Financial Report: The 3/31/2018 financial statements will be sent in prior to our April 16 presentation, or will be presented at that meeting.

Annual Report to County: Valeo Board Chairman, Frank Henderson, will make our Annual Report to the Commission on May 21 51 on behalf of the Board.

KDADS Task Force: Last fall, I was appointed to serve on this task force by Sen. Hensley. Our work concluded prior to the start of the '18 Legislative Session, and a report was generated by the Secretary. This report has been widely reviewed and relied upon as guidance in public policy for behavioral healthcare.

Grant-Writing/Fund-Raising/Information:

• We fully executed an agreement (1/1/18 through 12/31/18) with KDADS that provides $500,000 for The Residence, our community crisis center; a 24/7/365 walk-in facility at 400 SW Oakley Avenue. These dollars go towards professional security, improved access to psychiatric medication, and other enhanced services. It also covers about 18% of the cost of serving the un-insured/under-insured at The Residence. Current estimates reveal that serving the un-insured at The Residence costs an average of $73, 153/month. This award also allows us to expand our Co-Responder Program to 24/7. The Co-Responder Program is a partnership between Valeo and the Topeka Police Department, and also involves the Shawnee County Sheriff's Officers as needed.

• Our znd Annual Fund-Raiser, "Un-Masking Stigma", will be October 20 at the Capitol Plaza Hotel, and will feature Jennifer Ayers-Moore, sister of Nathaniel Ayers, whose struggles with mental illness were portrayed in the movie, "The Soloist". Back by popular demand will be last year's emcee, Melissa Brunner, and live mask auctioneer, Matt Pivarnik!

• May is "Mental Health Month". Valeo and its affiliates will be getting a great deal of information out to the community about mental health problems and mental illness.

Local Collaborations (just a few highlights):

• We're actively involved with a violence prevention initiative sponsored by the Peace and Justice Center.

• We serve on the Mayor's Task Force Against Domestic Violence.

.. • I've been appointed as a Section Leader for Freedom Now USA. We'd like to say "Thank

You!" to the Commission for your active endorsement of this first-of-its-kind movement, and to The Rescue Mission for taking the lead on this.

• We're also active with an effort organized by Police Chief Cochran and Fire Chief Duke to develop a Para-Medicine program.

• We helped initiate a very successful drug take-back day last summer, and are partnering in preparation for another one this coming July.

• In partnership with The Rescue Mission and other organizations, we were active again this year with the "point in time count" of persons who are experiencing homelessness.

• We commend the efforts of the Shawnee County Health Department regarding their work on producing valuable health-rankings and health outcomes data. Their presentation on April 9, sponsored by Heartland Healthy Neighborhoods and TSCPL, raised issues and awareness, and, amongst many other trends, noted the importance of mental health and social/environmental factors in one's personal health and the health of a community.

• We continue our work with numerous other groups focused on expanding Medicaid/KanCare.

• A Valeo team has been working closely with The Hon. Lori Daugherty-Bichsel, and other professionals in the municipal court/legal system, to make improvements in the Alternative Sentencing Court (ASC) Program. The ASC Program is designed to provide an opportunity for recovery from mental illness and/or addiction for eligible persons charged with certain offenses, and is partially supported by a grant from the City of Topeka and KDADS. We would also like to take this opportunity to state that both the City and County court and legal system, as well as law enforcement, are working more closely than ever with Valeo to promote recovery in the community vs. in a psychiatric hospital.

Public Policy: We're watching HB2517 (lottery vending machine bill) that, if enacted into law, would provide funding specifically for community crisis centers, such as The Residence here in Topeka.

Purpose: Board of Commissioners acceptance of the attached documents from the February 2018 Shawnee County Parks + Recreation Advisory/ Advocacy Board Meeting is requested.

Justification: Highlights of the February meeting include Deferred Maintenance, appointment of Mr. Ping Enriquez (County District 3), Board Diversity, committee reports and public comment as noted in the supporting documentation.

The Shawnee County Parks + Recreation Advisory/ Advocacy Board was formed through Contract 304-2011 and 313-2011. The Board was organized exclusively to provide input, assistance, feedback and support to the department and its Director, as well as provide advice and information to the Board of County Commissioners of the County of Shawnee, Kansas, and provide the public an avenue for input and feedback as well.

The scope of the board's purpose is to provide advisory and advocacy input only and it shall not retain any binding authority over final decisions by the Director and/or the Board of County Commissioners of the County of Shawnee, Kansas.

Aquatic Centers/Community Pools/Splash Pads Shawnee County Parks + Recreation is responsible for:

3 Aquatic Centers (Blaisdell, Shawnee North and MidWest Health) 2 Splash Pads (Domwood and Samuel Jackson) 4 Community Pools (Garfield, Hillcrest, Oakland and Rossville)

Annual projects at these aquatic facilities will be identified and scheduled to allow for appropriate

painting of pool basins, repair of concrete decks and basins, renovation of features such as slides and

other amenities, as well as other building renovations. Each aquatic facility involves a highly complex system of piping, valves, pumps, disinfection equipment, etc. The need to maintain the highest water quality at each of these facilities is a life-safety requirement for their continued operation and

generation of revenues.

Annual cost of painting pools could range from $30,000- $60,000. Other scheduled maintenance would include resurfacing or replacing slides at these facilities with

annual costs ranging from $10,000- $100,000 or more depending on what is done and which slide or

amenity is worked on.

Each of the aquatic facilities has a full complement of restroom facilities, guard offices and concession area. Restroom fixtures, partitions, surfaces, etc. are old and in need of replacement and renovation. Cost for this type of work could range from $5,000 at one of the smaller newer venues to

as much as $75,000 at a facility like Blaisdell where the restrooms are in need of a full renovation.

Carpeting/Flooring/Painting Shawnee County Parks+ Recreation are responsible for 157 buildings. Each of the buildings needs to be regularly painted inside and out and flooring, whether carpet or tile, replaced when it becomes worn. There are 9 community centers with a total of 114,4 7 6 square feet of space, 161,625 if you include gym space. These centers as well as other buildings like the Administrative Offices, golf course pro shops, mini-train depot, and all of the shelter houses need regular care to keep them in good condition for our patrons and visitors.

