INTRODUCTION
Building activity on Adelaide Airport is subject to statutory controls under the Airports Act 1996 and the Airports (Building Control) Regulations.
Approval is required from Adelaide Airport Limited (AAL) and the Airport Building Controller (ABC) prior to the commencement of works.

Applicant / Lessee Responsibilities All lessees/applicants are expected to take all reasonable steps to ensure a safe and compliant workplace during Building Approval works. This should be reflected in the application and the quality of documentation submitted. Changes to the WHS Act and Regulations places additional responsibilities on the provision of documentation and processes associated with risk assessment, safety documentation such as Safe Work Method Statement (SWMS) and compliance documentation such as operator licences for high risk equipment
Work Health and Safety Compliance All works undertaken on the airport is to be compliant with the WHS Act and Workplace Health and Safety Regulations 2012 and be supported by the appropriate documentation as part of the application. This may include but not limited to

FEES AND PAYMENTS
Application fees apply for both the AAL and the ABC assessment. Payment to AAL must be received on submission of the Building Activity Consent application and prior to commencement of application processing. The fee is based on the estimated value of the building activity as follows:

NOTE: AAL fees are GST inclusive.
Invoicing AAL will issue a tax compliant invoice to the applicant / lessee upon receipt of either the application and / or payment of the application fee in accordance with ATO GST legislation. There will be no other invoice requirements for that application beyond this. Details of the application will be provided to AAL Finance department for invoicing purpose upon receipt of an application. This will ensure AAL is complaint with its obligations whilst providing AAL customers with the necessary documentation.
Fees Payable to Airport Building Controller A separate fee applies for Permit applications to the Airport Building Controller. The Airport Building Controller fee structure is based on Schedule 1, Part 1 of the Regulations.

REVIEW BY ADELAIDE AIRPORT LIMITED (AAL)
Administration Applications complete with supporting information must be submitted independently to both the Airport Building Controller and Adelaide Airport Limited. Upon receipt, the application must be reviewed for completeness and any deficiencies noted. The application will then be registered in the AAL database and numbered with a BA number and AAL document file number. These details shall be recorded on the front page of the first application sheet. Invoicing and payment procedures shall be finalised appropriate to the payment status, prior to any further review. Any documentation identified as ABC application documentation shall be immediately forwarded to the ABC via the email, external mail or courier system within 48 hrs of receipt. The AAL document package will be forwarded to the AAL Building Approval Project Officer for processing to commence as early as is practicable once full payment has been received. AAL will provided the applicant/client with a letter acknowledging receipt of the application and requesting final payment and full documentation prior to assessment. Assessment may take up to 28 days from submission of the complete application. Delays in the submission of correct and detailed information may delay assessment and approval or otherwise.

REVIEW BY AIRPORT BUILDING CONTROLLER
The Airport Building Controller represents the Commonwealth, (Department of Infrastructure & Transport) throughout the approval process and is responsible for “Building Approval”. The Airport Building Controller will review the application for compliance with the Building Code of Australia (BCA), Australian Standards, engineering, aviation and environmental compliance.

WORKS PHASE
Client / Applicant Obligations
The client / applicant is responsible for conducting all works in a safe and secure manner ensuring compliance with the condition of the approvals. It is the client’s responsibility to ensure all contractors comply with these same conditions. Only those works approved by AAL and the Airport Building Controller are authorised to be carried out. The Client /applicant is also responsible for the provision of documentation to meet general compliance obligation and the conditions detailed with the AAL Consent and Airport Building Controller Permit. Where applicable, copies of this documentation are to be provided to the AAL Project Officer prior to the commencement of works.
Other Client Responsibilities

Note 1 Application fee In accordance with regulation 2.02(1), an application fee is required to be paid to the CPM Department of Infrastructure and Transport (to be collected by the Airport Building Controller) prior to the issue of the demolition permit. The basis for calculation of that fee is set out in regulation 2.02.
Note 2 AAT Review Under regulation 5.02 the applicant for the approval may make application to the Administrative Appeals Tribunal to have the decision of the Airport Building Controller to refuse or fail to approve a building activity reviewed.

Airport Building Controllers (ABCs) are appointed by the Secretary of the Department of Infrastructure and Regional Development (the Department) under the Airports
(Building Control) Regulations 1996 (the Regulations) to exercise the powers and functions which the Regulations vest in the ABCs, in relation to building control at leased
federal airports. ABCs are also appointed as authorised officers by the secretary under the Airports Act 1996 to exercise certain powers under this Act, in relation to leased
federal airports.
ABCs are contracted private companies, or employees or officers of such companies, and act independently of the Department. However, ABCs consult with the Department
as necessary on certain matters, such as the interpretation of the regulations.
