The Board of Professional Engineers and Professional Land Surveyors held a regular meeting on July 29 - 30, 2019 at the Salmon Rapids Lodge, 1010 S. Main St., Riggins, ID 83549 to conduct Board business. Obermayer) Subcommittee to work with the Department of Labor on survey education and apprenticeship program. The subcommittee had nothing new to report.

b. Veteran’s Licensure Subcommittee: (Mr. Szatkowski, Mr. Tomkinson, Mr. Obermayer and Mr. Bennett). The Board continued this matter for discussion at a later meeting.

Board noted the information. 4. UK Chartered Engineers update. Mr. Szatkowski updated the Board on the

The Board noted the information. Mr. Obermayer joined the meeting. Attorney Mike Kane joined the meeting by telephone. 6. Law and Rules review – Proposed rules and final law language Moved by Mr. Bennett, seconded by Dr. Murgel to approve all as amended. Motion passed unanimously. 7. Update Board Opinions for agency guidance documents. The Board noted the

information and directed Mr. Simila to continue to prepare the guidance documents.

Attorney Kane left the meeting. Moved by Mr. Watkins, seconded by Mr. Elle to recess until Tuesday, July 30 at 8:00 a.m. Motion passed unanimously. V. CONSIDERATION OF APPLICATIONS The Board reconvened at 8:00 a.m. on Tuesday, July 30 to review applications for licensure.

Moved by Mr. Watkins, seconded by Mr. Bennett to enter into executive session to consider records that are exempt from disclosure as provided for by Idaho Code 74-206(1)(d). Roll call vote results; Mr. Bennett, yes; Mr. Watkins, yes; Mr. Elle, yes; Mr. Obermayer, yes, and Dr. Murgel, yes. Moved by Mr. Elle, seconded by Mr. Bennett to dismiss as de minimis with letter of caution regarding notifying the other engineer employed on the same project. Motion passed unanimously. 12. Historic Board policies. The Board will revisit this item at a future meeting. 13. Policy on Investigation Process Moved by Mr. Bennett, seconded by Mr. Watkins to approve policy as amended. Motion passed unanimously. 16. Corner Record fee statute. The Board noted the information and directed Mr.

Judge to work with IAC to update the statute. VI. CONSIDERATION OF DISCIPLINARY MATTERS Moved by Mr. Watkins, seconded by Mr. Bennett to enter into executive session to consider records that are exempt from disclosure as provided for by Idaho Code 74-206(1)(d). FY16.08 Scott RFI toward Erickson – Time extended at March 2017. Tom Judge to

finish investigation pending litigation. This matter was continued. FY17.02 Mayberry (GHD RFI matter) Received 09/07/2016. Mr. Judge to finish this

investigation. Time extended at the January 2017 meeting. This matter was continued.

FY17.05 Jared Leavitt CO/STIP non-compliance & suspension. The Board noted the

information.

FY17.09 Elam RFIs toward Ketcham. Time extended at March 2017 meeting. Mr. Judge to finish this investigation pending litigation. This matter was continued.

FY19.01 Andrew Adams. Received 08/20/18. Time was extended at the November

2018 meeting. This matter was continued. FY19.02 Chris Pfahl, PLS. Time was extended at the November 2018 meeting. Mr.

Obermayer is recused in this matter, Mr. Elle is acting Chairman.

Obermayer is recused in this matter, Mr. Elle is acting Chairman. Moved by Dr. Murgel, seconded by Mr. Bennett to refer FY19.02 and FY19.03 to the prosecutor. Motion passed with Mr. Obermayer recused. FY19.04 Eric Eldenburg, P.E. Received 11/16/2018. This matter is continued. FY19.07 Al Johnson PLS. Received 02/26/2019. The Board noted the information.

