WHY BUY GENUINE?

Kyocera has received evidence that non-genuine Kyocera toners have been circulated, distributed and sold within our sales territories. It’s important to be alert to this issue because you as a customer can face serious technical problems from using counterfeit or third party/“compatible” toners. Such damage caused will not be covered by your warranty or maintenance agreement.

DIFFERENCE BETWEEN COUNTERFEIT AND THIRD PARTY/"COMPATIBLE" TONER?

A counterfeit toner bears the name of a genuine Kyocera product. It is intended to give the impression that it is a genuine Kyocera product. But, it is not. It is a counterfeit.

A third party or so-called “compatible” toner is one that bears the name of a third party. It does not have Kyocera brand marks on the toner container or packaging. The word “compatible” is intended to lead the customer to believe the toner is suitable for Kyocera machines. But, third party or “compatible” toner is not developed for use in Kyocera machines, and can cause damage to your machine.

In the event that a customer faces technical problems arising from use of a third party or “compatible” toner, the customer will need to refer any complaint caused by the third party product, to the third party manufacturer – not to Kyocera. This is because the third party or “compatible” toner is not covered by Kyocera quality assurance. Such damage will also not be covered by the Kyocera warranty or maintenance agreement.

IS COUNTERFEITING A CRIMINAL OFFENCE?

Yes. Counterfeiting of Kyocera products is a violation of Kyocera’s intellectual property rights. There are serious penalties for any individual or business that manufactures counterfeits, or imports, sells, attempts to sell, possesses for the purpose of trade, distributes or otherwise deals in products known, or ought to have been known, by the individual or business to be counterfeit.

HOW TO IDENTIFY COUNTERFEIT TONER?

Kyocera incorporates special technology features which have been in production since October 2007, an example being the Kyocera Trustgram (hologram) on the toner container which makes it easier to identify a genuine Kyocera toner from a counterfeit one.

There are several indicators of a counterfeit toner which we wish to draw to your attention: Toners sold at a low price is an indication that they might be counterfeit. Colours and materials used in the packaging may be different from Kyocera

genuine toner packaging. Materials used in the counterfeit toners are most likely of poorer quality than

those in a genuine Kyocera toner. The method by which counterfeit toners are sold can differ from the usual.

LEGAL ACTION AGAINST MANUFACTURERS & DISTRIBUTORS OF COUNTERFEIT TONER

Kyocera refers cases to prosecuting authorities, which can lead to raid of premises for the seizure of counterfeit products. We also take legal action to recover damages from counterfeiting manufacturers, distributors and sellers. Our zero tolerance policy aims to ensure that, ultimately, all counterfeits seized are confiscated and destroyed, and that counterfeit manufacturers, distributors and sellers are held legally accountable. We also work in cooperation with other companies in the industry to eliminate counterfeit products. Once we discover that an individual or company has sold a counterfeit product, we take legal action to ensure the individual or company signs an undertaking to never again sell counterfeit products and compensate for legal costs in bringing the action. We also demand that, at their cost, they destroy stored counterfeit products and disclose the names of the suppliers from whom they have purchased counterfeit products.

KYOCERA'S POLICY FOR ELIMINATING COUNTERFEIT TONER

The manufacturing of counterfeit toner or the distributing or selling of toner known to be counterfeit are illegal acts that not only damage customers’ trust in our company, but also violate our company’s intellectual property rights. To protect our customers from counterfeit products and to ensure that our customers feel safe when using our products, we take various measures to eliminate counterfeit products.

BORDER WATCH

We continually update customs authorities (through meetings and presentations) with information to help enable them to recognise suspicious products and stop the import and export of counterfeits at the border.

TRUSTGRAM

We attach a trustgram (hologram) to our Kyocera toner containers to help customers to be able to distinguish between genuine and counterfeit toner.

COOPERATION

Kyocera works on cooperation with national and international anti-counterfeiting networks and enforcement authorities to help combat the manufacture, distribution and sale of counterfeits.
