A. TheBoardofEducationofBethaltoCommunityUnit8hereinafterreferredtoasthe“Board,”hereby
recognizestheBethaltoEducationAssociation(BEA),anaffiliateofIEA/NEA,hereinafterreferredtoasthe“Association,”astheexclusiveandsolenegotiationagentforallfullandregularpart-timecertifiedemployees,exceptcertifiedsubstitutes,alldistrictadministrators,andanyothermanagerialorsupervisoryemployees.
B. TheBoardagreesnottonegotiatewithanyorganizationotherthantheAssociationforthedurationofthis
agreementexceptasprescribedintheIllinoisEducationalLaborRelationsAct.
ArticleIIDefinitionofResponsibilitiesandRights
A. BoardofEducation–Itisrecognizedthatthelegalresponsibilitiesoffinaldecisionmakingcannotbe
delegated.TheBoardshallretainwhateverrightsandauthoritythatarenecessaryforiteffectivelytocarryoutitsfunctionsunderthelawsoftheStateofIllinois,whichshallinclude,butnottobelimitedto,allrightsexercisedbytheBoardpriortotheinceptionofthisagreement.TheBoardmaydevelopandrevisefromtimetotimeamanualofpolicyforitscertifiedemployees.NothinginthisagreementshalldeprivetheBoardofitsresponsibilitiesdelegatedtoitbythelawoftheStateofIllinois,norshallanythinginthisagreementabrogatetherightoftheBoardtodismissacertifiedemployeeforreasonssetforthintheIllinoisSchoolCode.
B. Bothpartiesagreethatitistheirmutualresponsibilitytoconferupontheirrespectiverepresentative(s)the
necessarypowerandauthoritytomakeproposals,toconsiderproposals,tomakecounterproposalsinthecourseofnegotiations,andtoreachtentativeagreements,whichshallbepresentedrespectivelytotheBoardandtotheAssociationforratification.
C. TheBoardagreesthatcertifiedemployeesshallhavetherighttoorganize,tojoinandtoassistthe
Association,toparticipateinprofessionalnegotiationswiththeBoardthroughrepresentativesoftheirownchoosing,andtoengageinotherlegalactivitiesforthepurposeofmakingsuggestionstotheBoardfortheestablishing,maintaining,protecting,andimprovingprofessionalserviceandtheeducationalprogram.
D. Bothpartiesagreethattheywillcontinuenottodiscriminateagainstanycertifiedemployeebyreasonof
his/hermembershipornon-membershipintheAssociation,his/herparticipationinanylegalactivitiesoftheAssociationorinnegotiationswiththeBoard,orhis/herinstitutionofanygrievanceunderthisagreement.
E. Bothpartiesagreethattheyshallnotdiscriminateagainstanemployeeforreasonofrace,creed,color,
gender,ornationalorigin.F. TheregulardistrictmailserviceshallbemadeavailabletotheAssociationforlegalcommunicationsto
certifiedemployeesinreasonableamounts.G. TheAssociationanditsrepresentativesshallbeallowedtouseschoolbuildingsformeetingsandforofficial
Associationbusinesswhenstudentsarenotpresent,withtheapprovaloftheSuperintendentordesignee.OnetimepermonththeAssociationshallbeallowedtoholdamonthlyinformationalBEAmeetingandameetingateachschoolsiteten(10)minutespriortotheendofthenormaldutyday.

H. TheAssociationwillbefurnished,uponrequest,allregularlyandroutinelypreparedinformationconcerningthefinancialconditionoftheschool,includingannualfinancialstatements,audits,andadoptedbudgets.Inaddition,theBoardandtheAdministrationwillgrantreasonablerequestsforanyreadilyavailable,pertinentinformationthatmayberelevanttonegotiations.TheAssociationshallbefurnishedacopyoftheBoardpacket(nottoincludeprivileged,personnel,orstudentinformation)andminutesofallBoardmeetings.TheAssociationwillgrantreasonablerequestsforanyreadilyavailable,pertinentinformationthatmayberelevanttonegotiations.
I. ByMarch15thofeachyear,equalrepresentationfromtheAssociation,BESPA,andtheDistrict
(Board/Administration)shallbeinvitedtomeet,discuss,anddevelopcalendarrecommendationsforthefollowingyearbeforesubmittingrecommendationstotheBoard.Three(3)certifiedmembersfromthebargainingunit,inadditiontotheAssociationPresidentandVicePresident,shallbepresentduringanymeetingofthecommittee.Eachparticipatingcommitteememberinattendancewillreceiveoneballotvotetowardsthecalendarrecommendation.FinalauthorityinthematterrestswiththeBoardofEducation.
J. AcopyoftheNegotiatedAgreementisavailableforviewingonthedistrictwebsite.Associationleadership,
whichincludesexecutiveofficers,willeachbeprovidedahardcopy.
ArticleIIIProfessionalRightsandResponsibilities
A. TheBoardagreesthatenforcementofcertifiedemployeedisciplineshouldbereasonable.Disciplineshall
meanverbalwarnings,writtenreprimands,lossofpay,noticetoremedy,suspensionwithpay,andsuspensionwithoutpay.Unlessnon-remedial,disciplineshallbeprogressiveinnature.Basedupontheseverityoftheincident,disciplinaryactionmaybeinitiatedatanyleveloftheprocess.TheBEAPresidentwillreceiveacopyofthisdisciplinaryaction.
B. Documentationofaverbalwarningwillberemovedtwo(2)yearsafterthedateissuedifnosubsequent
disciplinaryactionistakenontheoffense.C. Wheneveranydisciplinaryactionreachesthelevelofawrittenreprimandorisinitiatedatthatlevel,the
administrationshallholdameetingwiththecertifiedemployeeforthepurposeofdiscussingtheactionandthereasonsfortheaction.Thecertifiedemployeeshallbenotified,inwriting,ofthemeetingtwenty-four(24)hoursinadvancewithreasonsforthemeeting.ThecertifiedemployeeshallbeentitledtohavearepresentativeoftheAssociationpresenttoadviseandtorepresenthim/herduringthemeeting,oranysubsequentmeetingsrelativetothematterthatmightresultinfurtherdisciplinaryaction.
D. TheAssociationandBoardagreethatmattersrelatingtosupervisor-certifiedemployeeorboard-certified
employeerelationshipsshallnotbediscussedinthepresenceofstudentsorothercertifiedemployees.Thiswouldnotprohibit,inanyway,thesupervisororBoardoritsdesigneefromtakingwhateveractiondeemednecessaryfortheoperationoftheschool.
E. TheAssociationandtheBoardagreetothefollowingwithregardtoverbaldisciplinarywarnings:
1. Thedocumentationofverbalwarningswillresidewiththesupervisorwhoissuedsuchwarningandthesuperintendent.
2. DocumentationofthatverbalwarningwillalsoresidewiththeAssociationPresident.Thiscopyofthewarningwillserveasthefirststepinprogressivedisciplineshouldfutureactionbewarranted.
3. Allotherdocumentationofemployeediscipline,otherthanverbalwarnings,willbeplacedintheemployee’spersonnelfile.

