Introduction
The inaugural 2012 DCIG Early Case Assessment Buyer’s Guide presents the results of an extensive and objective analysis of the Early Case Assessment (ECA) software currently commercially available within the eDiscovery market.
With the accelerating increase in the amount of Electronically Stored Information (ESI) combined with changes to federal, state and local rules of civil procedure, eDiscovery has become the single most important and costly process within the early stages of the litigation life cycle.
eDiscovery is the Information Management process of identifying, collecting, integrating, normalizing, culling, analyzing, reviewing and producing relevant electronic evidence as may be required by litigation. Given the fact that document review is the most human resource intensive and therefore the most expensive component of the eDiscovery life cycle, the industry relies upon ECA software to help reduce the amount of ESI that must be reviewed.
Historically, the task of eDiscovery was accomplished by litigation service providers and law firms through a combination of manual data collection, computer forensics and a variety of different software programs at different phases of the eDiscovery life cycle. Within this context, ECA software was primarily utilized for general culling, rudimentary search and analytics.
However, with the increase in volume and complexities of ESI, responsibility for eDiscovery is migrating to the enterprise. As a result, sophisticated enterprise IT users are now part of the buying process and are demanding that ECA software include tighter integration with enterprise systems, more standard information governance functionality and support for a larger percentage of the eDiscovery life cycle with a single holistic platform.
As part of the research to produce this Buyer’s Guide, DCIG interviewed vendors, users and potential users of ECA software to better understand these new requirements and develop a set of buyer criteria for selecting ECA software.
As an example, with the increase in the various types of data that users expect ECA software to identify, ingest, process, search, analyze, normalize and review, ECA software vendors have had to increase the number of different data connectors that they support. Some vendors have increased the number of data types that they support to over 400; others concentrate on Microsoft email and office documents.
In response to buyer demand for more sophisticated search capabilities, some vendors have chosen to develop proprietary indexing and search technologies to support semantic search as a native function of its ECA software. Vendors have taken different product paths to support sophisticated search. The paths range from integrated next generation search technology from third party providers to Boolean search.
With the ever increasing number of legal matters and complexities in eDiscovery life cycles, some vendors have decided to develop proprietary support for legal hold, workflow and project management as a native function of its ECA software. Other vendors have chosen to address these requirements by integrating with workflow and project management software from third party providers. Unfortunately, some vendors have chosen not to support legal hold, workflow or project management.

Finally, with the world moving to Cloud Computing, buyers are requesting vendors to offer the option of accessing their ECA software under a Software-as-a-Service (SaaS) delivery model. With the launch and rapid adoption of enterprise class Cloud Service Providers (CSPs) such as Amazon Web Services (AWS), Rackspace and BlueLock, vendors must now decide whether to maintain their own data centers, offer their SaaS solution through litigation services providers and law firms or provide hosting through one of the CSPs.
The emergence and evolution of these new requirements within the ECA software market introduces complex choices for buyers as they navigate their way through the buying process. The inaugural 2012 DCIG Early Case Assessment (ECA) Buyer’s Guide addresses these complex buyer choices by providing an objective ranking of the leading ECA software based upon the product features and functionality that DCIG determined to be the most relevant in today’s eDiscovery market.
DCIG understands not all buyers require support for the same features and functionality. As an example, some buyer’s may require ECA software that can ingest, process and cull Lotus Notes with cursory first pass review, simple Boolean search, tagging and production of a load file for kCura Relativity. As such, the Buyer’s Guide enables buyers to perform “at-a-glance” comparisons of product features and functionality to easily develop a short list of ECA software that meets their specific and unique requirements.

The inaugural 2012 DCIG Early Case Assessment Buyer’s Guide presents the results of an extensive and objective analysis of the Early Case Assessment (ECA) software currently commercially available within the eDiscovery market.
The amount of Electronically Stored Information (ESI) that the world produces and stores on a daily basis is increasing at an accelerating rate. In 2012, the number of business emails sent and received per day total 89 billion. In 2012, the numbers of worldwide Instant Messaging (IM) accounts total over 2.7 billion. DCIG measures the amount of ESI in terms of zettabytes (ZB). There are more than one billion terabytes in a zettabyte. In 2012, there are 2.8 ZB’s of ESI and we expect that amount to grow by 50% every year1.
This extraordinary increase in the amount of ESI is placing a heavy burden on the world’s legal system. The system is struggling to provide a cost effective process which enable litiga-tors to present ESI as evidence in legal proceedings. This process is collectively referred to as eDiscovery. eDiscovery is comprised of identifying, collecting, integrating, normalizing, culling, analyzing, reviewing and producing relevant ESI as may be required by litigation.
A growing practice within the eDiscovery process is Early Case Assessment (ECA). ECA is the practice of identifying, collecting and analyzing potentially relevant ESI before an incident is prosecuted e.g. before a law suit goes to trial.
In the book, Art of War, Sun Tzu wrote, the best victory is that which is achieved before the fight. These ancient words of wisdom hold true for ECA. Organizations can utilize ECA software within their ECA practice to determine the overall merits of a matter and develop a strategy. ECA software reduces costs associated with analyzing potentially relevant ESI. As such, ECA Software has become an important asset to any organization that is routinely involved in investigations, internal incident resolution, litigation, etc.
As part of the research to produce this Buyer’s Guide, DCIG interviewed vendors, users and potential users of ECA software to better understand these new requirements and develop a set of buyer criteria for selecting ECA software.
Based on this research, DCIG placed a heightened focus on ECA software with the following features delivered as an integrated holistic platform:

