iii) Tenderers are referred to the abovementioneddocuments for the full intent and meaning of eachclause thereof (hereinafter referred to by heading andclause number only) for which such allowance must bemade as may be considered necessary.

All references in the above mentioned documents andthis Preliminaries Bill to "Architect"/"Principal Agent"are deemed to be references to "The Engineer"

iv) Where standard clauses or alternatives are notapplicable to this contract such modifications,corrections or supplements as will apply are givenunder each relevant clause heading.

v) Where N/A appears opposite any clause, such clauseas detailed in the standard documents referred to isNOT APPLICABLE to this contract.

Should any partsof the documents or drawings not be clearly intelligible to theContractor, he must, before submitting his tenderobtain clarification from the Engineer.

Any remeasurement of work required during the contract will besimilarly remeasured in accordance with the above system ofmeasurement.

In addition, the items in these Bills of Quantities are deemed tobe read and priced in conjunction with and the descriptionsregarded as amplified by the Model Preambles for Trades asrecommended and published by the Association of SouthAfrican Quantity Surveyors (2008 Edition) and no claim arisingfrom brevity of description of items fully described in the saidModel Preambles for Trades will be entertained. The attention of the Tenderer is directed to the fact that hisoriginal priced Bills of Quantities used for tenderingpurposes must be completed in black ink and must besubmitted together with the Form of Tender.

The use of correcting fluid and failure to initial every pagemay result in the disqualification of the Tender.

173 B1.7: Performance guarantee by the Contractor Item

The full security for the due fulfilment of all obligations underthis contract is to remain in force after the 60 (sixty) days a f t e rthe issue of the Practical Completion certificate.

No guarantee containing any clause which allows the financialinstitution providing such guarantee to withdraw from theirundertaking before 60 (SIXTY) calender days after the dateof issue of the Practical Completion Certificate by the PrincipalAgent nor any guarantee stipulating an expiry date, will beacceptable by the Employer.

Notwithstanding the above, the guarantee will only bereturned to the contractor after receipt of satisfactoryproof that the contractor has met all his obligations underany and all selected and nominated sub-contractagreements applicable to this contract.

Notwithstanding anything contained in this clause tendersshall be valid for a period of ninety days (90) from theclosing date of tenders.

The Employer reserves the right to correct any arithmetical orother errors in the extension of the rates and totals in the tenderand / or to adjust any rates that are considered by him to beimbalanced and unacceptable. Such adjustments will be donewithout affecting the Tender Sum.

Tenders shall complete all the information requested on theForm of Tender and provide copies of all supportingdocumentation requested on the Form of Tender and clauseB1.5.

The adjustment of preliminaries will be on the basis of fixedprice, value related and time related items in accordance withmethod 2.

239 Clause C1.2: Non cession of monies

The Contractor shall not cede or assign his rights or claims toany monies due or to become due under this contract, as nocession or assignment will be recognised by the Employer. Item

240 Clause C1.3: Site instructions

Site instructions issued by any of the Consultants on site are tobe recorded in triplicate in a site instruction book which is to bemaintained on site by the Contractor.

It shall be the Main Contractor's responsibility to ensure thatany verbal instructions given on the site are recorded in the siteinstruction book and signed by the Engineer. Item

241 Clause C1.4: Employment of Namibian People

No employee of the Contractor originating from any othercountry shall enter Namibian territory without a work permit anda residence permit, obtainable from the Ministry of HomeAffairs.

It is an explicit condition of this Contract that no unskilled orsemi-skilled labour may be employed on the works unless he orshe is a Namibian citizen.

It is a further condition that a minimum of 30% skilled labouremployed on the works, shall be Namibian citizens.

Where a Tenderer's labour component consists of more than30% or up to 100% Namibian citizens, the requirementstipulated below still applies.

''The Tenderer is encouraged to employ Namibian citizensfor skilled and semi-skilled artisans and employ unskilledlabour from the areas of intervention.''

"All Namibian skilled artisan and unskilled employees areto be registered in accordance with the Social Security Actof 1994 (Act no 34 of 1994) and the Tenderer must submitCertificates of good standing from the Social SecurityCommission, which are obtainable from the Commission'soffices. Item

242 Clause C1.5: As built drawings (structural concrete)

The position of construction joints and the extent of individualconcrete pours are to be recorded by the Contractor on theStructural Engineer's drawings and are to be submitted to thePrincipal Agent and the Structural Engineer for their records. Item

The Contractor is to allow for one set of Plumbing and drainagedrawings "marked up" by the sub-contractor to indicate forinternal and external installations as executed on the projectsite to facilitate the preparation of the "as built" drawings to beand submitted by the Engineer to the user Ministry. 244 Clause C1.7: Specific Products

The Contactor is advised that his rates must be based onspecific products or items as described in these Bills ofQuantities. He may only deviate from the designated product oritem to another product or item after written consent hasbeen obtained from the Engineer, and only after theContract has been awarded to the successful Tenderer.Where applicable, the cost of such substitution with anotherproduct or itemsshall be adjusted by the Quantity Surveyor in the final accountfor this project.