F. Thecertifiedemployeeshallhavetherighttowritearebuttaltoverbalwarningsandwrittenwarningswithinfifteen(15)calendardays.Thisrebuttalshallbeattachedtothedisciplineandplacedintheemployee’spersonnelfile.
G. Eachcertifiedemployeeshallhavetheright,uponwrittenrequesttwenty-four(24)hoursinadvance,to
reviewthecontentsofhis/herpersonnelfilewiththeexceptionofconfidentialmaterials.Certifiedemployeesshallhavetherighttoplaceintheirpersonnelfileswrittenreactionstoanyofthecontentscontainedintheirpersonnelfiles.Materialsrelatedtodiscipline,tocontinuationofemployment,toevaluation,ortoanyderogatorymaterialtoacertifiedemployee’sconduct,service,character,orpersonalitymaynotbeplacedinthepersonnelfilesunless(1)thecertifiedemployeehasfirstbeengivenacopyofsuchmaterial,(2)aconference,ifrequestedbythecertifiedemployee,hasbeenheldwiththecertifiedemployee,anAssociationrepresentative,andtheappropriateadministrator,and(3)thecertifiedemployeehasbeengivenanopportunitytoattachawrittenresponsetosuchmaterial.Nooneotherthantheimmediatesupervisor,thesuperintendent,ordesigneeshallhaveaccesstothefilewithouttheprior-writtenconsentofthecertifiedemployee.Allcorrespondenceplacedinacertifiedemployee'spersonnelfilemustbesignedbytheoriginatorofthecorrespondence.
ArticleIVCitizenship
A. Thecertifiedemployeeshallbeguaranteedtherighttoengageinlegalpoliticalactivities.B. Thecertifiedemployeeshallnotuseinstitutionalprivileges,facilities,ortimetopromotepolitical
candidatesortofurtherpoliticalactivities.C. Thepartiesseektoeducateyoungpeopleinthedemocratictraditiontofosterarecognitionofindividual
freedomandtheframeworkofsocialandlegalresponsibilityandtoinspiremeaningfulawarenessofandrespectfortheConstitutionandtheBillofRightsoftheUnitedStatesandtheConstitutionoftheStateofIllinois.
ArticleV
CertifiedEmployeeProtection
A. InthecaseofanassaultonacertifiedemployeeduringthescopeofemploymentorunderthedirectionoftheBoard,theincidentshallbepromptlyreportedtotheBoardoritsdesigneeinwriting.Uponreceiptofawrittencomplaintfromanycertifiedemployee,thesuperintendentshallreportallincidentsofassaultorbatterytolocallawenforcementagenciesnolaterthanthree(3)daysaftertheoccurrence.
B. Inaccordancewiththeprovisionsofsection10–22.3oftheIllinoisSchoolCode,theBoardshallprovide
liabilityinsurance.C. Ifanemployeebecomesawareofapotentiallyunsafeorhazardouscondition,theemployeeshouldreport
thissituationtohis/herimmediatesupervisorwhoshallpromptlytakestepstocorrectanyunsafeorhazardouscondition.

ArticleVIProfessionalQualificationsandAssignments
A. Acertifiedemployeeshallbegivennoticeofhis/hertentativeassignmentfortheforthcomingyearnolater
thanfive(5)daysbeforethelastdayofschoolofthecurrentyear.Incaseofinvoluntarytransfers,notificationtothecertifiedemployeeshallbegivenafterthestudent-schooldaywithrationalegivenforthedecision.Thecertifiedemployeeshallbegiventhree(3)daystorespondinwritingorinconferencebeforethefinaldecisionismade.ThecertifiedemployeemayrequestAssociationrepresentation.Shouldthecertifiedemployeechoosenottoaccepttheassignment,he/shemayresign.
BargainingUnitPositionsB. UnitPositions
1. Avacancyshallexistwhenanewbargaining-unitpositioniscreatedorwhenanexistingbargaining-unitpositionisvacatedasaresultoftermination,resignation,retirement,transfer,ordeath.
2. Atanytime,acertifiedemployeemayrequestinwritingachangeinteachingassignmenttoadifferentgradelevel,building,oracademicarea.Thenotificationshallindicateallareasofinterest.Thistransferrequestwillbeconfidential.Shouldarelatedvacancyoccur,itistheresponsibilityofthecertifiedemployeetocontacttheDistrictAdministrativeServiceCentertoexpressinterestinthevacancy.ThewrittennotificationofinterestshallremainonfileintheDistrictAdministrativeServicesCenter(ASC)throughthefirstteacher-attendancedayofeachschoolyear.
3. Vacanciesinbargainingunitpositionsshallrequireaninternalpostingofthree(3)school-businessdays.Afterthree(3)daysofinternalposting,positionswillbepostedpublicly.Postingsshallbemadeatallbuildingsbeforetheendofthebusinessday.ThePresidentoftheBethaltoEducationAssociationshallbenotifiedbye-mailbeforetheendofthebusinessday.AllpostingswillbeemailedtotheEaglesNestemailgroup,addedtoafolderlabeled"DistrictEmploymentOpportunities"withinthedistrict'ssharedGoogledrive,andpostedontheDistrictwebsite.Iftheoriginalpostingoccursafter2:00P.M.onthefirstdayofposting,thenextbusinessdaywillbeconsideredthefirstdayoftherequiredthree(3)daysofposting.
4. Vacanciesoccurringfromfifteen(15)calendardaysprecedinganduptothefirstattendancedayofthenewschoolyearwillbepostedatallbuildings,theDistrictAdministrativeServicesCenter,andontheDistrictWebsite,buttimelimitswillnotbeimposed.
5. Anewly-createdpositionshallbepostedinthesamemannerasallothervacancies,exceptthepostingwillbeforten(10)workdayspriortothepositionbeingfilledonapermanentbasis.BothpartiesagreethatBoardactionmaybetakenonanewlycreatedpositionafterthree(3)days,yetpriortotherealizationoften(10)postingdays.
6. VacanciesoccurringafterNovember1stoftheschoolyearshallbefilledatthediscretionofthesuperintendentonatemporarybasis;however,suchvacanciesshallbepostedforthenextschoolyear.
7. Infillingofvacancies,ifallotherfactorsareequal,senioritywillbeconsidered.Thedistrictreservestherighttoselectandtoemploypersonsfromoutsidethedistrictwhenacceptableapplicantsarenotavailablefromwithinthedistrict.
ArticleVII
TeachingHoursandAssignments
A. Acertifiedemployeewhoisassignedtoaclassthatrequirestheforfeitureofhis/herpreparationperiodshallbecompensatedusingthehourlyrateasdefinedinAppendixA.Dollaramountsshallbedeterminedfortheactuallengthoftheelementary,middleschool,andhighschoolclasses.Whenteachersofhigh-schoolseniorshavenostudents(duetoexamsandearlydismissal/graduation)andareaskedorvolunteertocovertheclassesofcolleagues,theywillnotbecompensated.Eachschoolshallmaintainacertified