Water Quality Water quality is a concern in any large park system with bodies of water. It is especially a concern to Shawnee County Parks + Recreation not only for our signature location Lake Shawnee but also for smaller bodies of water throughout the park system such as Westlake in Gage Park, Clarion Woods Pond in Clarion Woods Park, Central Park Lake in Central Park and others. Each of these areas has their own special and particular concern but each centers on water quality. We know that several of our waters, especially Lake Shawnee, have an ongoing problem with the invasive aquatic plant Eurasian Milfoil. Intervening years between the treatment at Lake Shawnee the department should plan on aggressively managing water quality issues through a combination of in-house work and the application for grants for best management practices related to water quality. -

Central Park Pond, miscellaneous bio-swales. Milfoil treatment, silt and solids removal from harbor area, design, pump replacements and excavation of areas at lake Shawnee.

Lake/Beach Access Facilities Access to Lake Shawnee and amenities like the swim beach and the marina mean the care and maintenance of docks and ramps. Improved access to the water also means the addition of ramps at currently underserved locations. An allocation of $25,000 every other year will allow parks + recreation to replace old docks and ramps and add new ones

to keep them up to date and fully functional.

Landscaping Shawnee County Parks + Recreation maintains many landscaped areas including the Ted Ensley

Gardens at Lake Shawnee, The Old Prairie Town Botanical Garden, the Reinisch Rose Garden in Gage Park and many individual landscaped areas throughout the park system. Landscapes grow

old and need rejuvenated from time to time so there is an ongoing need to purchase replacement plants. Hardscapes at gardens and landscaped areas have a lifespan so from time to time new walls need to be built, pergolas repaired, furniture replaced, etc. Also, many of our landscaped areas do not have an automatic irrigation system requiring staff to spend many hours during the season moving and setting up hoses to keep the beds watered. The addition of irrigation systems is a must

that will free up staff to take care of other issues. Allocating up to $75,000 per year will allow the department to keep up with the needs and refurbish landscaped areas keeping them fresh for our

patrons.

Parks and Playgrounds Shawnee County Parks + Recreation has a strategy that states, "In existing parks, upgrade aging park amenities, add new improvements and provide quality maintenance based on community expectations, departmental maintenance standards, budget parameters, and available park capital improvement funding. " To accomplish this strategy the removal and replacement of aging playground equipment and surfacing is essential. In playgrounds where older equipment is detached, the department will also replace and/or combine elements into a single contained edge facility with fall zones for all playgrounds and apparatus. The department additionally will install walkways connecting these areas and provide sufficient trash receptacles throughout parks and provide tamper resistant connections to deter theft of these cans.

Park Roads and Parking Lots Shawnee County Parks + Recreation maintain _ miles of asphalt roads and _ square feet of parking

lots throughout the park system. The department budget for road and parking lot repairs is $20,000 for in-house repairs and approximately half that for contract work. That amount obviously barely makes a

dent in the ongoing needs to maintain our roads and parking lots. Parks + Recreation should, on an annual basis, make road repairs and mill and overlay parking lots to ensure that all roads and parking

lot are in good shape on a consistent basis. The work needs to be done on a rotating basis so that at the end of a pre-determined period all roads and parking lots are refurbished and the process starts over. The initial work needs to be accelerated so that the worst roads and parking lots can be done first, at

one time. It should be pointed out that some parking lots, Lake Shawnee Swim Beach parking lot, are in such bad shape that it needs to be completely replaced and curbs and lighting added as part of the

project. There are other parking lots like this throughout the system.

Sign age Shawnee County Parks + Recreation has developed standard sign type and style to assist in developing a brand for the department In addition there are a number of electronic message centers throughout the system that need updated and other parks that are in need of an electronic message center. Neighborhood parks, community parks and regional parks will each have a standard sign type. Natural areas will have enhanced signage that will be interpretive in nature describing to visitors what they are seeing. Community Center System Assessment: Since the consolidation and assumption of the responsibility for all City and County parks and recreational facilities, the department has operated and maintained the existing system of nine (9) community centers located throughout the City of Topeka and Shawnee County. Proposed for the community center system by the Master Plan, indicated the potential for substantial ($9 M) capital re-investments for all centers. However, these CIP proposals appear to be mainly based on the physical nature of the existing facilities and not associated with any type of future programming needs, increased patron use, or visions for future operations. The Recreation Center Study was approved by the Advisory/ Advocacy Board last fall.

Restroom Renovation There are a minimum of 7 5 restroom facilities throughout the park system. These include stand alone restrooms, restrooms in shelters, community centers, aquatic facilities and restrooms

associated with sports facilities. The restrooms in aquatic centers and community centers are being addressed elsewhere in this plan. These renovations will focus on the stand alone

facilities and the facilities that are associated with shelters and sports facilities. In many cases these restrooms are old and out dated and in serious need of a facelift. This work will range from $10,000- $25,000 per facility depending on size ofthe facility and the scope of the work. Work would generally include replacing fixtures, partitions and surfaces.

Sidewalks/Trails Currently the department manages over 27 miles of concrete trails with more being added annually. In general these trails are in good shape but there are at times needs for repairs to damaged and broken slabs as well as an ongoing need to create connections from trails to park amenities. Sport Court Resurfacing The department is responsible for 82 outdoor sport courts throughout the park system. These include tennis, pickleball, basketball and one accessible baseball diamond. Most of these courts see significant use. Generally you can expect to resurface on a 6-8 year cycle. Kossover Tennis Center, an 18 court tennis complex, is currently being resurfaced at a cost of $104,000. That works out to $5,777 /court. An allocation of $62,000/year for sport court resurfacing will allow the department to stay on a 7 -year resurfacing cycle. The amounts needed per court may reach $10,000 -$12,000 if foundation or subsurface needs become necessary. Additionally the department is conducting a review of existing sport courts for removal or repurposing unproductive sport courts and sport fields where deterioration is seen and return to open parkland that is less expensive to maintain.

Sport Turf Replacement Shawnee County Parks + Recreation currently have six baseball infields that have artificial turf infields. The oldest Jerry Robertson was replaced this winter. We also manage an artificial ~multi­purpose field that is used primarily for soccer. A typical life span of artificial turf infields is 6-8 years of use. The lifespan of an artificial turf field can be somewhat dependent on amount of play and type of play. There have been discussions between parks + recreation and some user groups about adding to the number of artificial turf infields by converting some of our conventional surface infields to artificial turf. The presence of artificial turf increases playability in inclement weather and reduces day-to-day maintenance needs of the facility. Sports turf in numerous other applications other than artificial, likewise need renewed and refreshed periodically as well.

