CALL TO ORDER Community Health Center (CHC) Board Chair called the meeting to order at 12:01 pm A quorum was present. Due notice had been mailed.

APPROVAL OF MEETING MINUTES The minutes of the March 3, 2015, CHC Board meeting were approved as presented.

QUALITY ASSURANCE (QA) COMMITTEE The Quality and Risk Management Officer report the committee did the annual review of the Risk Management (RM) Plan. The RM Plan is designed to support the mission and vision of the Shawnee County Health Agency-Community Health Center (SCHA-CHC) as it pertains to clinical risk and patient safety. The RM Plan lists policies and federal regulations that apply to the CHC.

The committee also reviewed policies associated with Federal Tort Claims Act (FTCA) deeming and brought them to the Board for approval. Revisions to the policies were highlighted in yellow.

Wanetta Bean made a motion to approve policy 20.25 Referral Tracking. Kim Hodgson seconded the motion. No discussion took place. Motion carried.

Wanetta Bean made a motion approve policy 20.26 Hospitalization Tracking. Commissioner Archer seconded the motion.

Michelle Sweeney inquired about the privacy practices in place with the policy because it pertains to transferring records from place to place. The Executive Director advised the Health Insurance Portability and Accountability Act (HIPAA) was in place. Kim Hodgson inquired about requesting to take the medical records from the hospital to the provider doing the follow up. The Executive Director explained the medical records are sent from the hospital to the primary care provider after hospitalization. The Medical Director advised when a patient is hospitalized, they sign paperwork a4thorizing the release of medical records to their primary care provider.

The motion was reiterated. Motion carried.

Wanetta Bean made a motion to approve policy 20.27 Diagnostic Tracking. Commissioner Archer seconded the motion. No discussion took place. Motion carried.

The Executive Director reported that the first diabetes education class took place. The feedback from the class was very positive and some of the participants were not diabetic but still benefited from the health education provided by the class. The next diabetes education class is scheduled for July.

Wanetta Bean made a motion to approve the RM Plan. No discussion took place. Motion carried.

FINANCE COMMITTEE The Chairman reported the CHC's year to date (YTD) revenue is $876,260 with expenditures of$720,622 leaving the earned net income at $155,637. The estimated total yearend income is approximately $213,044. The total cost per patient is at $393.36. The visits are slightly down because there is still one more provider vacancy but should improve once a provider fills the position and goes through the credentialing process. That number will continue to grow throughout the year to approximately $800. The accounts receivable (AR) trend summary report reflects an ending AR balance of $257,125 which is a net AR decrease of $57,610. Commissioner Archer inquired regarding the International Classification of Diseases-10 (ICD-10) and how the CHC is preparing for that. The Executive Director advised there is an ICD-10 planning committee.

CHC EXECUTIVE DIRECTOR'S REPORT •!• There were face to face meetings with the various sub-committees from the

Safety Net System in March and today there have been conference calls. GraceMed, Inc. is working to develop pro forma based on operational staffing

needs. Once developed, it will be shared with the Board of County Commissioners (BCC) following review and approval of the GraceMed, Inc. Board. A grant opportunity was released called Health Infrastructure Investment Program (HIIP). They are awarding 100-150 grants for up to $1,000,000 each for the purpose of renovating or purchasing a building. The Executive Director met with the Health Resources and Services Administration (HRSA) project officer and it was indicated a Service Area Competition (SAC) grant process may be necessary for the operational change to take place. The Executive Director also spoke with the Grants Management Office and they indicated there may be another method that can be used and information has been conveyed to them.

•!• Received a 330 notice of grant award for period of May 2015 through April2016 funding with no conditions. The funding is in the amount of $957,578.

•!• The Executive Director announced the trip to Washington D.C. was successful. The House of Representatives have supported legislation to maintain the funding for CHCs for an additional two years.

•!• The most recent communication has indicated that primary care funding from the state has been reduced by approximately $300,000. The CHC requested $195,000 in funding for fiscal year 2016.

