3.1 Switchyard (Exclusion)

All Switchyard equipment and accessories inside Switchyard boundary and related relay panels

in Unit#10 relay room and MCB, associated power and control cables and systems are excluded

from Sale. Any equipment related to the operation and maintenance of the Switchyard are part

of the exclusion.

4. Temporary Exclusions

The items shown under Table - 2 form the part of initial exclusion. However, these items are part of sale and will be

disposed as per instruction of PVUNL as last segment after disposal of 06 (six) segments linked to the Payment

Term within the overall disposal period of 30 months from the date of issue of Sale Release Order . The price

offered in e-Auction by the bidder will be inclusive of items mentioned in Table-2.

6. Brief History of Plant

6.1 Introduction :

Patratu Thermal Power Station (PTPS) was a coal-based thermal power plant located near Patratu town in Ramgarh

district in the Indian state of Jharkhand. The power plant was operated by the Jharkhand State Electricity Board.

PTPS comprises of coal fired Power Station with a total installed capacity of 840 MW comprising of 400 MW (4x50 MW

+ 2x100 MW) Russian units and 440 MW (4X110MW) Indian units. The plant had been constructed in four different stages.

The first stage consists of 4x50 MW (Units 1 to 4) and second stage consists of 2x100 MW (Units 5&6). Unit#5,6 have two

boilers and one TG set each. Hence, there are total 12 boilers and 10 TG sets. Unit # 1 to 6 were supplied by M/S Energy

Machine Export, USSR under trade agreement. Later, to meet the growing power demand of the state the Indian

Government installed four unit of 110 MW each (normal Indian site -1) in third and fourth stages leading to total installed

capacity of 840 MW. The third stage consists of 2x110 MW (Units 7& 8) and fourth stage consists of 2x110 MW (Units

9&10) supplied by BHEL. Six Russian- aided units were commissioned between 1966 and 1972 and the rest four units

were set up by Bharat Heavy Electricals between 1977 and 1986.

Due to environmental cum techno commercial reasons five units were already retired by CEA in past and remaining five

units were phased out w.e.f 24 th January 2017 and the same was retired by CEA. A MoU was signed between the Jharkhand

state and NTPC on May 3, 2015, to set up a 4,000MW project. For this, Patratu Vidyut Utpadan Nigam Ltd (PVUNL) was

formed as a joint venture company between the state's JBVNL and NTPC on October 15, 2015, where JBVNL holds 26

per cent stake, the power giant NTPC holds 74 percent stake.

The existing plant consists of 12 nos. boiler units and 10 nos. TG Units. It may be noted that boiler no. 5

& 6 is for TG unit 5. Similarly, boiler no. 7 & 8 is for TG unit 6.

the system/items included in initial exclusion i.e. Table-2.

Specifications shown in the table in the section are original specifications which might have

deteriorated over the period of operation. All participating vendors must visit the site and get

themselves satisfied before bidding for the same. All items lying outside plant isolation boundary, e.g.

Russian Cooling Towers, CHP, Railway siding, Russian oil facilities etc, are either dismantled or

being dismantled. All such items are kept or being kept in Open Storage Area which will be part of

the auction.

9.2 M/s MSTC Limited is the Selling Agent of PVUNL and hereinafter referred to as MSTC.

The “Buyer” or “Contractor” or “Successful Bidder” mentioned anywhere in the Auction

Catalogue refers to the participating bidder who has offered the highest price in the Auction

and whose bid has been accepted by the Owner.

De-commissioned Plant is sold on Ex PVUNL Patratu Site basis. Dismantling, Handling,

Loading, Transportation, Insurance, Storage, Safety of workmen, labor, operators &

equipment, materials, items and structures of self as well as others in close vicinity, meeting

statutory requirements, compliance with the Rules, Acts and Laws of the Land, etc. shall rest

with the Buyer (s) and neither MSTC nor PVUNL will be responsible for the same in any

manner, whatsoever. The participating bidders shall comply with all Rules, Acts and Laws of

the Central Government of India or the concerned State Government or the local bodies or

their authorized Departments for purchase, transportation and storage of various

items/materials for which they intend to participate in the Auction. Further they shall obtain the

requisite Permits, Licenses, Permissions, Registration, etc. from the concerned Departments or

bodies. An indicative but not the exhaustive list of Rules, Acts and Laws is given below:

a) Central Motor Vehicles Rules, 1989 and its subsequent amendments for transportation;

b) Manufacture, Storage and Import of Hazardous Chemical Rules, 1989 and its subsequent

amendments for storage and import of Hazardous chemicals;

c) Various Laws, Rules and Acts of Petroleum and Explosives Safety Organization, Dept. of

Industrial Policy & Promotion, Ministry of Commerce & Industry, Govt. of India;

d) Labour Laws of Central and concerned State Governments;

e) Employee‟s Compensation Act, 1923, etc.

The participating bidders are advised in their own interest to appraise themselves with various

Rules, Acts and Laws of the Land. PVUNL and/or MSTC shall not be responsible in any

manner, whatsoever for any liability, commercial or otherwise, due to non-compliance or

non-adherence to such Rules, Acts and Laws.

Further, PVUNL reserves the right to check any permit or license or certificate or permission

at any stage till the Decommissioned Plant is completely disposed off, site is cleared as

specified and EMD is released. Any non- compliance observed at any stage will render the

bid invalid and lead to forfeiture of Pre Bid EMD and/or EMD and/or Security Deposit

and/or any payment made to PVUNL/MSTC till the date of observance of such non-

compliance in addition to any other action that MSTC and PVUNL and Law enforcement

agencies may take against the Buyer. Bidders may also note that checking of the aforesaid

documents by MSTC and/or PVUNL will neither be construed by the Buyer as certification

by the Owner or MSTC of compliance of Rules, Acts and Laws of the Land by him nor relieve

the Buyer from compliance of Rules, Acts and Laws of the Land. Under all circumstances,

Buyer shall solely be responsible for meeting statutory requirements and compliance with the

Rules, Acts and Laws of the Land.

9.3 The entire offer shall be valid for a period of 120 calendar days from the date of closing

of e-auction which may be extended for any further period of time as may be mutually

agreed upon by PVUNL and Buyer.

9.4 Bidders have to quote for the entire lot together against this e-auction. Bids for part of lot

will not be accepted by the portal.

9.5 It will be at the sole discretion of PVUNL to accept or cancel the sale without assigning

any reason.

9.6 The completion period shall be 30 months from the date of issue of the Sale Release

Order by PVUNL.

9.7 THE AUCTION CATALOGUE ON THE E- AUCTION FLOOR AS ON THE DATE

OF AUCTIONING SHALL BE TREATED AS FINAL AND BINDING.

The material as per the list declared on the MSTC‟s website shall be disposed off by

way of e-auction through ww.mstcecommerce.com.

The Buyer must clearly understand that MSTC/PVUNL, PATRATU do not guarantee

the correctness or accuracy of any description printed, readout or verbally declared. The

prospective bidders may inspect the Decommisioned Plant offered for e- auction sale

within the Inspection Period during working hours, at the site where the Plant is located.

The bidders shall satisfy themselves about condition, quality, quantity, and measurement

etc. of the entire materials, items, equipment & machinery, structures of the

Decommissioned Plant which they intend to purchase. No complaints shall be

entertained regarding description, quantity, quality, size, measurement, number and

weight as the information given in the catalogue is approximate and no warranty or

guarantee shall be implied. Materials shall be sold on “AS IS AVAILABLE BASIS

AND NO COMPLAINT BASIS” and on the

assumption that the bidders have inspected the entire Decommissioned Plant thoroughly

physically at all the areas of the site and know what they are buying, irrespective of

whether the bidders have physically inspected the site prior to e- auction sale or not; the

principle of “CAVEATEMPTOR” shall apply. Error in the description/ quantity/ quality/

measurement/ utility/ number/ weight/ condition etc. of the material as given in the

catalogue/ list published on the Auctioneer‟s website shall not form a cause to the bidder

to complain or to avoid completed sale or bid.

9.8 CAVEAT EMPTOR:

i. The quantity, quality, measurement and condition of the materials indicated are all

approximate. Participation and bidding by anyone in this sale shall be treated as

conclusive evidence of the fact that the party has inspected the entire materials,

items, equipment & machinery, structures of the Decommissioned Plant offered for

sale and satisfied himself in all respect regarding quantity, quality, measurement,

weight and condition of materials, taxes and duties, local working condition and

other extraneous factors and principle of Caveat Emptor (let the Buyer beware) will

apply.

ii. It shall be implied and taken for granted that the party has carefully gone through

and understood the terms and conditions of e- Auction including the amendments if

any, prevailing at the time of bid. No complaints or objections

shall be entertained by PVUNL and / or the Authorities.

iii. PVUNL do not give any warrantee or guarantee for the quality, chemical

composition of each individual items in the lot or about the end use or fitness for a

particular purpose.

IN CASE BIDDERS COME ACROSS ANY MATERIAL BEYOND THE

SCOPE OF THE DESCRIPTION OF MATERIAL, IT SHOULD BE

INFORMED TO SELLER/MSTC. MSTC WILL NOT BE RESPONSIBLE

FOR ANY COMPLAINT IN THIS REGARD. BUYERS ARE ALSO

REQUESTED TO VISIT DIFFERENT SITES SUCH AS TURBINE AREA,

BOILER AREA, ELECTRICAL AREA, COOLING TOWERS, CHIMNEY

AND OTHER BUILDING STURCTURES BEFORE BIDDING.

10. TERMS AND CONDITIONS OF SALE OF DECOMMISSIONED PLANT

10.1 Non-Acceptance of Bid

Bidders have to quote for the entire lot together in this e-auction and bids for part of lot or with

any attached condition shall not be considered. Further it will be at the sole discretion of

PVUNL to accept or cancel the sale without assigning any reason.

