This has reference to Board’s letter No. 279/Misc.102/2007-ITJ dated 9th January, 2008, calling for the captioned information in respect of this office. In this connection, it is submitted that at the time of Restructuring Process in the Department, the total number of Benches functioning here was 5 and each Bench was headed by a CIT(DR) as the Restructuring norms envisaged that each Bench should be headed by a CIT(DR). Such norms also provided that the cases of each Bench be represented by two Sr. DRs, which means that 2 Sr. DRs per Bench. On the basis of this analogy, the sanctioned strength at that time was 5 CIT(DRs) and 10 Sr. DRs. As a corollary to this and adhering to the Restructuring norms, since the total number of Benches currently existing has risen to 12 including one SMC and one Friday Bench i.e. 10 regular Benches which includes recently-introduced one Bench for International Taxation, the sanctioned strength of CIT(DRs) and Sr.DRs ought to be 10 and 21 respectively as under:

CIT (DRs): 10X1 = 10

Sr. DRs: 10 Regular Benches X 2 = 20

21Although, the present working strength of CIT(DRs) equates with the sanctioned strength but with the transfer of Ms. Smita Jhingran, CIT(DR), ‘C’-Bench to the Settlement Commission, vide Board’s orders No. 12/2008 dated 16th January, 2008, who has relinquished her charge in the

dated 5th October, 2007, on the captioned subject, enquiring about the reasons for non-attendance of the concerned DR before ‘E’ Bench on 10.07.07 to argue the Departmental appeal in the case of Shri Gulshan Kumar, which resulted in dismissal thereof by the Bench. To recapitulate the facts in this regard, it is submitted that the Departmental appeal in this case was fixed for hearing on 10th July, 2007, before Hon’ble ‘E’ Bench and two Sr. DRs, deployed on Rotational basis – namely Shri P.K.Prusty and Shri Mitha Lal Meena – were to argue the cases before this Bench. The Departmental appeal in the case of Shri Gulshan Kumar was assigned to Shri P.K.Prusty. However, Shri Prusty, owing to some compelling reasons could not attend the Bench as he was out of station with the result that the case remained unrepresented. As rightly pointed out by your Goodself, Shri M.L.Meena, the other Sr. DR of the Bench could not suddenly say before the Bench either about any request for adjournment or for any reasons of absence of Shri Prusty as he had no information about it.

2. It is, therefore, earnestly requested that an application u/s 254(2) of the Act, for recalling of the order citing these valid reasons, may kindly be moved, so that the Departmental appeal is refixed and reheard.

Today, a telephone call has been received from Ms. Nambiar that she has suffered from an eye injury and would not be able to attend the duty before the Bench during the entire week.

Sub: Sanctioned and working strength ofCIT(DRs) and Sr. DRs in ITAT –

This has reference to Board’s letter No. 279/Misc.102/2007-ITJ dated 9th January, 2008, calling for the captioned information in respect of this office. In this connection, it is submitted that at the time of Restructuring Process in the Department, the total number of Benches functioning here was 5 and each Bench was headed by a CIT(DR) as the Restructuring norms envisaged that each Bench should be headed by a CIT(DR). Such norms also provided that the cases of each Bench be represented by two Sr. DRs, which means that 2 Sr. DRs per Bench. On the basis of this analogy, the sanctioned strength at that time was 5 CIT(DRs) and 10 Sr. DRs. As a corollary to this and adhering to the Restructuring norms, since the total number of Benches currently existing has risen to 12 including one SMC and one Friday Bench i.e. 10 regular Benches which includes recently-introduced one Bench for International Taxation, the sanctioned strength of CIT(DRs) and Sr.DRs ought to be 10 and 21 respectively as under:

CIT (DRs): 10X1 = 10

Sr. DRs: 10 Regular Benches X 2 = 20

21Although, the present working strength of CIT(DRs) equates with the sanctioned strength but with the transfer of Ms. Smita Jhingran, CIT(DR), ‘C’-Bench to the Settlement Commission, vide Board’s orders No. 12/2008 dated 16th January, 2008, who has relinquished her charge in the

afternoon of today and the new incumbent having yet to join, the current working strength of CIT(DRs) can be said to be 9.

