Briefing on OSC Template of Common Checklists of the External Technical Agenciesrehda Institute organized a half-day briefing on the OSC Template of Common Checklists of the External Technical Agencies on 18 August 2009 at The Saujana Kuala Lumpur. The OSC Template is the latest initiative by the Local Government Department of the Ministry of Housing and Local Government to streamline the housing delivery system. The template details the checklists by all the eleven external technical agencies on the submission requirement to OSC in order to expedite processes and procedures.

Datuk Arpah bt Abdul Razak, Director General of the Local Government Department, presented a paper on the ‘Status of Implementation and Performance of OSC’ from 13 April 2007 to 30 June 2009. According to Datuk Arpah, the national average of the OSC performance, monitored through the OSC portal, has improved from 70.32% to 85.67% since OSC was implemented on 13 April 2007 (as per table below).

As part of the follow through actions by the Local Government Department, Datuk Arpah highlighted that her department has initiated awareness and reinforcement programs, OSC portal, the ISO template on OSC processes and the template for common requirements for eleven external technical agencies. In addition, the Local Government Department is also currently working on the OSC online and the template for common requirements for internal technical departments.

Representatives from the external technical agencies, namely IWK, Jabatan Alam Sekitar, Jabatan Bomba dan Penyelamat, JKR, Jabatan Mineral & Geosains, JPBD, Suruhanjaya Komunikasi & Multimedia, SPAN, TNB and JPS, were also present at the briefing to field questions and queries from members and developers.

Datuk Arpah reiterated that the Local Government Department will continue to hold regular dialogue sessions with industry stakeholders and local authorities to further expedite and improve the housing delivery system.n

ladies and Gentlemen,First and foremost, I would like to express

my congratulations to the Real Estate and Housing Developers’ Association Malaysia on the occasion of REHDA’s Malaysia 39th Anniversary.

The Association has certainly come a long way from its inception nearly four decades ago. Today, REHDA is a key partner of the Malaysian government in the quest of making Malaysia a home owning democracy. I would like to thank all committee members of REHDA Malaysia, both past and present for their contributions to the nation.

Ladies and Gentlemen,The housing and property market as all

other sectors of the economy has had its shares of ups and downs. At this time last year the sector was riding high on the momentum from the first two quarters of the year and today we are faced with the reality of the deepest downturn in the global economy since the depression era.

The government takes cognizance that the housing sector is a key industry in generating domestic demand, more so in an economic downturn, as proven in past experiences. It is on this basis that the Government has provided numerous incentives to the industry to help shore up the economy. Among others, a total of rm400 million had been allocated in the two stimulus packages to build some 13,000 “rumah mesra rakyat”. In addition, the Government has also allowed for tax relief on housing loan interest up to RM10, 000 for three years in the 2009 Budget to stimulate the industry and ease buyers’ burden. The Government welcomes REHDA’s feedback on

the progress and effectiveness of these two packages.

The Government had set into motion various initiatives to transform the Malaysian economy from an upper middle-income developing economy into a high income developed economy within a decade. The sustained development and growth of the housing industry is indeed critical towards realising this objective. This is centred on the fact that the housing industry is people-centric, utilizes substantive local content and by virtue of it having a high multiplier effect given its cross-linkages to some 140 related industries.

Whilst we have in the last four decades, made great strides in enhancing the living standards of Malaysians by developing a first class infrastructure, we certainly need to do more to ensure a more sustainable and progressive future. Towards this goal, we need the full co-operation and commitment of our private sector partners in nation building.

Ladies and Gentlemen,It is apt that the theme for REHDA’s

Anniversary celebrations is “Towards Sustainable Development”. It rightly encapsulates the challenges of our time at this point of national development. Malaysia has successfully made the transformation from an agriculture economy to an industrial economy. Along the way we have managed to increase the living standards of millions of Malaysians bringing them out from the depth of poverty and hopelessness into the ranks of the middle class and within the embrace of the Malaysian dream.