10.2 Pre-Bid Earnest Money Deposit/Earnest Money Deposit (EMD):

10.2.1 The bidder should deposit Pre-Bid Earnest Money Deposit of INR 8,00,00,000/-(Indian

Rupees Eight Crores) through MSTC e-payment gateway. The Pre-Bid EMD of unsuccessful

bidders shall be returned by MSTC within 15 calendar days after the completion of e-auction

without any interest. For successful bidder, the Pre Bid EMD may be converted as part of

Security Deposit or the same may be returned once Bank Guarantee in lieu of Security

Deposit is submitted as per Cl No 10.3 below.

10.2.2 If a bidder withdraws its bid after submission or fails to deposit EMD within the

stipulated time, the pre bid EMD of such bidder shall be forfeited without any further notice

to him.

10.2.3 The status of the highest bid accepted on STA (Subject To Approval) basis must be

personally seen by the bidders online through the link “Auction Lot Status”.

10.2.4 Bidders must always keep their registered email account valid and keep a watch on their

incoming emails for their own convenience. Non- payment or delay in payment of post bid

EMD on the plea of non-receipt of SIL (Sale Intimation Letter) will not be entertained by

MSTC.

10.3 Security Deposit

Interest free Security Deposit @ 10% of final e-auction price offered by the successful bidder

(Sale value without taxes & duties and TCS) is to be deposited to MSTC by successful bidder

within 10 calendar days of issue of intimation about acceptance of its auction bid.

Alternatively, Bank Guarantee of an amount equal to 10% of the final e-auction price (Sale

Price without taxes & duties and TCS) is to be submitted to PVUNL by the successful bidder

within 10 calendar days of issuance of Sale Intimation Letter by MSTC. The above

security deposit / BG will be returned by PVUNL only after three months of successful

completion of the job (contract) i.e.33 months in all respects including dismantling of

foundations to zero level and filling of the hollow places/ craters as a result of dismantling to

surface/ground level.

If any extension with/without penal rent is granted, the above BG shall also be extended for

the corresponding period i.e upto & including 3 months beyond the completion of extended

period. No interest whatsoever will be paid on the said security deposit by PVUNL /MSTC

Ltd.

Security Deposit (without interest)/ BG will be released only after completion of site

clearance and issuance of No-Objection Certificate from PVUNL. Getting the No- Objection

Certificate issued would be the sole responsibility of the Buyer, and therefore, the Buyer /

bidder shall not hold MSTC/PVUNL responsible for it in any case. IT IS TO BE NOTED BY

THE BUYER THAT ISSUANCE OF NOC BY PVUNL WILL TAKE SO ME TIME

AFTER COMPLETION OF SITE CLEARANCE.

10.4 Inspection Decommissioned Plant is sold on AS IS WHERE IS AND NO COMPLAINT BASIS

condition and all items, materials, equipment, machinery, structures, debris generated out

of dismantling civil structures are to be removed and taken from the site by the Buyer

without any condition within the overall completion period of 30 months.

The entire materials, items, equipment & machinery, structures of the

Decommissioned Plant offered for sale may be inspected by interested bidders as per

the catalogue during day hours of working days by observing the entry procedure of

PVUNL, Patratu. Interested bidders may contact PVUNL, Patratu with the following:

Efforts have been made that the entire materials, items, equipment & machinery,

structures of the Decommissioned Plant offered for sale shall be as per catalogue

however, some items may vary. The agency cannot claim for the missing items.

Therefore, the bidders are requested to check the material at site physically before

bidding.

The bidders should thoroughly satisfy themselves about the nature, specifications,

physical condition, quantity, quality, place of existence of the entire materials, items,

equipment & machinery, structures of the Decommissioned Plant and working

conditions at site. MSTC/PVUNL provides no guarantee or warranty as to the condition /

quality / fitness for any specific purpose or use. It should be clearly understood that no

claim / complaint about the quality, specifications, quantity, conditions or fitness for use

shall be entertained by MSTC/PVUNL once a bid has been registered into the e-auction

floor of MSTC.

NOTE: Interested Buyers are advised to get in touch with the above officers of PVUNL

and fix the date of inspection, to avoid any inconvenience during the Inspection period.

10.5 Sale Release Order The contract shall be treated as having been entered into as soon as the Acceptance Letter

is issued to the Successful Bidder by MSTC on behalf of PVUNL. The contract shall be

deemed to be completed when the Buyer clears the entire area by the removal of entire

material, scrap, debris etc., excavation of foundations and filling all the potholes to bring

the area to ground level. PVUNL shall certify the completion of the work on physical

inspection on the written request of the Buyer, when the job is completed by way of issue

of No Objection Certificate.

10.6 Payments 10.6.1 100% payment i.e. Sale Price or final e-auction price of the successful bidder together

10.6.2 The entire lot of Plant & Machinery including Civil Structures has been divided into SIX (6)

segments keeping in view the locations and ease of dismantling and lifting of material of

various segments. Although the value of each lot has been equally divided i.e. 1/6th of the

total lot value but the actual worth of the material in each lot may not be same. This shall be

binding to the Buyer.

10.6.3 Against the Payment detailed at Sl No 10.6.1, segment allowed to be dismantled and

10.6.4 Instead of making 100% payment together with taxes & duties and TCS at the beginning of

the Contract as specified at 10.6.1, the Buyer may choose to make payment in 6 installments

as per schedule given at 10.6.6 below. In case of installment payment, interest @12.60% will

be charged on the value of installment for a period counted from 21stday of issue date of

Acceptance Letter/Sale Order by MSTC to the date of payment within the last day for receipt

of that particular installment. The cost of material, along with all applicable taxes & duties

and TCS shall be paid by the Buyer in six equal installments through NEFT/RTGS to

PVUNL, Patratu on a/c detail provided at Cl No 10.6.1 above. However, if the Buyer chooses for

installment payment and at a later stage decided to pay balance full payment, he will be permitted

to do so without interest on the balance payment. However, no refund of the interest already paid

along with the premium installment will be done.

10.6.5 MSTC Ltd shall issue the delivery order, on production of proof of remittance of payment to

the PVUNL‟s A/C by Buyer and confirmation of receipt of payment from PVUNL and all the

statutory documents required (if any) from the Buyer The lifting order/Sale Release Order shall

be issued by PVUNL on receipt of all the statutory documents required (if any) and delivery

order from MSTC Ltd. The Buyers shall have option to deposit all the required statutory

documents directly at PVUNL‟s office or at MSTC office.

10.6.6 First installment shall be deposited within 21 calendar days from the date of issue of

Acceptance Letter/Sale Release Order (including date of issue) by MSTC. It would, however,

be obligatory on the part of the Buyer to deposit the 2nd, 3rd, 4th, 5thand 6th installments

within the period mentioned here under:

It would also be obligatory on the part of the Buyer to deposit the installment as per

schedule without any notice / reminder from PVUNL. After making the payment for

the first installment, the Buyer will be allowed to dismantle the material of first

segment only. The Buyer shall be allowed to lift the material of the first segment only

after deposit of 2nd installment with PVUNL. The dismantling and lifting schedule as

per the installment payments submitted by the Buyer is given in the following table:

10.6.7 The rates must be quoted exclusive of all taxes, duties and other levies etc. The GST (Goods

& Services Tax) rate prevailing at the time of execution shall be applicable. In case any other

levy/ duties etc. are imposed by Central/ State Government of Jharkhand / Local Authorities,

the same shall have to be borne by the Buyer. Bidder shall submit this / their Income Tax

Clearance Certificate (latest), partnership deed of organization as and when demanded by

MSTC/PVUNL.

10.6.8 The Buyer may clearly note that all the taxes, duties, levies, etc., if any are levied/ imposed by

any Statutory Authority till the final conclusion of the contractual period / contract shall be

borne by him / them including the inter-state transactions and PVUNL shall not be responsible

to pay the same, if any, since the sale is on „AS IS WHERE IS AND NO COMPLAINT

BASIS”.

10.7 Late Payment Penalty It shall be in the interest of the Buyer to pay all the installments well within the stipulated

payment schedule. However, in case of default in payment within the stipulated time, Late

Payment Penalty @ 1% per week or part thereof for the full material value as per

10.6.1 or for the full material value of that installment (i.e. 1/6 thof the total sale value plus

interest plus taxes) as per Cl No 10.6.6 above shall be charged up to four (4) weeks of delay

in payment. Acceptance of late payment beyond four weeks and thereafter shall be at the

sole discretion of PVUNL. However, PVUNL reserves the right not to accept the payment

with or without the additional penalty after the expiry of the above mentioned due time limit

of four (4) weeks in each segment and in such an event the contract shall be liable to be

terminated and the Earnest Money / Security Deposit of the bidder together with any

payment deposited shall automatically stand forfeited without prejudice to the right of

PVUNL to dispose off the remaining materials, items, equipment & machinery,

structures of the Decommissioned Plant at the risk and cost of the Buyer and realize the

deficit, if any, from the Buyer. However if the sale value of the remaining items is more

than the amount due from the Buyer, nothing will be paid to the Buyer. If PVUNL allows to

accept the payment of installment after four weeks with additional penalty, then additional

2% per week or part there of shall be charged i.e. a total of 3% per week or part thereof.

10.8 Statutory Taxes & Duties

The Buyer shall be responsible to pay all the statutory taxes & duties at prevailing rate as

declared by the respective Local Bodies/State/ Central Government Authorities due in

respect of this sale. If the Buyer claims exemption/concession in the statutory taxes, he

shall furnish the necessary declaration in that respect. If, competent authority of PVUNL

allows the Buyer to lift the goods in multiple installments and make the payments

accordingly, the statutory taxes in such cases shall be paid on the proportionate sale price of

each installment along with payment of corresponding installment. The rate of applicable

taxes & duties shall be indicated against individual lot in the list displayed on the e-auction

site. However, the Buyer at the rates applicable shall pay statutory taxes & duties at the time

of delivery.

10.9 Authorization/ Identity The authorized representative of Buyer shall produce the authorization /identification letter

issued by the Successful Bidder while depositing amounts of security deposits, balance

payments and also while lifting the concerned lot.