employeesubstitutevolunteersignuplistforinternalsubstitutionsthattakeplaceontheirpreparationperiod.Thislistwillbeusedtodetermineeachvolunteer’savailabilitytofillanabsence.Acertifiedemployeemaynotbeassignedtoaclassduringtheirpreparationperiod,withoutexhaustingthevolunteerlistfirst.
B. Ifacertifiedemployeeteachesanextraclassonaregularbasis,thecertifiedemployeeshallreceive1/7of
thesalarylistedincellM.S.-Step5ofthesalaryscheduleineffecttheyearinwhichtheoverloadcourseisbeingtaughtforanoverloadatthemiddleschoolleveland1/7ofthesalarylistedincellM.S.-Step5ofthesalaryscheduleineffectintheyearinwhichtheoverloadcourseisbeingtaughtattheseniorhighlevel.
C. Theregular-classroomelementary-certifiedemployeeshallnotberequiredtoberesponsiblefor
playgroundsupervisionofstudentseitherbeforeschool,duringmorningandafternoonrecess,duringthelunchperiodrecess,oranyothersupervisorydutyexceptinemergencysituations.Anemergencysituationshallbedeemedtoexistifanon-certifiedemployeehasbeenemployedbutisabsent.Intheeventsuchanemergencysituationarises,thedistrictshallhavetherighttoassignsuchdutytocertifiedemployeesandshallmakesuchassignmentonarotatingbasis,startingwiththeemployeeinthebuildingwiththeleastamountofdistrictseniority.Ifacertifiedemployeeisassignedsuchemergencysupervisiondutypursuanttothissection,theemployeeshallbepaidattherateinAppendixAforperformingsuchaduty.
D. Certifiedemployeeswillnotberesponsible,duringtheschoolcodemandateddutyfreelunchperiod,for
supervisioninthecafeteriawhilethestudentsareeatinglunch.Theelementary/middleschool/highschool-certifiedemployeeshallhavetheoptionoflunchsupervision,withapprovalfromtheirbuildingadministrator,andwillbecompensatedwithafreeschoollunchonsupervisiondays.Supervisionexpectationswillbeestablishedbythebuildingadministrator.TheSuperintendentand/orBoardwillhavetheoptiontowithdrawthisbenefitatanytime,butwillnotifytheBEApresidentfirst.
E. Ifthepositionofatenured,certifiedemployeeistobeeliminatedforthenextschoolyear,thecertified
employeeshallbenotifiedbytheSuperintendent,notlessthanten(10)calendardaysprecedingtheBoardactionontheelimination.
F. EarlyDismissal
December23rdand24thwillnotberequiredworkdays.Theendofthecertifiedemployeeworkdayshallbethesameasten(10)minutesaftertheregular,non-block/non-earlyrelease/non-semesterexam,studentdismissaltimeforthethree(3)workdaysprecedingChristmasvacation.
G. ClassSize
ThedistrictacceptsthegoalthattheK-5classesshouldbelowerthanothergradelevelsandthegoalofnomorethan25studentsinK-5classes.CertifiedemployeesinK-5classroomswith31ormorestudentsonemonthfromthebeginningofschool,includingstudentsinattendancefortwohoursormoreoftheday,willreceiveastipendof$200/semesterwhiletheyareabovetheprescribedlimit.Thedistrictalsoacceptsthegoalthatmiddleandhighschoolclasses(withtheexceptionsofmusicandphysicaleducation)willhavenomorethan30students.Inthecaseofmusicandphysicaleducation,thegoalistohavenomorethana35to1pupil-teacherratio.
H. CertifiedEmployeeInput
Thepartiesagreetoestablishaplanningcommitteeforthepurposeoforganizinguptofourquarterly“roundtablediscussions”involvingtheAssociation,theadministration,andtheSchoolBoardeachschoolyear.OnepurposeofthiscommitteeistoprovideaforumforAssociationinputconcerningcurrentissues,educationalgoals,andfuturedevelopmentalplanning.Proceduresfortheconductingofthe“roundtables”includingspecificagendasandanumberofparticipantswillbedecidedbymutualagreement.Furthermore,