Tech noloi!VIIT Shawnee County Parks + Recreation are behind our peers in terms of technology capability in parks and other facilities. There is an identified need to upgrade department capacity in allowing

park patron's access to Wi-Fi, charging stations, computer access at facilities, etc. The Shawnee

County IT Department does no~ have the funding necessary to assist in the cost of such

improvements. There is also a need to exten4 fiber capacity to a number of existing department facilities. Again, the IT Department does not have the funding for this and at this point the parks +

Recreation Department does not either. Significant cost savings as the department transitions from

print program guides to on-line guides. Additional transition of registration from mail-in and call- l

in to on-line will see a savings is personnel. Increased efficiencies and accountability will also be

realized with periodic implementation of point-of-sale systems.

Roberts - to Knight - if it doesn't get to the amount you have to have, are we going to lose viability of something?

Knight- Not yet, it would not be hard but it is not finished.

Roberts - I would like to see from a health and safety standpoint that we identify the essential­water, ADA, liability, whatever it may be; not that all of the requests are not important but public safety needs identified. I would like it to be identified. How does the County not know how much money they have left over?

Knight - the best way I can explain that is they still have bills coming in so they should know more in March.

Ledbetter- on prioritization, we have to do ADA requirements when a center doesn't have an elevator, buckling trails is a health and safety issue, roofs leaking like in Ward Mead Park, artifacts in danger of being ruined, plus possibilities of mulch I consider health and safety so I would like all ofthat included in the prioritization.

Roberts -just so I am clear, health and safety highest priority, then 2nd level or pending liability issue would be a leaking roof.

Martin - a second potential for amending the motion, it appears there is additional funding for deferred maintenance; Expo is working with $45 million in improvements so another $2 was going to Expo but because P+R has no dedicated funding source, I would appreciate it if this board goes on record that our preference would be that the full $6 million goes to SCP+R in lieu of Expo getting any additional funding above $45 million already allocated. My motion is that this board go on record that if they do put out $6 million, it goes to P+R and nothing above the allocated funds go to the Expo. Second by Ledbetter.

Roberts - I was at the Expo Advisory board meeting. Lots of info about bonding and wondering and how that place can be energized. Where the additional $2 will go? Equestrian?

Martin- No, a chiller and other things were identified to be done quickly once excess funds were made available. The Expo is already getting major money to improve the site. I am all in favor of the expo getting improved but to come up with immediate needs that have been known for some time is not right. This system serves the entire County. You can see clearly by this report that excess funds need to go to P+R. One commissioner is not in favor of it at all. A horse barn is a whole separate deal. It needs weighted as to what they need versus what they can do.

Ketterman - So, for what we are discussing here, we know that $2 will probably go up as well.

Martin - This board is not anti Expocenter but as a Board we should support a funding source.

Ledbetter - In 2015 I went to the county budget meeting after I walked through the Expo and I

specifically asked for a line item and the board gave a quarter of a million dollars for deferred

maintenance and it passed for '16, '17, and in '18 it wasn't as much but something like $100,000

for deferred maintenance, just at the Expo. So they should be able to squeeze a lot out of $45

million.

ADA is a Federal Law and the North request has been out there for years. This is a good list.

They could use revenue bonds if they needed additional funds that P+R doesn't have access to at

this time.

Roberts - the 1st menu item by the Expo of what to get done with the allocated $45 million was

the HV AC so it is already marked to be done! What is a good term as this is

borderline ... encroachment. My point is that P+R is entitled to the $6 million as this is a balanced

approach.

Polly- I am uncomfortable voting without some sense of verbiage.

Martin - read his drafted letter stating strong opposition to allocation of additional County funds

when P+R needs are so great and a dedicated funding mechanism is not available.

Polly- Voting on the 2nd motion of supporting this letter drafted by Martin; Unanimous

Roberts -Please inform the board as to when this will be presented at the commission meeting.

Ledbetter - Just a question, how do we tell people who to appoint? Include education and

background in order to be diverse. You need to include everything.

Ketterman - Talk to friends, neighbors those around us and get more diversity on this board by

giving them names. Just show an interest without being college graduates and help the County.

Roberts- Not just color ofyour skin but socioeconomic status should play a role in recruitment.

Miller- I use this as an example, met with John, Cook, and these ladies built this park as they

were promised that someone would get back with those present before the restroom was removed without notice. Wants to serve as an example because they were not listening to us. Don't want it

to happen again.

SUBJ: Land Garden Fact Finding Summary Report

Background Lane Gardens is located on the NE comer ofSW 12th Street and SW Lane Street in the Tennessee Town NIA. This parcel was not transferred to the Shawnee Country Parks and Recreation (SCRP) from the City of Topeka when consolidation occurred. The Tennessee Town NIA has over time, since 1980 provided upkeep, provided and maintained planters and benches through their NIA volunteers. On a previous occasion, they requested the Shawnee County Commission to accept the parcel of land into the SCPR system, and this failed. The Tennessee Town NIA on two previous occasions submitted SORT grant requests to fund the Lane Park upgrades, and these failed to be approved due to the maintenance responsibility issue.