10.10 Delivery

10.10.1 The completion period for the listed items of the plant including dismantling, cutting,

bringing down to ground level and taking out from PVUNL premises and leveling the

surface to ground level is 30 months from the date of issue of Sale Release Order by PVUNL

issued against Delivery Order of MSTC. Please note that bringing the entire area to

ground level / base level requires sufficient time. This factor may be kept in mind while

taking out of all the scrap. (Buyer to take necessary margin for stopping of movement of his

trucks during traffic restriction and VVIP movement in the area). Note: -PVUNL shall not

entertain any requests from the Buyers regarding extension of payment period / delivery

period as stipulated in the Sale Release Order.

10.10.2 The dismantling and lifting schedule of the material will be item-wise in SIX SEGMENTS

as per the details of the material mentioned (refer the heading Sequence of Disposal).

10.10.3 Vehicles deputed for disposal of the material(s) should report for loading in early hours in

such a manner that requisite time is available for loading and vehicles are released before

closing of the working hours i.e. at 17:00 Hrs. No loading shall be permitted during lunch

hours (13:00hrs. to 14:00hrs) and after 17:00 hrs. Any relaxation in the above may be

considered by the PVUNL upon specific request by the Buyer. Bidder shall use only the

allocated security gate for entry and exit. The Gate no. may change at any time and shall be

binding to the Buyer.

10.10.4 The Buyer shall dismantle and lift the listed scrap material mentioned in the specified lots

allotted to them by employing their own labor and at its own cost. The material in all the

segments shall be lifted from the area within the prescribed period of 30 months allowed

from the date of issue of the Sale Release Order by PVUNL.

10.10.5 The material will have to be removed on “AS IS WHERE IS AND NO COMPLAINT

BASIS” and at the Buyer‟s own cost and expenses. No processing, whatsoever, other than

dismantling, required for convenient transportation, will be permitted by the PVUNL. The

Buyer shall not be provided with any work force or equipment. The Buyer would have to

arrange for all the tools and equipment insufficient quantity keeping in view the period

allowed for dismantling and transportation including Dozer, Scrapper, Cranes,

grinders, Cutters, Gas, Power or other facilities. While removing materials of one

segment, the other segment’s materials, for which payment has not been made, will not

be disturbed/damaged otherwise the Owner representative may impose penalty as

deemed fit in his/her opinion for the damage caused which shall be paid by the Buyer

along with the next instalment amount or recovered by encashing/ from EMD/Security

Deposit.

10.10.6 The agency / Contractor shall make his own arrangement of providing all facilities like

lodging, boarding, furniture & transportation etc. for his supervisors / labor engaged by him

for the job outside the premises of PVUNL.

10.10.7 Gas cutting work to be carried out in the course of dismantling will be allowed only under

the supervision of the Buyer‟s supervisory personnel who will ensure that all safety

precautions have been taken including those for prevention of fire and other safety hazard in

and around the area.

10.11 Removal of Plant/ Machinery/ Equipment/ Items/ Debris Successful Bidder / Buyer will submit a plan to PVUNL for dismantling / demolishing,

transporting of dismantled materials / accessories, equipment from the site of work prior to

actual start of the work for PVUNL concurrence. The material stored / dismantled first

should be removed first. The time schedule and sequence of the dismantling & removal of

material shall be prepared by the Buyer as per the dismantling & lifting schedule & as per the

segments indicated and its prior approval shall be obtained from PVUNL. The approved

dismantling & lifting schedule shall be strictly adhered to.

10.11.1 Ground Rent: -It shall be in the interest of the Buyer to complete the entire work as per the

scope i.e. upto leveling of the ground within the stipulated period of 30 Months. However, in

case of default in lifting of the materials by the successful Bidder within the specified time

limits, the outstanding material would only be allowed to be lifted after payment of Ground

Rent for the period of delay beyond the specified due delivery period by the Buyer. The

Ground Rent is to be deposited in advance and in stages as required for a period of four

weeks (minimum) as per the below mentioned rates. However, the actual amount of Ground

Rent will be determined after completion of lifting of outstanding quantity and balance

amount, if any, will be refunded to the purchaser.

The completion of lifting of all the segments including the leveling of the entire ground

upto the entire satisfaction of PVUNL shall be confirmed / certified by PVUNL who will issue certificate to the firm for the same. The firm shall submit the written request for issue of the certificate after completion of entire work.

The Ground Rent shall be as under: -

i) For First Four weeks i.e. 1stto 4thweek from the permitted date - Ground

[email protected]% per week or part thereof of the total Sale Price (Without taxes).

ii) For Next Four weeks i.e. 5th to 8th week from the permitted date-Ground Rent

@0.10% per week or part thereof of the total Sale Price (Without taxes). th

For Next Four weeks, i.e., 9 to 12 week from the permitted date-Ground

[email protected]% per week or part thereof of the total Sale Price (Without taxes).

Note: GST/any statutory levy, applicable on Ground Rent shall also be payable by the

Buyer.

iv) The permission to allow the lifting with Ground Rent (as decided by the disposal

committee) beyond twelve weeks will be on the discretion of PVUNL whose

decision on Ground Rent shall be final and binding.

Please note that Ground Rent is applicable on the entire Sale Price/contract

value (Without taxes) and not on the portion, which has not been cleared. To

avoid Ground rent, the Buyer should make all out efforts to complete the job

within stipulated period of 30 months.

However, it will be the sole discretion of PVUNL to allow or not to allow the

Buyers(s) to lift the material with the ground rent after expiry of additional twelve

weeks beyond the stipulated due completion period of 30 months. In such event the

sale of the material not lifted by the Buyer(s) will automatically be cancelled and the

Earnest Money /Security Deposit including payment of installment in full or part

made, as the case may be, will automatically stand forfeited. Further the Owner shall

have the absolute rights to dismantle and dispose off the remaining of the

Decommissioned Plant as deemed fit without any further reference / compensation to

the Buyer. In case of any debris/refuse/rejects left undisposed by the Buyer after the

expiry of scheduled completion period 30 months or any extended period, the same

shall be got done by the PVUNL at the risk and cost of the Buyer and the expenses

incurred thereupon shall be deducted from the Security Deposit.

10.11.2 Dismantling / Demolition & Disposal including transportation of the goods/materials/

Equipment shall be the responsibility of the successful bidder at his cost and risks, taking all

safety precautions. The Buyer shall demolish, dismantle and lift the entire material including

scrap material mentioned in the specified lot break up allotted to them by employing their

own labor and cost.

During dismantling / demolition, precautionary measures are to be taken to avoid any type of

damage to the systems linked with the other segment and any environmental pollution. If

there is any damage occurred, successful bidder (Buyer) is required to take immediate action

at their own risk and cost. The total material in the lot shall be lifted from the area within the

prescribed period.

10.11.3 The successful bidder/Contractor will arrange to remove the demolished and dismantled

material and clear the site as directed by PVUNL within the stipulated time.

10.11.4 The material will have to be removed on AS IS WHERE IS AND NO COMPLAINT BASIS

at the Buyer‟s own cost and expenses. No processing other than dismantling as may be

required for convenient transportation will be permitted at the sole discretion of the owner or

his authorized representative. The successful bidder shall not be provided with any

manpower or any equipment etc. by Owner (PVUNL) for dismantling/ demolition/loading/

unloading/transportations etc. of the materials. The successful bidder will have to arrange for

any or all of these at their own cost and they shall take prior permission from PVUNL

representative for this purpose. While removing one segment, the other segment should not

be disturbed/ damaged.

10.11.5 For heavier and longer consignments, the successful bidder shall arrange trailers with prime

movers through their own resources, as required. PVUNL shall not be responsible for any

delay occurring due to non-availability of trailers, etc. The successful bidder shall lift the

materials and site shall be cleared as per the direction of the PVUNL representative.

10.11.6 Civil structures of the plant are to be demolished up to ground level preferably by erecting

scaffolding etc. All the RCC Cooling Towers (Unit#7 to 10) and all four (04) number

chimneys shall be allowed to be demolished up to ground level by means of controlled

blasting or by erecting scaffolding or any other safe means etc. The Buyer shall obtain the

necessary clearances from all the concerned agencies for using explosives for demolition, if

any. All out efforts shall be made so that these structures fall-off downwards without

damaging the surroundings. The safety of man and machine is the sole responsibility of the

Buyer and his deputed agencies.

10.11.7 PVUNL or its authorized representatives shall have the right to stop dismantling and loading

of the material if they feel that the Buyer or his representative is not following the

instructions given to them or the job is not being carried out in accordance with the

provisions of terms & conditions and/or Special Terms & Conditions and Buyer will be solely

responsible for the same.

10.11.8 Dismantle / Demolition and Disposal / removal of materials on pick and choose basis shall

not be allowed.

10.11.9 Dismantling / Demolition work and transportation of materials shall be done only during Day

Shift hours of PVUNL. No materials will be allowed to go out after 5.00P.M. on working

days. Similarly, no material will be allowed to go out on Sundays and holidays observed by

PVUNL. In case of requirement, any relaxation in the above may be considered as per the

discretion of PVUNL.

10.11.10 The Buyer shall make his own arrangement for the security of materials, items,

equipment & machinery, structures of the Decommissioned Plant sold to him i.e. with

effect from the start date of the contract. The firm shall take into his custody the entire lot

after satisfying himself with the material as per the lists supplied in the Auction Catalog

within 7 calendar days and shall furnish a certificate that the entire material has been taken

into the custody of the firm and now onwards firm shall make its own arrangement for

the security of the material. The custody of the entire material to the firm will be for the

purpose of security only and to confirm that all the material as per the list in the auction

catalog is available and thereafter PVUNL, in no way shall be responsible for any kind of

theft, misplacement, fire, etc.