•!• The Executive Director presented slides of data regarding the Health Insurance Marketplace. There have been just over 4,400 people who were assisted by the SCHA with the Health Insurance Marketplace. Tracking was challenging because the navigators were unable to keep any information on the people assisted for privacy purposes. The Executive Director advised Board members that not all 4,400 people were eligible for coverage; it is possible the person was assisted one time and completed the rest of the enrollment on their own, and this number represents duplicated people because they may have been assisted on several different occasions.

•!• The CHC Board decided to have the annual Board retreat on June 2, 2015.

•!• The SCHA received free bus passes from Topeka Metro. The bus passes are one way trips. A process for distributing them is being developed but if a patient expresses the need for transportation, staff can mail out the bus passes for the appointment. The free bus passes will be available for a limited amount of time but after that, patients can fill out applications for income based discounted bus passes.

•!• A job offer has been made to a Physician's Assistant (PA). It was accepted and the Executive Director anticipates he will start in the next 4-6 weeks. The credentialing process will start as soon as possible. Two Certified Medical Assistants (CMAs) started on April 6, 2015. A licensed practical nurse (LPN) is converting her status from full time to intermittent.

MEDICAL DIRECTOR'S REPORT The Division Manager reported new patient orientation started again in February. The orientations rotate between Tuesday evenings and Thursday mornings. In March, 85 people attended orientation. Out of those, all of them were scheduled for an appointment and there were 10 that did not keep their appointment which is approximately 12%. Orientation is going very well. Staff has been able to complete orientation within an hour and patients are usually able to be scheduled within a two week span.

HEALTHACCESS(HA)REPORT Karla reported the eighth annual "Music ... Just What the Doctor Ordered!" was a success. There were over 400 people who attended.

NEW/MISCELLANEOUS BUSINESS No new business.

COMES NOW, Plaintiff, Bank of America, N.A., and for its cause of action ~gainst the I

Defendants states as follows:

1. Plaintiff is a corporation duly organized and existing by virtue of law.

2. Venue is proper in this District by way of the subject matter, i.e., the foreclosure of a

mortgage on certain real estate located in the County of Shawnee, State of Kansas.

3. On or about October 29, 2009, Kyle E. Cordts, Kendra M. Steckline aka Kendra M. Cordts

[hereinafter "Borrower(s)"] borrowed money from, executed and delivered Bank of America,

N.A., a Note, payable in monthly installments, in the original principal sum of $116,353.00,

together with interest as stated. A true and correct copy of the Note is attached and

incorporated by reference as if fully set forth as Exhibit 1.

4. As a part of the loan transaction and in order to secure payment of the Note, Borrower(s)

executed and delivered to Mortgage Electronic Registration Systems, Inc., as nominee for

Bank of America, N.A, a Mortgage of the same date upon the following described real estate:

The Shawnee County Counselor's Office recommends approval of the attached Settlement Agreement and Release related to Shawnee County Case No. 14-CV161 (Lana Brown v. Hamid Circus, Inc., Arab Shrine Temple, SMG, and Board of County Commissioners of Shawnee County).

The Co-Defendants have settled all claims with the Plaintiff and no portion of the settlement is to be paid by SMG or Shawnee County. Additionally, the Cross-Claim of SMG and Shawnee County against Defendants Arab Shrine Temple and Hamid Circus, Inc., for their failure to defend and indemnify, has also been settled.

SETTLEMENT AGREEMENT AND RELEASE

This Settlement Agreement and Release is entered into by SMG and the Board of County Commissioners of Shawnee County, Kansas Qointly referred to as "Expocentre"), Arab Shrine Temple ("Shrine"), and Hamid Circus, Inc. ("Hamid"), and their agents, insurers, successors and assigns. Shrine and Hamid, along with their respective insurers, are collectively referred to as Releasees.

