In the 14th century, the Aztec empire, 2 million strong, was one of the most

powerful civilizations in the western hemisphere, but it was conquered within a year

by a Spanish force of about 600 lightly armed soldiers. How did it happen?

TRADEMARK INFRINGEMENT CASE

SEES NORTH AMERICAN PASTOR IMPRISONED

A North American pastor is in prison for defying a court’s ruling in a trademark

infringement dispute case that underscores the significance of the Seventh-day

Adventist Church’s corporate identity.

Walter McGill was apprehended and turned over to San Bernardino County

law enforcement on the campus of church-run Loma Linda University in Loma

Linda, California on July 13. His arrest concluded a legal saga spanning nearly a

decade and drawing widespread media attention.

McGill raised concern among church legal counselors when he used the phrase

“Seventh-day Adventist” to name his small congregation in Guys, Tennessee, the

Creation Seventh Day Adventist Church. McGill claimed he was an Adventist

pastor, but a database of service records administered by the church in North

America

indicates otherwise.

In 2005, the Adventist world church’s Office of General Counsel first asked McGill

to cease using the name “Seventh-day Adventist” on both his church building and

several websites.

“At the time, everyone thought, ‘Oh, it’s just a little church in Tennessee,’ but our

primary concern was McGill’s Web presence,” said Todd McFarland, an associate

general counsel in the Office of General Counsel at Seventh-day Adventist world

church headquarters.

A year later, the church’s Office of General Counsel pursued a trademark

infringement case against McGill, suing him for wrongful use of “Seventh-day

Adventist.” The Seventh-day Adventist Church’s name is a registered trademark and

can legally apply only to official church congregations, entities, institutions,

denominational ministries and certain lay and professional groups as approved by

the world church headquarters. Most such trademark infringement disputes are

settled

outside the court, with litigation a “last resort” only after “months or years” of

dialogue, McFarland said. More often, a ministry is granted a name-usage license if

they qualify, or are persuaded to change their name.

When McGill refused to attend a court-ordered settlement conference, the court

dismissed the case. McGill appealed to the Sixth Circuit Court of Appeals, but the

Adventist Church won despite his eleventh-hour raising of the Religious Freedom

Restoration Act.

The act, which the Adventist Church supports, is meant to prevent laws that

encumber an individual’s free expression of religion. In McGill’s case, however, the

Sixth Circuit ruled that the act did not apply. McGill responded by filing a writ of

certiorari to the Supreme Court, seeking judicial review of the Sixth Circuit’s

decision. The nation’s highest court denied the writ.

“In the interim, there were some orders for the signs to come down,” McFarland

said. “They actually sent the marshals in to remove some signs, which McGill

promptly put back up.”

In May, the Sixth Circuit found McGill in contempt for not complying with court

orders to remove the signs, issuing a warrant for his arrest. Responding to McGill’s

recent apprehension, Seventh-day Adventist Church officials have emphasized that

McGill was imprisoned strictly for ignoring the court’s orders.

“Mr. McGill is free to engage in any ministry he wants, preach whatever he wants,

say whatever he wants,” McFarland said. “What he simply cannot do is falsely

associate himself with the work of the Seventh-day Adventist Church.”

Garrett Caldwell, Adventist world church Public Relations director and church

spokesman, added that in cases such as McGill’s, the church is fundamentally

protecting its identity.

“People understand what identity theft means on a personal level and how

devastating it can be to an individual or a family,” Caldwell said.

“When a congregation that has never had a connection with our denomination, and

who does not wish to, because of differing beliefs, wants to simply co-opt our name,

we should not overlook this or find this acceptable. To do so would be irresponsible

on our part,” he added.

STATE DEPARTMENT HIGHLIGHTS GLOBAL RELIGIOUS

RESTRICTIONS IN NEW REPORT

Religious minorities continue to suffer loss of their rights across the globe, the State

Department reported Monday (July 30), with a rise in blasphemy laws and

restrictions on faith practices.

Almost half of the world's governments "either abuse religious minorities or did not

intervene in cases of societal abuse," said Ambassador-at-Large Suzan Johnson

Cook at a State Department briefing on the 2011 International Religious Freedom

Report.

"It takes all of us -- governments, faith communities, civil society working together

to ensure that all people have the right to believe or not to believe," she said.

Christians in Egypt, Tibetan Buddhists in China and Baha'is in Iran are among those

without religious rights, the report states.

In Pakistan, Saudi Arabia and Indonesia, people have been killed, imprisoned or

detained because they violated or criticized blasphemy laws. In Indonesia, a

Christian was sentenced to prison for five years for distributing books that were

considered "offensive to Islam."