This is only the first phase of our development stage; my administration is committed towards a better future for all Malaysians, a future of plenty, of full employment, of high wages and a quality of life equal to that of a developed nation. In order to move forward to the next level, Malaysians need to shed dogmatically and rigidly held assumptions and beliefs whilst wholeheartedly embracing reform and change. It is said that the definition of insanity is doing things the same way over and over again while expecting different results. Let us not fall into this abyss.

Our only way forward as a nation is to embrace a new economic model based on creativity, innovation and high value. It is a national imperative to shift our reliance and dependence on semi skilled and low cost

labour to a high tech manufacturing and modern services economy staffed by skilled and knowledge workers.

The housing and property sector must embrace and strategically position the industry to thrive in this new economic model. Granted such a change in direction cannot happen overnight as it requires fundamental changes and a mindset overhaul. The government will continue to provide the necessary, conducive environment to facilitate this quantum leap. The recent deregulation of the Foreign Investment Committee (FIC) Guidelines bears testimony to the Government’s commitments to make the necessary changes required to ensure pragmatic and practical policies are adopted to support the country’s sustained growth and position it competitively.

Ladies and Gentlemen,The country’s private housing sector is

unique in many ways. It is about the only industry that is not a pure economic venture but also bears the responsibility of fulfilling the nation’s social reengineering agenda. Through its low cost, low medium cost and medium cost housing policies, as well as Bumiputera quota and discounts, the industry has played a very crucial part in meeting not only the rakyat’s homeownership aspirations but also playing a socio economic role.

I thank the industry for its perseverance and commitment throughout the years and the support that you have lent to the public sector. Let me assure you again that we hear your cries loud and clear and the Government, through its Economic Planning Unit, is studying the most feasible and sustainable model for the country’s social housing goals where the lower income group is assured of continuous access to quality and affordable homeownership with proper facilities and amenities. It is timely that the Government looks into a total revamp of the current system and comes up with a new winning formula for all parties involved so that the social agenda continues to be realised in tandem with the growth and progress of the private sector.

In regard to the woes concerning the release mechanism of unsold Bumiputera quotas which have plagued the industry for many years, I would like to urge the relevant State Authorities to study this problem objectively so that a long term solution can be found. Whilst the Government stands firm on

first and foremost, I thank everyone for joining us in celebrating REHDA’s 39th Anniversary. On behalf of the Association, I would like to express our heartfelt appreciation to Yang Amat Berhormat Dato’ Sri Mohd Najib Tun Hj Abdul Razak for being with us tonight. Your graceful presence makes this special occasion an even more memorable event for the housing and property industry.

YAB Datuk Sri, Distinguished Guests, Ladies and Gentlemen,

Today, our economy is challenged by uncertainties of the global downturn, and the housing and property industry is not spared from the negative impact of such a slowdown. The weakened demand and decelerated buyers’ confidence have led to greater circumspect on the part of industry players in order to ensure that investments do not turn into holding costs due to lower market absorption. But unlike other sectors of the economy, the housing market has a strong underlying demand due to the country’s demography and young populace. Indeed the industry has proven to be the engine of growth for domestic demand, even in difficult times, given the right levers that could help stimulate the market. Premised on these fundamentals, REHDA had submitted to the Government through various forums, a series of proposals to fortify demand condition and mitigate market’s crisis of confidence. Whilst the Government has taken heed of some of the proposals through the Stimulus Packages announced earlier, we believe that more could be done to help the industry regain its momentum. Specifically, our proposal for a comprehensive Home Ownership Campaign and across the board reduction of stamp duty

rates are but two measures that could help bring the industry out of the current doldrums efficiently and at the same time benefit the economy on a larger and more impactful scale. The Government may have yet to respond in the positive to our proposals, but we firmly believe that such constructive measures should be implemented sooner rather than later. We optimistically await further announcement on the proposed measures, YAB Dato’ Sri.