thesuperintendentshallnotifytheBEAPresidentwhensignificantchangeswithinthedistrictarebeingconsidered(e.g.startingandendingtimes,movinggradelevelsamongbuildings,etc.)
I. SummerSchoolPay
Acertifiedemployee’srateofpayforteachingsummerschoolshallbedeterminedbythehourlyrateinAppendixA.
J. ProfessionalStaffMeetings
Thepartiesagreethereisaneedforprofessionalstaffmeetings.Theadministration’sgoalistodistributecommitteeassignmentsequitablywhenpossible.Effortswillbemadetoavoidschedulingcommitteemeetingsduringhighclassroommanagementtimes,suchasattheendofthequarter.
ArticleVIIILeaves
A. SickLeave
1. Eachcertifiedemployeethroughyearten(10)onthesalaryscheduleshallbeentitledtoatotaloften(10)sickdays,withfullpay,perschoolyear.Afterten(10)years’longevity(yearsinthedistrict)andforeveryyearthereafter,eachcertifiedemployeeshallbeentitledtofourteen(14)sickdays,withfullpayperschoolyear.
2. Annualcontractualsick-leavedaysshallbegrantedatthebeginningofeachschoolyear.Unusedsickdaysshallnotexceedamaximumof340daysattheendofeachschoolyear.a. UnusedsickdaysmaybeappliedtoyearsofservicebasedoncriteriaestablishedbytheTeachers’
RetirementSystem. b. UseofaccumulatedsickdaysappliesonlytocertifiedemployeeswhoretireundertheStateof
IllinoisTeacherRetirementSystem.c. SickLeaveBalloon
Certifiedemployeeswhohavecompletedatleastten(10)yearsoffull-timecreditableservicetoBethaltoCommunityUnitSchoolDistrictNo.8whoprovidefive(5)yearsadvancednoticeofretirementshallbeeligibleforasickleaveballoonbenefit.Inordertoreceivethisbenefit,theemployeeshallprovidethedistrictwithanirrevocablelettereffectivefive(5)yearsfromthedateofnotificationandbeatleastfifty-five(55)yearsofagebyDecember31stoftheyearofretirementwithtwenty(20)ormoreyearsofcreditableservicewiththeIllinoisTeachers’RetirementSystem.Uponreceiptoftheemployee'sletterofresignationandacceptancebytheboard,theemployershallimmediatelyaddupto170daystotheemployee'saccumulatedsickleave,withtheresultingaccumulatedsickleavenottoexceed340days.TheDistrictwillnotberesponsibleforthissickleaveballoonoptioniftheDistrictmustpayanypenalty(employercost)totheIllinoisTeachers'RetirementSystem.
3. Sickleaveshallbeinterpretedtomeanpersonalillness,quarantineathome,seriousillnessordeathintheimmediatehousehold,birth,adoption,orplacementforadoption,and/ortoattendIEP/504meetingsforachildunderthecareofthecertifiedemployee.Sickleavecanbetakeninclockhours.
4. Theimmediatefamily,forpurposesofthissection,shallincludethefollowing:father,mother,sister,brother,spouse,fiancé,children,grandparents,grandchildren,stepchildren,domesticpartners,orthoselivingintheimmediatehousehold,legalguardians,andcorrespondingin-laws.
5. TheBoardoritsdesigneemayrequireaphysician’scertificateasabasisforpayduringleaveafteranabsenceofthree(3)daysforpersonalillness,orasitmaydeemnecessaryinothercases.
6. Intheeventacertifiedemployeehasexhaustedhis/heraccumulatedsickleaveandpersonalleave,eachcertifiedemployeeshallbeallowedtocontributeamaximumoftwo(2)sick-leaveorpersonal-leavedaysfortheuseassick-leavedaystosaidemployee.Allcertifiedemployeesshallbegivenupto

two(2)opportunitiestocontributedaystosaidcertifiedemployeeforatotaloffour(4)daysperyear.Saiddaysshallbeutilizedintheorderinwhichtheemployeereceivedthem.a. Acertifiedemployeewhohasdepletedhis/hersickleaveandwishestobeconsideredfordonated
sickdaysshallobtainaneligibilityformfromtheBEA.ThecertifiedemployeewilltakethecompletedformtotheDistrictAdministrativeServicesCenterforverificationofeligibility.
b. Afterreceivingthecompletedverificationform,theAssociationwillthennotifymembersandadministerthedistributionofdonatedsickdays.
B. BereavementLeave
1. Intheeventofadeathintheimmediatefamilyoruncle,aunt,niece,nephew,ordomesticpartner,four(4)days(accumulated)willbegrantedandnotchargedagainstsickleave.
2. OnedayofEmergencyLeavemaybeusedinanyyeartoattendfuneralsforindividualsnotallowedassickleave.
C. EmergencyLeave

D. PersonalLeave
1. Certifiedemployeeswillbegrantedtwo(2)personal-leavedaysperyearunderthefollowingcriteria:a. Amaximumofeight(8)certifiedemployeesshallhaveavailablepersonalleaveonthefirstandlast
teacher-attendancedayandpriortooraftereachscheduledholiday.TheearliestopportunitytosubmitapersonalleaverequestforthefallsemesterwillbethefirstMondayinJuly.TheearliestopportunitytosubmitapersonalleaverequestforthespringsemesterwillbethefirstMondayinDecember.
b. Aminimumofforty-eight(48)hoursnoticemustbegiven,whenfeasible,totheSuperintendent,andtheresponsibilityisontheemployeetoseethatthisrequestissubmittedinatimelyfashion.Oncesubmittedtherequestshallbeactedupon,iffeasible,withintwenty-four(24)hours.

F. UnpaidLeave
Atanytime,certifiedemployeesmayapplyforunpaidleave.ApprovalofunpaidleaveisatthediscretionoftheSchoolBoard.Suchleavemaybeutilizedonlywhenotherleaveprovisionsdonotapplyorhavebeenexhausted.EmployeesshallberesponsibleforthepaymentofhealthinsurancepremiumsduringtheperiodofunpaidleaveforextendedleaveapprovedbytheBoard.

G. MisuseofLeaveCertifiedemployeeswillnotmisuseanyleavegrantedbytheBoardoritsdesignee.Misuseofleaveshallresultinthedockingofpay.MisuseofleavemayalsoresultindismissalinaccordancewithprovisionsoftheIllinoisSchoolCode,section10-22.4
H. FamilyMedicalLeave
1. Allfull-timeandpart-timeemployeesshallbeeligibleforuptotwelve(12)weeksoffamilymedicalleaveforanypurposeallowedbytheFamilyMedicalLeaveAct(FMLA).Anemployeemusthaveworkedforthedistrictforatleastone(1)yearinordertobeeligible.
2. Duringthefamilymedicalleaveperiod,thedistrictshallcontinuetopaythehealthinsurancepremiumspursuanttothiscollectivebargainingagreement.Theemployeeshallhavetheoptiontotakefamilymedicalleaveoranyotherrelevantcontractualleave.Employeesshallnotberequiredtousefamilymedicalleavepriorto,insteadof,orasasubstituteforanyaccruedleave.Attheemployee’soption,theemployeemayelecttousepersonalleaveorsickleaveduringfamilymedicalleave.
3. Whenthedistrictemploysbothspouses,eachwillbeentitledtotwelve(12)weeksofleaveinanytwelve(12)monthperiod.Followingtheleaveperiod,theemployeeshallbereinstatedtohis/herpreviousposition,ifitisavailable.Iftheemployee’spreviouspositionisnotavailable,theemployeeshallbereinstatedtoanequivalentposition.