Historically speaking, the Tennessee Town has a rich and vibrant history in our community. The earliest residents of Tennessee Town were newly freed slaves who migrated from the South to the West as part of the Exoduster Movement. Some of them, who left plantation life behind in Tennessee, arrived in Topeka in 1879 on what was then the western edge of the city, in an area known as King's Addition. After arriving in Topeka and establishing Tennessee Town, the settlers built homes, businesses, schools and churches, making Tennessee Town one of the centers ofTopeka's African-American community. The 1880 Topeka census identified 880 blacks in the city, comprising 31 percent of the city's population. Lacking financial and city support to aid their efforts to settle here, living conditions were less than those of the rest of the city. However, during the 1890's, Tennessee Town residents began to garden and trade produce for clothes and other necessities. Soon after, businesses, schools and churches began to dot the Tennessee Town landscape. Also during the 1890's, the first white man to show any real interest in Tennessee Town, Dr. Charles Sheldon, came into the settlement from his post as pastor of Central Congregational Church, which still stands at SW Huntoon and Buchanan Street. He spent three weeks in Tennessee Town surveying the people and conditions. He found that there were about 800 people who had migrated here directly after leaving behind plantation life in the South, 1 00 children between the ages of three and seven who might be considered kindergarten age, and four black churches. Sheldon thought that Jordan Hall would be a good place to start a kindergarten, and by the spring of 1893, the first black kindergarten west of the Mississippi River was opened. By the early 1900's, four churches had sank roots in Tennessee Town: Shiloh Baptist (still on the southwest comer of 12th and Buchanan Streets), Mt. Olive Episcopal (now Asbury-Mt. Olive United Methodist Church, on the northeast comer of 12th and Buchanan Streets), The Church of God (now Lane Chapel, at 12th and Lane Streets), and the Christian Church (now Dovetail, at 12th and Washburn Streets). The Colored Women's Club was also founded at about 8 that time. It occupied the house at 1149 SW Lincoln St. until a few years ago. The Topeka nonprofit Living the Dream, Inc.'s headquarters now occupy the clubhouse During the 1970s Tennessee Town experienced the first rumblings of a renaissance. The Community Development Block Grant Program, through the U.S. Department of Housing and

Urban Development, began in Topeka in 1974. CDBG funds began to come to Topeka as an entitlement to poor neighborhoods like Tennessee Town. In 1976, Tennessee Town became one of the first Neighborhood Improvement Associations in the city. A group of Kansas State University architecture students came into the neighborhood in the early 1980's to conduct a semester-long inventory of housing. The results of their work were impressiv~, including recommendations for in-fill housing that included actual prototypes. At about that same time the neighborhood began working with Topeka Metropolitan Planning on a comprehensive look at Tennessee Town, including housing, infrastructure and safety issues. A comprehensive manual was compiled, along with an executive summary.

Request Shawnee County Commissioner Cook requested that the SCPR Advisory Committee review the Land Garden issue. Terri Roberts, SCPR Advisory Committee Vice Chair was appointed Chair of the Lane Garden Task Force, with Shari Black, Mike Morris and LJ Polly also. Information was shared and collected electronically from the Tennessee Town NIA President, Mike Bell, SCPR, and Karen Hiller, Topeka City Council Member representing the area of the Lane Gardens. A face-to-face meeting was held December 7th with the Task Force members, and Mike Bell and Karen Hiller were present. Views and suggestions were exchanged and a final meeting was held to review this Fact Finding Summary Report.

Tennessee Town NIA Position The Aaron Douglas Art Park, which is a mural and is only used once a year for the Art Fair is considered a park worthy of attention while Lane Garden, in existence since the early 1980s and the neighborhood's only recognized green space for the vast majority of that time, is not. At one point, Lane Garden had a sign, benches, and planters, among other amenities. Time and the City's refusal to make improvements and the county's refusal to recognize its oversight during the department consolidation discussed above have not been kind to the park. The NIA is mindful of how quickly the county brought the Aaron Douglas Park under its umbrella while ignoring Lane Garden.

SW 12th and Lane Streets border both Lane Garden and the Aaron Douglas Art Park. The argument "there is no connectivity for this parcel as main ruteries pass on the south and west of the parcel" is not used against Art Park and this disparate treatment is of concem to the Tennessee NIA. Additionally, SW 12th and SW Huntoon Streets ru·e slated for improvements as a part of a recently passed half-cent sales tax. SW 12th Street connects to the previously cited "lineru· park" in Elmhw·st and SW Lane and Washbum Streets are arterials that lead to Washbum University, Central Park Community Center, Lowman Hill Elementary School, the Topeka and Shawnee County Public Library, Stormont-Vail HealthCare and St. Francis Hospital. The "demographic need" is contained within the Tennessee Town NIA, a low-to moderate-income neighborhood which has had Lane Garden as its only recognized greenspace for decades.

The Tennessee NIA has requested assistance in covering the parcel from a liability perspective, so that in 2018-2019, they can move forward with SORT grant monies and volunteers to provide Lane Garden with amenities that would significantly improve the parcel and contribute a well-manicured green space to their community.

Shawnee County Parks and Recreation Departments Position The Individual Management Plan Committee recommended recently (September,2017), to refuse Lane Garden parcel due to it not being in the best interest of the SCPR to accept the parcel. The

Justification included that the vision of the adopted Master Plan is to acquire parcels based on the strategies for land, and that this parcel of land falls outside the recognized criteria. Strategy: 1.10 Identify and acquire land to preserve and enhance access to natural resources, open spaces, and outdoor recreation. Tactic: Identify and aggressively pursue properties/parcels that are adjacent to major regional/community parks.

~ The parcel does not meet any of the criteria in 1.1 0, nor any of the criteria in the tactic. Nearby but not adjacent park properties include- specialty park (Aaron Douglas Art Park), Hnear park (Elmhurst Green), and Neighborhood/Community (Central Park). This parcel does not meet the criteria of 1.1 0, "Identify and acquire land to preserve and enhance access to natural resources, open spaces, and outdoor recreation."

• There is no connectivity for this parcel as main arteries pass on the south and west of the parcel. ·

• There is no demographic need to connect to this parcel.

• The department would need to spend significant funds initially to meet the approved maintenance standards and annually to maintain the park into the future.

• The parcel needs to have a genuine purpose and that purpose must create value and align with SCP+R goals and objectives. It may add beautification to the neighborhood, help solve an abandoned home issue but neither are primary functions for Parks + Recreation.

• This parcel has been offered to the department before and has been rejected.

• There are numerous public and private lands within a half mile radius (national standard) that have amenities of which duplication would occur such as greenspace, landscaped areas, play structures for youth, sitting areas for adults and other specialty purposes.

• Based on park classifications throughout the system, acquisition would increase the imbalance in existing Shawnee County quadrants (MacVicar and SW 21st Streets as dividers)as detailed below:

Preserve the greenspace of Lane Garden, utilizing it as a garden, perhaps with recognition for a past City contributor Marge Henney & Keep America Beautiful through educational and peaceful destination or stopover contributions for naming rights. The targeted audience would be the passerby's residents within the neighborhood of all ages and abilities. With an endowment created, this could support underwriting for maintenance, and trash pick-up and the minimal mowing. From the educational perspective the Lane Garden could be nature focused with Kansas flora and fauna, to support butterfly flyways, plant/insect and bird relationships. Support the NIA in obtaining the connecting property to the north east, to expand it slightly.