1. Background. Expocentre, Shrine, and Hamid are defendants in an action styled Lana Brown v. Hamid Circus, Inc., Arab Shrine Temple, SMG, and Board of County Commissioners ofShawnee County, Case No. 2014CV161, filed in the District Court of Shawnee County, Kansas (the "Lawsuit"). Expocentre has filed a cross-claim against Arab Shrine Temple in the Lawsuit alleging it is entitled to contractual indemnification for any liability to Plaintiff Lana Brown as well as recovery of defense costs from Arab Shrine Temple or its insurer based on the provisions of a "Permit for Use of Facilities" entered into between Expocentre and Arab Shrine Temple on or about July 21, 2011. Arab Shrine Temple and its insurer, Praetorian Insurance Company, have made demand on Hamid Circus, Inc. and its insurer for defense and indemnity of Expocentre and Shrine in the Lawsuit based on contracts and agreements between Shrine, Hamid, and their respective insurers. The parties have agreed to settle the Lawsuit and have entered into one or more separate agreements memorializing and fmally resolving all claims by Plaintiff Lana Brown against all defendants. Expocentre, Shrine, and Hamid further agree to compromise and settle all claims and demands in any way arising out of the Lawsuit, including claims and demands for defense, indemnity, and contribution, between all parties, their agents, insurers, related entities, successors, and assigns, in accordance with the terms set forth herein.

2. Payment. Releasees agree to pay to Expocentre or others on their behalf the sum of TWENTY THOUSAND DOLLARS ($20,000.00). The total payment shall consist of payment by Shrine or its insurer ofTEN THOUSAND DOLLARS ($10,000.00) and payment by Hamid or its insurer of TEN THOUSAND DOLLARS ($10,000.00), payable to the order of Federal Insurance. Expocentre acknowledges and agrees that payment to its insurer, Federal Insurance, as set forth herein constitutes full and valid consideration for this Relea~e. As further consideration for this Release, Releasees agree to pay Expocentre's one-quarter share of the mediation fees incurred for the mediation held on April2, 2015.

3. Dismissal. Expocentre agrees to dismiss with prejudice the cross-~laim against Shrine in the Lawsuit. Expocentre agrees to refrain from making any further claim~ or filing any further litigation against Releasees arising out of or connected to Lana Brownts injury, the Lawsuit, or the defense of the Lawsuit. 4. Release. Expocentre hereby releases and forever discharges Releasees and all employees, agents, or others acting for or on behalf of Releasees from any and aU claims and demands arising out of the Lawsuit wherein Plaintiff claimed damages for injunies sustained when she fell at the Arab Shrine Circus, including all claims for defense and indemnity in the Lawsuit, whether arising by contract, tort, or status as additional insureds under any policy of insurance issued to Shrine and/or Hamid.

5. No Admission of Liability. Expocentre understands and agrees that Releasees do not admit liability of any kind for any of the claims or demands that have been asserted by Expocentre, including any claims or demands for indemnity or defense. Expocentre acknowledges that this settlement is made by the Releasees to resolve all claims. and demands and to avoid the inconvenience, burden, and expense of additional litigation that' could exceed the amount of the settlement paid herein.

6. Binding Effect. The terms of this Agreement are contractual and not merely a recital. The Agreement shall be enforced under the laws of Kansas and be binding upon the parties hereto, their agents, insurers, successors and assigns. The undersigned(s) expressly represents and warrants that he or she has the authority to enter into this Release agreement and execute this Release and settlement of all claims for and on behalf of SMG and Board of County Commissioners of Shawnee County Kansas.

AGREEMENT

This Agreement is between MICHAEL S. KING, Secretary of Transportation, Kansas Department of Transportation (KDOT) (the "Secretary") and SHAWNEE COUNTY, KANSAS (the "County").

RECITALS:

A. Secretary has authorized a Federal Fund Exchange Program under which local units of government may exchange some or all of the Federal Funds allotment by KDOT to the local unit in a specific federal fiscal year for State Funds allocated to Secretary.

B. County desires to exchange all or a portion of County's annual allotment of Federal Funds for State Funds at the Exchange Rate or to bank all or a portion of its annual allotment, such amount to be used in the future for either a Federal-Aid Project or exchanged for State Funds at the Exchange Rate.

C. Secretary and County are empowered by the laws of Kansas to enter into agreements incident to the financing, construction, and maintenance of county roads utilizing federal or

NOW,,THEREFORE, the Parties agree as follows:

ARTICLE I

DEFINITIONS:

As used in this Agreement, the capitalized terms below have the following meanings:

1. "Agreement" means this written document, including all attachments and exhibits, evidencing the legally binding terms and conditions of the agreement between the Parties.

2. "County" means Shawnee County, Kansas.

3. "Effective Date" means the date this Agreement is signed by the Secretary or his designee.