10.11.11 The firm shall ensure that material of only those segment(s) shall be dismantled /

demolished or lifted as per the payment schedule and shall strictly adhere to. In case, firm is

found lifting / demolishing the material for which it was not eligible at that moment, the

penalty as decided by the PVUNL shall be imposed and be binding to the firm to pay. The

penalty can be extended even upto the cancellation of the contract, depending upon the

severity of the fault in view of the PVUNL. In that case, the entire BG / SD shall be

forfeited and no further demolishing / lifting shall be allowed. In case in any

material/building falling in the higher segment is causing hindrance and is absolutely

necessary to demolish the same to complete the demolish of lower segment, in that case

firm will submit a request to PVUNL to allow to demolish / dismantle the material /

structure of that higher segment. PVUNL will allow only keeping in view the genuineness of

the request and after submission of the payment of that segment

10.11.12 The Buyer will be allowed to post sufficient no. of security guards round the clock and the

names of the security guards will have to be made available to PVUNL so that Gate Passes

may be issued to them. PVUNL/MSTC shall neither be responsible for any theft of material

sold to the Buyer nor shall entertain any complaint on this account of whatsoever nature. The

Buyer will be responsible for the safe custody of his own tools, tackles and other materials

w.e.f. start date of the contract. PVUNL reserves the right to ask for removal of specific

security guard(s) whose activities are deemed unlawful or detrimental to PVUNL interests.

The Buyer has to deploy alternative guards for the purpose.

10.11.13 Material shall be allowed to be taken out on valid Gate Passes, issued by PVUNL. These gate

passes shall have to be signed by authorized representatives of PVUNL as well as the Buyer.

The material shall only be allowed to go out from the Security gate earmarked and shall be

binding.

10.11.14 The Buyer shall not be allowed to store the material on the road sides or in any other way

which may cause hindrance or inconvenience to movement of public or vehicles.

10.11.15 No delivery of material would be effected by PVUNL to any persons other than the Buyer

or his authorized representative.

10.11.16 The Buyer shall comply with all statutory provisions as applicable.

10.11.17 All items covered under exclusions are property of PVUNL and not allowed to be

dismantled or lifted by the Buyer.

10.11.18 The Buyer has to demolish and remove the equipment / foundations / buildings / civil

structure upto the ground level. All holes, craters, hollow places and spaces created due to

dismantling / removal from minus meter levels including cable galleries and underground

pipe lines too have to be filled up with appropriate material to bring the surface to even

ground level.

10.11.19 Dismantling of plant, removing and sweeping of debris/waste arising out of dismantling

shall be carried out simultaneously. If at any time after the sale order / delivery order is

issued and PVUNL wants to retain any item / items for their own use, the Buyer will have to

release such items to be compensated by PVUNL as per assessment done, which shall be

binding on the Buyer.

10.11.20 Stacking and removal of dismantled material should be in a manner so as not to disturb the

normal working.

10.11.21 Buyer shall ensure that during dismantling/removal of materials no pollution is caused to

environment and will follow all pollution norms. COMPLIANCE OF MUNICIPAL SOLID

WASTE MANAGEMENT RULES, 2016 IS TO BE ENSURED BY THE BUYER.

10.11.22 Controlled Blasting for dismantling of Cooling Towers, Chimneys & foundations or

otherwise shall not be allowed, unless PVUNL provides prior special permission.

10.11.23 Barricading of areas / pits created after dismantling / excavation shall have to be done with

the materials that would be available after dismantling as per directive of the Owner or

their authorized representative.

10.11.24 DEMOLITION OF CIVIL STRUCTURES:

A. Utility Building, foundations of boilers, turbines, major auxiliaries etc.:

1. The Buyer has to demolish & remove the foundations/ buildings/ structures and level the

ground upto the satisfaction of PVUNL, wherever the equipment / buildings / structures

are subject to sale.

2. All structures/ equipment/ RCC are to be dismantled to ground level / base level and all

debris to be cleared off from the site.

3. For dismantling of foundations, explosion will not be allowed (except for special cases).

However, the agency can use pneumatic hammers for breaking the hard foundations of

turbines, ID/FD Fans, Condensers, stack, boiler, etc.

4. The Buyer shall arrange to dump the debris/ waste material at an authorized dumping

place at his cost & risks.

B. Cooling Towers &Chimneys: -

1. Cooling Towers (Unit #7 to 10) & Chimneys (04 nos.) are to be demolished upto ground

level by way of controlled blasting or erecting/scaffolding etc. The Buyers shall arrange

to dump the debris/ waste material at an authorized dumping place at his cost &risks.

2. The scaffolding, if needed, shall be certified before use following any adverse weather

conditions or following any damage/ incident related to the structure.

3. Necessary safety precautions for the working staff should be taken such as safety belts,

oxygen kits etc.

4. Systematic process of dismantling shall be adopted.

5. Fire brick linings shall be removed manually collection from top to bottom and lowering

by lift as safety measure.

6. Explosiveness and presence of hydrocarbons shall be checked before dismantling.

7. Dismantling of chimneys shall generate a mix of building material, containing bricks

& concrete. This shall be removed.

8. Dismantling of chimneys may generate glass wool insulation/ asbestos waste. Such

waste shall be disposed off as per statutory rules for disposal of such items and in

compliance to Environment Norms.

9. Before starting of dismantling of Cooling Towers & chimney, a work out plan is to be

submitted to Decommissioning Department of PVUNL for their clearance/guidelines.

10. For dust mitigation required for Civil structure (esp. Chimney and Cooling Towers),

PVUNL shall provide a source of water from where the Agency shall have to make

arrangements for dust suppression system. The system needs to be effective and tested

before actual demolition as the entire area of demolition is surrounded by new project

construction area.

C. Boiler and Turbine Auxiliaries: -

1. Waste generating out of dismantling activities such as debris, glass wool etc. shall be

removed as per statutory rules for disposal of such items and in compliance to

Environment Norm.

2. The EOT Crane installed in the TG Hall shall be provided for the dismantling of TG sets

in MPH. However, agency has to arrange for its operator and breakdown maintenance if

required.

10.12 Engagement of Labour 10.12.1 The recruitment of labour should be in accordance with the labour laws of Central

Government/State Government.

10.12.2 The Buyer will be required to declare the names of their authorized representative,

supervisors and working force and make available a register at site bearing their names,

photos, designations, rate of pay, permanent and local addresses, phone No. etc with their

authorized site in-charge.

10.12.3 The entry of the employees of the Buyer shall be regulated through the valid gate passes

issued by CISF, PVUNL at the request and verification of the Buyer and on the

recommendation of the Engineer-In-charge at site. All rules enforced from time to time in

this respect shall have to be followed by the Buyer.

10.12.4 The payment of monthly wages to the labour/staff of the Buyer, as per the Labour Laws and

for all the claims/compensation/damages will be the sole responsibility of the Buyer. Agency

must ensure payment of minimum wages as per Central Govt wage rate which is subject to

revision from time to time.

10.12.5 It shall be the responsibility of the Buyer to fulfill all statutory obligations in respect of labor

laws and therefore, shall keep PVUNL indemnified for all the consequences in case of any

default of any kind in this regard.

10.12.6 The Buyer shall not deploy any labour less than 18 years of age for any of the above work at

the Plant of PVUNL.

10.12.7 The labour and other supervisory staff shall use the necessary PPEs like helmets, gloves,

glasses, safety belts, safety nets, full body harness etc. for their safety. Agency must comply

to all PVUNL safety rules and regulation applicable within the premises of PVUNL.

10.12.8 PVUNL shall not be legally or otherwise responsible for any accident fatal/non-fatal.

10.12.9 The Buyer shall deploy sufficient qualified safety supervisor all the time at site to ensure that

all requisite safety precautions including use of PPE are in place.

10.13 Indemnity Damages and Insurance

10.13.1 The Buyer shall indemnify PVUNL for all acts/commissions or omissions of their

Engineers/officials, their agents or employees from and against all losses and all claims,

demands, payments, suits, actions, recoveries and judgments of every nature and description

brought or recovered from PVUNL during execution of the work. An indemnity bond to this

effect in the form as approved by PVUNL will be submitted to Decommissioning

Department by the Buyer before start of the work.

10.13.2 The Buyer shall also indemnify PVUNL against payment under the employee‟s

compensation act., which PVUNL / MSTC may suffer, sustain or be in any way subjected to

be reason of injuries to the Buyer‟s or the PVUNL employees, or other person or damage to

the property of any person or corporation arising out of or resulting from the performance of

the work of this contract.

10.13.3 Employees‟ compensation policy shall contain waiver of the insurer‟s right under the

employees‟ compensation law to recover from the owner compensations and other expenses

paid for any injury to or death of any employee of the purchaser which is performing be

covered by the contract.

10.13.4 FORCEMAJEURE: -

The delay in the completion of the work may be treated as force majeure to the

Contractor only if: -

i) The delay is resulted from any causes arising out of compliance with regulations,

orders or instructions of the Central or State Governments, acts of God, acts of Civil

& Military authority, fires, floods, strikes, lock- outs, freight embargoes, war-risk riots

and civil commotion.

ii) If the delay is the result of reasons exclusively attributable to PVUNL.

iii) The Contractor‟s request for extension of the contract period along with all necessary

evidence comes, before the expiry of the schedule date of completion of work.

10.13.5 The Buyer shall pay all costs and maintain throughout the period of the contract, public

liability and property damage liability insurance with the following coverage: -

i) Public liability limits for bodily injury and death not less than Rs.2,00,000/- and Rs.

5,00,000/- per person for each accident respectively.

ii) Property Damage liability limit for each accident not less than Rs. Two Lacs.

10.13.6 The owner shall have the right at any time to require public liability insurance and property

damage liability greater than those specified. In any such event, the additional premiums

payable solely as the result of such increase in insurance shall be added to the contract sum.

10.13.7 In addition, the Buyer is fully responsible for all the equipment and material for damage or

loss from any cause during transition and/or while in custody of Buyer at his works site until

his complete work is formally accepted by PVUNL.

10.13.8 The Buyer shall submit insurance policy for entire duration of contract for “Dismantling of

machinery under CONTRACTOR‟S ALL RISK POLICY for sum insured value equal to

contract award value plus damage / theft / pilferage to surrounding property for sum insured

value Rs. One Crore favoring PVUNL and be handed over to PVUNL before start of work at

Site.

