Pursuant to Rule 6.2 of the Rules of Practice and Procedure of the California Public

Utilities Commission (Commission) and Ordering Paragraph 4 of the Administrative Law

Judge’s Ruling setting prehearing conference, entering staff proposal into record, and seeking

comments (ALJ Ruling), Southern California Edison Company (SCE) respectfully submits these

Reply Comments.

I.

INTRODUCTION

On May 7, 2018, the Commission issued an Order Instituting Rulemaking (OIR) to

Evaluate the Mobilehome Park Pilot Program and to Adopt Programmatic Modifications.

Pursuant to the OIR, on June 21, 2018, the ALJ Ruling entered into the record the Joint Staff

Proposal of the Commission’s Safety and Enforcement Division (SED) and the Energy Division,

which is titled “Evaluation of the 2015-2017 Mobile Home Park (MHP) Utility Conversion Pilot

Program and Joint Staff Proposal for Proposed Program Continuation and Refinements in

R.18-04-018.” The ALJ Ruling allowed parties to provide comments on the topics set forth in

the Joint Staff Proposal and directs reply comments to be submitted by July 25, 2018.1

SCE agrees with parties2 on a number of comments, including the following six

recommendations:

1. The Commission should establish flexible, not mandated, conversion targets.3

2. The SED should retain responsibility for the selection and prioritization of

MHPs.4

3. Utilities should continue to provide input into selection of beyond-the-meter

(BTM) contractors, but MHP owners should retain responsibility for the final

BTM contractor selection.5

4. If the Commission adopts a goal of converting 50 percent of MHP spaces by

2030, the Commission should clarify whether that goal includes those spaces that

were converted during the pilot period and subsequent extension.6

5. Cost caps should be rejected, due to the potential for unintended consequences,

such as excluding difficult or high-cost MHPs from the program.7

6. Information provided in the annual reports should be aggregated to preserve the

competitive nature of the contracting process and protect customer privacy.8

SCE also identified several areas of concern in the opening comments addressed herein:

(1) proposals recommending expansion of eligibility in the MHP program to permanent

buildings and recreational vehicles (RVs) should not be adopted without additional assessments

and/or information; (2) TURN’s and ORA’s proposals to change the treatment of BTM costs are

inappropriate and out of scope in this OIR; (3) TURN’s recommendation that the Commission

adopt forecast ratemaking for the MHP program is also out of scope and is misguided; and (4)

the Commission should not adopt proposals related to Risk Spend Efficiency (RSE) until the

utilities, Commission staff, and parties have more experience with the model.

II.

DISCUSSION

A. Additional Assessments are Needed Prior to Expanding Eligibility in the MHP

Program

SoCalGas and SDG&E recommend extending program eligibility to (1) permanent

buildings (to-the-meter funding only) and (2) “RV spaces that are interspersed amongst

mobilehome spaces.”9 SoCalGas and SDG&E propose that the MHP program adopt eligibility

and permit to-the-meter (TTM) funding for permanent buildings, because they state that some

MHP owners declined to participate in the MHP pilot because conversion of these permanent

buildings is not included in the MHP pilot.10 It is unclear how many MHP owners view the

exclusion of permanent buildings as a barrier to participation, or what types of permanent

buildings should be eligible for participation in the program. Further, if the Commission expands

eligibility, the definition of a permanent building should be clearly established. Specifically,

would eligible permanent buildings be limited to common area facilities or would permanent

housing, such as a house or condominiums located within the park, also be eligible? SCE

suggests that additional data be gathered and that these types of questions be considered and

assessed before a decision is made to expand eligibility and TTM funding to permanent

buildings.

