WEGULATIONS, 2004.

2. (1) In these Regulations, unless the context lntcirpretation.

otherwise requires -

" Authority" means the Belize Agricultura1 Health Authority CAP. 21 1.

established under section 3 of the Act;

"accredit" or "accredited" rneans officially recognized by the competent authority to certify, inspect or audit the quality, diagnostic or calibration laboratory, and to verjfy in the national environ, the compliance of technical conditions and requiremeats required for the functioning of the entities responsible for control and vetifications of sanitary and Phytosanitary measures;

"cargo vessel" means any conveyance carrying comodities from one place to another;

"certificate" means anofficial document which attests to the sanitary or phytosanitary status o f any consignment affected by sanitary or phytosanitary regulations;

"certification" means the procedure by which officjal certification bodies or officially recognized certification bodies provide written or equivalent assurance that foods or food control systems confirm with requirernents . Certification of food may, as appropriate, be based on a range of inspection activíties which may include continuous online inspections , ' auditing of quality assurance sy stems , and examinarion of finished products;

"commodity" means any type of plant, animal, their products and byproducts, or other article being moved for trade or other purpose;

"consignment" rneans a quantity of plants, ptant products, animal and animal products or other regulated commodity being moved from one country or region to another;

"consignment in transit" means a consignment that is not imported into a country but passes throiigh it to another country, subject to official procedures which ensure that it remains enclosed, and is not split up, or combined with other consignments or has its packaging changed;

" construction material " means cement, steel, plywood, fibre-cement, lumber, stone, sand, gravel, ceramic tiles, cement blocks, cerarnic bricks, rnarble stones, granite and other like material;

"conveyance" means any vessel, aircraft , vehicle, cart, container, animal or other thing thatcan convey plants, plant products, animal, animal products, carcass, biologics,

veterinary drugs pests , beneficia1 organisms, or other commodity frum one place to another;

"cruise ship" means a ship carrying fare-paying passengers on a tour and calling on a port in Belize;

"cut flowers and branches" rneans a class of commodity of fresh parts of plants intended for decorative use and not for planting ;

"designated officer" means a person ernployed andfor accredited to carry out the functions of the Authority;

"entry" rneans in relotion to a consignment, movernent through any official designated port of entry into the territory of Belize;

"exporter" means anyone who, whether as owner, consignar, consignee, agent, broker or otherwise, is in possession of or in any way entitled to the custody of any plant, plant product, animal, animal product, pest, beneficial organism or other reguíated article landed or likely to be landed in any country or region other than Belize;

"floral arrangement" means a regulated commodity which is made of flowers or ffora with greens and piaced in a proper order or in a correct or suitable sequence or adjus tment and includes bouquets ;

" greens" means and includes ferns, stems, leaves, grass and branches;

" import" means bringing into Bel.ize by any means whatever;

LL importer " means any person who, whether as owner, consignor, cansignee, agent, broker or otherwise, is in possession of, or in control of, in any way entitled to the cus tody of any plant , plant product , animal, animal product ,

pes t , beneficia1 organism or other regulated article landed or likely to be landed in Belize from another country or region;

"inspection" means afficial visual examination of plants, plant products, animals, animal products or ather regulated articles to determine if pests ar diseases are present and/or to determine cornpliance with sanitary and phytosanitary regulations;

"large yacht" means a vessel rneasuring fifty (50) feet or more in fength andlor ten (10) feet or more in width;

cbn~n-c~rnmercial purposes" means the use of irnported commodities or products for purposes other than for sale to the general public;

"normal working hours" rneans the hours between 8:00 a.m. and 5:00 p.m. from Monday io Friday in each week, except on a bank or public holiday;

"point ofentry" rneans airport, seaport or land border point officially designated for the importation of consignments, andlor entrance of passengers;

"regulated commodity " means any cornmodity , storage place, packaging, conveyance, container, soil and any organism, object or material capable of resulting in the entry, harbouring or spreading of pests or diseases;

"sanitary and pllytosanitary measure" include al1 reievant laws, decrees, regulations, requirernents and procedures including, inter alia, end product criteria, processes and production methods; testing, inspection, certification and approval procedures; quarantine treatments including relevant requiremenrs associated with the transport of anirnals or plants, or with the materials necessary for their survival during transport; provisions on relevant statistical

rnethods, sarnpling procedures and methods of risk assessment; and packaging and labelling requirements directly related to food safety;

"small yacht" means a vessel measuring less than fifty (50) feet in length andtor less than ten (10) feet in width;

"station'' means the place where a Quarantine Inspector is assigned to remain or work;

" waod packaging material" means wood, dunnage or wood products, excluding paper products, used in supporting, protecting or carting a commodity.

