The Bar Council’s Advocates and Solicitors’ Compensation Fund A. About the Fund The Bar Council’s Advocates and Solicitors’ Compensation Fund was established in 1978 to protect the interests of members of the public whom, as clients of lawyers, have suffered losses arising out of the dishonesty of lawyers. One example is where a lawyer misappropriates monies held by him as a stakeholder. The funds in the Compensation Fund come from compulsory annual contributions from every practising lawyer registered with the Bar Council. A fixed sum in the Compensation Fund, which is allocated annually, is used to pay out claims for a particular year. The main prerequisite for a claim against the Compensation Fund is that the lawyer concerned must have been struck off the Roll of advocates and solicitors. All approved claims are paid in full, unless the monies in the Compensation Fund for the particular year are insufficient to meet the total sum of the approved claims. In such an event, the grants are paid out on a pro-rated basis. Payments made to the lawyers as legal fees are not claimable against the Compensation Fund. The Bar Council does not restrict the number of claims in a particular year, provided each claim is in compliance with the Advocates and Solicitors’ Compensation Fund Rules 1978. B. Application Procedure Each year, the Bar Council publishes a notice, in major newspapers, containing the names of lawyers struck off the Roll of advocates and solicitors in the preceding year. Members of the public who have sustained any loss owing to the dishonesty of these struck-off lawyers may make an application for a grant out of the Compensation Fund, which must be done within 21 days from the date of the notice. For example, the notice with the names of lawyers struck off the Roll of advocates and solicitors in 2009 was published in March 2010. Claims with respect to these lawyers must be made within 21 days from the date of the notice. The Bar Council would not entertain any claim in respect of lawyers struck off prior to 2009. The Bar Council will appoint an Adjudication Panel comprising senior lawyers to review the applications. Claimants will be notified to attend a hearing before the Adjudication Panel, together with witnesses (if any) to support their claims, and must produce their original documents. Upon conclusion of the hearing, the adjudicators will submit their written report with recommendations on whether the claim is approved (in full or in part) or rejected. All recommendations must be approved by the Bar Council. Claimants will be notified of the outcome of their applications for grants out of the Compensation Fund. Successful claimants will be requested to present themselves/their representatives at the Bar Council Secretariat on a specified date to collect the cheques. The entire process is usually completed within a year. C. Documents Required Claimants are required to submit the following documents when making an application: (1) One set of duly completed Forms A & B, which is provided in the Schedule to the Advocates and Solicitors’ Compensation Fund Rules 1978. The forms may be obtained from the Bar Council Secretariat or downloaded from the Malaysian Bar’s website, at http://www.malaysianbar.org.my/forms. html; (2) A certified true copy of the police report lodged by the claimant against the lawyer; (3) RM100 per claim, being payment for administrative fees. Payment should be made by cheque or postal order payable to “Bar Council”; (4) A photocopy of the claimant’s identity card/passport; and (5) Other documents in support of the claim (refer to the “Schedule of particulars to be annexed to Form A or B”, provided in the Advocates and Solicitors’ Compensation Fund Rules 1978). Semua tuntutan yang diluluskan akan dibayar penuh, melainkan wang yang terdapat di dalam Dana Pampasan Peguambela dan Peguamcara adalah tidak mencukupi pada tahun berkenaan, di mana pampasan akan dibayar mengikut pro-rata. Yuran guaman yang dibayar kepada peguam yang berkenaan tidak boleh dituntut. The funds in the Compensation Fund come from compulsory annual contributions from every practising lawyer registered with the Bar Council. A fixed sum in the Compensation Fund, which is allocated annually, is used to pay out claims for a particular year.

The main prerequisite for a claim against the Compensation Fund is that the lawyer concerned must have been struck off the Roll of advocates and solicitors. Dana Pampasan Peguambela dan Peguamcara Majlis Peguam

A. Mengenai Dana PampasanDana Pampasan Peguambela dan Peguamcara diwujudkan pada tahun 1978 bertujuan untuk melindungi kepentingan orang awam, sekiranya anak guam telah mengalami kerugian yang berpunca dari ketidakjujuran peguam. Sebagai contoh, kerugian yang dialami apabila peguam telah menyeleweng wang yang dipegang peguam tersebut di dalam kapasitinya sebagai pemegang amanah.

Dana Pampasan Peguambela dan Peguamcara merupakan sumbangan tahunan dari semua peguam yang bertauliah yang berdaftar dengan Majlis Peguam Malaysia. Jumlah yang terkumpul pada tahun tersebut akan digunakan untuk membayar tuntutan pada tahun berkenaan.