ProfessionalCompensationandRelatedProvisionsA. SupplementalPolicies
1. Uponemployment,certifiedemployeesnewtothedistrictwillbegivencreditonthesalaryscheduleforallcompleteyearsoffull-timeteachingexperienceinthepublicelementaryandsecondaryschools.Part-timecertifiedemployeesworking50%ormoreofafulldayshallbeallowedtomoveonestepforeachtwo(2)yearsofemployment.Theseprovisionsshallnotapplyifitisnecessarytohirenewcertifiedemployeeswhohaveretiredfromtheteachingprofession.
2. ThesalaryscheduleshallbeaddedasAppendixB.Thecertifiedemployeework-yearshallnotexceedonehundredandeighty(180)days.
3. AtnotimewillanyTRScreditablesalary/benefit/stipendincreasetoanyemployeebeinexcessofand/orcausetheBethaltoUnit#8DistricttoincuranyTRSpenaltyundertheprovisionsPA94-0004thatlimitstheamountofTRScreditablesalaryforretirementpurposes.
4. Inadditiontoreceivingsalaryscheduleenhancements,certifiedemployeesbeyondstep26willreceivea$750longevitybonusstipendforeachyearofadditionalservice.Suchstipendswillterminateuponreceiptoftheretirementbonuscompensation.
B. PayrollProcedures
1. Payrollchecksshall,wheneverfeasible,beissuedonthe15thofthemonth.Payrollchecksshallbedeliveredinasealedenvelope.
2. Ifaregularpaydayduringtheschoolyearfallsonadaywhenschoolisnotinsession,certifiedemployeesshall,wheneverfeasible,receivepayonthelastdayofschoolsession.Duringthesummerperiod,checksshallbemailedontheregularpaydaytothedesignatedaddressofthecertifiedemployee.
3. InaccordancewithBoardpolicy,payrolldeductionsforAssociation,IEA,andNEAduesshallbemadeonanauthorizationformsuppliedbytheAssociation.
4. Withholdingformsshallbedeliveredinanenvelopewheneverfeasible.5. Certifiedemployeesshallhavetheoptionofhavingtheirpayrollcheckdirectdepositedelectronicallyin
thebankinginstitutionoftheirchoice.

C. Insurance1. TheBoard,foreachfull-timecertifiedemployee,shallpay80%ofthemonthlypremium,nottoexceed
$480foranindividualhospitalizationinsuranceplanforthefirstyearofthiscontractandnottoexceed$520forthesecondyearofthiscontract.TheBoardwillpayanadditional$100permonthforthecertifiedemployeeswhoenrollinthefamilyinsuranceplan.Afull-timecertifiedemployee,forthepurposeofmembershipintheinsuranceprogram,shallbedefinedasonewhoworksaminimumoffive(5)periodsperdayor5/7ofadayforelementary.
2. Eachcertifiedemployeewhoisnotamemberofthegrouphospitalizationprogramshallbeprovidedwithaterm-lifeinsurancepolicyintheamountof$50,000.
3. Anadvisoryinsurancecommitteemadeupofanequalnumberofinviteddistrictadministrators,BoardofEducationmembers,andcertifiedemployeesselectedbytheBEAshallbeestablishedtoconsideroptionstoreducehealth-insurancepremiumsandtoprovideinputtointerestedpartiesregardinghealthinsurancecoverageandoptions.Suchcommitteemaybecalledtomeetbythesuperintendent,bytheBoardofEducation,orbytheBEA.Aminimumofthree(3)teachersinthebargainingunit,inadditiontotheAssociationPresidentandVicePresident,shallbepresentduringanymeetingofthecommittee.TheadvisoryinsurancecommitteeshallmakerecommendationstotheBoardandtotheBEAwithrespecttopotentialchangesininsurancecoverageandoptions.
4. Thereshallbenochangesincoverageand/orcarriers,exceptforthosechangesmadebytheinsurancecarriers,whicharebeyondthecontrolofthedistrict,unlessbargainedwiththeBEA.
5. TheBoardwillestablishandmaintainaSection125Plan,whichallowsshelteroffamilyorindividualhealth-insurancepremiumamounts.TheBoardofEducationalsoofferstheoptionforcertifiedemployeestoincludetheflexiblespendingaccountsforun-reimbursedmedicalexpensesanddependentcareexpenses,consistentwithapplicablelaw.
6. Anyfull-timecertifiedemployeecompletingayearofservicewhoisnotrehiredfortheforthcomingschoolyearshallbeentitledtoremainintheSchoolDistrictHospitalizationInsurancePlanuntilAugust31stofthatyear.
D. SalaryScheduleAdvancement
OnlycourseworkforpostBachelor’sDegreesandPostMaster’sDegreescompletedthrougharegionallyaccreditedcollegeoruniversity,aslistedbytheIllinoisStateBoardofEducation,willbeapproved.FortheappropriateplacementontheDistrictSalarySchedule,anofficialtranscriptmustbeonfilebythefirstdayofOctoberintheschoolyearinwhichpaymentwillbemade.Inaddition,districtdocumentationshowingthatthehourshavebeenapprovedinadvanceashoursrelatingeithertotheteachingpositionortotheprofessionaldevelopmentofthecertifiedemployeeseekingthesalaryplacementmustbeincluded.AcertifiedemployeeshallbeabletomoveacrossthesalaryschedulebeyondtheMasterslevelbymeetingtheextrahourrequirements,providedthehoursareatthegraduatelevelandarehoursincoursesinoneormoreofthefollowing:1. Theareainwhichhe/sheisteaching2. Inanareainwhichhe/sheiscurrentlyqualifiedtoteach3. Inprofessionaldevelopmentareastomaintainand/ortoimproveskillsasacertifiedemployee(i.e.,
technology,drugabuse,violenceprevention,curriculumstandards,andassessments,etc.)4. AdditionalcourseworktoobtainateachingendorsementforcertificationinanotherISBEapproved
area.5. CertifiedemployeeswhosuccessfullyachieveNationalBoardCertificationwillbeeligibleforadditional
hoursofeducationalcreditforadvancementonthesalaryschedule.
E. MileageReimbursementForallrequiredordistrictapprovedmileageinpersonalcars,certifiedemployeesshallbepaidthecurrentrateestablishedbytheInternalRevenueService.