(2) The words and expressions used in these Regulations shall have the meaning assigned to them in the Belize Agricultura1 Health Authori ty Act unless such words CAP. 21 1.

and expressions are defined in sub-regulation (1).

3. (1) Al1 exports which require certification shall be Export

inspected by the designated officer prior to the issuance of eertification.

(2) Every exporter of a comerc ia l commodity or his authorized agent shall ensure that a11 necessary infor- mation including sanitary or phytosanitary requirernents of the importing country, are presented to the designated officer not less than seventy-two (72) hours prior to the inspection date.

(3) Every exporter of a commercial comrnodity or produci, or his authorized agent, shall pay to the Authority the following fees for the issuance of a Phytosanitary Certificate for such commodity -

(4) Al1 fees payable under rhis Regulation shall be borne by the exporter and paid to the designated officer upon compietion of the inspection or to the Authority at any of their offices throughout the country of Belize.

( 5 ) A Sanitary Certificate will be issued if the commodities for exports ineet the requirements of the importing couotry .

( 6 ) The exporter or his agent shall pay to the Authority a fee of fifty dolIars (BZE $50.00) for the Sanitary Certificate.

(7) Where there are no provisions for the issuance of Sanitary Certificates this Regulation shaZI apply and shall be read and construed together with the Belize Agricultural Health Authority (Food Safety) Regulations 2001 (S.I. 25 s.!. 25/2001.

of 2001) and the Belize Agricultura1 Health Authority (Fish and Fisheries Products Inspection) Regulations, 200 1 (S. 1. 173/2001.

(8) A rnileage fee of one dollar and fifty cents (BZ $1.50) per mile shall be paid tu the Authority for field inspections in respect of the issuance of the certificates refetred to in this Regulation.

(9) Fees for sampling and tested sllall be as pre- Schedule I I I .

(1 O) The fees to be paid for the inspectionof packing facility services shall be as follows - - - -- .. .

rnay amount to less than four (4) containers,

(e) inspection of plant and plant products, irrespective of number of containers per consignment, after normal working hours

(f) inspection of animal products 30.00; for export

(g) inspection of live anirnals 50.00.

(11) Al1 exporters required to sign a compliance agreement, shall pay to the Authority an administrative fee of one hundred dollars (BZ $100) per agreement. It shall be compuIsory to renew the compliance agreernent every year.

(12) Ali fees payabfe under this Regrilation shall be paid immediately to the Quarantine Inspector or to the Authority ar any of their offices throughout the country of Belize upon compietion of the inspection or the issuance of the relevant certificate, as the case may be.

Bonrding c ~ c . , 4. (1) Every shipping agent, owner of a vessel, and of vcsssls. any owner of a private marina or his authorized agent shall

inform a Quarantine Inspector of scheduled arrivals of vessels comíng from international porrs within twenty-four hours prior to the scheduled arrival of such vessels.

(2) No perrnission ro land shall be granted uniess a ship inspection has been conducred by a designated officer and his findings indicate Eull compliance with the Sanitary and Phytosanitary regulations of Belize.

(3) Every owner of a vessel, or his authorized agent, shall pay to the Authority, the following fees for boarding and quarantine inspection of the vessel:

(a) Cruise ships and cargo 60.00 per hour; vessels

(b) Large yachts 50.00 per hour;

(c) Small yachts 20.00 per inspection;

(d) Water taxis (arriving 20.00 per inspection. from international ports)

(4) The owner of a vessel with a Belize based agent shall make payments to the nearest office of the Authority on a bi-weekly basis.

( 5 ) The owner or captain of a vessel without a Belize based agent shall make payments directly ro the designated o fficer conducting the qlrarantine inspection.

(6) The owner or captain of a vessel, or his authorized agent, shall pay the certified transporration expenses of the designated officer, isi the case of payments made under sub-regulation ( 3 ) (a), (b) or (c) and such expenses shall run from the time the designated officer leaves his station to the time he returns to his station.

(7) The inspection fees referred to in sub-regulation (3) shall run from the time the designated officer leaves ¡lis station until the time he returns to his station.

5. (1) Every airline representative, owner of an air- Boarding ctc.

officer of scheduied arrivals of aircrafts at the internationai airport within twenty-four hours prior to the scheduled arrival.