Land Gardens Task Force Assessment

Neither the City of Topeka or Shawnee County are receptive to making Lane Garden a "park" at this time. However, we do after a discussion about reducing blight, improving green space and visual appearances within the City neighborhoods, want to recommend that the Tennessee Town NIA be supported in their attempt to use SORT grant money to provide amenities for this parcel to enhance the green space in their community.

Showtime Women HD channel 2421 Showtime Family Zone HD channel 2422, Showtime 2 HD channel 2416, Showtime Next HD channel 2420 and The Movie Channel Extra HD channel 2424 will be added to the Showtime lineup. Movie Max HD channel 2411 will be added to the Cinemax lineup. Showtime 2 SD West will no longer be available on channel433.

PETITION FOR FORECLOSURE OF MORTGAGE

COMES NOW, Plaintiff, Wells Fargo Bank, NA, and for its cause of action against the

Defendants stales as follows:

1. Plaintiff is a corporation duly organized and existing by virtue of law.

2. Venue is proper in this District by way of the subject matter, i.e., the foreclosure of a

mortgage on certain real estate located in the County of Shawnee, State of Kansas.

3. On or about December 29, 2014, Nelly Martens [hereinafter "Borrower(s)"] borrowed money

from, executed and delivered to Wells Fargo Bank, NA, a Note, payable in monthly

installments, in the original principal sum of $56,708.00, together with Interest as stated. A true

and correct copy of the Note is attached and Incorporated by reference as if fully set forth as

Exhibit 1.

4. As a part of the loan transaction and in order to secure payment of the Note, Borrower(s)

executed and delivered to Wells Fargo Bank, NA, a Mortgage of the same date upon the

following described real estate:

THE LAND REFERRED TO HEREIN BELOW IS SITUATED IN THE COUNTY OF

SHAWNEE, STATE OF KANSAS, AND IS DESCRIBED AS FOLLOWS: LOT 5, BLOCK 5,

WESTVIEW HEIGHTS MANOR, A SUBDIVISION TO THE CITY OF TOPEKA, SHAWNEE

COUNTY, KANSAS.

known and numbered as 2517 SW Moundview Drive, Topeka, KS 66614. The Mortgage was

duly recorded on January 12, 2015, in the Office of the Register of Deeds of Shawnee County,

Kansas, In Document No.2015R00395. The Mortgage tax was paid. A true and correct copy of

the Mortgage is attached and incorporated by reference as if fully set forth as Exhibit 2.

5. Wells Fargo Bank, NA is the current legal holder of the debt, and possesses all rights,

including the right of enforcement of the Note and Mortgage.

Purpose: Board of Commissioners approval is requested on the attached docume:qtS' as required by the Kansas Department of Agriculture, Plant Protection and Weed Control.

Justification: Pursuant to Kansas Statutes Annotated (KSA) 2-1316(d), the boards of county commissioners, governing bodies of cities and township boards, with the aid of their weed supervisors, shall make by February 15th each year an annual weed eradication progress report to the secretary of agriculture for the preceding calendar year, on a form supplied by the secretary, and such other weed reports as established by rules and regulations of the secretary of agriculture.

Pursuant to KSA 2-1317, the county commissioners and the governing body of cities, shall report to the secretary of agriculture as to the extent and the official methods of control and eradication of noxious weeds to be undertaken in any one season in their jurisdiction, subject to the approval of the secretary.

MISSION STATEMENT

The Shawnee County Weed Department enforces the Kansas Noxious Weed­Law K.S.A. 2-1314 et seq. and the Nuisance Weed & Rank Grass Resolution H.R. 2005-3 for Shawnee County. The Shawnee County Weed Department is also indirectly responsible for the control of noxious weed infestations on all county owned property and right-of-way and contracts with local governmental entities to fulfill their responsibility in complying with the· Kansas Noxious Weed Law.

Shawnee County Weed Department

SERVICES I DAY TO DAY FUNCTIONS

The Shawnee County Weed Department is directly or indirectly responsible for the control of noxious weeds in Shawnee County. The Kansas Noxious Weed Law K.S.A. 2-1314 et seq. requires all persons who own, or supervise land in Kansas to control and eradicate all weeds declared noxious by legislative action. The department's primary role is to enforce the Kansas Noxious Weed Law and the Nuisance Weed & Rank Grass Resolution H.R. 2005-3 for Shawnee County. The department acts as a liaison between landowners to control these spreading noxious and nuisance weed infestations. As a regulatory agency, the Shawnee County Weed Department enforces weed control on private property, and provides noxious weed control for most public properties in Shawnee County. Shawnee County uses a three-prong approach to encourage landowners to comply with the noxious weed statute and the county resolution. Those prongs are Education, Enforcement, and Control.

Education: The Shawnee County Weed Department strives to educate and provide information to landowners on the regulations and the benefits of weed control and property management in a professional and courteous manner.

The Weed Department maintains a website with program descriptions, control options and contact information.

Educational brochures and training materials for noxious weed control and pesticide use are available and on display at the warehouse and office.

The Shawnee County Weed Department sponsored an educational display booth at the Kansas Lawn & Garden Show, the Topeka Farm Show, each held at the Expocenter annually, an educational presentation and appreciation breakfast for all state & county officials, county department and township officials and at the Gage Zoological Park on Earth Awareness Day.

The department offers plant identification and control recommendations for non-noxious weeds (i.e., poison ivy, brush, lawn weeds). This service is utilized by many of our Shawnee County residents.

In conjunction with the KSU Extension Service, the Weed Department publishes monthly inserts in their newsletter.

The Shawnee County Weed Department has an excellent working relationship with other governmental educational agencies such as the KSU Ag Extension Service and the Natural Resource Conservation Service.

The Shawnee County Weed Department conducts pesticide training seminars and other educational field days. The department conducted 1 area wide plant identification seminar and spoke to 9 additional clubs & organization groups in 2017.

The department communicates the value of noxious weed control and weed management at garden clubs, extension programs, and to FFA and 4-H youth at the Shawnee County Fair.

Enforcement: The Shawnee County Weed Department encourages compliance with the law by offering incentives for proper weed management. As required by the Kansas Noxious Weed Law, the Shawnee County Weed Department provides cost-share chemical control to landowners. Landowners receive the controls at approximately 75% of the departmental cost.

