The Shaker Heights Board of Education met in regular session on Friday, June 13, 2008 at 9:04 a.m. at the Shaker Heights Board of Education Administration Building, 15600 Parkland Drive, Shaker Heights, Ohio 44120. Members present: Mr. Norman A. Bliss, Ms. Freda J. Levenson, Mr. Peter A. Robertson, Ms. Annette Tucker Sutherland and Mr. F. Drexel Feeling. President F. Drexel Feeling presided. Upon the presentation of the Minutes of the May 13, 2008 regular meeting, Ms. Levenson moved, seconded by Ms. Sutherland to approve the minutes as presented. Roll Call: Ayes: Mr. Bliss, Ms. Levenson, Mr. Robertson, Ms. Sutherland, Mr. Feeling. The motion carried. 08-06-86 TREASURER’S REPORT AND RECOMMENDATIONS Upon the recommendation of Mr. Bryan Christman, Treasurer, Mr. Bliss moved, seconded by Ms. Levenson that the financial statements for May 2008 be accepted and placed on file for audit. President Feeling asked Mr. Christman to review the highlights of the financial statements. He commented on items as delineated in the financial and miscellaneous briefs and as follows:

18 • Real Estate/Personal Property Taxes – Even though for the year this category will be

below budget by $934,893, the total tax collections (real estate, personal property, and the homestead exemption and rollback) budget variance is estimated to end the year with a favorable variance approximating $2.5 million. This is primarily due to the better-than-expected personal property tax collections (due to OfficeMax settlement payment) partially offset by lower real estate tax collections due to delinquencies. The reduction in real estate tax collections due to the increased senior citizen tax credit is offset by an increase in the Homestead & Exemption payments received from the State.

• Personal Property Taxes - We received $1,650,645 for the first 2008 tangible personal property tax advance in May, which was approximately $1.5 million higher than expected. This large advance is due to a second OfficeMax tangible personal property tax settlement. As you may recall, a year ago we received a large payment in settlement of the OfficeMax 2003 tangible personal property tax return as amended. It is our understanding, based upon our discussions with the County, that OfficeMax had originally filed the returns and paid their initial obligation, but due to a State edict they were forced to amend the returns reporting a much higher liability than their initial filing. They appealed the amended filing obligation and lost a year ago on the 2003 year and earlier this year lost their appeal on the 2006 return, thus triggering the 2nd large settlement payment. The total OfficeMax 2006 settlement payment amounted to $2,026,943, of which the District’s share approximates 84% or $1.7 million. Additionally, the District is in line to receive approximately $150,000 of a total $184,164 settlement payment from Adelphia for its 2002 return. We will continue to monitor and report as additional information becomes available.

• Investment Earnings - $1,584,787 received this year, which is $598,898 or 60.7% more than received at this time last year. The Fed lowered the targeted Fed funds rate 25 basis points to 2.00% on April 30th. It is believed that the Fed will leave the rate unchanged at 2.00% for the ensuing several months in anticipation of a stabilizing or slightly improving economy.

• Other State Sources – Included in May receipts was the special education catastrophic aid reimbursement for last fiscal year (2007) totaling $647.198. The reimbursement received a year ago for Fiscal 2006 totaled $869,525. The difference in the two reimbursement amounts is due primarily to a lower State reimbursement rate this year (48.7% vs. 59.4% a year ago), coupled with a slightly lower submission for reimbursements this year ($1.328 million vs. $1.462 million a year ago). The lower reimbursement rate this year resulting in a $222,327 lower reimbursement is the sole reason for the unfavorable $217,286 budget variance for this category line item through the end of May.

• Homestead Exemption and Rollback - This payment follows the real estate tax settlement from the County, and thus was received early in May this year since the real estate tax settlement was received early in April. The current month payment is up approximately $500,000 over both the prior year payment (received in June 2007) and the budget due to the new increased Ohio senior citizen homestead exemption that went into effect with tax bills payable in calendar 2008. (Reduced local tax collections due to the increased senior citizen credit are offset by this increase in the Homestead & Exemption payment from the State).

• Federal Sources - We are currently reviewing the State’s proposed final settlements for the CAFS fiscal years 2001 through December 2003, including the fiscal 2003 audit. Our preliminary final CAFS settlement payment for fiscal years 2001 through December 2003 is estimated at a combined net total of $231,000, for which we expect to receive payment later this summer.

• Total Expenditures –On a cash basis, total expenses were $3,726,205 or 5.2% more than the YTD expenditure level for the prior fiscal year. This variance is due to a combination of increased costs and timing differences in payments. On a budgetary basis, we have a $552,756, or 0.7% favorable cash basis variance and an unfavorable encumbrance variance of $1,065,488, most of which is attributable to timing differences.

19 • Property Tax Base Protection Efforts - Increase Complaints Filed By The District:

We have filed one increase complaint for one rental apartment building. The total increased market value requested is $663,734, which approximates $232,307 of assessed value, which would produce additional annual (or at least until the next year that H.B. 920 would take effect) tax revenue approximating $21,600 for the District. Decrease Complaints Filed By Taxpayers: Taxpayers filed 153 decrease complaints, 15 commercial and 138 residential, with the Cuyahoga County Board of Revision. The requested decrease in market value amounts to $15.3 million for commercial properties and $7.1 million (top 66 properties total only) for residential properties, which if awarded would result in collective tax reduction amounts of $500,000 and $170,000, respectively. In addition to filing counter-complaints against commercial property decrease complaints, we have reviewed the current year residential decrease filings and, similar to last year, we have decided to also file counter-complaints on 45 of the 138 residential decrease complaints. We only filed counter-complaints in those instances where we felt the decrease request was either not warranted or the justification reasons given were questionable or not valid. The market value reduction requested for these 45 properties amounts to $5.7 million, which equates to a collective tax reduction amount of $135,000. Board of Revision and Board of Tax Appeals Activity in 2007-08: I have also attached a copy of the reports prepared by Braman and Co. that summarize the activity at the Board of Revision level during 2007-08. This activity relates to increase and decrease complaints filed in prior years. These reports indicate the amount of market and assessed value dollars protected. The estimated tax dollar savings from our efforts at the Board of Revision level approximated $222,000. The BTA activity is still in process.

Mr. Christman also commented on the following legislative items: • Medicaid Program Status –

--Recent State Capital Budget Bill passed earlier this week (June 10, 2008) included language authorizing the new “Medicaid School Program” (MSP). --Oral approval has been received, but still awaiting written Federal approval which is expected to occur shortly. --Program will begin effective with start of the new school year, including a retroactive provision allowing submissions back to July 1, 2005.

• House Bill 428 – Teacher Misconduct II Bill passed by both houses and sent to Governor for signature. Clarifies many of the requirements from Teacher Misconduct I including providing for penalties and narrows requirements for employees of private contractors working in schools.

• Cuyahoga County Reform Bill – Part of amendment to Capital Budget Bill. Proposal would create a nine-member panel to recommend to State General Assembly how to best restructure Cuyahoga County government. The total Bill was sent to the Governor’s desk for signature.

• Ohio’s launch of a national reform campaign aimed at the country’s next president “ED in ‘08” took place in late May includes many Ohio representatives and State General Assembly members and education stakeholders.