SoCalGas and SDG&E also recommend that the Commission expand eligibility in a

permanent MHP program to RV spaces that are interspersed amongst mobilehome spaces, in

order to address certain operational efficiency challenges.11 Specifically, when MHP owners are

unable to identify which spaces were permitted for mobile homes or RVs, the utilities may have

to expend additional time and effort to validate which spaces qualify for participation.12

SoCalGas and SDG&E do not appear to propose extending eligibility to RV spaces that are

located in a separate section of the park, but rather only to those RV spaces that are interspersed

among the mobilehomes.13 Although SCE thinks that this suggestion could prove beneficial, it

warrants further discussion among the stakeholders to make sure that the resulting benefits

outweigh any potential challenges and that any expanded eligibility is clearly defined.

SCE requests that parties be provided an opportunity to discuss and assess the benefits

and impacts associate with any request to extend eligibility in the MHP program to permanent

structures and/or RV spaces.

B. TURN’s and ORA’s Proposals to Change Treatment of BTM Costs are

Inappropriate and Out of Scope

In comments, ORA proposes that the Commission consider alternative financing for

BTM construction in the OIR, including financing alternatives such as the use of ten-year debt

instruments.14 Similarly, TURN suggests that the Staff Proposal should have adopted TURN’s

recommendation to have the utilities expense BTM costs rather than include them in rate base.

TURN further states, “the Staff Proposal opts for exactly the kind of ‘cost plus’ ratemaking that

the Commission has decried as producing inefficient and ‘lethargic’ cost management.”15 Both

of these proposals are out of scope in this OIR and therefore should not be considered.

Moreover, ORA’s suggestion to consider debt financing is inappropriate and out of scope for this

OIR.

1. Revisiting the Utilities’ BTM Cost Methodology is Out of Scope

In R.18-04-018, the Commission held that issues related to the overarching legal

or policy determinations made in Decision (D.)14-03-021 are out of scope for this proceeding.16

Because these issues were litigated in D.14-03-021, TURN’s and ORA’s proposals to revisit the

financing approach for BTM costs are out of scope. Specifically, in D.14-03-021, the

Commission considered and disagreed with the Joint Parties’17 assertion that BTM construction

costs should be expensed rather than capitalized.18 The Commission found that reasonably

incurred BTM costs should be treated as a regulatory asset, subject to a reasonableness review in

the utility’s General Rate Case.19 This finding is detailed in Ordering Paragraph 8, which states

that “beyond the meter construction costs must be capitalized based on actual (not forecast)

expenditures and consistent with their status as a regulatory asset, these costs must be amortized

over ten years at a rate equivalent to the utility’s then-current authorized return on rate base.”

Because the Commission already carefully considered and decided this policy issue, it should not

be re-litigated in the present OIR.

2. ORA’s Recommendation to Consider Debt Financing is Inappropriate and Is

Out of Scope

ORA’s proposal to consider alternative financing for BTM construction, such as

the use of ten-year debt instruments, is inappropriate and out of scope.20 If the Commission were

to mandate that the utilities utilize only debt financing, it would: (1) increase SCE’s financial

risk, causing SCE to increase its equity ratio for the financing of its other assets, which could

raise SCE’s costs on other parts of its business; and/or (2) require the Commission to relax the

requirement that SCE maintain its authorized equity ratio or exempt BTM-related debt from that

calculation.

Recovering the cost using only debt financing does not capture all the BTM

investment risk. Although the utility does not own the BTM facilities, it still bears both recovery

and residual risk. Not accounting for the BTM investment risk effectively raises the risk of other

utility assets. The utility bears recovery risk because BTM costs are subject to reasonableness

review by the Commission before recovery is allowed. In addition, the utility bears some

residual risk associated with the BTM work simply as a result of the utility’s involvement in

funding such work. In accordance with the concept of intertemporal equity, costs of long-lived

assets, such as those costs associated with BTM construction, should be recovered over their

useful lives to properly align benefits and costs.