4.- "Exchange Rate" means the exchange of Federal Funds allotment for State Funds at a rate of ninety percent (90%) of State Funds for one hundred percent (100%) of local federal obligation authority for costs incurred pursuant to this Agreement, on a reimbursement basis.

5. "Federal Funds" means federal-aid transportation funds, including Surface Transportation Program funds, for use on state and local federal-aid transportation projects.

6. "KDOT" means the Kansas Department ofTransportation, an agency of the state of Kansas, with its principal place of business located at 700 SW Harrison Street, Topeka, KS, 66603-3745.

7. "Parties" means the Secretary and KDOT, individually and collectively, and the County.

8. "Secretary" means Michael S. King, in his official capacity as Secretary of Transportation of the state ofKansas, and his successors.

9. "State Funds" means State ofKansas transportation funds.

ARTICLE II

TERMS OF AGREEMENT:

1. Secretary Authorization. Secretary is authorized by County to take such steps as are deemed by Secretary to be necessary or advisable for the purpose of securing the benefits of the current Federal-Aid Transportation Act for this exchange.

2. Incorporation of Program Application. County has submitted a program application for this Federal Fund exchange, which is hereby incorporated into and made a part of this Agreement-forall:purposes;-- ----------- ------ ----- -···-------- · --- --------------

3. Exchange of Funds.

(a) When the County requests to use the banked funds for a Federal-Aid Project, the Secretary will apply one hundred percent (100%) of the requested amount to said project, up to $1,293,512.44 in Federal Funds.

(b) When the County requests to use the exchanged or banked funds pursuant to the Federal Fund Exchange Program, the following terms will apply to the exchange:

(i) County authorizes Secretary to retain and use $1,293,512.44 of County's annual allotment of Federal Funds for federal fiscal year 2015 in exchange for State Funds at the Exchange Rate.

(ii) Secretary shall reimburse County, with State Funds, for one hurldred percent (100%) of costs incurred pursuant to this Agreement, up to $1,164,161.20. All costs incurred in excess of the fund exchange amount will be the sole responsibility of the County.

(iii) Any State Funds exchanged pursuant to this Agreement may be carried over in the next federal fiscal year by County.

(iv) County understands that Secretary may use the retained Federal funds exchanged by County for any federally eligible purpose or project within the State.

(v) The Secretary will make partial payments to County for amounts not less than $1,000 and no more frequently than monthly. Such payments will be made after receipt of proper billing showing costs paid by County and any reimbursement form required by KDOT.

4. Limitations on Use of State Funds.

(a) County shall not deposit the exchanged State Funds into the operating budget for the County.

(b) County shall use the State Funds exchanged pursuant to this Agreement for:

(i) specific road and bridge projects, as pre-approved by the Secretary, which are eligible under KDOT's Federal Fund Exchange Guidelines, including but not limited to roadway construction, reconstruction or rehabilitation, pavement preservation programs, bridge construction, replacement, rehabilitation, repair and removal, construction of low water crossing, safety improvement programs; and

(ii) for all phases of the pre-approved road and bridge project including, but not limited to preliminary engineering, right of way acquisition, utility relocation, construction and inspection.

(c) Upon completion of the road or bridge project, County shall notify Secretary and allow the Secretary to participate in a final review of the road or bridge project. Reviews by the Secretary are not done for the benefit of County or its contractors, or agents, or other political subdivision, or the traveling public. The Secretary makes no representation, express or implied warranty to any person or entity concerning the adequacy or accuracy of the design plans, specifications, estimates, surveys, and any necessary investigations or studies, including, but not limited to, environmental, hydraulic, and geological investigations or studies for the Project, or any other work performed by County.

5. Availabilitv of State Funds. The total dollars exchanged under this Agreement are contingent upon the availability of State funds. If, in the judgment of Secretary, sufficient State Funds are not appropriated to continue the function performed in this Agreement, Secretary may terminate this Agreement without further notice. Secretary will not be responsible to County for any reduction in State Funds.

6. Availability of Federal Funds. The total dollars exchanged under this Agreement are also contingent upon the availability of Federal funds. If, due to Congressional funding restrictions, sufficient Federal funds have not been allocated to County, Secretary shall exchange funds in the amount available.