(2) Every airline representative, owner of an air- craft, or his authorized agent, shall pay to the Authority, the following fees for boarding and quarantine inspection of his aircraft-

(d) srnall, private and domestic 10.00. aircraft arriving in Belize hom international airports or frorn a quarantine area

(3) The airline representative or owner of the aircraft, or his authorized agent, shail pay the certified transpottation expenses of the designated officer, in the case of payrnents made under sub-regulation (2) (a), (6) or

(4) The inspection fees referrcd to in sub-regulation (2) (a) and (b) shall run from the time the designated officer leaves his station unti1 the time he returns to his station.

(5) Where an inspection has to be conducted outsjde of normal working hours, the owner of the aircraft or his agent shallpay to the Authority the fees associated with the inspection oE the aircraft including an overrime rate of BZ $30.00 per hour.

(6) The owner of an aircraft with a Belize based agent shall make payrnents to the nearest office of the Authority on a bi-weekly basis.

(7) The owner or pilot of an aircraft withouta Belize based agent shall make payments directly to the designated officer conducting the quarantine inspection.

6. (1) Any person desiring to import any comrnodity Inlpurt Pcrmit.

or product into Belize shall apply for an import permit for such commodity or product.

(2) Any person desiring to import any commodity or product into Belize shaIl pay to the Authority the following administrative fees associated with irnport permit applications -

(xiii) beneficia1 agents

(xiv) any other

(3) Fees associated with the registration of veteri- nary drugs, veterinary biologics, veterinary pesticides and animal feed shall be as prescribed in regulations made

S.l. 18412001. therefor.

(4) Where the importarion of a given food cornmod- ity requires a Sanirary Certificate, but the importer was not able to cornply with that importation requirement the followi~ig shall apply -

(a) samples of the food shalI be taken and tested and the importer shall bear al1 costs associated with the laboratory analysis as prescribed regulations made therefor;

{b) where upon inspection, food commodity is determined to be safe for hurnan consump- tion and rneets all other importation re- quirements, a Sanitary Certificate shall be issued;

(c) the fee for a Sanitary Certificate issued under paragraph (b) above shall be fifty dollars (BZ $50.00);

(d) al1 fees prescribed in this Regulation shall be borne by the importer and paid to the Authority immediately upon receipt of an official bill.

(5 ) Fees associated wirh post entry quarantine shall be as follows:

(a) any person requiring an inspection of irnported comrnodities at a nursery sha1I pay to the Authority a fee of thirty doilars (BZ $30.00) per hour plus a mileage fee of one dollar and fifty cents (BZ $1.50) per mile;

(b) fees associated with the registration of nurseries with the Competent Authority shall be two hundred dollars (32 $200.00) per nursery;

(c) fees associated with the observation and mainrenance of plants held at the Quaran- tine facility in Central Farm shall be as foílows:

(i) seedling in trays . . . . BZ $2.50 per traylday ;

(ii) individual plants in bags or pots.. . . . . . . . . . . . .BZ $2.50 per day ;

(i) a fee of fifty dollars (BZ $50.00) per hour for the inspection of the animals plus a mileage fee of one doIlar and fifty cents (BZ $1.50) per mile;

(iii) fees for the post mortem examina- tion and disposal of anirnals shall be paid as prescribed in Schedule 1;

(e) any additional fees incurred wirh the post entry quarantine of such comodities shall be paid by the owner or his authorized agent to the Authority upon receipt of an official bill.

(a) a commodity has never been previously imported into Belize;

(b) a comrnodity or product originates from a country or region not previously approved;

(c) a comrnodity or product originates, comes from ar passes through a country or region whose health status changes or is not known by the Authority;

(d) there is new information on a particular

pest or disease; or

(e) it is required that a country or region provides evidence that an export commod- ity does not present threat orrisk to Belize,

then an import risk analysis shall be conducted.

(2) Every import risk analysis conducted ~ n d e r sub-

regulation (1) shall incur a fee of one thousand dollars (BZ $1000.00) of which two hundred dollars (BZ $200.00) shall be paid to the Authority irnmediately upon application and

the remaining balance shafl be paid tu the Authority upon cornpletion of the irnport risk analysis.

(3) Where an import risk analysis requires inspec- tion in a foreign country in accordance with regulations presaibed therefor, the interested parties shall bear all s.]. 5412004.

8. (1) Every irnported comrnodity ar product shall be inspection of imported

(3) Where a landing permit is not issued for a commodity or product under sub-regulation (2) above, such commodity or product shall be confiscated, destroyed or returned to the country of origin at the owner's expense, by the Authority.