10.13.9 The Buyer must submit to the PVUNL insurance policy valid upto 33 months & shall be

extendable as per requirement of PVUNL. The Buyer shall name PVUNL in each policy in

addition to himself as the insured. Selection of the Insurance Co. shall be with the approval of

PVUNL from amongst the Govt. insurance companies (The New India Assurance Co. Ltd. /

Oriental Insurance Co. ltd. / National Insurance Co. Ltd / United Insurance Co. Ltd.)

10.14 Provident Fund/ Esi Registration

The successful bidder will be required to furnish the provident fund code number in respect

of provident fund contribution by the firm against the wages to their employees deputed for

work and should also be registered under ESI as per statuary Act / Rules. The successful

bidder has to submit copy of challan for depositing contribution to these agencies along with

his bill to PVUNL, if applicable, every month.

10.15 Safety

Safety of man, machines and environment is of utmost importance to PVUN. All precautions

must be taken to ensure safe dismantling, storage, transportation and disposal of the plant,

machinery, or any civil structure.

The Buyer shall be responsible to follow safety instructions as per the safety permit issued to

him and other safety regulations of PVUNL / State Govt. and will ensure that no accident or

damage to either man or machine inside the PVUNL premises takes place. Any loss/ accident

on this score will be dealt in accordance with the Factory rules and Buyer shall be liable for

the same.

Any loss / damage caused to the property of the PVUNL has to be made good by the Buyer

as per the assessment of PVUNL management whose decision shall be final and binding on

the Buyer.

Gas cutting work to be carried out by the Buyer in the course of dismantling work etc. will be

allowed only under the supervision of the Buyer‟s qualified safety supervisory personnel,

who will ensure that all safety precautions have been taken including those for prevention of

fire in and around the area. Any loss on account of fire shall have to be borne by the Buyer.

The Purchaser shall ensure that his employees does not affect the Project Activities relating to

ongoing 3 x 800 MW Thermal Power Plant & do not loiter around within the plant premises

of PVUNL. They shall not touch any material except that material shown to them. If any of

his employees is even found violating these restrictions, the Buyer shall be responsible for

making good the loss to the owners on which their decision shall be final and binding.

10.15.1 SAFETY PROVISION RELATING TO CONTRACTOR

i. The Contractor / Buyer shall incorporate the safety provisions of clause 10.15 of auction

catalogue & direction of authorized Safety officer of PVUNL. Same are required to be

complied by Contractor‟s employees during execution of the contract to facilitate safe

working during execution of the work.

ii. The Contractor/Buyer shall observe the safety requirements as laid down in the clause 10.15

of auction catalogue that all safety compliances are fulfilled by the employees and staff of

the sub-Contractor.

iii. The Contractor / Buyer shall have a qualified Safety Supervisor who shall deal all the matters

relating to safety and his name shall be displayed on the notice boards at a prominent place at the

worksite. The Safety Supervisor should have experience in Deep Excavation, Scaffolding, hot

work, heavy equipment movement, enclosed space, gas cutting, welding , material Lifting

and Rigging, Site transportation, Construction power setup, electrical safety, working at

height, tall structure, working at Overhead High Tension Transmission Towers. For

imparting training to the workers, he must maintain the details along with their

photographs.

iv. While dismantling oil lines of HFO and LDO and their tanks, Contractor shall ensure deployment

of qualified workmen under the supervision of qualified Safety Supervisor. It will also be ensured

to put firefighters at the work place to avoid any fire hazard.

v. Work permits shall be issued by PVUNL executing department only after a joint visit is

conducted to ensure the area is safe for work. Permits shall be received only by the safety

supervisors of the agency after ensuring that the area is safe for its workers. Agency has to

take all measures to ensure the safety of the working area; for instance, purging of closed

ducts may be required before starting work or disposal of acids may be required before

dismantling of storage tanks. Agency must be prepared to carry out such works if required at

site. Decommissoning department of PVUNL shall guide for such precautionary measures

based on site requirements. All hazardous material such as asbestos, acids, insulation glass

wool etc. shall have to be disposed by the agency as per Environment norms and legal

procedures for disposal of those items.

vi. The Contractor/Buyer shall be responsible for non-compliance of the safety measures,

implications, injuries, fatalities and compensation arising out of such situation or incidents. vii. In case of any accident, the Contractor shall immediately submit a statement of the same to

the Owner and Safety officer, containing the details of the accident, any injury or casualties,

extent of property damage and remedial action taken to prevent recurrence and in addition,

the Contractor shall submit a monthly statement of the accidents to the owner at the end of

each month.

10.15.2 OTHER SAFETY CLAUSES/ PROVISIONS

i. The Contractor / Buyer shall comply with all the requirements of respective regulations.

Regulation of Employment & Conditions of Service Act, and its Central Rule / State Rules

and any other statutory requirements as applicable.

ii. The Contractor / Buyer shall follow PVUNL Safety Rules as issued from time to time with

respect to safety in construction & erection.

iii. The Contractor/Buyer shall have the approved Safety, Health and Environment(SHE)

guideline in respect of Safety and health of Workers and it shall be circulated widely and

displayed at common places in English and local language understood by the majority of the

workers. A copy of the safety guideline should be submitted to Head of the Project.

iv. The Contractor / Buyer shall submit JSA / the safety plan comprising of methods to

implement the Safety guideline / Rules, Risk assessment and ensuring Safety at work areas,

Safety audits, inspections and its compliance, Supervision and responsibility to ensure

Safety at various levels, Safety training to employees, review of Safety and accident

analysis, ensure Health and Safety Procedures to prevent accidents to Head of the Project

for approval.

v. The Contractors / Buyer shall ensure proper safety of all the employees, materials, plant and

equipment belonging to him or to the Employer or to others, working at the Site.

vi. All equipment shall be strictly operated and maintained by the Contractor in accordance with

manufacturer‟s operation manual. The Contractor should also follow Guidelines / Rules of

the Employer in this regard.

vii. The Contractors / Buyer shall provide suitable latest Personal Protective Equipment of

prescribed standard to all their employees and employees according to the need. The

Engineer I/C, Head of the station / Project shall have the right to examine the safety

equipment to determine their suitability, reliability, acceptability and adaptability. The

Contractor / Buyer should also ensure these before their use at work site.

viii. The Contractor/Buyer shall provide safe working conditions to all employees and

employees at his workplace including safe means of access, railings, stairs, and ladders,

scaffolding, work platforms, toe boards etc. The scaffoldings shall be erected under the

control and supervision of an experienced and competent person having at least 05 years of

experience in this field. Upon demand, the experience certificate in the field of erecting

scaffolding may be provided to EIC or his representative. For erection of scaffolds, access,

work platforms etc. shall be good and the Contractor shall use standard quality of material.

ix. The Contractor/Buyer shall have his own arrangements with nearby hospitals for shifting

and treatment of sick and injured. Agency has to deploy a good quality Ambulance during

working hours at the work place.

x. Their health records shall be maintained accordingly and to be submitted to PVUNL when

asked for. If any worker found suffering from occupational health hazard, the worker should

be shifted to suitable place of working and properly treated under intimation to Engineer

I/C, Head of the Station/Project. The medical fitness certificate to be submitted to Engineer

(I/C). Head of the Station/Project.

xi. First Aid boxes equipped with requisite articles as specified in the Rules for the use of

workers. Training has to be provided on first aid to employees & office bearers working at

site.

xii. Emergency Action Plan: – The Contractor shall prepare an emergency action plan and is to

be approved by his competent authority to handle any emergency occurred during

dismantling work. Regular mock drills shall be organized to practice this emergency plan.

The Emergency Action Plan should be widely circulated to all the employees and suitable

infrastructure shall be provided to handle the emergencies.

xiii. Scaffolding: -The Contractor/Buyer shall take all precautions to prevent any accidental

collapse of scaffolding or fall of persons from scaffolding. The scaffolding shall meet the

required strength and other requirements for the purpose for which the scaffold is erected.

xiv. Opening: -The Contractor / Buyer shall ensure that there is no opening in any working

platform/any floor of the building, which may cause fall of workers or material. Whenever

an opening on a platform / any floor of the building is unavoidable, the opening should be

suitably fenced and necessary measures for protection against falling objects or building

workers from such platform are taken by providing suitable safety nets, safety belts or other

similar means.

xv. Explosives: -The Contractor/Buyer shall take all precautions while handling, using, storing

or transporting of all explosives. Before usage of any explosive necessary warning / danger

signals are erected at conspicuous places to warn the workers and general public. The

Contractor should strictly ensure that all measures and precautions required to be complied

for use, handling, storing or transportation of explosives under the rules framed under the

Explosives Act,1884.

xvi. Dangerous and Harmful Gases / Equipment: -The Contractor/Buyer shall ensure that

the workers are not exposed to any harmful gases during any activity including excavation,

tunneling, confined spaces etc. The Contractor / Buyer should not allow any worker to go

into the confined space unless it is certified by PVUNL to be safe and fit for the entry. The

Contractor should not go for gas cutting of any confined drums, vessels, containers etc.

where there is supposed to have harmful gases or inflammable liquids/gases.

xvii. Overhead Protection: -The Contractor / Buyer shall ensure that any area exposed to risk of

falling materials, articles or objects is roped off or cordoned off or otherwise suitably

guarded from inadvertent entry of any person. Wherever there is a possibility of falling of

any material, equipment or workers while working at heights, a suitable and adequate safety

net should be provided. The safety net should be in accordance with BIS Standards.

xviii. Handling of Hazardous Chemicals: -The Contractor / Buyer will notify well in advance to

the PVUNL of his intention to bring to the Site any container filled with liquid or gaseous

fuel or explosive or petroleum substance or such chemicals which may involve hazards.