F. ExtracurricularScheduleAjointcommitteeofcertifiedstaffconsistingoftheBEAPresidentorappointee,andone(1)representativefromeachareaoffinearts,highschool,middleschool,andelementary,shallmeetwiththeathleticdirectorandBoard/administrationtoestablishfuturestipends.ThedesignofthecommitteewillallowforanequalnumberofcertifiedstaffmembersandBoard/administration.Thecommitteewillmeetinthefallofeachyearafterasuccessorcontracthasbeenratifiedbybothparties,toestablishstipendsforthelengthofthecurrentcontract.Thecommittee’sproposalwillbepresentedtotheBoardforitsapproval.
G. ReimbursementforApprovedStudy
Certifiedemployeesmayreceivetuitionreimbursementforapprovedcollegecoursessuccessfullycompletedasfollows:1. Tuitionreimbursementwillbeasmuchas$50.00persemesterhour,$100persemesterhourfor
certifiedemployeesseekingcontentareacertifications,foruptosixsemesterhourspercontractyearuponsatisfactorycompletionofgraduatelevelcoursework.Acertifiedemployeemustreceivean“A”or“B”toreceivereimbursement.
2. Thecertifiedemployeemustbeanemployeeofthedistrictatthetimethecourseworkiscompleted.3. Reimbursementshallnotexceedthecostoftuitionassessedthecertifiedemployee.4. Anycoursecurrentlyacceptableforhorizontalmovementonthesalaryschedule,oranycourse
deemedascontributingtotheprofessionalimprovementofthecertifiedemployee,oranycourseusedtosatisfytheemployee’scertifiedprofessionaldevelopmentprogramwillbeeligibleforreimbursement.
5. Applicationforreimbursementshouldbemadeassoonaftercourseenrollmentaspossible.6. Reimbursementwillbedeterminedasfollows:
a. Totalreimbursementfundswillbedividedbytotaleligiblehoursforcompensation.b. Reimbursementshallnotexceed$300perpersonperyear,$600perpersonperyearforcertified

H. RetirementTheBoardshallrecognizetheserviceoffull-timecertifiedemployeeswhohavecompletedatleastten(10)yearsoffull-timecreditableservicetoBethaltoCommunityUnitSchoolDistrictNo.8immediatelyprecedingretirementandwhoareeligibletoreceiveregularretirementpensionbenefitsthroughtheIllinoisTeachers’RetirementSystem.Tobeeligibleforthisbenefit,acertifiedemployeemustcomplywithallofthefollowingrequirementsandlimitations:1. Mustbeatleastsixty(60)yearsofagebythetimeofretirementormustbeatleastfifty-five(55)years
ofagebyDecember31stoftheyearofretirementwiththirty-five(35)ormoreyearsofcreditableservicewiththeIllinoisTeachers’RetirementSystem.
2. AnirrevocableletterofresignationforretirementmustbefiledonorbeforeMay1statleastoneyearpriortotheeffectivedateofretirementanduptothree(3)yearspriortotheeffectivedateofretirement.
3. Duringthepre-retirementperiod,thecertifiedemployeeshallberemovedfromtheregularsalaryscheduleandwillreceivea5%increaseoverthepreviousyear’stotalcreditableearningsineachyearofthepre-retirementperiod.

ArticleXCertifiedEmployeeEvaluation
A. Thepartiesagreethattheprimaryobjectivesofcertifiedemployeeevaluationsaretoimprovethequality
ofinstruction.Thepartiesrecognizetheimportanceandvalueofaprocedureforassistingandevaluatingtheprogressandsuccessofallcertifiedemployees.
B. TheDistrictEvaluationPlanforcertifiedemployeesshallbedevelopedand/ormodifiedincooperationwiththeAssociationviatheP.E.R.A.JointCommittee.TheP.E.R.A.JointCommitteewillmeetandreviewtheinstrumentonanongoingbasispriortoeachnew(2-year)evaluationcycle,ormoreoftenifmutuallyagreedupon.Thepurposeofanevaluationistoaccuratelydocumentobjectiveevidenceandsolelyrelyuponthatevidencetorateateacher'sperformanceasexcellent,proficient,needsimprovement,orunsatisfactory.TheDistrictwillcomplywithstatelawandregulationsregardingtheevaluationofcertifiedemployees,includingprovidingtherequirednotices.Theuseofstillcamerasand/orelectronicdevicessuchasaudioandvideoequipmentshallnotbeusedduringformalorinformalobservations,unlessrequestedbytheteacher.Theappropriateuseofsick,parental,familymedicalleave,and/ormilitaryleaveorattendanceatextra-curriculareventsshallnotbecountedagainstattendanceontheteacher'sevaluation.Formalobservationsshallnotoccurduringtheweekofhomecomingactivities,oron"emotionallychargeddays"suchasHalloween,Valentine'sDay,thedaypriortosubstantialschoolbreaks,etc.TheP.E.R.A.JointCommitteewilldevelopalistof"blackoutdates"forformalobservations.Tenuredcertifiedstaffwhoareintheretirementpipeline,whoreceivedeitheranexcellentorproficientperformanceratingintheirprevioustwoevaluationcycles,maynotbeevaluatedintheirfinalevaluationcycle.Ifnotevaluated,thelastsummativeevaluationratingwillbecomethedefaultratingforthelastevaluationcycle.Administrationmaintainstherighttoconductinformalevaluationsandformalevaluationsasdeemednecessaryandasallowableundertheschoolcode.
ArticleXINegotiationProcedures
A. BargainingNotification
ThepartiesshallcommencebargainingforasuccessoragreementpertheIllinoisEducationalLaborRelationsActanditsrulesandregulations.Groundruleswillbedevelopedpriortoeachsuccessoragreementnegotiations.
B. MediationItisagreedthatthepartieswilljointlyrequesttheFederalMediationandConciliationService(FMCS)ifeitherpartytothisagreementdeterminesthattheassistanceofamediatorwillbenecessary.ShouldFMCSbeunavailable,thepartiesshallimmediatelycommencediscussionastoareplacement.Intheeventthatthepartiescannotagreeuponareplacement,theIllinoisEducationalLaborRelationsBoardshallbenotified.