The Shawnee County Weed Department maintains a warehouse and sales counter to provide cost-shared herbicide controls and rental equipment to landowners. The rental sprayer program is a very popular service for property owners that do not have their own spraying equipment.

Our department strives to take a proactive and deterrent role in performing our regulatory duties and therefore, out of literally hundreds of noxious & nuisance weed investigations, the county weed department only forced action on fewer than 50 landowners.

The Shawnee County Weed Department is responsible for enforcing noxious weed control on private and public property in all areas of Shawnee County, and acts as a liaison between neighbors with invasive noxious, or nuisance weeds near property boundaries.

Landowners failing to control the noxious, or nuisance weeds within the time period allowed may result in the county treating the weeds at the landowners expense and placing a lien on the property if the bill is not paid within 30 days, or filing criminal charges for non-compliance.

'The Shawnee County Weed Department routinely contacts salvage yards, businesses, storage fadlities, and construction equipment lot owners to utilize the cost-shared herbicide program to rid their properties of noxious and other nuisance weeds.

The Shawnee County Weed Department routinely contacts cemeteries, golf courses, and caretakers of large manicured grass areas to utilize the cost­shared herbicide program to rid their properties of noxious and other nuisance weeds.

Control: Government must be a good steward of land, and just like private property owners, is required to comply with the weed control laws. The Shawnee County Weed Department works diligently to keep the property and rights-of-way of the public, in compliance with the Kansas Noxious Weed Law.

The Shawnee County Weed Department controls invasive and noxious weeds on county property and R-0-W; all state highway R-0-W in Shawnee County; City of Topeka Parks; R-0-W in Auburn, Dover, Grove, Menoken, Mission, Monmouth, Rossville, Silver Lake, Tecumseh, Topeka, and Williamsport Townships; Tri-County, Kaw River, North Topeka, and City of Topeka Drainage Districts, and Wakarusa River watershed lakes in Shawnee, Osage, and Douglas Counties.

Every city street and right-of-way in Shawnee County, including the City of Topeka, is inspected for noxious weeds at least once and typically three times, during the summer growing season.

Our weed control crews are working diligently to control and curtail weed infestations any day wind speeds allow, the ground is not frozen, and/or the air temperature is above 30 degrees. Normally, these conditions occur between March 1st and December 1st.

The Shawnee County Weed Department inspects real and personal property, feed and forage crops, and topsoil extraction sites in Shawnee County for noxious and nuisance weeds.

The Shawnee County Weed Department encourages the use of bio-control agents and holistic weed control practices. Bio-control agents to control Musk Thistle and Field Bindweed have been released within Shawnee County.

FACILITY AND MAJOR EQUIPMENT

The Shawnee County Weed Department's office, equipment shop, and warehouse are located at 2044 SW Western, Topeka, Ks. This is on the southwest corner of the Expocentre grounds in central Topeka. The office, warehouse, and cost-share sales counter are available to the public Monday through Friday, 7:00a.m. to 5:00p.m. year around.

The following is a list of major equipment housed at 2044 SW Western and used by the Shawnee County Weed Department.

FACTS & FIGURES

Noxious weeds can and will grow on any property without regard to size, location, or ownership.

There are 12 plants listed as "Noxious Weeds" by the Kansas Noxious Weed Law. Four grow readily in Shawnee County, Three are in small, localized infestations, and five are not known to exist in Shawnee County.

As of Jan, 1 2017, there are , 75,672 different landowner parcels, approximately 556 square miles, or 355,840 acres in Shawnee County.

In 2017, the Weed Department controlled noxious and invasive weed infestations on 2300 miles of Township, City, County and State/Federal Right-of-Ways, 45 miles of drainage levees, 40 acres of sewage treatment district property, and 20 District Watershed and causeways lakes along the Wakarusa River in Shawnee, Osage, and Douglas Counties.

The Weed Department maintains a mailing/service list of over 10,000 names of landowners, operators and businesses in the County.

The Weed Department had a 2017 property tax supported operating budget of $286,604dollars. The remaining portion of the budgetary expenses is funded by outside weed control contracts, sprayer rentals and reimbursable herbicide sales. The 2018 budget is $294,057.00. +.A'/- Sl)fP~ Cf~.r~~,

In 2017, the Weed Department assisted ove ~hrough sales, and. walk-in, or telephone inquiries. Annual revenue from chemical sales, sprayer rental and contract work totaled $268,473.

In 2018 the Weed Department will again partner with Shawnee County Parks and Recreation to provide equipment and labor for the purpose of noxious weed control in the 115+ 'public use' parks in Shawnee County consisting of over 640 acres.

Justification: On August 14, 2017, a project budget, W04803, was approved by the Board of Commissioners to renovate the Hillcrest Family Aquatic Center for the first time since 1997. On September 18, 2017, the department received approval from Betty Greiner, Director of Administrative Services identifying this purchase as a sole source.

RE: Memorandum of Understanding- Kansas Children's Discovery Center Recreation - Programs

Purpose: Board of Commissioner authorization and execution on the attached Memorandum of Understanding between Parks+ Recreation and Kansas Children's Discovery Center (KCDC) is requested. The MOU reflects collaboration on the Serious Fun Mondays program where Chesney Park is the chosen site for children to gather for healthy lunches and resources necessary for opportunities of physical and social growth. Minimal operating expenses will be absorbed by Parks + Recreation operating budget.

Justification: Collaborating on efforts to address local childhood hunger and stimulate youth through a healthy play environment are key components for these children to be given opportunities for normalcy. KCDC provides their services with SCP+R serving as the host site and together create a shared level of equity that meets the service provider partnership criteria.

KCDC is a nonprofit that served 484 lunches during the 2017 summer months. This positive impact has helped Kansas improve a few spots from 48th in the nation according to the Food Research & Action Center's report. The parties wish to continue such collaborative efforts to promote park usage where civic pride and resources may help eliminate social inequalities.

A MEMORANDUM OF UNDERSTANDING BETWEEN SHAWNEE COUNTY AND THE KANSAS CHILDREN'S DISCOVERY CENTER FOR THE SERIOUS FUN MONDAYS MEAL PROGRAM AT CHESNEY PARK

TIDS Memorandum of Understanding is made this day of ______ , 2018, between the Kansas Children's Discovery Center and the Board of Commissioners of the County of Shawnee, Kansas, hereinafter referred to as the "County."