PVUNL shall have the right to prescribe the conditions, under which such container is to be

stored, handled and used during the performance of the works and the Contract shall strictly

adhere to and comply with such instructions. The Engineer I/C shall have the right at his sole

discretion to inspect any such container or such construction plant / equipment for which

material in the container is required to be used and if in his opinion, its use is not safe, he

may forbid its use. No claim due to such prohibition shall be entertained by PVUNL and

PVUNL shall not entertain any claim of the Contractor towards additional safety provisions/

conditions to be provided for/ constructed. Further, any such decision of the Engineer I/C

shall not, in any way, absolve the Contractor of his responsibilities and in case, use of such

a container or entry thereof into the Site area is forbidden by PVUNL, the Contractor /

Buyer shall use alternative methods with the approval of the PVUNL without any cost

implication to the PVUNL or extension of work schedule. Where it is necessary to provide

and / or store petroleum products or petroleum mixtures and explosives, the Contractor shall

be responsible for carrying-out such provision and / or storage in accordance with the rules

and regulations laid down in Petroleum Act 1934, Explosives Act 1948 or its latest version

as applicable, and Petroleum and Carbide of Calcium Manual published by the Chief

Inspector of Explosives of India. All such storage shall have prior approval of the Engineer

I/C. In case any approvals are necessary from the Chief Inspector (Explosives) or any

statutory authorities, the Contractor shall be responsible for obtaining the same.

xix. Eye Protection: -The Contractor/Buyer shall provide suitable personal protective

equipment to his employees depending upon the nature of hazards and ensure their usage by

the workers engaged in operations like welding, cutting, chipping, grinding or similar

operations which may cause injuries to his eyes.

xx. Excavation: -The Contractor /Buyer shall take all necessary measures during excavation to

prevent the hazards of falling or sliding material or article from any bank or side of such

excavation which is more than one and a half meter above his footing by providing adequate

piling, shoring, bracing etc. against such bank or sides.

Adequate and suitable warning signs shall be put up at conspicuous places at the excavation

work to prevent any persons or vehicles falling into the excavation trench. No worker

should be allowed to work where he may be stuck or endangered by excavation machinery

or collapse of excavations or trenches.

xxi. Electrical Hazards: -The Contractor/Buyer should ensure that all electrical installations at

the dismantling /construction work comply with the requirements of latest electricity acts /

rules. The Contractor/Buyer shall take all adequate measures to prevent any worker from

coming into physical contact with any electrical equipment or apparatus, machines or live

electrical circuits which may cause electrical hazards during the dismantling construction

work. The Contractor shall provide the sufficient ELCBs / RCCBs for all the portable

equipment, electrical switchboards, distribution panels etc. to prevent electrical shocks. The

Contractor should ensure use of single / double insulated hand tools or low voltage i.e., 110

volts‟ hand tools. The Contractor / Buyer should also ensure that all temporary electrical

installations at the dismantling construction works are provided with earth leakage circuit

breakers.

xxii. Vehicular Traffic: -The Contractor / Buyer should employ vehicle drivers who hold a

valid driving license under the Motor Vehicles Act,1988.

xxiii. Lifting Appliances, Tools &Tackles, Lifting Gear and Pressure Plant & Equipment

etc. - The Contractor/Buyer shall ensure all the lifting appliances, tools & tackles including

cranes etc., lifting gear including fixed or movable and any plant or gear, hoists, Pressure

Plant and equipment etc. are in good condition and shall be examined by competent person

and only certified shall be used at sites. Periodical Examination and the tests for all lifting /

hoisting equipment & tackles shall be carried out. A register of such examinations and tests

shall be properly maintained by the Contractor and will be promptly produced as and when

desired by Head of Project or the person authorized by him.

xxiv. Excessive Noise, Vibration: -The Contractor / Buyer shall take adequate measures to

protect the workers against the harmful effect of excessive noise or vibration. The noise

should not exceed the limits prescribed under the concerned rules, Noise Pollution

(Regulation and Control) Rules,2000.

xxv. Electrical Installations: -The Contractor/Buyer shall not interfere or disturb electric fuses,

wiring and other electrical equipment belonging to the Employer or other Contractors under

any circumstances, whatsoever, unless expressly permitted in writing by PVUNL to handle

such fuses, wiring or electrical equipment.

10.15.3 SAFETY ORGANIZATION

I. The Contractor/Buyer shall employ at least one full time qualified safety officer

exclusively to supervise safety aspects of the equipment and employees, who will

coordinate with the PVUNL Safety Officer. Further requirement of safety officers,

if any, shall also to be deployed by Contractor. In case the work is being carried

out through sub-contractor, the employees / employees of the sub- Contractor

shall also be considered as the Contractor‟s employees / employees for the above

purpose.

II. The name and address of such Safety Officer of the Contractor will be promptly

informed in writing to the Head of the Station / Project with a copy to the Safety

department before he starts work or immediately after any change of the

incumbent currency is made during of the Contract.

III. Reporting of Accident and Investigation:- In case any accident occurs during

the dismantling /demolition / de-erection or other associated activities

undertaken by the Contractor thereby causing any near miss, minor or major or

fatal injury to his employees due to any reason , it shall be responsibility of the

Contractor / Buyer or to promptly inform the same to PVUNL Safety

Department with a copy to PVUNL Head of Project in the prescribed form and

also to all the authorities envisaged under the applicable laws.

10.16 Right to Stop Work

10.16.1 The Engineer I/C shall have the right at his sole discretion to stop the work, if in

his opinion the work is being carried out in such a way that it may cause accidents and

endanger the safety of the persons and / or property, and / or equipment. In such cases,

the Contractor / Buyer shall be informed in writing about the nature of hazards and

possible injury / accident and he shall comply to remove shortcomings promptly. The

Contractor / Buyer after stopping the specific work can, if felt necessary appeal

against the order of stoppage of work to the Head of the Station/Project within 3

working days of such stoppage of work and decision of the Head of the

Station/Project in this respect shall be conclusive and binding on the Contractor.

10.16.2 The Contractor / Buyer shall not be entitled for any damages / compensation for

stoppage of work due to safety reasons and the period of such stoppage of work shall

not be taken as an extension of time for Completion of the Facilities and will not be the

ground for waiver of levy of liquidated damages.

10.16.3 Fire Protection: -The Contractor/Buyer shall provide sufficient fire

extinguishers at place of work. The fire extinguishers shall be properly maintained as

per relevant BIS Standards. The employees shall be trained to operate the fire

extinguishers

/equipment.

10.17 Facility by PVUNL within the premises

10.17.1 At present, electricity for general lighting purposes only is available in the plant

premises and shall continue during the dismantling and lifting period also at no cost to the

Buyer. However, for any additional work for lighting / dismantling/ lifting purposes by the

Buyer, electricity, if available, the bidder has to take the electric connection on chargeable

basis from PVUNL / concerned agency. This can in no way be cited as any reason for

delaying / not carrying out dismantling/ lifting work by the Buyer. PVUNL shall not be

responsible for any disruption of supply caused due to dismantling work.

10.17.2 All arrangements of dismantling, removal, loading and transportation of the sold

material have to be made by the Buyer himself. PVUNL does not take any responsibility for

providing any consumables including oxygen/DA gas, welding rods etc. to the Buyer for

dismantling and lifting job.

10.17.3 Neither any arrangement for stay for any supervisor or employees shall be made by

PVUNL nor shall anyone except security guards of the Buyer, be allowed to remain inside

the plant premises during night or on any „off‟ day. Also washing of clothes etc. shall not be

allowed in the plant premises.

10.18 Security of Sold Equipment

a. The Buyer shall make his own arrangement for the security of materials sold to him

w.e.f. the start date of the contract. The Buyer will be allowed to post Security Guards round

the clock and the names of the Security Guards will have to be made available to PVUNL so

that Gate Passes may be issued to them. PVUNL will neither be responsible for any loss or

theft of material sold to the Buyer nor entertain any complaint on this account of whatsoever

nature. The Buyer will be responsible for safe custody of his own tools, tackles and other

materials w.e.f. start date of the contract. PVUNL reserves the right to ask for removal of

specific security guard/s, whose activities are deemed unlawful or detrimental to PVUNL‟s

interests. The Buyer has to deploy alternative guards for the purpose.

b. The Buyer shall be responsible for any damages that may be caused to the premises of

PVUNL while dismantling, storage or removal of the lot/ material purchased by him and

before removing such lots or items from PVUNL premises, the Buyer shall be liable to pay the

amount of damages assessed by PVUNL in this regard.

c. The Buyer shall abide by and will be responsible to follow all the Labour Laws in respect of

persons engaged by them. PVUNL shall not be responsible for any claims raised by their

personnel in respect of the e-auctions. The safety statutory measure shall be applicable during

entire contract period.

d. Sale Release Order, Delivery Orders, Delivery Challans, Sale Release Orders, Lifting

Orders, Gate Passes, etc. shall be made in the name of actual Buyer only.

e. The Buyer shall insure the plant and equipment, his personnel and take cover for third party

risk if thought essential by him or if required by statutory regulations. Also, necessary

clearance from the statutory authority, if required, shall be obtained by the purchaser.

PVUNL will not be called upon to bear any responsibility in this regard. The Buyer shall agree

to keep PVUNL harmless and indemnified from and against all costs and expenses incurred

and all losses and damages suffered by PVUNL due to or as a result of any misrepresentation

or fraud on the part of Buyer and / or his employees or agents. The Buyer shall bear

insurance costs and maintain throughout the period of contract, public liability and property

damage liability in consultation with PVUNL.

f. In case of any accident during the contract period, in the premises of PVUNL, the

amount of compensation payable to the affected person/his family shall be assessed by

Statutory Authority and payable by the Buyer.

g. In case of damages to any equipment or property which is not covered in the contract, the

amount of compensation as assessed by PVUNL Authority shall be final and shall be

payable by the Buyer.

h. In respect of any dispute regarding material or regarding execution of contract that may arise

during contract period, the decision of PVUNL shall be final.

i. Whenever any claims for the payment of sum of money arises out of or under this sale against the

purchaser, PVUNL shall without prejudice to any other remedy, be entitled to deduct such sum of

money from the proceeds of sale under this contract or from any sum then due or which at any

time thereafter may become due to the Buyer under this or any other Contract with PVUNL and

if sufficient amount is not due to Buyer to cover the full amount recoverable from him, the Buyer

shall pay to PVUNL on demand the balance remaining dues or the BG submitted by Buyer will

be invoked.

j. It will be the sole responsibility of the Buyer, for any type of accident occurred during the

disposal / decommissioning / dismantling / transporting of the Unit No.1, 2, 3, 4, 5, 6, 7, 8, 9 &10 and associated auxiliaries.

k. The terminal points for dismantling during disposal of Unit No.1,2,3,4 ,5,6,7,8, 9 &10 will

be finalized by the PVUNL.

l. All safety precautions are to be taken by the Buyer & use of Personal Protective Equipment

(PPE‟s) will be mandatory while dismantling during disposal of units.

m. It will be the sole responsibility of the Buyer for any mishap/ theft in connection with the

allotted material & premises where the disposal units are situated.

n. The technical parameters indicated in the catalogue / nameplates are at the time of

installation of the units. These parameters like pressure / temperature etc. might have been

derated due to old age. As such, PVUNL is not responsible for performance of these

machineries on account of such parameters indicated in the catalogue.

