• successful business migrants are first granted a Business Skills (Provisional) visa for four years, then• after establishing the requisite level of business or maintaining

their eligible investment, are eligible to make an application for a Business Skills (Residence) visa (permanent residence) - applied for in Australia

A direct permanent residence category will still be available for certain business migrants sponsored by State/Territory governments. This is known as the Business Talent visa.

Who can apply for a business skills visa?

• business owner: for owners or part-owners of a business• senior executive: for senior executive employees of major businesses• investment: for investors/business people willing to invest in Australia• business talent: for high-calibre business people who have sponsorship from a State/Territory

governmentPersons who are in Australia on temporary visas (existing 457 independent executive visa holders - new applications for a 457 independent executive was discontinued on 1 March 2003) may still apply for Permanent Residence under the following two categories (or under the new Business Owner / Residence visa):

• established business in Australia (EBA): for people temporarily in Australia who are owners or part owners of a business

• regional established business in Australia (REBA): for people temporarily in Australia who are owners or part owners of a business in a designated area of Australia

The Australian Business Visa encourages successful business people (business owners, investors and senior executives) to settle permanently in Australia and develop new or existing businesses in Australia.

General Australia Business Visa Information:

Under the new two-stage arrangements introduced on 1 March 2003:

• successful Australian business visa applicants are first granted a Business Skills (Provisional) visa for four years, then;

• after establishing the requisite level of business or maintaining their eligible investment, are eligible to make an application for an Australian Business Skills (Residence) visa (permanent residence) - applied for in Australia

A direct permanent residence category will still be available for certain business migrants sponsored by State/Territory governments. This is known as the Business Talent visa.

Australia Tightens Up Eligibility Criteria

The Australian Government has tweaked the eligibility criteria for several of its business-related visa classes in order to try to “increase the potential contribution of business migrants to the economy, create more jobs for Australians and improve visa integrity”.

The changes raise the required asset value level of both the federal and state-sponsored visa classes for business owners and senior executives. In addition, the percentage of controlling interest for business ownership has been increased, especially in the case of smaller businesses (with turnover less than AU$400,000) where the holding must be at least 51%.

There has also been a tightening in the potential candidates for one of the main provisional visas – Subclass 163 - with the exclusion now of senior managers. Only business owners are now eligible for this visa.Source: DIAC, April 2010All of these changes mean that potential business migrants to Australia should carefully consider the terms and

direction of their application, as well as other factors, such as their business strategy and the time-scales involved. The use of a MARA-registered Migration Agent is

highly recommended for a thorough pre-application assessment and professional visa processing.

JULY 2012 MAJOR CHANGE: Expression of Interest (EOI)

What if my circumstances change after lodging my EOI?

If your circumstances change after lodging your EOI and before you are invited to lodge a visa application, you would be required to update your information in the database. Updates to your skills would ensure that any documentation you submit in respect of a visa application is consistent with the information on the database. This may increase your score on the points test, therefore improving your chance of being issued with an invitation to lodge a visa application.

If the details you provide in your visa application do not match those contained in your EOI, you may not be granted a visa even if you meet the threshold criteria.

Find out your business migration options please contact Global Migration Solutions at +603 2142 5199 as soon as possible.