7. Audit. County will participate and cooperate with Secretary in an audit which will occur either annually or by project. County shall make its records and books available to representatives of Secretary for audit for a period of five (5) years after date of final payment under this Agreement. If any such audits reveal payments have been made with State Funds to the County for items considered non-participating, County shall promptly reimburse Secretary for such items upon notification by Secretary.

8. Compliance with Federal and State Laws. County shall comply with all applicable federal, state, and local laws, regulations, executive orders, and ordinances governing the projects undertaken pursuant to this Agreement.

9. Right of Way Acquisition. All right of way acquisition for the project shall be done in compliance with the Uniform Relocation Assistance and Real Property Acquisition Policies Act of 1970 as amended by the Surface Transportation and Uniform Relocation Assistance Act of 1987, and administrative regulations contained in 49 C.P.R. Part 24, entitled Uniform Relocation Assistance and Real Property Acquisition for Federal and Feder{llly Assisted Programs.

10. Legal Authority. County shall adopt all necessary ordinances and/or resolutions and take ----------- -----------such-administrative--or-legal-steps -as -maybe required- to-give--full-effect tothe-terms-of-this---

11. Indemnification. To the extent permitted by law, County agrees to defend, indemnify, hold harmless, and save Secretary and his or her authorized representatives from any and all costs, liabilities, expenses, suits, judgments, damages to persons or property or claims of any nature whatsoever arising out of or in connection with the provisions or performance of this Agreement by County or County's employees.

ARTICLE III

GENERAL PROVISIONS:

1. Civil Rights Act. The "Special Attachment No. 1," pertaining to the implementation of the Civil Rights Act of 1964, is attached and made a part of this Agreement.

The Secretary of Transportation for the State of Kansas, in accordance with the provisions of Title VI and Title VII of the Civil Rights Act of 1964 (78 Stat. 252), §504 of the Rehabilitation Act of 1973 (87 Stat. 355) and the Americans with Disabilities Act of 1990 (42 USC 12101), the Age Discrimination Act of 1975 (42 USC 6101), the regulations of the U.S. Department of Transportation (49 C.F.R., Part 21, 23, and 27), issued pursuant to such Act, Executive Order 12898, Federal Actions to Address Environmental Justice in Minority Populations and Low Income Populations (1994), and the DBE Program (49 C.F.R., Part 26.1), hereby notifies all contracting parties that, the contracting parties will affirmatively ensure that this contract will be implemented without discrimination on the grounds of race, religion, color, gender, age, disability, national origin, or minority populations and low income populations as more specifically set out in the following ''Nondiscrimination Clauses".

CLARIFICATION

Where the term "Consultant" appears in the following ''Nondiscrimination Clauses", the term "Consultant" is understood to include all parties to contracts or agreements with the Secretary of Transportation of the State of Kansas.

Nondiscrimination Clauses

During the performance of this contract, the Consultant, or the Consultant's assignees and successors in in~erest (hereinafter referred to as the "Consultant"), agrees as follows:

1) Compliance with regulations: The Consultant will comply with the regulations of the u.s1

Department of Transportation relating to nondiscrimination in its federally-assisted programs and codified at Title 49 Code of Federal Regulations, Parts 21, 23 and 27, (hereinafter referred to as the "Regulations"). The Regulations are herein incorporated by reference and made a part of this contract.

2) Nondiscrimination: The Consultant, with regard to the work performed by the Consultant after award and prior to the completion of the contract work, will not discriminate on the grounds of race, religion, color, gender, age, disability, national origin or minority populations and low income populations in the selection and retention of subcontractors, including in the procurements of materials and leases of equipment. The Consultant will not participate either directly or indirectly in the discrimination prohibited by Section 21.5 of the Regulations, including employment practices when the contract covers a program set forth in Appendix B of the Regulations.

3) Solicitations for Subcontractors, including Procurements of Material and Equipment: In all solicitations, either competitive bidding or negotiation made by the Consultant for work to be performed under a subcontract including procurements of materials and equipment, each potential subcontractor or supplier shall be notified by the Consultant of the Consultant's obligation under this contract and the Regulations relative to nondiscrimination on the grounds of race, religion, color, gender, age, disability, national origin or minority populations and low income populations.