WHEREAS, the County is the owner of Chesney Park and operates the public park and facilities located therein for the recreational use by the public and patrons of the park; and,

WHEREAS, Children who are hungry are at an increased risk of demonstrating negative behavior; and

WHEREAS, Kansas ranks 45th nationally in the number of children participating in summer meals; and

WHEREAS, Parks are areas where children naturally congregate in the summer that make good locations for lunch distributions; and

WHEREAS, Shawnee County Parks + Recreation shall be the department responsible for performing the duties of the County; and

WHEREAS, Kansas Children's Discovery Center shall operate the Serious Fun Monday lunch program to meet this urgent social need; and

NOW, THEREFORE, Kansas Children's Discovery Center and the County agree that the Serious Fun Monday lunch program at Chesney Park shall operate as follows:

1. From June 4, 2018, though August 6, 2018, Kansas Children's Discovery Center may serve lunches to children in Shawnee County at specific park locations approved by the Shawnee County Parks + Recreation Department.

2. Kansas Children's Discovery Center shall be responsible for site preparation, providing meals, post event clean-up and provide Serious Fun Mondays Lunch Program activity. Hy-Vee grocery store will be preparing the lunches.

3. County shall provide trash receptacles; refuse service, water and location for the Serious Fun Monday Lunch Program to be provided for youth. In accordance with County Code, Alt II. Sec. 21-55, Special Use of the Parks, the County does hereby grant th~ Kansas Children's Discovery Center permission during the event to allowing temporary structures and activities.

Kansas Children's Discovery Center agrees to defend, hold harmless, and indemnify Shawnee County and its officers, employees, and agents against and fi·om any and all loss, liability, damage, claim, cost, charge, demand, or expense for injury to persons and damage to property including prope1ty of the Kansas Children's Discovery Center, caused by the negligent acts or omissions of the Kansas Children's Discovery Center in the performance of this Agreement. l. TERMS HEREIN CONTROLLING PROVISIONS. It is expressly agreed that the terms of each and every provision in this attachment shall prevail and control over the terms of any other conflicting provision in any other document relating to and a part of the contract in which this attachment is incorporated.

2. AGREEMENT WITH KANSAS LAW. It is agreed by and between the undersigned that all disputes and matters whatsoever arising under, in connection with or incident to this contract shall be litigated, if at all, in and before a Court located in the State of Kansas, U.S.A., to the exclusion of the Courts of any other states or country. All contractual agreements shall be subject to, governed by, and construed according to the laws of the State of Kansas.

3. TERMINATION DUE TO LACK OF FUNDING APPROPRIATION. Shawnee County is subject to the Kansas Cash Basis Law, K.S.A. l 0-110 l et seq. ff, in the judgment of the Financial Administrator, Audit-Finance Office, sutlicient funds are not appropriated to continue the function perfonned in this agreement and for the payment of the charges hereunder, County may terminate this agreement at the end of its current fiscal year. County agrees to give written notice of termination to contractor at least thirty (30) days prior to the end of its current fiscal year. In the event this agreement is terminated pursuant to this paragraph, County will pay to the contractor all regular contractual payments incurred through the end of such fiscal year. The termination of the contract pursuant to this paragraph shall not cause any penalty to be charged to the County or the contractor.

4. DISCLAIMER OF LIABILITY. Neither the County of Shawnee nor any department thereof shall hold hannless or indemnit'y any contractor for any liability whatsoever.

5. ANTI· DISCRIMINATION CLAUSE. The contractor agrees: (a) to comply with the Kansas Act Against Discrimination (K.S.A 44-1001 el seq.) and the Kansas Age Discrimination in Employment Act, (K.S.A. 44-1111 et seq.) and the applicable provisions of the Americans With Disabilities Act (42 U.S.C. 12101 et seq.) [ADAJ and to not discriminate against any person because of race, religion, color, sex, disability, national origin or ancestry, or age in the admission of access to or treatment or employment in. its programs or activities; (b) to include in all solicitations or advertisements for employees, the phrase "equal opportunity employer"; (c) to comply with the reporting requirements set out in K.S.A. 44-1031 and K.S.A. 44-1 Il6; (d) to include those provisions in every subcontract or purchase order so that they are binding upon such subcontractor or vendor; (e) that a failure to comply with the reporting requirements of(c) above or if the contractor is found guilty of any violation of such acts by the Kansas Human Rights Commission, such violation shall constitute a breach of contract; (f) if the contracting agency determines that the contractor has violated applicable provisions of ADA, that violation shall constitute a breach of contract; (g) if (e) or (f) occurs, the contract may be cancelled, terminated or suspended in whole or in part by the County. Parties to this contract understand that subsections (b) through (e) of this paragraph number 5 are not applicable to a contractor who employs fewer than four employees or whose contract with the County totals $5,000 or less during this fiscal year.

6. ACCEPTANCE OF CONTRACT. This contract shall not be considered accepted, approved or otherwise effective until the required approvals and certifications have been given and this is signed by the Board of County Commissioners ofthe County of Shawnee, Kansas.

7. ARBITRATION, DAMAGES. WARRANTIES. Notwithstanding any language to the contrary, no interpretation shall be allowed to find the County has agreed to binding arbitration, or the payment of damages or penalties upon the occurrence of a contingency. Further, the County shall not agree to pay attorney fees and late payment charges; and no provisions will be given effect which attempts to exclude, modit'y, disclaim or otherwise attempt to limit implied warranties of merchantability and fitness for a particular purpose.

8. REPRESE.'iTATIVE'S AUTHORITY To CONJRACT. By signing this document, the representative of the contractor thereby represents that such person is duly authorized by the contractor to execute this document on behalf of the contractor and that the contractor agrees to be bound by the provisions thereof.

9. RE§PONSIBILITY FOR TAXES. The County shall not be responsible for, nor indemnit'y a contractor for, any federal, state or local taxes which may be imposed or levied upon the subject matter of this contract

10. INSURANCE. The County shall not be required to purchase, any insurance against loss or damage to any personal property to which this contract relates, nor shall this contract require the County to establish a "self-insurance" fund to protect against any such loss or damage. Subject to the provisions of the Kansas Tort Claims Act (K.S.A. 75-6101 et seq.), the vendor or lessor shall bear the risk of any loss or damage to any personal property to which vendor or lessor holds title.