C. ContractualAmendmentsThepartiesmaymodifyoramendthisagreementonlybymutualconsentorthroughmid-termbargainingrights.Suchchangesshallbereducedtowriting,ratifiedandsignedbytheparties,becomeanamendmenttothiscontract,andconsideredapartofthisagreement.
D. Labor-ManagementCommittee1. RepresentativesoftheemployerandtheAssociationwillmeetonedayofeachmonthforthepurpose
ofreviewingtheadministrationofthecontractandtoresolveproblemsthatmayarise.Ameetingmaybepostponedorcancelledbymutualconsentofbothparties.Thesemeetingsarenotintendedtoby-passthegrievanceprocedure.
2. Theseon-goingmeetingswillnotconstituteawaiveronthepartoftheAssociationofmid-termbargainingrightsgrantedundertheIELRA.
ArticleXII
GrievanceProcedure
A. Definition1. AgrievanceshallbeanyclaimbytheAssociation,anemployee,orgroupofemployeesthatthereisan
allegedviolation,misinterpretation,ormisapplicationofthetermsofthisagreement.2. AlltimelimitsconsistofdayswhenschoolisopenforbusinessorwhentheDistrictAdministrative
ServicesCenterisofficiallyopenforbusinessduringacademicintersession.
B. ProceduresThepartiesacknowledgethatitisdesirableforthecertifiedemployeeandtheimmediately-involvedsupervisortoresolveproblemsthroughfreeandinformalcommunications.If,however,theinformalprocessfails,aformalgrievanceshallbefiledwithinthirty(30)daysofthefailureoftheproblemtoberesolvedattheinformallevel,orwithinthirty(30)daysofwhentheAssociationmightreasonablyhavehadknowledgethereof,unlesstheviolationisofacontinuingnature.StepOneTheAssociation,orgrievantifotherthantheAssociation,shallpresentthegrievanceinwritingtotheimmediatelyinvolvedsupervisor,whowillarrangeforameetingtotakeplacewithinten(10)daysofreceiptofthegrievance.Thegrievanceshallstatethespecificviolation,misinterpretation,ormisapplicationoftheagreementandtherequestedremedy.TheAssociation’srepresentative,thegrievant,andtheimmediatelyinvolvedsupervisorshallbepresentforthemeeting.Withinten(10)daysofthemeeting,theAssociationshallbeprovidedwiththesupervisor’swrittenresponse,includingthereasonsforthedecision.StepTwoIfthegrievanceisnotresolvedatstepone,thenitmaybereferredtothesuperintendentorthesuperintendent’sofficialdesigneewithinten(10)daysafterreceiptofthesteponeanswer.Thesuperintendentshallarrange,withtheAssociationrepresentative,forameetingtotakeplacewithinten(10)daysofthesuperintendent’sreceiptoftheappeal.Withintendaysofthemeeting,theAssociationshallbeprovidedwiththesuperintendent’swrittenresponse,includingthereasonsforthedecision.StepThreeIftheAssociationisnotsatisfiedwiththedispositionofthegrievanceatsteptwo,theAssociationmaysubmitthegrievanceeithertotheAmericanArbitrationAssociation(AAA),ortotheFederalMediationandConciliationService(FMCS)forfinalandbindingarbitration.Ifademandforarbitrationisnotfiledwiththe

employerwithinthirty(30)daysofthedateofthesteptwoanswer,thenthegrievanceshallbedeemedwithdrawn.Withinten(10)daysofreceiptofalistofavailableAAAorFMCSArbitrators,thetwo(2)partiesshalleithermutuallyagreeonanarbitratororshallsubmittotheAAAorFMCSthosenamesonthelistthatareacceptable.Thedecisionofthearbitratorshallbefinalandbindingonbothparties.
C. BypassBymutualagreement,anystepofthegrievanceproceduremaybebypassed.
D. DirectSubmissiontoArbitrationBymutualagreement,thegrievancemaybesubmitteddirectlytoarbitration.
E. ClassGrievanceAgrievanceinvolvingmorethanonecertifiedemployee,morethanonesupervisor,oranadministratoratthebuildinglevel,maybeinitiallyfiledbytheAssociationatsteptwo.
F. NoReprisalNoreprisalsshallbetakenbytheemployeragainstanyemployeebecauseoftheemployee’sparticipationorrefusaltoparticipateinagrievance.
G. InvestigationAnyinvestigation,handling,orproceedingofagrievancebythegrievantorAssociationshallbeconductedsoastoresultinnointerferencewithorinterruptionwhatsoevertotheinstructionalprogram,relatedworkactivities,thegrievant,orthedistrict’semployees.
H. ReleaseTimeShouldthetimeofthehearingbeforethearbitratorrequirethatacertifiedemployeeoranAssociationrepresentativebereleasedfromhis/herregularassignment,onecertifiedemployeeorAssociationrepresentativeshallbereleased,atthediscretionofthesuperintendent,withoutlossofpayorbenefitsforthetimenecessarytoattendthehearing.
I. DisclosureofInformationBoththeAssociationandtheemployeeshallprovideeachotherinformationrelevanttothegrievance.NeithertheemployernortheAssociationshallbepermittedtoassertanygroundsorevidencebeforethearbitratorthatwasnotpreviouslydisclosedtotheotherparty.
J. FilingofMaterialsAllrecordsrelatedtoagrievanceshallbefiledseparatelyfromthepersonnelfilesoftheemployee.
K. GrievanceWithdrawalAgrievancemaybewithdrawnatanylevelwithoutestablishingaprecedent.
L. NoWrittenResponse/ExtensionofTimeLimitsIntheeventthatthegrievantfailstoactonanygrievancewithintheprescribedtimelimits,thegrievanceshallbeconsideredtoberesolved.Anadministrator’sfailuretogiveadecisionwithinthetimelimitsshallpromotethegrievanttoproceedtothenextstep.Timelimitsmaybeextendedbymutualagreement.