10.19 Labour/ Health/ Safety Conditions and Provision of Employees

Compensation Act I. In every case in which, by virtue of the provision of Sec. 12, Sub-Sec.(i) of the Employees

Compensation Act,1923 or any other law for the time being in force, if PVUNL is obliged to

pay compensation to an employee employed by the Buyer in execution of the works,

PVUNL is entitled to recover from the Buyer the amount of the Compensation so paid, and

without prejudice to the rights of PVUNL, Under Section -12, Sub-section (2) of the said Act

or any other law for the time being in force, except on written request of the Buyer and upon

his giving to PVUNL full security for all costs for which PVUNL might become liable in

consequence of the contesting such claim.

II. In addition to the above, in the event of death of the Buyer‟s employee while on duty, an

immediate ex-gratia payment of Rs. 10,000/- (Indian Rupees Ten Thousand only) should be

paid by the Buyer to the dependents of the employee. In case the Buyer fails to pay such

amount, as mentioned above, the PVUNL management may pay the amount to the deceased

employee‟s dependent and recover the amount from the Buyer.

III. It shall be the responsibility of the Buyer to fulfill all statutory obligations in respect of

labor laws and therefore, shall keep PVUNL indemnified for all the consequences in case of

any default of any kind in this regard.

10.20 Jurisdiction The Contract shall in all respect be construed and operated as an Indian Contract and in

accordance with the Indian laws in force and is subject to the exclusive jurisdiction of only

Jharkhand Courts at Ranchi.

10.21 Arbitration

All the matters, questions, disputes, differences and /or claims arising out or and / or concerning

and / or in connection and / or in consequences or relating to this contract whether or not

obligations of either of both parties under this contract be subsisting at the time of such dispute

and whether or not this contract has been terminated or purported to be terminated or completed,

shall be referred to the sole Arbitrator to be appointed by CEO, PVUNL. The award of the

Arbitrator shall be final and binding on the parties to this contract. Provisions of Arbitration and

conciliation act, 1996 and the rules made thereunder as amended from time to time shall be

deemed to apply to the Arbitration proceedings under this clause.”

10.22 Contact during execution of work

Throughout the contract period, Buyer shall keep his mobile phone (which Buyer has intimated at

the time of start of work) in active/operative condition. Further, mobile phone contact number of

the site supervisor shall also have to be intimated at the time of start of work and his mobile also

be kept in active/operative condition throughout the contract period. In case, under some

emergency, contact could not be maintained on these intimated mobiles, under those

circumstances, PVUNL will recover Rs. 500/- per mobile per day till the mobile contact is again

made active / alternate mobile number provided to site-in charge. The Buyer shall also intimate

the e-mail accounts of himself and those of their authorized representatives at the start of the

work.

10.23 The Sale will be governed by the Material List, Terms & Conditions & Special Terms &

Conditions (STC) displayed on the Live e-Auction Floor (and not under forthcoming Auctions) as

well as the General Terms & Conditions (GTC) and Buyer Specific Terms & Conditions (BSTC)

already accepted by the Bidder at the time of e-Auction Registration with MSTC. The Material

List & STC displayed under View Forthcoming Auctions on MSTC's e-Auction Website are

tentative and subject to change at MSTC's sole discretion before the start of e- Auction. Bidders

should therefore download the Material List and STC displayed only under View Live Auctions

for their record purpose, if required. The BSTC and GTC can be seen and downloaded by going to

the Home Page of the e-Auction Website and clicking on NEW USER. Participation in the e-

Auction will be deemed to imply that the Bidder has made himself thoroughly aware of and

accepted the STC, BSTC and GTC. In case of any conflict between the STC and BSTC, the STC

shall prevail. MSTC shall have the right to issue addendum to the STC or BSTC, to clarify,

amend, modify, supplement or delete any of the conditions, clauses or items stated therein and the

Addendums issued shall form a part of the original STC.

10.24 The Principal / Owner of the materials reserves the right to withdraw at any stage of the sale any

item or quantity of material either by number or by weight or any other specific unit etc, even

after issue of Sale Release Order/Delivery Order. The Principal/Owner will not be bound to

assign any reason or details thereof. Value of the materials, as ascertained by PVUNL for the

materials so withdrawn, if any, and paid by the Buyer will be refunded. The Principal will

however, not be responsible for any damage, loss, direct or consequential compensation

whatsoever to the Buyer nor for payment of any interest.

10.25 PVUNL / MSTC reserves its right to demand copy of any other document / License / Certificate

issued by any Statutory / Govt. Authority in favor of the Bidder, if required, under any Statutory

or State / Central Government Act / Law / Order / Rules, etc.

10.26 Statutory requirement

The bidder shall abide by all Acts notified by the Govt. of India, Govt. of Jharkhand from time to

time to the extent they are applicable during the execution of the contract. Further, the bidder

should comply with all statutory requirement / clearances in respect of laws, regulations and

procedures governing this contract.

10.27 Blacklisting

If it is found that the Buyer is not following the terms and conditions of payment / delivery or

other conditions of the e-Auction and also indulging in any malpractices either himself or by his

agents, deputies or observer, such bidder is liable to be blacklisted for the appropriate period for

claiming the future business with PVUNL at the discretion of PVUNL and appropriate action

will be taken as deemed fit by PVUNL/ MSTC however before blacklisting, a Notice of 15

calender days will be given.

10.28 Law Governing Contracts

All contracts shall be governed by the laws of India for the time being in force irrespective of

the place of delivery, place of performance or place of payment under a contract, the contract

shall be deemed to have been made at the place where the acceptance of the tender has been

issued i.e. PVUNL, Patratu.

10.29 Termination Clause

PVUNL can terminate the contract by giving 15 calender days‟ notice in case the work executed

by the Buyer is not satisfactory to PVUNL or Buyer makes a material default in performance of

contract. On termination, security deposit/BG submitted and /or any payment deposited by the

Buyer shall be forfeited.

Annexure-I: Safety Guidelines

(Clauses mentioned hereunder are only supplement to the Safety Clauses at 10.15. In case of any difference, clauses

mentioned hereunder will prevail.)

Safety Clauses for Dismantling work

GENERAL

1. SAFETY SHALL BE THE TOP MOST PRIOTY OF EVERY STEPS OF DISMANTLING

WORK.LIFE IS PRECIOUS.ALL EFFORT SHALL BE MADE TO AVOID A SINGLE

INJURY EVEN FIRST AID. ALL NEARMISSES SHALL BE

ANALYSED AND SHALL BE REPORTED TO PVUNL SAFETY DEPARTMENT.

2. The Buyer shall comply the provisions of Factories Act 1948, THE BUILDING AND

OTHER CONSTRUCTION WORKERS‟ (REGULATION OF EMPLOYMENT AND

CONDITIONS OF SERVICE) ACT, 1996 and any other statutory provisions applicable to

them to ensure occupational health and safety. PVUNL Electrical & Mechanical Safety

Rules and any other Rules made by PVUNL relating to

Operation & Maintenance of plants. The Contractor shall make arrangements at all his work

places for ensuring safety and absence of risks to health of the works. THE WORKER AND EMPLOYEE

The employees employed by the Buyer should be skilled / competent in accordance with the

job requirement to be satisfaction of the Engineer-in-Charge shall have a right to remove any

employee of the Buyer whom he feels to be incompetent. The

Contractor shall employ sufficient number of supervisors to ensure supervision at all places

of his work at all the times. SAFETY ORGANIZATION

A The Buyer should have at least one qualified Safety Officer ( Diploma on Industrial Safety

from CLI and RLIs).Additional Number of Safety Officers shall be appointed per 250 nos workers

B Certificate regarding Qualification of Safety Officer/Officers shall be submitted to PVUNL

Safety Department and get it approved before to start of work. C Facilities and status of the Safety Functions shall be submitted along with Safety plan

5 SAFETY PLAN

The Contractor shall submit SAFETY PLAN indicating JSA or HIRA of the activities to be

undertaken and get it approved from PVUNL. 6 SAFETY AWARNESS AND TRAINING

A The Contractor shall arranged Daily PEP Talks / tool Box training to each group daily before

to start work.

B Each worker shall have Pre employment training and certificates in this regard shall be

submitted to PVUNL Safety Department.

C The Contractor shall arrange Post employment Training (minimum 1 day duration) for all of

his worker at least once of every six month report to be submitted to PVUNL Safety

Department.

D No tress shall be given to worker engaged during training. Salary, working lunch shall be

proved by Contractor. MEDICAL CHECK UP AND OCCUPATIONAL HEALTH CHECK UP

A The contractor shall provide premedical heath checkup of workers to be employed before to

start of work B Shall have First Aid medical facilities and competent First Aid attended.

C The Contractor shall have medical facilities and arrange occupational health checkup. Lung

function test is mandatory.