YAB Dato’ Sri, Distinguished Guests, Ladies and Gentlemen,

The complexity of the housing and property industry has resulted in it being exposed to increased costs vulnerabilities. Whilst the market may have been able to absorb these increased costs in the past, the challenging downtrend in recent times and the avalanche of financial contribution and charges imposed on the industry have led to breach of tolerance level on the part of developers as investors. If left unchecked, the increased costs of doing business may result in house prices being too prohibitive and beyond the reach of the general rakyat. In some cases, the added costs may be too punitive for development projects to even be economically viable.

On behalf of the stakeholders of the housing and property industry, we would like to highlight to YAB Dato’ Sri, the industry’s quandary resulting from the recent amendment to the Stamp Act, whereby construction contracts are categorized as service contracts thus charged with ad valorem rate of 0.5%. Such imposition is not fair to the industry and is counter-productive to Government’s policies and objectives of stimulating the economy through development and infrastructure projects. The industry is of the opinion that construction contracts should not be categorized as service contracts as construction is mainly an assembly of construction activities and not a service. The industry appeals to YAB Dato’ Sri to grant an exemption on construction contracts from being charged with ad valorem duty as such duty would result in sharp escalation of construction costs as a whole. The industry is currently already subjected to various payments and taxes including construction levy payable to the CIDB.

YAB Dato’ Sri, Distinguished Guests, Ladies and Gentlemen,

REHDA is in full support of One Malaysia,

the issue of social justice, it is in cognizant that holding on to Bumiputera quota units where the demand is lacking is proving to be problematic for developers. Certainly it is not the Government’s intent to burden the industry unnecessarily and an expedient resolution to the problem will help the industry move forward and promote further re-investment for the benefit of the economy.

As a responsive Government, we welcome consultations with the private sector, particularly REHDA, in finding comprehensive solutions to various long-standing issues and challenges faced by the industry. In this regard, we welcome proposals for improvement that could facilitate the industry in embracing the new economic model as well as specific proposals to boost demand and market activities in these trying times so that Malaysians can continue to afford better living environment.

That being said the industry on its part must continue to carry out its role of providing affordable and quality housing for the nation in an efficient and effective manner. In today’s challenging environment, let us not only look at addressing short-term vulnerabilities but also long term competitiveness of the industry and the economy. In supporting this strategy, research and development, creativity, innovation and the adoption of new technologies will need to be the new industry buzzwords.

The industry needs to develop new products and concepts that bring added value to the nation in a more efficient, sustainable and highly economic manner. The importance of training and improvement of human skills cannot be over emphasized and I am pleased to note that REHDA had taken steps in the right direction in providing training to the industry through its education arm, REHDA Institute.

Ladies and Gentlemen,On this note, I take this opportunity to

congratulate REHDA again on the occasion of its 39th Anniversary. The major part of today’s built environment is attributed to members of REHDA, and the 4 million units of houses built for the rakyat over the last thirty nine years is in itself a major milestone worthy of celebration. Nevertheless, let us all remember that there are still lots of work to be done, lots of quality housing to be built, so I wish all of you every success in housing the nation for many years to come.n

People First, Performance Now. It is in the true spirit of One Malaysia that REHDA fully subscribes to the country’s pursuit for sustainability and the government’s commitment towards social agenda of low cost and bumiputera housing policies. Nonetheless, we believe these responsibilities should not be solely shouldered by the housing industry but should instead be shared out more equitably. In order to competitively position the housing and property industry as an efficient value adding sector of the economy, a total review of passé and impracticable policies, legislative provisions, guidelines and practices that inhibit progress is opportune.

Specifically, on behalf of the industry we seek YAB Dato’ Sri’s indulgence on the heavy cross-subsidization borne by the industry in the provision of low cost housing. Whilst low cost house prices have remained at 1998 prices, the development costs of such units have soared up significantly beyond the ceiling prices. The blanket 30% quota has also created a situation of mismatch between supply and demand for such houses, resulting in many unsold and unoccupied low cost units.

In this regard, REHDA proposes that the role of social housing provision be reverted back to the Government through the Syarikat Perumahan Negara Berhad (SPNB), a vehicle specifically established for the very purpose of building affordable housing for the rakyat. We were made to understand that the Economic Planning Unit is already looking into the matter and we applaud the Government for taking such proactive steps to ensure that all spectra of the society has adequate and easy access to quality affordable housing.