Adalah menjadi prasyarat utama untuk membuat tuntutan dari Dana Pampasan Peguambela dan Peguamcara bahawa peguam yang terlibat telah dibatalkan namanya dari Daftarai Peguambela dan Peguamcara.

Semua tuntutan yang diluluskan akan dibayar penuh, melainkan wang yang terdapat di dalam Dana Pampasan Peguambela dan Peguamcara adalah tidak mencukupi pada tahun berkenaan, di mana pampasan akan dibayar mengikut pro-rata. Yuran guaman yang dibayar kepada peguam yang berkenaan tidak boleh dituntut.

Majlis Peguam Malaysia tidak menghadkan jumlah permohonan pada setiap tahun, dengan syarat setiap permohonan adalah memenuhi terma di dalam Kaedah-Kaedah Kumpulan Wang Pampasan Peguambela dan Peguamcara 1978.

B. Kaedah Tuntutan Setiap tahun, Majlis Peguam Malaysia akan mengeluarkan notis di akhbar-akhbar utama, yang mengandungi senarai peguam-peguam yang telah dibatalkan namanya dari Daftarai Peguambela dan Peguamcara pada tahun sebelumnya.

Orang awam yang telah mengalami kerugian berpunca dari ketidakjujuran peguam yang telah dibatalkan namanya (seperti yang diterbitkan) mesti membuat tuntutan terhadap Dana Pampasan Peguambela dan Peguamcara dalam tempoh 21 hari dari tarikh notis dikeluarkan.

Sebagai contoh, notis yang menyenaraikan nama-nama peguam yang telah dibatalkan namanya dari Daftarai Peguambela dan Peguamcara pada tahun 2009, telah disenaraikan pada bulan Mac 2010. Tuntutan perlu dibuat dalam masa 21 hari dari tarikh pengiklanan. Majlis Peguam Malaysia tidak akan melayani permohonan yang melibatkan peguam-peguam di mana namanya telah dibatalkan sebelum tahun 2009.

Majlis Peguam Malaysia akan melantik Panel Adjudikasi yang terdiri daripada peguam berpengalaman untuk menilai permohonan. Pemohon akan dimaklumkan untuk menghadiri perbicaraan di hadapan Panel Adjudikasi bersama dengan saksi (jika ada) untuk menyokong permohonan tersebut, dan harus membawa bersama dokumen-dokumen asal. Di akhir perbicaraan, Panel Adjudikasi akan menyerahkan laporan bertulis bersama-sama dengan cadangan samada permohonan diluluskan (penuh atau sebahagian) atau ditolak, kepada Majlis Peguam Malaysia untuk kelulusan.

Pemohon akan dimaklumkan status permohonan secara bertulis. Pemohon yang berjaya akan diminta untuk menghadirkan diri/wakil ke Majlis Peguam Malaysia pada tarikh yang ditetapkan untuk mengambil cek.

Keseluruhan proses biasanya mengambil masa satu tahun.

C. Dokumen-dokumen yang Diperlukan Pemohon perlu menyerahkan dokumen-dokumen yang tertera di bawah apabila membuat tuntutan: (1) Sesalinan Borang A & B, sepertimana yang disertakan

bersama Jadual kepada Kaedah-Kaedah Kumpulan Wang Pampasan Peguambela dan Peguamcara 1978, yang telah dilengkapi. Borang tersebut boleh didapati

dari Pejabat Sekretariat Majlis Peguam Malaysia atau dimuat turun dari laman sesawang, http://www.malaysianbar.org.my/forms.html;

(2) Satu salinan diakui sah laporan polis terhadap peguam yang berkenaan;

(3) Yuran pentadbiran sebanyak RM100 bagi setiap tuntutan. Bayaran hendaklah dibuat melalui cek/kiriman wang pos di atas nama “Bar Council”;

(4) Sesalinan kad pengenalan/pasport pemohon; dan

(5) Lain-lain dokumen sokongan untuk membuat tuntutan (sila rujuk kepada “Jadual Butiran yang dikepilkan bersama Borang A atau B” sebagaimana yang termaktub di dalam Kaedah-Kaedah Kumpulan Wang Pampasan Peguambela dan Peguamcara 1978).

Permohonan yang diterima tanpa dokumen-dokumen (1) hingga (4) yang dinyatakan di atas akan ditolak.