4) Information and Reports: The Consultant will provide all information and reports required by the Regulations, or orders and instructions issued pursuant thereto, and the Secretary of the Transportation of the State of Kansas will be permitted access to the Consultant's books, records, accounts, other sources of infmmation, and facilities as may be determined by the Secretary of Transportation of the State of Kansas to be pertinent to ascertain compliance with such Regulations, orders and instructions. Where any information required of a Consultant is in the exclusive possession of another who fails or refuses to furnish this information, the Consultant shall so certifY to the Secretary of Transportation ofthe State of Kansas and shall set forth what efforts it has made to obtain the information.

5) Employment: The Consultant will not discriminate against any employee or applicant for employment because of race, religion, color, gender, age, disability, or national origin.

6) Sanctions for Noncompliance: In the event of the Consultant's noncompliance with the nondiscrimination provisions of this contract, the Secretary of Transportation of the State of Kansas shall impose such contract sanctions as the Secretary of Transportation of the State of Kansas may determine to be appropriate, including, but not limited to,

(a) withholding of payments to the Consultant under the contract until the Consultant complies, and/or

(b) cancellation, termination or suspension of the contract, in whole or in part.

7) Disadvantaged Business Obligation

(a) Disadvantaged Business as defined in the Regulations shall have a level playing field to compete for contracts financed in whole or in part with federal funds under this contract.

(b) All necessary and reasonable steps shall be taken in accordance with the Regulations to ensure that Disadvantaged Businesses have equal opportunity to compete for and perform contracts. No person(s) shall be discriminated against on the basis of race, color, gender, or national origin in the award and performance of federally-assisted contracts.

9) Incorporation of Provisions: The Consultant will include the provisions of paragraphs (1) thro~gh (8) in every subcontract, including procurements of materials and equipment, unless exempt by the Regul~tions, order, or instructions issued pursuant thereto. The Consultant will take such action with respect to any subcontract or procurement as the Secretary of Transportation of the State of Kansas may direct as a means of enforcing such provisions including sanctions for noncompliance: PROVIDED, however, that, in the event a Consultant becomes involved in, or is threatened with, litigation with a subcontractor or supplier as a result of such direction, the Consultant may request the State to enter into such litigation to protect the interests ofthe State.

The parties agree that the following provisions are hereby incorporated into the contract to which it is attached and made a part thereof, said contract being the __ day of , 20 __ .

1. Terms Herein Controllina Provisions: It is expressly agreed that the terms of each and every provision in this attachment shall prevail and control over the tenns of any other conflicting provision in any other document relating to and a part of the contract in which this attachment is incorporated. Any terms that conflict or could be interpreted to conflict with this attachment are nullified.

2. Kansas Law and Venue: This contract shall be subject to, governed by, and construed according to the laws of the State of Kansas, and jurisdiction and venue of any suit in connection with this contract shall reside only in courts located in the State of Kansas.

3. Termination Due To Lack Of Funding Appropriation: If, in the judgment of the Director of Accounts and Reports, Department of Administration, sufficient funds are not appropriated to continue the function performed in this agreement and for the payment of the charges-hereunder, State may tenninate this agreement at the end of its current fiscal year. State agrees to give written notice of termination to contractor at least 30 days prior to the end of its current fiscal year, and shall give such notice for a greater period prior to the end of such fiscal year as may be provided in this contract, except that such notice shall not be required prior to 90 days before the end of such fiscal year. Contractor shall have the right, at the end of such fiscal year, to take possession of any equipment provided State under the contract. State will pay to the contractor all regular contractual payments incurred through the end of such fiscal year, plus contractual charges incidental to the return of any such equipment. Upon termination of the agreement by State, title to any such equipment shall revert to contractor at the end of the State's current fiscal year. The termination of the contract pursuant to this paragraph shall not cause any penalty to be charged to the agency or the contractor.

4. Disclaimer Of Liability: No provision of this contract will be given effect that attempts to require the State of Kansas or its agencies to defend, hold harmless, or indemnify any contractor or third party for any acts or omissions. The liability of the State of Kansas is defined under the Kansas Tort Claims Act (K.S.A. 75-6101 § §lill.,.).

