Class B. This Type II New Juvenile Hall Project will replace the original late 1950’s facility. The new facility will be constructed inphases with existing buildings being demolished to make way for the new recreation yard and support buildings. Upon completion, thefacility will provide approximately 63,438 square feet (sf) of total building area and approximately 100,108 sf of site improvements on9.217± acres of the greater 38.407± acres of county owned land in Salinas. The completed 120-bed facility will be laid out in a campusstyle design with a central 1-1/4 acre recreation yard surrounded by four housing buildings and support buildings. Two new 30-bedmedium security housing buildings will be approximately 7,176 sf with single and double rooms, and the new 30-bed high-securityhousing building will be approximately 9,715 sf with single and double rooms. Each new housing building will have three 10-bedhousing units with connecting dayroom and showers surrounding a central multi-purpose room, staff-support spaces, and an outdoorrecreation area. Additionally, the high-security housing building will provide on-unit classrooms and a satellite medical exam room. Thebase project includes the renovation of the existing 4,775 sf medium-security dormitoryhousing building; the renovation includes theremodel two existing housing units, one with 10 beds and one with 20 beds, with existing day room and programming space retained.Program services space will be provided at each housing building for education; religious services; counseling; substance abuseclasses; group counseling; mental health evaluations; and, other programs to reduce recidivism. The new dministration buildingprovides spaces for contact and non-contact visitation; central control; medical facilities; staff offices; intake processing; release; stafftraining; staff locker rooms; staff break room; equipment storage; and, maintenance shop with direct access to the new juvenile hallcampus. The project provides a new central kitchen, dining, laundry and warehouse building, and a school/gymnasium building with ateacher resource room, educational offices and staff support areas directly off a large recreational yard. Primary security and visualsupervision for the new facility will be provided by the new central control room, which will utilize closed circuit television to providevisual control and assist in the control of the security perimeter fence line. Central control will have visual supervision of the housingunits, attached outdoor exercise areas, and program spaces. Each new and existing housing unit will also be monitored by a smallerunit security station, located off the multi-purpose room.

OSHA Anti-Retaliation Rules Survive ChallengeA Federal judge decided not to stop a new Occupational Safety and Health Administration (OSHA) record-keeping rule's anti-retaliation provisions from taking effect on Dec. 1.The controversial provisions will require employers to inform employees about their right to report workplace injuries and illnesses without facing retaliation. They will also restrict workplace safety incentives and drug-testing programs.Several businesses and trade associations challenged OSHA's authority to create these provisions in a lawsuit filed with the U.S. District Court for the Northern District of Texas.The business groups asked Judge Sam Lindsay to issue a preliminary injunction, which would temporarily stop the anti-retaliation provisions from taking effect until the court had time to make a final ruling on the merits of the case.However, on Nov. 28 the court declined to block the rule because the challengers didn't show that they would suffer "irreparable harm" if the rule took effect. "Potential future injury based on unfounded fear and speculation … is insufficient to establish a substantial threat that irreparable harm will occur if a preliminary injunction is not granted," Lindsay said.Barring a stay by the 5th U.S. Circuit Court of Appeals or a sudden and unlikely reconsideration by the district judge, the anti-retaliation provisions will go into effect Dec. 1, said John Martin, an attorney with Ogletree Deakins in Washington, D.C.One thing to keep in mind about the lawsuit is that Lindsay said his decision isn't a comment about whether OSHA will ultimately prevail on the business groups' challenge, Martin noted. "At the end of the day, the provisions could still get this struck down, but that doesn't help employers by Dec. 1.""The court simply held that the plaintiffs in the case could not meet the strict standards for an injunction at this early stage of the litigation," explained Patrick Miller, an attorney with Sherman & Howard in Denver.It's important to note, however, that "the ruling does mean that OSHA may proceed with enforcement of the new rule while the case works its way through the system," he added.Record-Keeping RuleThe anti-retaliation provisions are part of a broader record-keeping rule that will require certain businesses to electronically submit injury and illness data—some of which will be available to the public on the agency's website.While the electronic reporting provisions are scheduled to take effect on Jan. 1, 2017, the anti-retaliation provisions had an initial enforcement date of Aug. 10, 2016.Enforcement was delayed twice while the agency addressed employer confusion over the rulesand while the Texas district court reviewed the business groups' legal challenge.The agency issued guidance on Oct. 19 in an attempt to clear up confusion about the provisions, but some enforcement aspects are still vague.Particularly with regard to the drug-testing provisions, it's difficult to understand what OSHA is trying to condemn with this rule, Martin said.
It seems like OSHA will be taking a look at drug-testing programs on a case-by-case basis, which doesn't help employers to clearly understand what steps they need to take to avoid citations, he added.Martin noted that the incoming administration might not attempt to aggressively enforce these provisions. President-elect Donald Trump criticized overreaching regulations during his campaign, so it's possible he could decide not to defend the lawsuit or not to enforce the rules, he said. "But it's difficult to take out a crystal ball and read what the Trump administration is going to do."