Similarly, the issue of release mechanism for unsold Bumiputera quota units has plagued the industry for far too long. The increasingly high quota has led to enlarged numbers of unsold Bumiputera quota units, especially in States with higher quotas and in locations that are less preferred by the

target market. The absence of a structured and transparent release mechanism for such unsold units has created project cash flow uncertainties and held up resources unproductively. More often than not, developers are left in the dark as to when these unsold units can be released, if ever, to the open market and this poses an onerous burden on the industry.

What the industry is urging for is the implementation of a fairer, more transparent, certain and structured release mechanism so that incidences of unproductive tie up of resources can be minimized, if not eliminated. It is only just that the discount for such quota be standardized throughout the nation and capped at 5%. Additionally, to ensure that such policy benefits the specific target group effectively, discounts should be applicable only to properties with specified ceiling prices and not across the board.

YAB Dato’ Sri, Ladies and Gentlemen,REHDA, on behalf of the industry,

would also like to place on record our appreciation to YAB Dato’ Sri for your understanding of the industry’s predicament concerning steel bar issues. The recent liberalization of the steel industry will provide our industry with the much needed breather. The industry collectively is a major user of steel bars and the liberalization will help alleviate the impact of increased development costs.

YAB Dato’ Sri, Ladies and Gentlemen,On this propitious occasion of REHDA

Malaysia’s 39th Anniversary, I would like to thank all members for your unwavering support and active participation in REHDA over the last four decades. Your contribution and invaluable feedback have enabled us at REHDA to better represent the association in tackling the issues and challenges confronting the industry. REHDA’s growth over the years is attributed to all members and it is apt that we share with you tonight, another momentous milestone in our quest for excellence, the proposed REHDA New Headquarters. It is our genuine hope that

the expansion of REHDA Headquarters will enable more activities, R&D and training programmes to be organized for the benefit of members specifically and the housing and property industry generally.

REHDA fully supports the Green Building Concept and its significance to the advancement of the industry. The new REHDA Headquarters encapsulates our commitment towards sustainable development. Towards this end, we have carefully ensured that the design of our proposed new Headquarters subscribes to such concept and incorporates environmentally friendly and sustainable features. The building, expected to be in full operation by 2011, manifests yet another REHDA’s commitment in leading the industry to a new level of maturity.

On behalf of REHDA National Council, I would also like to extend our heartfelt appreciation to our past leaders, who have paved the way for the Association and charted its direction to where REHDA stands today. Your commitment to the industry will inspire us to strive harder in promoting a more sustainable and orderly growth of the housing and property industry.

It is therefore befitting that on the occasion of this 39th Anniversary celebration, we record our appreciation and gratitude to our Immediate Past President and Patron, Yang Berbahagia Dato’ Jeffrey Ng Tiong Lip for his selfless contribution to REHDA and the industry.

business Licensing Electronic Support System (BLESS) is a portal developed by the Government to facilitate licences application in Malaysia. It was launched by YAB Tun Abdullah Ahmad Badawi on 5 September 2008. BLESS is a virtual One Stop Service Center that assists companies to obtain business licences efficiently and in an organized manner.

The system allows company representative to select relevant licences, fill up the online application forms, submit online and track the progress of the application throughout the process until notification of approval or otherwise. At the same time, BLESS provides an online communication platform for the licensing agencies to communicate directly with the company for any clarification and justification on the licence applications which effectively save time and resources for both parties.

Implementation of BLESS

PHASE 1Development of Manufacturing Sector (Feb 2008), Construction Sector (May 2009) and Hotel Sector (June 2009) within the Klang Valley.

PHASE 2Development of other sectors within the Klang Valley and integration with existing electronic system at agencies.

PHASE 3Development throughout Malaysia (Excluding Sabah and Sarawak).