5. Contractor agrees to comply with all applicable state and federal anti-discrimination laws.

8. Representative's Authoritv To Contract: By signing this contract, the representative of the contractor thereby represents that such person is duly authorized by the contractor to execute this contract on behalf of the contractor and that the contractor agrees to be :bound by the provisions h~ '

9. Responsibility For Taxes: The State of Kansas and its agencies shall not be responsible for, nor indemnify a contractor for, any federal, state or local taxes which may be imposed or levied upon the subject matter of this contract.

i 10. Insurance: The State of Kansas and its agencies shall not be required to purchase any insurance against loss or damag!'J to property or any other

subject matter relating to this contract, nor shall this contract require them to establish a "self-insurance" fund to protect against any such Joss or damage. Subject to the provisions of the Kansas Tort Claims Act (K.S.A. 75-6101 § §lill.,_}, the contractor shall bear the risk of any Joss or damage to any property in which the contractor holds title.

11. Information: No provision of this contract shall be construed as limiting the Legislative Division of Post Audit from having access to information pursuantto K.S.A 46-1101 ,!tl~.

12. The Eleventh Amendment: "The Eleventh Amendment is an inherent and incumbent protection with the State of Kansas and need not be reserved, but prudence requires the State to reiterate that nothing related to this contract shall be deemed a waiver of the !Eleventh Amendment."

13. Campaign Contributions I Lobbying: Funds provided through a grant award or contract shall not be given or received in exchange for the making of a campaign contribution. No part of the funds provided through this contract shall be used to influence or attempt to influence an officer or employee of any State of Kansas agency or a member of the Legislature regarding any pending legislation or lhe awarding, extension, continuation, renewal, amendment or modification of any government contract, grant, Joan, or cooperative agreement.

Permission is requested to create and fill an Office Assistant II Position that would serve the Shawnee County Solid Waste Department (SCSWD).

Since the implementation of the curbside recycling program, an increased need in the level of administrative support was recognized and resulted in significant amounts of overtime for existing staff. The SCSWD attempted to mitigate the overtime issue by first utilizing intermittent staff on a part-time basis and then on a near full-time basis.

Subsequently, it has been very difficult keeping an employee in the intermittent staff position for any lengthy amount of time due to the fac~ ~hat no benefits accompany intermittent positions, thus increasing the nfed to frequently train new staff for that positiOn. :

Approval to close operations of Shawnee County Health Agency-Community Health Center (SCHA-CHC) on Wednesday, August 26, 2015 to conduct a staff training with Coleman Associates at the Topeka & Shawnee County Public Library

Action Requested: Approve the closing of operations on Wednesday, August 26, 2015 from 8:00am- 5:00 pm to enable staff to participate in the Dramatic Performance Improvement Workshop.

Shawnee County Health Agency-Community Health Center (SCHA-CHC) was recognized in December 2014 with a grant in the amount of $38,552 by U.S. Department of Health and Human Services (HHS) for our quality improvement achievements for the UDS reporting year of 2013. Nationwide health centers that received these awards were proven leaders in areas such as chronic disease management, preventive care and the use of Electronic Health Records (EHRs) to report quality data.

SCHA-CHC received these funds for high levels of quality performance in the following categories:

• Health center quality leaders - best overall clinical outcomes, ability to focus on quality in all aspects of clinical operations

• Clinical quality improvers - demonstrating at least a 10 percent improvement in clinical quality measures between 2012 and 2013, showing a significant improvement in the health of the patients

• Electronic Health Record reporters - used EHRs to report clinical quality measure data on all patients.

It is expected that SCHA-CHC utilize the funds to continue to improve quality of care and patient satisfaction. SCHA-CHC plans to utilize a portion of the funds to conduct an all staff workshop on Dramatic Performance Improvement, facilitated by Coleman Associates. The cost of the workshop is $9,260. Coleman Associates will create and execute a one-day workshop for up to eighty staff to foster dialogue and discussion '(round the Ideal Patient Visit and Medica} Home experience. The workshop will introduce best practices in health care, orient participants to current Medical Home vocabulary, improve participants use of data to drive the derision making of every staff member and clinician in the clinic and provide a variety of jumping off points for rna agers and front lines staff to take steps to improving the way care is delivered.