These statutes, the U.S. government says, silence people in countries that claim to

be "protecting religion."

The report highlighted the plight of religious minorities in countries that have been

in political transition, especially Egypt, which it said has failed to halt increasing

violence against Coptic Christians.

"Government officials have not been held accountable for their actions, and there

were indications in early 2012 of mounting Coptic emigration," the State

Department report noted.

Some religious groups struggle to be recognized by their countries. A new law in

Hungary reduced the number of recognized religious groups from more than 300 to

fewer than 32.

Iran, one of eight nations designated by the State Department as "countries of

particular concern," was criticized for deterioration of an already "egregious" state

of religious freedom. Christian pastor Youcef Nadarkhani -- who has garnered

support from U.S. Christians -- remains in jail and faces possible execution, while

seven Baha'i leaders' sentences were returned to their original 20 years after they

were reduced to 10 in 2010.

Conditions in China, another country designated for particular concern, also

deteriorated, with growing restrictions on Tibetan Buddhists.

"The self-immolation of over 40 Tibetans in protest of Chinese policies continue to

demonstrate their desperation," Johnson Cook said.

Katrina Lantos Swett, chair of the U.S. Commission on International Religious

Freedom, called the State Department report "commendable" but said the

department still must convince policymakers that religious freedom should be a

"moral imperative."

"The other challenge is convincing foreign governments to make needed

improvements," she said.

In several countries, the department noted a rise in anti-Semitism, from Holocaust-

denying websites sanctioned by Iran to an openly anti-Semitic party in Hungary.

Despite numerous examples of diminished religious rights, the State Department

said there has been improvement in some countries.

In Cuba, while "significant" restrictions remained, most religious organizations

reported increasing ability to hold activities and seek new members.

The Russian government "generally" showed respect for religious freedom, but the

Russian Orthodox Church received preferential treatment over less traditional faiths.

"Even as this report documents abuses of religious freedom, the events of 2011 show

that change is possible," the reports summary states, "and suggests that countries

whose constitution, laws, policies, and practices protect religious freedom and

human rights will be the most vibrant and stable."

An Appeal for Oneness in Christ

A Response by the General Conference Officers and Division

Presidents to the Columbia Union Conference

Constituency Meeting Action

“Holy Father, keep through Your name those whom You have given Me, that they

may be one as We are” (John 17:11, NKJV).

The unity among disciples for which Jesus prayed is a precious gift of God: this gift

must be continually nurtured and is a never-ending and often difficult task of those

gathered in His name. Thus the apostolic church could engage in vigorous

discussion and even robust disagreement with the assurance that each member’s

personal surrender to the Spirit would result in a God-honoring resolution to the

challenges and conflicts so that the essential unity of the church was preserved and

extended (Acts 15:1-29). Disagreement in such a community of faith is neither fatal

nor schismatic, for each believer accepts the responsibility to fulfill the prayer of

Jesus by acting and speaking to preserve the unity He expected as indicated in John

17.

Unilateralism—the premise that one individual or one group may pursue its vision

of truth at the expense of the unity of the whole—was and is the great adversary of

the unified Body of Christ. It ruptures the essential bond which brings people from

everywhere into the remnant church, tempting them to prefer one truth above the

higher and collective requirement to act in concert with each other.

Appealing for a serious recommitment to the principle of church unity, the officers

of the General Conference and the division presidents issued a call for restraint in

their consensus statement of June 29, 2012, “An Appeal for Unity in Respect to

Ministerial Ordination Practices”. Fully aware that significant differences exist

regarding the theology of ordination and the appropriateness of ordaining women to

the gospel ministry, they nonetheless urged all entities and individuals in the church

to respect current Church policy and General Conference Session decisions, and to

work harmoniously through the process established by the General Conference

Executive Committee in October 2011. That action established a worldwide three-

year study and discussion process culminating with a Theology of Ordination Study

Committee which will review all aspects of the practice of ministerial ordination in

the Seventh-day Adventist Church including the ordination of women to the gospel

ministry, with reports provided to the October 2014 Annual Council meeting of the

Executive Committee. This would allow any agreed-upon resolutions to be placed

on the agenda of the 2015 General Conference Session, the body accepted by church

entities and affirmed by the divinely-inspired counsel of the Spirit of Prophecy to be

the official voice and the highest ecclesiastical authority of the church. The General

Conference Executive Committee, the highest deliberative authority of the

worldwide church between General Conference Sessions, includes nearly 120 union

conference and union mission presidents as voting delegates, along with elected

officers, departmental directors, pastors, frontline employees and numerous

laypersons.