Construction Begins on $6B Project to Reduce TrafficA $6 billion project aimed at enhancing the environment and reducing traffic congestion along the Interstate 5 corridor between Solana Beach and Carlsbad kicked off Tuesday.Caltrans and the San Diego Association of Governments (SANDAG), along with local and state leaders, were on hand to commence construction on the first phase of the 40-year North Coast Corridor Program. Known as Build NCC, the first phase includes $700 million worth of transportation, public access and environmental improvements in the cities of Solana Beach, Encinitas and Carlsbad.According to a statement from Caltrans officials, this first phase is designed to lay the foundation for future components of the program and will help address the immediate transportation and environmental needs of the corridor.In the works for more than a decade, Build NCC has been a collaborative effort between Caltrans, SANDAG, local cities, resource agencies and community members, according to the Caltrans statement. The project is funded by a combination of local, state and federal resources, including TransNet, the voter approved half-cent sales tax.

Trump Faces Choice on Overtime AppealThe Department of Labor (DOL) under President-elect Donald Trump may withdraw the DOL's appeal of a preliminary blocking of the federal overtime rule if there hasn't been a decision on the appeal by Inauguration Day. But there's a slight chance the appeal will be decided before Jan. 20, though every day that goes by without an order on the appeal makes the chance of it "exponentially narrower," said Eric Magnus, an attorney with Jackson Lewis in Atlanta.The DOL moved for an emergency hearing on Dec. 2, but courts' dockets move slower this time of year, he added. And it isn't a persuasive argument to say an expedited hearing is needed because presidents are changing, he said.On the other hand, a single judge can grant a motion for expedited hearing. If it wanted to, the 5th Circuit could even hear the case without both sides submitting legal briefs. But the DOL requested a brief schedule that straddles Inauguration Day, making a decision before inauguration unlikely.Even if a panel of the 5th Circuit reverses the preliminary injunction before inauguration, the state plaintiffs in the case could delay the court's order by filing a petition to be heard by the full circuit—something the plaintiffs would be likely to do since 10 of the 15 judges on the 5th Circuit were appointed by Republican presidents, Magnus noted.
Whether the Trump administration withdraws the DOL's appeal is "a question of timing," agreed Brett Bartlett, an attorney with Seyfarth Shaw in Atlanta. If the court refuses an expedited hearing and briefs are filed after Jan. 20, Trump's DOL is more likely to withdraw the appeal, he predicted, though workers might perceive a withdrawal as pandering to corporate interests.
Trump's Position UncertainIf a decision is not reached before Jan. 20, the question becomes whether Trump "really is a Republican" who will withdraw a challenge of the court order blocking the rule, Magnus said.Maybe he figures he was elected because of blue-collar voters and decides not to withdraw the appeal in order to fight to preserve overtime rights, he noted. Then the case eventually is headed to the Supreme Court, he predicted.However, Carol Barnett, an attorney with Polsinelli in St. Joseph, Mo., thought Trump was more predictable, noting he mentioned on the campaign trail that he opposed the overtime rule's application to small businesses. Trump isn't likely to pursue an appeal originally brought by the Obama administration, she said.Trump could either withdraw the appeal or simply let the case languish. "If you do not proceed according to [court] deadlines, you may not be able to proceed at all," she said.
Other Ruling Could Be ImminentIn addition to 21 states challenging the overtime rule, the U.S. Chamber of Commerce and other business groups sued over it, and the states' and Chamber's lawsuits were consolidated. The business group plaintiffs sought summary judgment, a motion that has not been ruled on yet.Brett Coburn, an attorney with Alston & Bird in Atlanta, predicted that Judge Amos Mazzant, the same judge who granted the preliminary injunction, might grant the business groups' motion for summary judgment. And that ruling could be soon, Coburn said.Or Mazzant might choose to wait to see what the 5th Circuit does. Any granting of a motion for summary judgment could be appealed.
More Overtime Rulemaking?If the preliminary injunction still is in place Jan. 20, the Trump administration might ask the court to consider leaving it in place pending new rulemaking, said Alfred Robinson Jr., an attorney with Ogletree Deakins in Washington, D.C.While the district court questioned the DOL's authority to use a salary-level threshold for the white-collar exemptions, Robinson said the court really was taking issue with the department for overreaching on the exempt salary level by more than doubling it from $23,660 to $47,476 a year. Most people agree there needs to be an increase in the exempt salary level, just not too much too fast, he noted. The salaryamount should complement the duties test rather than supplant it, he explained."The Trump administration DOL could abandon its pursuit of an appeal and instead focus on more modest regulatory changes that allow the administration to maintain its pledge to support American workers while abrogating the drastic changes that were set to take effect," said Jim Swartz, an attorney with Polsinelli in Atlanta.If there were more rulemaking, the Trump administration might consider nuances overlooked by the Obama administration's overtime rule, such as modified overtime rules for small businesses, nonprofits
and rural areas, according to Robert Boonin, an attorney with Dykema in Detroit. And it could consider whether the Fair Labor Standards Act permits any salary-level threshold.In any event, new rulemaking could be lengthy, Bartlett observed.As for the status of the appeal, for now employers are "in a holding pattern and will have to keep their eyes on it," Coburn said.