RE: Memorandum of Understanding- Easterseals Capper Foundation Recreation - Afterschool/Camps

Purpose: Board of Commissioners authorization and execution on the attached Memorandum of Understanding between Shawnee County Parks + Recreation (SCP+R) and the Easterseals Capper Foundation (ECF) pertaining to a trade out of services and facilities is requested. The programs benefit both parties equally but more importantly participants. There is no exchange of funding.

Justification: SCP+R develop agreements with efficiencies in mind. Serving as the host site for the iCan Bike program in exchange for staff training and volunteer time, created a shared level of equity that meets the service provider partnership criteria. ECF is a nonprofit that is able to offer this camp to specific clientele in collaboration with SCP+R. And as noted in the Master Plan Program Portfolio (4.8) it is suggested to continue offering programs for persons with disabilities as requested by the public.

The program is unique in that it helps individuals with disabilities gain the self-confidence to ride a two-wheel bicycle within a week. Using specialized equipment, coaching and encouragement, participants "lose the training wheels!" ECF has the expertise and resources to help individuals with disabilities in such endeavor. They provide participants the environment needed to improve self-esteem, encourage inclusion, and most importantly an increased quality of life through a recreational experience.

The MOU creates a partnership that has ECF offering SCP+R staff specialized training (Ability Awareness, Behavior Analysis, Mandt) and providing volunteer assistance at our Civitan Summer Camp well worth the exchange for site use. Training helps summer camp staff with being prepared to handle specific or unique situations at camp. EFC volunteer hours are crucial to assisting SCP+R with offering a quality camp experience.

TmS MEMORANDUM OF UNDERSTANDING (MOU) between the Easterseals Capper Foundation, hereinafter refet·red to as "Capper Foundation" and the Board of Commissioners of the County of Shawnee, Kansas, hereinafter referred to as the "County'' is effective this day of 2018 for the purpose of developing a partnership benefitting people with disabilities to be held in public parklands throughout 2018.

WHEREAS, Shawnee County Parks + Recreation hereinafter referred to as the "Department" shall be responsible for performing the duties of the County; together the Department and Cappel' Foundlition shall be known as the "Parties"; and,

WHEREAS, the Parties wish to provide facilities to host prog~·ams and camps; and,

WHEREAS, the Parties shall collaborate on exchanging staff and _volunteer ~·aining hours; and,

WHEREAS, each Party shall supply the necessary means (equipment, volunteers, instruction) to facilitate programs and camps without exchanging funds; and,

NOW, THEREFORE, the Parties mutually agree to the following:

1. TERM. The MOD is effective from the date written above. This MOU may be terminated at any time by either party delivering written notice of termination to the other party.

2. FACILITIES. The Department shall provide Capper Foundation access to use the Central Park Community Center gym and track, 7:30 a.m.-5:30 p.m., June 4~8, 2018. Supply drop off and setup may occur prior during operating hours.

3. STAFF TRAINING. In exchange of services and facility usage, Parties agree:

a. Capper Foundation shall provide the Department volunteers to assist during the 2018 Civitan Camp.

b. The Capper Foundation shall allow attendance and provide to Department staff the Ability Awareness training, Department camp staff training and continuing education workshops through February 2019.

4. Both Parties agt·ee to have patticipants and volunteers abide by site or program rules and regulations. Parties agree to provide a release of liability/waiver form in order to obtain a parent/guardian or individual signatures on each form before pa1ticipants may use the facilities.

5. Capper Foundation agrees to defend, hold harmless, and indemnifY the Board of County Commissioners of Shawnee County, Kansas, its officers, agents and employees, from and against all claims, causes of action, liabilities, expenses and costs, including reasonable attorneys' fees, for iqjury of any person or damage to property, including propetty of the Capper Foundation, arising out of, or connected with, work or activities performed under this Agreement which is the result of any acts or omissions, whether negligent or otherwise, of Capper Foundation, its officers, agents, subcontractors or employees.

6. Capper Foundation and its officers, employees and agents at·e independent contractors and shall not be deemed employees of Shawnee County.

7. The provisions found in Contractual Provisions Attachment identified as "Attachment A" are hereby incorporated into this MOU.

RE: Stacking Chairs- Garfield and Shawnee North Community Centers Recreation Division - Centers

Purpose: Board of Commissioners approval is requested on the attached invoices from Modern Business Interiors, for the purchase of replacement stacking chairs at Garfield and Shawnee North Community Centers in the amount of $14,032.18. Modern Business Interiors is a State Contract provider which the department utilizes to purchase this style of chair. Funds are available from the Parks + Recreation Capital Maintenance (3R) Fund.

Justification: On March 2, 2018, a project budget for chairs was approved to replace the chairs at Garfield and Shawnee North Community Centers with this type of stacking chair available from the vendor. Past history includes replacement of chairs at Central Park (20 16) and Oakland and Crestview (2017) Community Centers.

The upgrades have been needed for several years due to safety concerns and it was not feasible to repair chairs. Parks + Recreation is now putting community center amenities and equipment on schedules based on useful life. This involves working to provide the public a safe and comfortable environment. The chair style was selected as the department's design standard for these chairs as they are utilized daily by the public or staff.

Request to negotiate with Terracon Consultants, Inc. for Geotechnical Consulting and Testing Services for Kansas Expocentre Renovation Project

Please place this item on the Monday, April16, 2018 Commission Agenda for consideration.

On March 26, 2018 the Board of County Commissioners authorized the issuance of a Request for Qualifications (RFQ) for geotechnical firms to provide consulting and testing services for the Kansas Expocentre Renovation Project. The proposal submission deadline was April 9, 2018. We received five responses from the following entities:

1. Terracon Consultants, Inc. 2. Alpha-Omega Geotech, Inc. 3. Cook, Flatt & Strobel Engineers, PA 4. Intertek-PSI 5. Kansas City Testing & Engineering, LLC

The Professional Services Selection Committee, consisting of myself, Pat Oblander, Bill Kroll, Tom Flanagan and Chuck Smith with HTK Architects, has reviewed and discussed the proposals submitted.

After thorough evaluation and discussion the Committee is recommending that the Commission award the final bid to Terracon Consultants, Inc. and authorize the County Counselor's office to negotiate a contract with the vendor which will be brought back before the Commission for final approval.