M. ExpeditedArbitrationBymutualagreement,theexpeditedrulesoftheAAAshallbeusedinsteadoftheVoluntaryLaborArbitrationRules.
N. CostsThefeesandexpensesofthearbitratorshallbesharedequallybytheparties.Ifonlyonepartyrequeststhepresenceofacourtreporter,thatpartyshallbearthecostofthereporter.Iftheotherpartywantsacopyofthereport,theotherpartymustsharethecost.
O. SettlementBymutualagreementoftheAssociationandtheemployer,agrievancemaybesettledatanystepwithorwithoutestablishingprejudiceorprecedent.
ArticleXIIIReductioninForce
A. Atenured-certifiedemployeewhoisbeingconsideredforReductioninForce(RIF)willbeconsultedbythe
Superintendentten(10)calendardayspriortoanyanticipatedboardaction.Thecertifiedemployeeshallbegiventheopportunitytodiscussthereasonsforthereduction.ABethaltoEducationAssociationrepresentativeshallalsobeinattendanceifrequestedbythecertifiedemployee.TheBethaltoEducationAssociationPresidentshallbenotifiedatleasttwenty(20)calendardayspriortoanyanticipatedRIFoftenuredcertifiedemployees.AllRIFnoticestocertifiedemployeesmustbedeliveredbyorbefore45calendardayspriortotheendoftheschoolyear,orasrequiredundertheSchoolCode.
B. SenioritylistswillbemadeavailablebyFebruary1stofeachyear.Acertifiedemployeewhofeelsthathe/sheisqualifiedinadditionalareasofcertificationhasuntilMarch1sttoshowproofofsuchcertification.TheSequenceofHonorableDismissalListswillbemadeavailabletotheAssociationPresidentnolaterthan75dayspriortotheendoftheschoolyear.TheSuperintendentorDesigneeshalldevelopameanstodisseminaterankingstocertifiedemployees.
C. AfterMarch1st,certifiedemployeesmayobtainadditionalcertificationthroughtrainingorcoursework,whichshouldimmediatelybesubstantiateduponcompletion.CertifiedemployeeswhohavebeenhonorablydismissedandwhoobtainsuchadditionalcertificationmaythenberecalledtoanyvacantpositionforwhichtheyhavebeenqualifiedaccordingtothestandardsoftheStateBoardofEducation.
ArticleXIVFairShare
A. Itisrecognizedthatthenegotiationsandadministrationofthisagreemententailexpensesthat
appropriatelyaresharedbyallemployeeswhoarebeneficiariesofsaidagreement.Tothisend,effectivewiththecommencementofthe1987–88SchoolYear,ifanemployeedoesnotjointheAssociation,suchemployeewilldothefollowing:1. Executeanauthorizationforthedeductionofasumequaltotheproportionateshareofthecostofthe
collectivebargainingprocessandcontractadministration,or2. PaydirectlytotheAssociationalikesum.
B. Intheeventthatsuchanauthorizationisnotsignedorsuchdirectpaymentisnotmadewithinthirty(30)
daysfollowingthecommencementofemploymentoftheemployeeortheeffectivedateofthissection,whicheverislater,theBoardwilldeductfromtheregular-salarycheckoftheemployeethefairsharefeeinpaymentsofequalinstallments,startingwiththesubsequentpayrollperiod,providedthefollowing:

1. TheAssociationhaspostedtheappropriatenoticesofimpositionofsuchfair-sharefeeinaccordancewiththerulesandregulationsoftheIELRB;and
2. TheAssociationhasannuallycertifiedinwritingtotheBoardtheamountofsuchfair-sharefeeandhasannuallycertifiedinwritingtotheBoardthatsuchnoticehasbeenposted.
C. Thepartiesexpresslyrecognizetherightofemployeestochallengetheamountoffairshare.ThepartiesacknowledgethatsuchchallengeswillbehandledpursuanttorulesadoptedbytheIELRB.
D. Intheeventthatanemployeeobjectstotheamountofsuchfee,theBoardshallcontinuetodeductthefeeandtotransmitthefee(ortheportionofthefeeindispute)totheIELRB,whichshallholdthefeeinescrowinanaccountestablishedforthatpurpose.TheBoardshallcontinuetotransmitallsuchfeestotheIELRBuntilfurtherorderoftheIELRB.Iftheemployeeisentitledtoarefund,theemployeeshallreceivesuchrefundplusanyinterestearnedontherefundduringpendencyoftheactionpursuanttoapplicableIELRBprocedures.
E. Thepartiesexpresslyrecognizetheirobligationstoandtherightofnonmemberstochoosenon-membershiptotheAssociationbasedontheirbonafidereligioustenantsorteachingsofachurchorareligiousbodyasprovidedinSection11oftheIERLA.Ifanon-memberemployeedeclarestherightofnon-Associationbaseduponbonafidereligioustenantsorteachingsofachurchorreligiousbodyofwhichsuchemployeeisamember,suchemployeeshallberequiredtopayanamountequaltohis/herproportionatesharetoanon-religiouscharitableorganizationmutuallyagreeduponbytheemployeeandtheAssociation.IftheemployeeandtheAssociationareunabletoreachagreementonthematter,acharitableorganizationshallbeselectedfromalistestablishedandapprovedbytheIllinoisEducationalLaborRelationsBoard(IELRB)inaccordancewithitsrules.
F. TheAssociationagreestoindemnifyandtoholdtheBoardharmlessagainstanyclaims,charges,demands,suits,orotherformsofliabilitythatmayarisebyreasonofanyactiontakenoromittedbytheAssociationortheBoardincomplyingwiththeprovisionsofthissection,includingreimbursementforanylegalfeesorexpensesincurredinconnectiontherewith.
G. TheBoardagreestonotifytheAssociationpromptlyinwritingofanywrittenclaim,demand,orsuitsinregardtowhichitwillseektoimplementtheprovisionsoftheSectionFabove,and,iftheAssociationsorequestsinwriting,tosurrenderclaims,demands,suits,orotherformsofliability.
ArticleXVEffectofAgreement
A. Thetermsandconditionssetforthinthisagreementrepresentthefullandcompleteunderstanding
betweenthepartieshereto.Thetermsandconditionsoftheagreementmaybemodifiedbyalteration,change,additionto,ordeletiononlythroughthevoluntarymutualconsentofthepartiesinawrittenamendmentexecutedinaccordancewiththeprovisionsofthisagreement.
B. ThisagreementandanysubsequentchangesshallbesubmittedforapprovaltobeincorporatedintotheBoardpoliciesofSchoolDistrictNo.8,MadisonCounty,Bethalto,Illinois,and,uponapproval,beapartofthesaidpoliciesduringthedurationofthisagreement.
C. Shouldanyarticle,section,orclauseofthisagreementbedeclaredillegalbyacourtofcompetentjurisdiction,orbeinterpretedasillegalbytheIllinoisStateBoardofEducationortheAttorneyGeneraloftheStateofIllinois,saidarticle,section,orclause,asthecasemaybe,shallbeautomaticallydeletedfromthisagreementtotheextentthatitviolatedthelaw.Theremainingarticles,sections,andclausesshall

remaininfullforceandeffectforthedurationoftheagreementifnotaffectedbythedeletedarticle,section,orclause.
ARTICLEXVIDurationandAcceptanceofAgreement
A. Thisagreementshallbeeffectiveasofthe11thdayofAugust2017,andshallcontinueineffectuntilthe
11thdayofAugust2019,exceptwherenoted.Thisagreementshallexpireonsuchexpirationdateunlessitisextendedforaspecificperiodorperiodsbymutualagreementoftheparties.
B. MedicalbenefitsbecomeeffectiveSeptember1,2017,forallcertifiedstaffmemberscoveredbythisagreement.