It was thus very disappointing to the senior leaders of the worldwide church to learn

of the unilateral action taken by the delegates of the Columbia Union Conference at

a special constituency meeting on July 29, 2012. That action is not in harmony with

General Conference Working Policy—the collective decisions of world leadership

that define the operating procedures and relationships applicable to all

organizations. Further, the action sets aside the 1990 and 1995 decisions of the

General Conference in Session respecting the practice of ordination. It pre-empts

the process voted by the General Conference Executive Committee for the current

study of ordination theology and practices by committing the Columbia Union

Conference to a particular outcome before the study-and-discussion process is

completed. In so doing, it asserts the right of one entity to place its conclusions

above the principle of unity in the Body of Christ. By this action, the delegates have

allowed for a principle of unilateralism and autonomy throughout their territory that

can only be disruptive to the harmonious functioning of the Columbia Union

Conference, as well as to that union’s relationship with the world church

family. Unfortunately, some conferences, congregations, and individuals may try

now to incorrectly cite the example of the Columbia Union Conference itself as

justification for pursuing any independent course of action. It is possible that some

who voted for the resolution on July 29 may not have fully understood the danger

their action poses to the functional unity of their own region and to the wider

denomination.

The action taken by the Columbia Union Conference represents a serious threat to

the unity of the worldwide Seventh-day Adventist Church, and thus, at its next

meeting in October 2012, the General Conference Executive Committee will

carefully review the situation and determine how to respond. In the Spirit of our

Lord and Savior, Jesus Christ, the officers of the General Conference and the

division presidents again appeal to all entities, organizations, and individuals,

including the Columbia Union Conference, to refrain from independent and

unilateral decisions and implementing actions on issues affecting ministerial

ordination, and to invest their energies and creativity in fostering a vigorous dialogue

through the established process about how the Church should recognize and affirm

the gifts of the Spirit in the lives and ministry of believers.

An important companion document, organized as a series of questions and answers

about key assumptions, assertions and historical backgrounds discussed at the recent

Columbia Union Conference constituency meeting or in related communication, will

be available approximately Wednesday, August 8, through the media outlets of the

General Conference.

ADRA Assists Congolese Refugees 09-Aug-2012

The Adventist Development and Relief Agency (ADRA) Australia has joined with

ADRA Uganda and other ADRA offices around the world to assist close to 30,000

refugees escaping ongoing civil war in the Democratic Republic of Congo.

Continued violent attacks between Congolese government forces and armed militia

since presidential elections in November 2011 have uprooted thousands of families.

As a result, more than 33,000 refugees have fled into neighbouring Uganda,

stretching already inadequate national resources to breaking point.

“With the population of the largest refugee settlement, Rwamawanja, continuing to

expand, ADRA Uganda is working to address the growing issues of food insecurity

and environmental threats,” said Mark Webster, acting Director of Emergency

Management for ADRA Australia. “Thousands of families are attempting to grow

food and cutting down trees for firewood, which puts the long term sustainability of

the settlement under threat.”

To counter these issues, ADRA Uganda, in partnership with the Food and

Agriculture Organisation of the United Nations, is beginning the distribution of high

yield and quick maturing vegetable and cereal seeds to 7,500 families. Plus, with

support from ADRA Australia and the global ADRA network, ADRA Uganda will

also be providing farm tools, material to protect crops and training in sustainable

agriculture practices.

In early 2012, ADRA Uganda was called upon by the Ugandan government to

distribute jerry cans, mosquito nets, soap and other non-food items to a refugee

camp in south western Uganda that ballooned to more than three times its planned

capacity of 1,000. Further, ADRA extended its provision of essential items when the

Ugandan government opened the Rwamawanja refugee settlement.

slack, disorderly person to make a good Christian. Their lives, in temporal and

religious things, are just as disorderly as their dress, houses, persons, and premises.

There is order in heaven. There are rules and regulations which govern the whole

heavenly host. All move in order. All there is cleanly, all in perfect harmony. And

everyone who will be counted worthy to enter heaven will be thoroughly disciplined

and will be without spot or wrinkle or any such thing. The uncultivated have spots

and wrinkles upon them now. They had better lose no time in commencing the work

of cleansing themselves from all filthiness of the flesh and spirit, perfecting holiness

in the fear of the Lord.

God loves purity, cleanliness, order, and holiness. God requires all His people who

lack these qualifications to seek them and never rest until they obtain them. They

must commence the work of reform and elevate their lives, so that in conversation

and deportment their acts, their lives, will be a continual recommendation of their

faith and will have such a winning, compelling power upon unbelievers that they

will be compelled to acknowledge that they are the children of God.

The truth as it is in Jesus will not degrade but elevate the receiver, purify his life,

refine his taste, sanctify his judgment.