(4) A non-governmental osganization or statutory body importing a commodity or product referred to in sub- regulation (2) for non-commercial purposes may apply to the Managing Director for a waiver of rhe fees prescribed in sub-regulation (2) above.

9. (1) Every commodity os product which is in transit In transit

(2) The owner of sucb cornrnodity or product or his authorized agent, shaIl pay to the Authority the fees for quarantine inspection prescribed in Regulation 8.

(3) The fees prescribed by sub-regulation (2) shall be paid promptly to the Authority before the inspection.

(4) Every owner of a commodity or product referred to in sub-regulation (1) or his authorized agent, shall pay

any other expenses of the designated officer incurred in carrying out his duties under this Regulatiun.

(5) The expression "other expenses" referred to in sub-regulation (4) includes transportation, overtime, sub- sistence and accornmodation expenses incurred by [he designated officer during the process of traveling from the point of entry to the point of departure in Belize, including the commercial free zones, of the commodity or product.

a privare warehouse or storage facility and for which Custorns entry forms have been stamped "VISUAL IN- SPECTION REQUIRED," shall not be ailowed to leave any air , sea or land port unless accompanied by a Container Application Form from the Authority and a designated officer .

(2) The importer of a commodity or product referred to in sub-regulation (1) above, or his authorized agent, shaIl pay to the Authority a fee of thirty dollars (BZ$30.00) per hour for the inspection of such commodity or product, plus the certified transportation expenses of the designated officer .

Irnportatiori 11. (1) Any perso~i who fails to produce an irnport of dogs o r c a t s . permit for a domestic dog or cat, but produces supporting

documents such as a health certificate or proof of rabies vaccination shall be allowed to import such domestic dog or cat upon paying an administrative fine to the Authority of one hundred doilars [BZ $100.00) per domestic dog or cat .

(2) Any person who produces an irnport permit but fails to produce any supporting docurnents in respect of a domestic dog or cat intended to be imported into Belize,

shall be allowed to import such domestic dog or cat on the condition that the dornestic dog or cat rernains in house quarantine and upon pay ing to the Authority an administra- tive fine of one hundred dollars (BZ $100.00) per domestic dog or cat.

(3) The Authority may in its sole discretion allow the irnportation of a domestic dog or cat where no import permit or supporting documents in respect of such domestic dog or cat are presented provided that an administrative fine af two hundred dollars (BZ$200.00) is paid to the Authority per dornestic dog or cat.

(4) Failure to pay the fines stipufated in sub- regulation (11, (2) and (3) shall result in the confiscation of the domestic dog or cat by the Authority.

(5) Any dornestic dog or cat confiscated under sub- regulation (4) shall be placed under the care of the Animal Health Deparfment and housed there for one (1) day and if the owner or irnporter does not remove such domestic dog or cat from Belize it shall be euthanized by an authorized officer of the Authority .

(6) The owner or irnporter of any domestic dog or cat euthanized under sub-regulation ( 5 ) above, shall be liable for any expenses incurred in carrying out such procedure.

12. (1) Any person traveling in transit through Belize Pets in

with a dornestic dog or cat who does not possess an import transit.

has been found to be free of abrasions and if certified by a local veterinarian to be free of pests and diseases.

(3) The fees incurred for the certification referred to in sub-regulation (2) shall be borne by the person traveling with the domestic dog or cat .

13. (1) Every owner of a vehicle or vessel. or his authorized agent, entering at any port of entry shall, due to the risk of disease or pest infestation, submit to quarantine treatment as prescribed in regulations made therefor.

(2) Where the owner of a vehicle or vessel or his authorized agent fails to submir to quarantine treatrnent. under sub-regulation (1) above, he shall be refused entry into Bel ize.

14. (1) Every consignrnent entering at any port of entry shall be inspectcd by a designated officer and a Customs Official .

(2) Every importer of a cornmodity or product who fails to subrnit to inspectionunder sub-regulation (1) above shall be liüble to an administrative fine of two hundred dollars (BZ $200.00) payable to the Authority or a designated officer .

15. The fees associated with the incineration of animals or other materials authorized by the Authoriry shall be as follows:

(a) for the incineration BZ $100.00 per of pets pet;

b for the incineration BZ $57.00 per of hospital rnaterials hour;

(3) A designated officer may, with the written approval of the Managing Director, enter into contractual agreernent with requesting parties for the translation of docurnents.

(4) The fees associated with the translation of documents referred to in sub-regulation (3) above shall be as follows:

(a) a fee of twenty-seven dollars (BZ $27.00) per page for certified translation frorn the Spanish language to the English language;

(b) a fee of thirty-seven dollars (BZ $37.00) per page for certified translation frorn the English language to the Spanish language.

