CHAPTER 96

SUPREME COURT (COUNSEL’S FEES INCAPITAL TRIALS) RULES

(Section 194 (2)

[27th January, 1964]1. These Rules may be cited as the

SUPREME COURT (COUNSEL’S FEES INCAPITAL TRIALS) RULES.

2. Whenever counsel is assigned by the Court or the Chief Justice orother Judge thereof to defend any person charged with a capital offence whohas not the means to retain and pay for the services of counsel, the honorariumwhich the Court or the Chief Justice or other Judge may authorise to be paidunder section 194 (2) of the Indictable Procedure Act to counsel so assignedshall be ascertained according to the following scale:

For Retainer ………………………………………... $500.00

In respect of each day on which Counsel in pursuanceof such assignment appears in Court and conductsthe defence before a jury ………………………….....$100.00

1. These Rules may be cited as the

INDICTABLE PROCEDURE (FORMS) RULES.

2. The forms set out in Part I and Part II of the Schedule are prescribedpursuant to section 197 of the Indictable Procedure Act, for use respectivelyin a preliminary inquiry into, and at the trial of, a crime, and like appropriateforms may be used in cases not provided for in these Rules.