The Contractor shall take delivery of, handle, store, use, applyand /or fix all proprietary branded products or items in strictaccordance with the manufacturer's instructions after theconsultation with the manufacturer's authorised representative.Where no specific product or item is specified, but a product oritems is referred to as "approved", the Contractor shall obtainwritten approval from the Principal Agent or the product or item,he intends to use in the Works, prior to ordering suchproducts/item or using such products/items in the Works. 245 Clause C1.8: Proprietary branded products

246 Clause C1.9: Labour record

At the end of each week the Contractor shall provide thePrincipal Agent with a written record, in schedule form,reflecting the number, description and citizenship of tradesmenand labourers employed by him and all Sub-Contractors on theworks each day. Item

At the end of each week the Contractor shall provide thePrincipal Agent with a written record, in schedule form,reflecting the number, type and capacity of all plant, excludinghand tools, currently used on the works. Item

248 Clause C1.11: Guarantees

Where guarantees are called for, the Contractor shall obtain awritten guarantee, addressed to the Employer, from the firmsupplying the materials and /or doing the work and shalldeliver same to the Principal Agent upon the certified finalcompletion of the contract.

The guarantee shall state that the materials, workmanship andinstallation are guaranteed for a specified period from the dateof certified final completion of the contract and that any defectsthat may arise during the specified period shall be made goodat the expense of the firm supplying the materials and doing thework, upon written notice of the Principal Agent to do so. 253 Clause C1.16: Testing and Handing over SpecialistInstallations

i) The Contractor shall satisfy himself that the installation is inaccordance with the specifications and any variations that havebeen issued, before requesting the Consulting Engineer toinspect the works.

ii) The Contractor shall at his own expense provide all testingequipment and materials for carrying out the tests.

iii) Prior to inspection the Contractor shall furnish the ConsultingEngineer with all wiring maintenance manuals, operationmethods of procedure, circuit drawings, etc.

iv) At taking over inspection, the Contractor will be issued with acertificate stating all defects of the installation or part thereof atthat time.

v) At "Taking over Certificate" will be issued once all defects (asmentioned in (iv) above) have been rectified.

vi) Only on issue of the "Taking over Certificate", will retentionbe reduced, the contract surety released and the guarantee andmaintenance period will commence from that date. Item

254 Clause C1.17: Drawings and dimensions

All drawings, wherever their origin, are to be issued to theproject site, or to any other person(s) only through the office ofthe Principal Agent, bearing the Principal Agent's officestamp.

The Contractor shall keep a date register of all drawings issuedat the project site at all times.

Any drawings not issued through the Principal Agent's to theproject site, will be used at the Contractor's own risk and shouldany work be incorrect due to the use of unauthorised drawings.Any rectification of work done in accordance with unauthoriseddrawings, shall be at the expense of the Contractor.

All drawings used on site must be properly mounted on suitablesheet material, or otherwise protected to the approval of thePrincipal Agent, and kept in good condition. Any drawingsthat become bleached or unreadable, must be returned to thePrincipal Agent for replacement. 255 Clause C1.18: Blasting

The Contractor shall take all responsibility during blastingoperations, should any be necessary, and must observe allconditions as set for and in the Government and Local AuthorityRegulations. The use of explosives is left to the discretion ofthe Contractor who must indemnify the Employer against anyclaims for damages to persons or property on or near theproject site, from any cause whatsoever arising out of the useof explosives.

The nature of the ground is assumed to be loose sandymaterial with a large content of clay, therefore "earth".

Classification of excavated material

ALUMINIUM FRAMES

NOTES:

Unless otherwise specified, anodising to aluminium must be aminimum of 25 micron covering thickness and must complywith requirements of SABS - Specifications 999.

Construction shall comply with the minimum performancerequirements contained in the relevant "Selection Guides" aspublished by the Association for Architectural AluminiumManufacturer's of South Africa (AAAMSA).

All sizes for windows and doors are overall sizes as indicatedon the Architect's drawings. All sizes must first be checked andverified on site before commencing with the manufacture of anywindows.