(5) For the purposes of this Regulation "page" rneans a type- written sheet of single-spaced character with

Receipt. 19. An oficial receipt of the Authority sfiall be issued for any payment made under these Regulations.

Adniinistrativc 20. (1) Any passenger who rnakes a false declaration on fines and penaltics. a Customs Declaration Form, pertaining to the irnportation

of plants, animals and their products and by-products, shall be liable to an administrative firie of one hundred dollars (BZ$100.00).

(2) Where an importer of a regulated commodiry or product fails to produce an import permit for such reguIated commodity or products prescribed under Regulation 6 , in the presencc of supporting documents such as Sanitary Certificate, Phytosanitary Certificate and/or Certificate of Origin he shall. be liable to anadministrative penalty of two hundred dolfars (BZ$200.00) per consignment in addition to an inspection fee of one hundred dollars (BZ$100.00).

(3) Where an importer of a regulated commodity or product fails to produce supporting documents in the presence of an iniport perrnit for such regulated comrnodity or product, such failure shall resuit in immediate detention of the commod- ity or product for inspection and the following administrative fines shall be inlposed arid paid before the commodity or product is released to thr: importer -

(4) Where aperson atternpts to import a commodity or product without an original import permit and original supporting documents from a country or region whose pest or disease status is of importance to Belize (as certified by the Authority), such commodity or product shall be detained and shall not be released unless original supporting documents in respect of such comrnodity or product are presented to the Quarantine Inspector.

(5) Where, for some unknown reason, original copies cannot be produced as prescribed under sub- reguIation (4) above, then fax copies from the Cornpetent Authority of the irnporting country will be accepted by the Authority provided that such documents are faxed directly from the Cornpetent Authority of the exporting country to the Authority. Fax copies transmitted directly frum the irnporters will nor be accepted.

(6) Where the documents presented under sub- regulation (4) or (5) are -

(a) acceptable to rhe Authority, then the fees s.1. 15912003.

(b) unacceptable to the Authority, then the consignment shall-

at the expense of the owner or importer.

(7) The Central Veterinary Diagnostic Laboratory based in Central Farm Cayo District is hereby designated as the official veterinary diagnostic laboratory for the purposes of these Regulatjons.

(8) Any person who -

(a) is found in illegal possession of any plant, pIant product, plant by-product, animal, animal product, animal by-product car- cass, feed, litter, dung, biologicals or similar commodity ;

(b) breaks a quarantine seal;

(c) fails ro inform a designated officer of scheduled arrivals of any conveyance com- ing from either an International port or airport within twenty-four hours prior to the scheduled arrival;

{d) fails to alIow the hoarding of any convey- ance for inspection to be conducted by a designated officer of the Authority;

(e) boards any conveyance without the pres- ente of a designated officer ;

(g) contravenes or fails to cornply with any of the provisions of any import perrnit re- ferred to in paragraph (d),

commits an offence.

(9) Every person who commits an offence under sub-regulation (8) shaIl be liable on surnmary canviction to a fine not Iess than two thousand dollars but not exceeding five thousand dollars or to a period of imprisonment not exceeding two (2) years, or to both such fine and period of imprisonment .

21. Failure to declare any regulated cornrnodity or product to a designated officer at a port af entry shall result in the confiscation of the cornrnodity or product and the importer of the comrnodity or product shall be subject ro a penalty as follows -

SCHEDULE II

Fees Associated with Inspection of Foreign Facilities

[Regulation 7(3)]

1. Unless otherwise stated, it will be the responsibility of the exporter1 importer to cover al1 certified costs associated with the inspection conducted in a foreign country. The costs shall include:

(a) airfare and other certified travel costs (taxi to airport, airport taxes, visa, etc.) which rnay be incurred and are associated with the inspection. Tickets shall be sent to the Authority at least three (3) days prior to the intended departure of tbe designated officer(s);

(b) al1 expenses within reasonable lirnits in respect of board- ing and lodging are to be met;

(c) a per diem of one hundred and sixty dolíars US ($1 60.00) per day per officer;

(d) the per diem shall be paid directly to the designated officers upon arrival at the country requesting the inspection.

2. A rninimum administrative fee of one thousand dollars (US $1000.00) shalt be paid directly to the Belize Agricultural Health Authority not less than ten (10) working days prior to the intended departure from Beíize. An inspection which rnay result in a length of stay that exceeds a rnaxirnum of three (3) working days shall result in an additional adrninistrative fee of one hundred dollars (US $100.00) per day .