Description

The objective of the Coleman Associates approach is to foster and nurture creativity and innovation to discover new ways of working that improve productivity, increase patient access, reduce patient waiting time, increase staff teamwork and satisfaction, build supportive infrastructure, deyelop the patient-centered medical home, optimize the wise use of technology, and produce stellar patient outcomes.

While we have little control over the environmental changes buffeting our health centers today, we do have control over how we respond to these changes. DPI is a powerful methodology for responding to the pressures of an increasingly competitive, quality based, and cost-conscious environment. DPI veterans in over I 000 health centers from coast to coast have taught us that a more efficient model is very attainable and that within that model of work patient and staff satisfaction can soar. Coleman Associates enjoys a reputation for creating and installing process improvement in a very practical, approachable style that resonates with staff and managers.

The workshop: Dramatic Perfom1ance Improvement is an opportunity for participants to learn about best practices around operational improvements and created a more patient-centered approac~ to care. This workshop will pull in lessons learned from the literature of innovators and health care improvement giants and will blend those lessons with practical steps. Workshop participants will learn the myths and truths about Operational Improvements as well as explore the compelling reasons for DPI. They will be introduced to the principles of successfully DPI'd sites. Results of peer sites will also be shared.

The initial objective of the workshop is for participants to conclude the workshop feeling challenged, inspired, appreciated, and intellectually provoked and stimulated about how they do their work everyday in caring for patients. And the more profound objective is for participants to learn that they play a pivotal role and can taking advantage of all opportunities to propel their organizations progressively forward-keeping them powerfu.lly relevant in the future. And, finally, to gain insight into how to measure and drive operational change to the benefit of the organization, the patient, and the staff.

Coleman Associates will create and execute a one-day workshop for up to eighty supervisors/leads, managers, providers, front lines staff to foster dialogue and discussion around the Ideal Patient Visit and Medical Home experience.

• A room spacious enough to accommodate all participants seated as well as additional room periphery space for brainstorming and problem-solving huddles. For a maximum · learning experience the learning room will have natural light.

• Refreshments for the start of the day, lunch, and PM refreshments should be coordinated and provided for all participants so that hunger or thirst do not get in the way of learning.

• A flip chart on an easel with markers for every 8 attendees (though the client may elect to use Post-It Flip Chart Sheets on room walls, if appropriate), and markers.

• An LCD projector, appropriate sound system (microphones, etc.,), and projection screen, along with an internet connection fast enough to play video (think YouTube) are required. House sound capable of playing music on an iPod is ideal, but not required.

Request to issue Request for Quotations for Uniform services

Board of County Commission approval is requested to issue a Request for Quotations for uniform services and to convene a multi-departmental committee to review the bids.

The County currently uses two uniform services and both contracts will expire on December 31, 2015. It is our desire to get the best uniform service for the County by utilizing the experience and knowledge of all the County departments that use or process uniform services. By convening a committee with one person from each department involved in uniform services, we hope to be able to contract with one quality service for the entire county. This committee will review and evaluate the bids based on their experience and departmental needs. The committee will then bring a recommendation to the Commission for approval.

During 2014, the County spent $104,454 on uniform services. This total was spread throughout the County expenditures by the various departments.

Request Approval to Accept Bid for Resurfacing of Department Shower Units

I am requesting approval to accept the bid of Advanced Coatings, Inc. (Advanced) to resurface multiple showers within the Adult and Juvenile Detention Centers. After receiving commission authorization, a Request for Proposal (RFP) was developed to solicit bids for this resurfacing work. An RFP was issued, a pre-bid conference was held, and two final bids were received by the deadline. A copy of the bid tabulation sheet is attached for your reference.

The received bids were reviewed and based on that review process I am recommending that the lowest and most responsive bidder, Advanced, be selected to complete the resurfacing work as specified in the RFP. Advanced's bid price for the specified work is $396,700.00, which is within the cost range we anticipated for the project. The cost of this project will be paid from Certificates of Participation funding authorized on February 19, 20 15. Accordingly, I am asking for your approval to accept Advanced's bid and proceed with final arrangements to complete this project.
