WHEN IS AN INTERPRETER NEEDED? Special education is a highly complex field and is difficult to

understand at times. Special educators often use very technical language

that is not readily understood by parents or others new to education.

While we try very hard to explain these terms so that others will

understand them, many may still have difficulty with the terminology

and paperwork. This is especially true when parents are not fluent in the

English language. It is the responsibility of the school district to ensure

that parents who do not speak English are given the same opportunity to

participate in the ARD process as English-speaking parents. Thus, if a

parent indicates that he/she does not sufficiently comprehend the

English language to be able to participate in the ARD process, an

interpreter should be used to facilitate their participation. It is wise to

check the Home Language Survey initially, but always speak with the

parent in person to ascertain their needs.

CONFIDENTIALITY

Both federal and state law require that the school district has

established and implemented policies, procedures, and operating

guidelines concerning confidentiality for special education students.

Special education records and paperwork are carefully safeguarded to

protect the privacy of students and their parents. The job of an ARD

interpreter does not require them to handle or maintain any special

education records or paperwork. However, it is encumbent upon them to

maintain confidentiality regarding information that they may hear in an

ARD meeting. ARD interpreters must be vigilant in maintaining

coinfidentiality about whatever they might hear or translate in an

ARD meeting. Once you step outside the ARD meeting room, you should

not casually discuss the ARD with others who are curious about the

proceedings. If you are not directly involved with a student as a

paraprofessional, teacher or administrator, you should not discuss the

ARD proceedings at all.

If you are directly involved with the student in some capacity as

designated by the student’s IEP, your responsibilities increase. (See

pages 6-2 through 6-4 attached.)

AVOIDING PERSONAL INPUT OR OPINION

One very challenging aspect of interpreting at an ARD is resisting

the urge to editorialize about the discussion. It is imperative that you

avoid offering your personal opinion on what is being said unless you are

specifically asked for your opinion. To interpret in an ARD means to

replicate in the parent’s native language, as closely as possible, what has

been said in English, or vice versa. An interpreter should not try to

explain what is being said to ensure that the parents understand! If

the parent indicates that they do not understand something said, relay

that information to the speaker and allow them to make the explanation

in English, which you should then translate as accurately as possible.

Due to the very technical and complex nature of special education

and assessment, only the certified assessment professional is qualified to

interpret the assessment. Please do not add to these explanations in any

way, but always make every attempt to translate the discussion exactly.

Because of the nature of special education, ARD committee

members can sometimes have differing opinions about the discussion at

hand. At no time is it appropriate for an interpreter to add his/her

opinion about the discussion unless they have been specifically asked as

a member of the ARD committee to do so. It is equally inappropriate for

an interpreter to have a conversation with the parent in a language that

the other ARD committee members do not understand; the interpreter’s

job is to translate the speaker’s words - not engage in conversation with

the parent.

AUDIOTAPING OF ARDS HELD TRANSLATED INTO SPANISH

Due to recent changes in Texas state law, the complete ARD

proceeding must now be available to the parents in their native language.

In our district, we have decided that ARDs held in languages other than

(only) English will be audiotaped from beginning to end so that the

parent may have a record of the discussion. An audiotaped ARD presents

the opportunity for your words to be kept for posterity! Therefore, choose

your words carefully! Once again, it is critical that interpreters accurately

translate the discussion without personal input or opinion.