2. As against this, the current working strength of Sr. DRs suffers from an alarming shortfall of 13 as there are only 8 Sr. DRs as against the sanctioned strength of 21, after tendering of resignation letter by Ms. Indira Aiyyer, Joint CIT and proceeding on study leave of 2 years By shri Purushottam Tripuri, Addl. dated 5th October, 2007, on the captioned subject, enquiring about the reasons for non-attendance of the concerned DR before ‘E’ Bench on 10.07.07 to argue the Departmental appeal in the case of Shri Gulshan Kumar, which resulted in dismissal thereof by the Bench. To recapitulate the facts in this regard, it is submitted that the Departmental appeal in this case was fixed for hearing on 10th July, 2007, before Hon’ble ‘E’ Bench and two Sr. DRs, deployed on Rotational basis – namely Shri P.K.Prusty and Shri Mitha Lal Meena – were to argue the cases before this Bench. The Departmental appeal in the case of Shri Gulshan Kumar was assigned to Shri P.K.Prusty. However, Shri Prusty, owing to some compelling reasons could not attend the Bench as he was out of station with the result that the case remained unrepresented. As rightly pointed out by your Goodself, Shri M.L.Meena, the other Sr. DR of the Bench could not suddenly say before the Bench either about any request for adjournment or for any reasons of absence of Shri Prusty as he had no information about it.

2. It is, therefore, earnestly requested that an application u/s 254(2) of the Act, for recalling of the order citing these valid reasons, may kindly be moved, so that the Departmental appeal is refixed and reheard.

CIT(DR) was deployed on Rotational duty in ‘D’-Bench for the week commencing 21st January, 2008, as also to hold the Charge of Administration vide Office Order No. P-321A/K02/CIT/CCIT/2007-08/12063 dated 18.01.08 as Shri K.C.Jain, CIT, who had proceeded on leave from 21st January to 7th February,2008, was sanctioned leave vide the same Order. The Fax order in this regard was received in this office at 6.30 PM on 18th January. As such, the case files for the D-Bench were sent to the residence of Ms.Meeta Nambiar as she was neither available on Mobile phone nor on the residential landline phone. However, it was found that her residence was locked with the result that the files were received back in this office. Today, a telephone call has been received from Ms. Nambiar that she has suffered from an eye injury and would not be able to attend the duty before the Bench during the entire week.

2. In the above circumstances, it is earnestly requested that order for rotational duty of the CIT(DR), D-Bench, in place of Ms. Nambiar may kindly be issued urgently so that the cases of the bench for the remaining three days 22nd to 24th January, do not remain unrepresented.

**** In the ensuing week beginning from 24th March, 2008, Dr.

M.L.Meena, regular Sr. DR, was assigned duty to represent the cases of H-Bench. However, at 5.30 PM today, a Fax message was received from the Ministry of Finance, Department of Revenue, North Block, New Delhi, that Dr. M.L.Meena has to participate in the Inter-Ministry Tournament from 24th March to 28th March, 2008. As a result, Dr. Meena shall not be able to attend the assigned Bench duty in the next week. It is, therefore, earnestly requested that a Rotational Sr. DR. may kindly be deployed for this week so that the cases of H-Bench do not remain unrepresented.

This is to apprise your goodself that the regular CIT(DRs) for A, B, E and International Taxation Benches are not available in the ensuing week commencing 18th August, 2008, and thus four Rotational CIT(DRs) would be needed for these Benches for the week. It is further stated here that in the ensuing week, two Benches namely, F and H are not functioning. It is, therefore, requested that four Rotational CIT(DRs) may kindly be deployed for these Benches for the ensuing week.

2. The Bench has directed that the matter of position of CIT(DR-Intnl. Taxation) may please be looked into as the Bench is not inclined to further grant adjournments in matters to be handled by CIT(DR-Intnl. Taxation).