The necessary registers and records relating to the medical examination of all the

employees should be maintained and shown to PVUNL Engineer in-Charge / Safety-in-

Charge on demand 8 HEALTINESS OF EQUIPMENT

The Contractor shall ensure that the equipment / electrical installation system / facilities are

provided and maintained by him as required under various statutes. He shall also ensure

testing / examination of the equipment wherever required, in accordance with the

provisions of the Factories Act or any other prescribed status.

The record of such inspection / testing and examination shall be kept at the site and shown to

PVUNL Engineer-in-Charge on demand. 9 WORKING AT HEIGHTS

A No work at Height shall be carried out without Check list clearance and Height Permit.

B All working platforms, ways and other places o area shall be free from accumulations of any

material causing obstructions and tripping.

C Every opening at elevation from ground level through which a worker, material, equipment,

etc. shall be covered and / or guarded suitable by the Contractor to prevent such falls.

D Wherever the works are exposed to hazards of falling from the height, the Contractor shall

provide full harness safety belts fitted with fall arresting system to the employees working at

the higher elevation and life line of 8mm diameter wire rope with turn buckets for anchoring

of safety belts while working or moving at higher elevations Safety nets shall also be

provided for saving them from fall from heights and such equipment should be in

accordance with BIS Standards.

E Wherever there is a possibility of failing of any material, equipment or workers while

working at heights a suitable and adequate safety net should be provided. The safety net

should be in accordance with BIS standards.

F The Contractor shall provide proper access like ladders, etc. where the workers are required

to reach higher elevations and ensure the workers and use them as an access for higher

elevations where a permanent access is not available. The workers shall be provided with

safety belts fitted with suitable for arresting system (Fall arrestors) for climbing / getting

down through ladders to prevent fall from height. 10 OPENING

The Contractor shall ensure that vessel, sump, tank, pit or opening in ground or in a floor

which by reason of its depth, situation, construction or contains or may be source of danger

at his workplace shall be either securely covered or fenced and necessary measures for

protection against falling materials / objects on workers from such platform are taken by

providing suitable safety nets, safety belts or other similar means.

11 FENCING OF MACHINERY

The Contractor shall not allow any worker to examine any part of the machinery or to carry

out the lubrication or other adjusting operation while the machinery is in motion. The workers

near the machinery in motion shall be provided with tight fitting clothes as required under

State Factory Rules.

12 SCAFFOLDINGS AND WORK PLATFORMS

The Contractor shall take all precautions to prevent any accidental collapse of scaffolding or

working platforms of fall of person from scaffolding or working platforms. The Contractor

shall ensure that scaffolding erection and repairs are done under the expert supervision. The

scaffolding shall meet the required strength and other requirements for the purpose of which

the scaffolding / work platform is erected. The material used for scaffold / work platform

should confirm to the BIS Standards. 13 CONFINED SPACE

No person shall be allowed to work without Permit and clearance of Checklist prepared for

this purpose. Prescribed Format of prepared by PVUNL is mandatory.

14 Explosives

The Contractor shall take all precautions while handling, using, storing or transporting of all

explosives. Before usage of any explosive necessary warning / danger signals are erected at

conspicuous places to warn the workers and general public. The Contractor should strictly

ensure that all measures and precautions required to be complied for use, handling, storing or

transportation of explosives under the rules framed under the Explosives Act, 1884

15 Excavation

The Buyer shall take all necessary measures during excavation to prevent the hazards of

falling or sliding material or article from any bank or side of such excavation which is more

than one and a half meter above his footing by providing adequate piling, shoring, bracing

etc. against such bank or sides.

Adequate and suitable warning signs shall be put up at conspicuous places at the excavation

work to prevent any persons or vehicles falling into the excavation trench.

A The Engineer-in-Charge/Contactor Safety Officer shall have right at his sole discretion to

stop the work, if in his option the work is being carried out / such a way that it may cause

accidents and endanger the safety of the persons and / or property and / or equipment. In such

cases, the Contractor shall be informed in writing about the nature of hazards and possible

injury / accident and he shall comply to remove shortcomings promptly.

B The Contractors shall not be entitled for any damages / compensation for stoppage of work,

due to safety reasons and the period of such stoppage of work shall not be taken as an

extension of time for Completion of the Facilities and will not be the ground for waiver of

levy of liquidated damages.

18 OVERHEAD PROTECTION

A The Contractor shall ensure that any area exposed to risk of falling materials, articles or

objects is roped off or cordoned off or otherwise suitable guarded from inadvertent entry or

any person.

B Wherever there is a possibility of falling of any material, equipment or construction workers while working at heights a suitable and adequate safety net should be in accordance with BIS Standards.

19 EYE PROTECTION

The Contractor should provide suitable personal protective equipment to his workmen

depending upon the nature of hazards and ensure their usage by the workers engaged in

operations like welding, chipping, grinding or similar operations which may cause injuries to

his eyes. 20 ELECTRICAL HAZARDS

A The Contractor should ensure that all electrical installations / equipments used in work area

comply with the requirements of latest electricity acts / rules.

B The Contractor shall take all adequate measures to prevent any worker from coming into

physical with any electrical equipment or apparatus, machines or live electrical circuits

which may cause electrical hazards during the construction work. The Contractor shall

provide the sufficient RCCBs for all the portable equipments, electrical switchboards,

distribution panels etc. to prevent electrical shocks to the workers.

C The Contractor should ensure use of single / double insulated / plastic body hand tools or low

voltage i.e. 110 volts hand tools.

D Wherever PVUNL Electrical and Mechanical Safety Rules prescribed, the Contractor shall not undertake any work till the permit is obtained for the specific work in accordance with PVUNL Rules.

E All electrical connections are to be taken by using plug top, no tapping of power by booking

will be allowed. 21 LIFTING TOOLS AND TACKLES

The Contractor shall use the lifting appliances, tools and tackles including cranes etc. lifting

gear including fixed or movable and any plant or gear, hoists, pressure plant and equipment

etc. are in good construction and examined by competent person and certified as per statutory

requirements. 22 REPORTING OF ACCIDENTS

A In case of any injury, the Contractor shall send the injured person to First Aid Center where

the injured shall be given the first aid treatment and the injured quantum of permanent

disablement / temporary disablement shall be assessed to ensure payment for compensation

to be paid, by the Contractor to the victim.

B In case the subsequent treatment given to other than PVUNL Hospitals, the Contractor shall

submit the full information about the treatment of injured person including the address etc.

till the person is certified fit by any Govt. / PVUNL doctor. He shall submit such record to

PVUNL safety department within 15 calendar days of certified fit by the Doctor as above.

C The Contractor shall report immediately about the serious injury / fatality in his work area to

the local police station, Dist. Magistrate, Safety Officer in-Charge and Engineer In-Charge

on the prescribed format. In case of near miss accidents minor injury, he shall report the same

Safety Officer in-charge and Engineer In-charge immediately after referring the injured to

PVUNL Plant Hospital / Dispensary/ First Air Center.

D Whenever asked by PVUNL, the Contractor shall send his employees to dispose in any

enquiry arising out of any injury / fatality / loss etc. without any reservation.

23 PERSONNEL PROTECTIVE EQUIPMENT

A The Contractor shall provide safety helmets to all his employees including Contractor labour

of his sub-contractor of his sub-contractor to prevent a danger of falling object. Whenever any

worker is engaged on a work at a place from which he is liable to fall more two matters shall

with safety Harness equipment with lifelines which are secured to a fixed structure. A

competent person to ensure that no belt or lifeline that is not a good condition is used shall

examine all safety belts and lifelines at frequent interval.

B Whenever the workers are exposed more than to the noise levels specified in the concerned

State Factory Rules, be provided with suitable ear plugs / ear muffs so as to reduce the

exposure below high noise level.

C Personal protective Equipment as prescribed in the Factory Act / or State Factories Rules,

the Contractor shall provide to the workers. In case the Factories Act / State Factories Rules

do not specify the personal protective equipment for the concerned work, the Contractor

shall provide the personal protective equipment prescribed by PVUNL Engineer In-charge.

The quality of the personal protective equipment shall be as prescribed in concerning Indian

Standards. In case, the Indian Standards do not exist for particular personal protective

equipment, International standard Marked shall be procured It will be the responsibility to

ensure that all his employees use these equipment without fail.

24 PENALITIES

A If the contractor falls in providing safer working environment as prescribed in General

Condition of Contract relating to safety and health of continue the work even after being

instructed to stop the work by Engineer in-Charge, the Contractor shall be penalized @ Rs.

5,000/- per day or part thereof till the instructions are complied with and so certified by the

Engineer in-Charge. However, in case of accident causing major injury or fatal, the

provisions contained below shall also apply in addition to the penalties mentioned in this cause.

B If the Contractor does not take all safety precautions and / or fails to comply with the Safety

Rules as prescribed by the Employer or under the applicable law for the safety of the plant

and equipment and for safety of personal and the Contractor does not prevent hazardous

conditions which cause injury to this own employees or employees of the other Contractors, or

the Employers employees or any other person who are at site or adjacent thereto, the

Contractor shall be responsible for payment of penalty to PVUNL as per the following

schedule : -

i. For fatal accident / injury causing death Penalty @ 10% of the contract value or

Rs. 5 lakh whichever is less for each fatal

Accident / injury causing death

ii. Major injury or accident causing 25% or more permanent disablement to

workmen

Penalty @ 2.5% of the contract value or Rs.

1 lakh whichever is less for each

disablement injury.

C Permanent disablement shall have the same meaning as indicated in Workmen's

Compensation Act, 1923. The penalty mentioned above shall be in addition to the

compensation payable to the workmen / employees under the relevant provisions of the

Workmen's Compensation Act and Rules framed there under or any other applicable laws as

applicable from time to time.

D If any Contractor worker found working without using the safety equipment like safety

helmet, safety shoes, safety belts etc. or without anchoring the safety belts while working at

height the Engineer in-Charge / Safety Officer of PVUNL, Shall have the right to penalize

the Contractor for Rs.200/- per person per day and such worker shall be sent out of the

workplace immediately and shall not be allowed to work on that day Engineer in-Charge /

Safety Officer of PVUNL will also issue a notice in this regard to the Contractor.