Improvements to Information and Processes Several improvement to the license application processes have been made since the inception of BLESS in 2008. BLESS is expected to act as a communication platform for the government agencies and the applicants by:

n A One-Stop Information and Submission CentreInformation regarding name of licences, agencies involved, license fees and application forms can be obtained through BLESS.

n Electronic Submission of ApplicationApplication for Manufacturing License (ML), Planning Permission, Building Plan Approval, Land Matters Approval and Operational Licence Approval can be made via the online portal. Examples; Licences from DOSH, Premise and Advertisement Licence.

n Electronic Composite Form

i. Applicants do not need to fill up again all the relevant information as it is already captured in BLESS;

ii. Company profile from Companies Commission of Malaysia automatically transferred to BLESS with a minimum fee of rm15. Company does not have to submit Form 9, 24, 44 and 49;

iii. Getting views from relevant agencies are done simultaneously and time frame for their respond are specified.

n Electronic Payment

n Electronic Communication between Applicant and Agency for the purpose of:

i. Seeking more information about the company and its application;

ii. Submission of additional information.

the 11th Malaysian Developers’ Council Meeting was held on 14 August 2009 at the Le Meridien Hotel Kota Kinabalu, Sabah. Hosted by the Sabah Housing and Real Estate Developers’ Association (SHAREDA), the tripartite meeting between REHDA, SHAREDA and SHEDA was held to discuss current issues and challenges facing the housing and real estate industry.

REHDA’s delegation was led by its President, Datuk Ng Seing Liong, JP, Vice President, Mr Ricque Liew, National Treasurer, Tn Hj Muztaza Mohamad and National Council Member, Mr Anthony Cho Tian Han. Deliberations from the meeting were communicated to the media in Semenanjung, Sabah and Sarawak through a joint statement released after the meeting. The statement is reproduced below for readers’ information:n MDC welcomes the recent announcement by the Prime Minister,

YAB Dato’ Sri Najib Tun Abd Razak that the government is currently reviewing its current low-cost housing system and policies through EPU and MDC urges that the Government should reassume its responsibility of prioritizing public housing for the rakyat through general taxation.

n The MDC would like the Bumiputera Quota to be capped at 30%. There must be a structured and transparent release mechanism. There should be a ceiling price for Bumiputera Quota as it is unfair for those who can purchase luxury house to enjoy the discount, which should be capped at 5%.

n The MDC appeals to the Federal Government to put on hold the 0.5% ad valorem Stamp Duty on Construction Contract as this has increased the cost of doing business and contractors are now already paying levy of 0.125% to CIDB.

n The MDC also appeals to the Federal Government to reduce the Stamp Duty on properties transactions.

n To reduce the levy on foreign workers by 50% and to allow employer to pay the levy by monthly installments. Employers should also be given Tax Incentives for hiring local workers.

n Electricity Capital Contribution imposed on housing developers in Sabah and Sarawak should be at par as Peninsular Malaysia’s TNB’s rate in line with “One Country, One Rate”. For information, Sabah and Sarawak’s electricity capital contribution is 700% more expensive than Peninsular Malaysia.

The host, SHAREDA also hosted a warm fellowship dinner at the Le Meridien Hotel following the meeting.n

Dinner with State Secretaryrehda Kedah/Perlis Branch organized an appreciation dinner at the Star City Hotel, Alor Setar on 4 August 2009, in appreciation for Yang Berbahagia Dato’ Bijaya Indera Dato’ Paduka Syed Unan Mashri bin Syed Abdullah on his retirement as the State Secretary. The dinner was also held in honour of Yang Berhormat Dato’ Seraja Setia Dato’ Wira Haji Rasli bin Basir on his recent appointment as the State Secretary. The event was attended by more than 200 REHDA members and distinguished guests.n

REHDA Penang 35th Anniversary Dinnerrehda Penang organized its 35th Anniversary Dinner 2009 on 19 August 2009 at G-Hotel, Penang with the aim to promote interaction and goodwill among member developers as well as to establish closer rapport with senior officials from the various State Government Departments and agencies. The event was graced by the presence of YAB Mr Lim Guan Eng, Chief Minister of Penang. Various heads of government departments and NGOs from fraternal organizations also attended the dinner.n