Referred to the AG’s office: Wangermann – Unlicensed surveyor out of Utah. The Board noted the information and will revisit this matter at the next meeting. Wilhelm (non-engineer stamping plans with license seal). The trial was held July 9th. The case was dismissed by the jury. The Board noted the information. IV. NEW BUSINESS 26. A business entity requested a waiver of the requirement for a COA from the Board. Moved by Mr. Bennett, seconded by Dr. Murgel to deny the request for a waiver of the COA requirement. Motion passed unanimously. 25. STS Engineering Services, LLC requested that the Board allow the use of their

business name in Idaho. Moved by Mr. Bennett, seconded by Dr. Murgel to deny the request to use the business name in Idaho. Motion passed unanimously. VI. CONSIDERATION OF DISCIPLINARY MATTERS Attorneys Tom Lloyd and Barbara Beehner-Kane joined the meeting. FY19.13 Kaemingk, Dale, CPD Default Hearing Moved by Mr. Bennett, seconded by Dr. Murgel to approve voluntary retirement in lieu of discipline. Motion passed unanimously. FY19.24 Nickerson, Christopher, CPD Default Hearing Moved by Mr. Bennett, seconded by Dr. Murgel to approve order to revoke Mr. Nickerson’s license. Motion passed unanimously.

signed and a Final Order has been drafted for the Board’s review. Moved by Mr. Bennett, seconded by Mr. Elle to approve the Final Order and consent agreement. Motion passed unanimously. Attorney Lloyd left the meeting.

IV. NEW BUSINESS 18. Electronic signatures by captured image. The Board noted the information and

referred this matter to the attorney for an opinion. Attorney Barbara Beehner-Kane left the meeting. V. CONSIDERATION OF APPLICATIONS

Moved by Mr. Watkins, seconded by Mr. Bennett to enter into executive session to consider records that are exempt from disclosure as provided for by Idaho Code 74-206(1)(d). Moved by Dr. Murgel, seconded by Mr. Bennett to approve the application of Barry Clark Miller for initial licensure as a professional engineer especially qualified in civil engineering. Motion passed unanimously. Moved by Dr. Murgel, seconded by Mr. Bennett to approve the application of Grady Gale Turner for initial licensure as a professional engineer especially qualified in mechanical engineering. III. UNFINISHED BUSINESS 11. Omnibus Rulemaking adoption of pending rule notice Moved by Mr. Bennett, seconded by Dr. Murgel to consolidate all rule chapters into one chapter as part of the pending rule consideration. Motion passed unanimously. 12. Revised opinion on ALTA Surveys as reports. Moved by Mr. Elle, seconded by Mr. Bennett to approve the revised opinion. Motion passed with Mr. Obermayer voting against the motion.

IV. NEW BUSINESS 1. Reports by Board Members and Staff of activities since the June meeting. Mr. Bennett attended ISPLS chapter meetings. Dr. Murgel was appointed to the NCEES education committee. Mr. Szatkowski attended the ISPE conference and was reappointed to the NCEES law enforcement committee. Mr. Elle attended the ISPE conference and answered questions from surveyors. Mr. Judge completed investigations; worked with GCTWDG on coordinates and attended ISPLS legislative committee meetings. Mr. Watkins attended the ISPE conference and answered questions from engineers. Mr. Simila attended the ISPE conference; attended the PNWER conference; attended DFM meetings on rules and met with ACEC-Idaho & Attorney Kane on the statute of limitations legislation. Mr. Obermayer had nothing to report. 2. Staff provided an update on the Board’s financial status as of June 30, 2019. The

Board noted the information.

3. Staff prepared an Expense Reimbursement Summary for the Executive Director for June 1, 2019 through June 30, 2019 for the Board’s review.

Moved by Mr. Watkins, seconded by Mr. Bennett to approve the expenses as presented. Motion passed unanimously. 4. NCEES Motions for Annual Meeting. The Board noted the information.

5. Budget for Fiscal Year 2021. The Board noted the information. 7. ACEC-Idaho Conference is scheduled for October 31 through November 2 in

McCall. Does the Board want to send a representative? Moved by Mr. Bennett, seconded by Mr. Elle to send Mr. Simila and Mr. Watkins to the ACEC-Idaho conference. Motion passed unanimously.