Action of windows, ironmongery of doors, etc., must be asspecified on the drawings.

Glazing to windows and doors must be as specified on thedrawings and fixed in frames in waterproofing mastic gasketswith glazing beads, or other approved method.

Prices for aluminium windows and doors must, amongst others,allow for manufacturing, protection during transporting, offloading, storing, setting up, building in, pointing between frameand plaster with an approved silicone compound, cleaning upon completion and commissioning to the complete satisfactionof the Principal Agent and/or Architect.

Where a specific manufacturer's paint products are describedin these Bills of Quantities the Contractor is advised that heshould price the specific product as specified and that he mayonly change from the designated product to another productafter written consent has been obtained from the Architect, afterthe closing of tenders. Where applicable the cost of suchsubstitution with another product shall be adjusted by theQuantity Surveyor in the Final Account for this project.

The Contractor shall apply all paints in strict accordance withthe manufacturer's instructions and after consultation with themanufacturer's authorised representative. Painting shall bedone by brush, roller or spraying as recommended by the paintmanufacturer (and at the descretion of the Contractor) toproduce a finish to the approval of the Architect.

No paint shall be applied during cold weather.

All materials for paintwork shall be brought onto the site inunopened containers and no adulteration will be allowed.

The area of paint measured is the nett area of the final paintedsurfaces and excludes for paint finishes behind joinery fittings,pinning boards, etc. Prices are to include for cutting to linearound such items or for painting behind such items ifpreferred.

Prices for paintwork are to include for all necessary precautionsfor the protection of finished work including masking or coveringall finished paintwork as well as all finished joinery, tiling, floorcoverings, etc. during painting. Any damage to such finishedwork shall be removed, repaired or replace at the Contractor'sown expense.

Prices for painting are to include for painting a one squaremetre sample panel of all finishing coats and for repeating ifrequired. Only after the written approval by the Architect of thesample panels may the finishing coats be applied.

The Contractor shall provide all necessary dust sheets, covers,etc. required during painting. All door handles, locks and otherironmongery, pelmets, electrical switch and socket covers, etc.are to be removed before commencing the painting and are tobe refitted after completion of the painting. All paint spots,stains, etc. are to be cleaned off all floors, walls, glass, doors,frames, fittings, etc. after completion of the painting.

Cellulose fillers such as "Aurora" and "Polyfilla" will not beaccepted. Plaster, concrete, fibre cement or timber surfacesare to be filled with "Polycell Mendall 90" or "Pera UniversalRepairing Compound" mixed with 30% marble dust in strictaccordance with the manufacturer's specifications.

Prices for painting on ceilings are to include for painting with astippled effect roller.

The nature of the ground is assumed to be loose sandymaterial, therefore "earth", but possibly interspersed with "softrock" or "hard rock".

Classification of excavated material

Hard rock shall mean granite, quartzitic sandstone or other rockof similar hardness, the removal of which requires drilling,wedging and splitting or the use of explosives.

Soft rock shall mean hard material the removal of whichwarrants the use of pneumatic tools and includes hard shale,ferricite, compact ouklip and material of similar hardness.

Earth shall mean all ground other than that classified as hardrock or soft rock and shall include made-up ground and anyloose stones or pieces of concrete not exceeding 0,03 m³ involume.

Descriptions of carting away of excavated material shall bedeemed to include loading excavated material onto trucksdirectly from the excavations or, alternatively, from stock pilessituated on the building site

The quantities of excavation, filling, carting away, etc.measured are the nett volumes and the Contractor is to makeallowances in his prices for the bulking of material.

The Contractor is to confirm in writing the reduced levelsof the site with the Quantity Surveyor and Engineer beforecommencement of excavations. No remuneration will beconsidered for excavation to incorrect levels.

NOTES:

1. The Specialist Contractors (hereinafter referred to as theSub-contractor) will be an ordinary Sub-contractor of the Maincontractor and will NOT be a Nominated Sub-contractor.

2. Provisional Sums have been included in this Bill to cover thecosts of such various specialist services as may be required.These amounts are NETT and do not include for any buildersdiscount.

3. Provision has been made in this Bill to allow the Maincontractor the opportunity to price for any profit so required onthe nett cost of the various specialist installations and theseitems for profit will be adjusted in the final account in directproportion to the final values of such installations.

4. A further item has been included to allow the Maincontractor to price for attending upon the Sub-contractors andthese items will only be adjusted in the final account if theextent of such installations either increases or decreases.
