agenda or non-agenda item if necessary to expedite the meeting in an efficient manner.

8. Violation of any of the above rules and procedures may result in termination of the public comments, removal from the meeting, and possible prosecution under State law.

SPI Social Restart Plan

Our goal is to both support the City’s messaging during COVID 19 and provide a“dreaming” space for our fans. Why restart? Our competitors are already active, for one,but, more importantly, because of the size of our audience (over 500k) we can betterelevate the messages the Island needs to get out. That said, the key is to make it clearthat visitation has rules in place for safety, provide positive and helpfulinformation, and set the stage for recovery. In addition to the proposed messagesbelow, we’d like to change our FB and IG profile images with a Stay Safe frame to drivehome the message even more.

Our hope is that posting can restart by Monday, April 27, as long as we workhand-in-hand with the city on each and every message until the crisis is over.

Note: On these posts we will use link shortners (bitly) to our covid page, virtual beachand city information pages as appropriate or as directed!

Day I post: On both FB and IGThe beach is open, but masks are required (see more of the rules on [city page]). Thatsaid, we encourage you to stay safe and enjoy “virtual” trips as well. In fact, we’ve setup a special page with our Virtual Beach Kit [bitly link] where you can bring a little ofSouth Padre’s beauty onto your phone or computer.