Finally, ORA’s proposal to consider alternative financing of BTM construction,

such as a ten-year debt instrument,21 is out of scope of this OIR. The Commission clearly

concluded in D.14-03-021 that “the utilities should fully recover actual, reasonably incurred

costs for new MHP distribution systems.”22 As explained above, R.18-04-018 held that issues

related to the overarching legal or policy determinations made in Decision (D.)14-03-021 are out

of scope for this proceeding.23

C. TURN’s Comments on Forecast Ratemaking are Misguided

In comments, TURN suggests that “[a] key problem with the Staff Proposal is the

assertion that utilities need to recover their actual costs, coupled with the rejection of forecast

ratemaking.”24 TURN states that this approach is at odds with the Commission’s view that

forecast ratemaking, as opposed to allowing utilities to recover actual costs, is the preferred way

to give utilities an incentive to reduce costs.25 However, TURN fails to acknowledge that, in

D.14-03-021, the Commission concludes that “the utilities should fully recover actual,

reasonably incurred costs for new MHP distribution systems.”26 Additionally, the Commission

stated, “We think recovery of reasonably incurred, actual costs would be clearer and cleaner and

from a ratemaking standpoint, would make much better sense.”27 Therefore, TURN’s comments

on forecast ratemaking should be rejected because this policy issue has already been litigated,

and therefore it is not within the scope of the present OIR.

Further, TURN’s citation of D.96-12-066 to support its argument28 is not relevant to the

instant case. In D.96-12-066, the Commission responded to an unusual request by PG&E to

waive its Rate Case Plan and to allow an increase in authorized revenues for maintenance and

Call Center budgets. In rejecting that request, the Commission wrote, “The revenues at issue

here … relate to the day-to-day cost of operating a safe and reliable electric utility business.

These are some of the cost areas in which savings can be generated during some years and in

which extra costs must be absorbed during others. Thus, they are not appropriately the subject of 23 See R.18-04-018, p. 16.

exceptional rate proceedings.”29 However, in the instant case, the Commission has specifically

ruled that the utilities should collect their actual reasonable costs related to the MHP program;

thus, the cited decision is not instructive here. Moreover, the behind-the-meter work in mobile

home parks is clearly different than standard electric utility work, as D.14-03-021 recognized,

referring to “the numerous uncertainties that underlie the parties’ construction cost estimates and

the lack of record-based specificity on the administrative functions and associated costs

necessary to implement a MHP conversion program …”30 Thus, the nature of the costs at issue

is different here, and D.96-12-066 does not provide useful guidance for the Commission in this

rulemaking.

D. The Commission Should Not Adopt Proposals Related to RSE until the Utilities,

Commission Staff and Parties Have More Experience with the Model

SCE agrees with TURN that an approach to focusing initial efforts on higher risk

mobilehome parks could help deliver more benefits to customers sooner. SCE also agrees that

the use of a Risk Spend Efficiency (RSE) model as a tool to identify the relative cost-

effectiveness of MHP projects could be informative to such an effort. However, at this point,

SCE does not agree that it is appropriate to adopt the RSE metric as referenced by, and for the

uses identified by, TURN for the following reasons:

1. The use of the RSE metric in the regulatory process as defined in the S-MAP is

still in its nascent stages. Utilities, including SCE, are testing these new practices

through their Risk Assessment & Mitigation Phase (RAMP) filings. Further

evaluation would have to be performed to identify whether the methods used in S-

MAP and RAMP would be appropriate to use in a park-by-park type risk analysis;

2. While qualitatively understood, there are challenges in obtaining adequate data to

quantify the risks and associated RSE at MHPs due to the limited access to

behind-the-meter information; and,

3. The concept suggested by TURN of establishing a RSE threshold to determine the

size of the program lends itself to an understanding and application of risk

tolerance, which is a concept that is currently expected to be discussed in a

forthcoming S-MAP Phase II proceeding. It would be premature to set a

threshold using RSE in MHP prior to the outcome of this proceeding.

For these reasons, SCE recommends that the Commission not adopt any immediate

requirements for the use of RSE until the utilities, Commission staff, and parties have had more

experience with RSE quantifications and can collectively define if and how it could apply to the

MHP.

III.

CONCLUSION