More Input Sought On Two Sets of Proposed Regulations: Use of Criminal Background Information and Transgender IssuesThe California Fair Employment and Housing Council (FEHC) is currently considering two different sets of proposed regulations.
• The FEHC is proposing regulationsrelated to the use of criminal history information in employment decisions that impose new burdens on employers.
• The FEHC also is proposing regulations to specifically address protections for transgender persons, including restroom-related protections.
The Council has made further modifications to both sets of proposed regulations and is seeking additional public comments. California’s Upcoming Minimum Wage IncreaseOn January 1, 2017, California’s minimum wage increases to $10.50 per hour for businesses with 26 or more employees. Small businesses with 25 or fewer employees will continue to pay the current minimum wage of $10 per hour.The increase for larger businesses is a result of SB 3, a bill that will increase the minimum wage in California to $15 per hour by 2022. Small businesses will not be required to begin the scheduled increases until 2018 and will have until 2023 to reach the $15 per hour rate.Employers need to be ready for the minimum wage increase. Also, employers should remember that state enforcement agencies have made it a top priority to stop employers from engaging in so-called “wage theft,” which includes not paying the minimum wage for all hours worked.

Q: I was wondering if you are able help with HIS (Home Improvement Salesperson) registrations. If our company, a Nevada LLC, has employees selling solar systems over the phone to CA homeowners, do their employees need to have their HIS registrations?
A: No, if the employees are selling solar systems over the phone, then HIS registration is not required. A Home Improvement Salesperson is defined as an individual who is employed by a licensed contractor to solicit, sell, negotiate, or execute contracts for home improvements, outside the contractor’s normal place of business.
Q: You are helping us with our Nevada Contractor’s license and we are almost to the finish line of issuance. I reached out to City of North Las Vegas to get my City Business License started. However, they say I need to provide my NV State Contractors License number first. My question is, on the letter I received from NV, called the Contingent Letter of Approval, at the bottom it states I will need my Business License before they will issue me a Contractor’s License number. So in other words, if I am reading this correctly, I will be running in circles. Can you explain how this will work?
A: You are not alone as we are often called to help! It is easy to feel as though you are running in circles when dealing with the bureaucratic authorities. Here’s the deal: you are required to have a State business license number (issued by the Nevada Secretary of State) before your Contractor’s License number can be issued. Similarly, you must have a Contractor’s License number to obtain a City business license number. So, the order is to first obtain your State business license number (which we have already completed), and second, obtain the Contractor’s License number (which is near completion), and lastly
you can start the process of obtaining a City business license in each city that you plan to conduct business in. Easy.
Q: Our Company is licensed with the “B” (General Building) and the “C-10” (Electrical) classifications. My brother has Qualified both classifications since the 1990’s. We have had several projects where the project owners are requiring
“C-7” (Low Voltage) licenses. We have an employee who has worked for a Low Voltage company in the past, and he can have his former employer sign to verify his experience, and he also should have no trouble passing the required exams. Does he need to get his own license first and then we add him to our license, or how does that work?
A: No, it is not necessary for him to obtain his own license first before adding the “C-7” to your Company license. You can avoid that step and apply to add a classification to your Company license.
Just FYI, since your brother has held the “C-10” classification since the 90’s, he can also apply to add the “C-7” classification to your license and request to Waive the exam. Based on B&P Code section 7065.3, a Qualifying individual can request to Waive the exam if the classification being added is closely related to the classification currently listed on the license (that is the case in your situation). Your brother will need to show that low voltage work has been a significant part of the work being done with your “C-10”.

Safety Tip of the WeekACCIDENT INVESTIGATION
An accident investigation is required whenever a serious incident happens on the job. The less time intervening between the accident and the investigation, the more accurate the in- formation that can be obtained. Facts are more accurate because people have not had time to become biased by the opinions of others, memories are clearer and more details are remembered.
Why do we investigate an accident? The reason is to obtain accurate information about what happened. What events led up to the accident; who was involved with the work; did anyone fail to follow procedures or did a piece of material or equipment fail? This information will be used to develop a conclusion regarding the physical cause of the accident.
Conditions at an accident scene are the only things that change faster than the opinions that evolve when there is a delay in compiling the facts. Much evidence is lost because it is removed from or altered at the accident site before any notice of it is taken or any record made. The contact phase of an accident is brief and initiates a wide spectrum of activity. People responding to an accident generally react rather than respond. Injured people are moved or removed for treatment. Equipment and other items are moved about to assist in the treatment of the injured party, and to provide passage or restore work. Prompt arrival at the scene allows the investigator to observe evidence before it has been removed or altered.
Since we all learn from accidents, the investigation will help us bring all the facts together, your input and involvement will help to assure that the necessary steps are taken to try to prevent a similar occurrence. All of us can learn from our mistakes. Make an effort to detect any existing hazards or improper procedures and report them to your foreman or supervisor immediately. Accidents are unplanned events, near misses let us know that there is a potential problem, and thorough accident investigations help us prevent recurrences.