Please note that DCIG is not indicating that ECA software that does not include all of these features and functionality will not meet the specific needs of a given organization. Our research found that there are ECA vendors that have defined a very narrow ECA product mission or target market that does not include many of these features or functionality. As an example, there are several ECA vendors reviewed in this Buyer’s Guide that target the small to mid-size regional litigation service providers and law firms and have no immediate plans to market to the enterprise.
There are other ECA vendors reviewed in this Buyer’s Guide that provide many of the features and much of the functionality that DCIG deemed to be most important to ECA software buyers. However, these ECA vendors accomplish this with a variety of independent ECA software products that requires users to pass data between the various modules.
Therefore, in support of buyers that have a much more narrow or specific set of buying criteria, the Buyer’s Guide also enables organizations to perform “at-a-glance” comparisons of product features and functionality to easily develop a short list of ECA software that meets specific and unique buyer requirements.

How to Use this Buyer’s GuideThis Buyer’s Guide is designed to assist buyers through the process of purchasing ECA software. It is NOT intended to tell buyers exactly which ECA software to purchase. Rather it intended to provide additional infor-mation to help guide buyers in developing a list of ECA software products that have features and functionality that meet their specific needs.
It is also important to note that just because a product scored the highest in a particular category or is ranked a certain way does not automatically mean that it is the right product for their organization. If anything, because of the scope of the products evaluated and analyzed, it may have features that are too robust for the needs of an individual department or organization.
However what this Buyer’s Guide does is give buyers some sense of how each product compares to other products classified in this Guide, as well as offers additional insight into what product offerings are available on the market.
DCIG recommends that you use this Buyer’s Guide in the following seven ways:
•Eliminate the painstaking research associated with
coming up with a short list of products that meet
their needs. This Buyer’s Guide ranks, scores and contains data sheets for 29 different products from 25 different vendors. Products are scored and then ranked as “Recommended,” “Excellent,” “Good” and “Basic” based upon its score. DCIG used over 300 different features to evaluate, weight, score and then rank each product. All an organization has to do is look at the scores and features of each product in order to come up with a short list of products for consideration.
•Do apples-to-apples comparisons of products from
different vendors. In today’s crowded ECA market, it behooves organizations to get competitive bids from multiple vendors. After all, when they compete, you win! But that tactic only works well when organizations know that they are receiving competitive bids on products that are roughly comparable. Using this Buyer’s Guide, organizations can do a better job of accomplishing that objective.
•Separate the apples from the oranges. Just as important as doing apples-to-apples comparisons is identifying when an orange is thrown into the mix. Sometimes it is very difficult for an organization to know if it is truly comparing products with similar features when the bids come in from vendors with different names for similar or like features. DCIG has done the work of normalizing feature sets across products thereby eliminating confusion and enabling buyers to engage a more accurate comparison.
•Provides perspective on how products from less
well known vendors compare against established
and better known brands. Anyone involved with ECA has minimally heard of Clearwell, Autonomy and Guidance. This familiarity creates a certain built-in level of comfort when buying products from these vendors and a corresponding built-in resistance to buying products from vendors that are perceived as unknown.
This Buyer’s Guide helps to remove some of that apprehension about buying from a less well known vender or even a less well known product from an established vendor. Using this Buyer’s Guide organiza-tions can see how these products from lesser known vendors as well as lesser known products from established vendors stack up.
•Normalizes complex terminology. Every segment across industries has a proclivity to adopt acronyms and jargon that is specific to it but the ECA segment seems to go out of its way to not only use unfamiliar terms but refer to the same technology in different ways. This Buyer’s Guide sifts through the acronyms, jargons, and terms to normalize them. This minimizes or even eliminates the need for users to try to understand all of the segments terminology.
•Creates a standardized data sheet. The product data sheets available from the different vendors are rarely laid out in the same way or contain the same information. Some vendors even have data sheet formats that varied from product to product within their own portfolio. This Buyer’s Guide tackles this problem by creating a standard, easy to read data sheet for every product. In this way, product data sheets for individual products can be printed out, laid down side by side and then the features on them quickly compared.

•Helps justify buying recommendations to business
teams. Nothing is easier for those on the business side to understand than a number when doing comparisons. So at the top of every product data sheet, a product score is included so the business side of the house can quickly see how the different products compare.
DisclosuresOver the last few years the general trend in the US has been for both large and boutique analyst firms to receive some or all of their revenue from vendors.
DCIG is no different in that respect as it also receives payment for the different services it performs for vendors. The services that DCIG provides include blogging, case studies, product reviews, executive white papers and full length white papers.
So in the interest of being fully transparent, a number of the vendors included in this DCIG Buyer’s Guide are or have been DCIG clients. This is not to imply that they were given preferential treatment in the Buyer’s Guide. All it meant was that DCIG had more knowledge of their products and that DCIG would consider their product for inclusion in this Buyer’s Guide.
In that vein, there are a number of important facts to keep in mind when considering the information contained in this Buyer’s Guide and its merit.

•Becauseofthenumberoffeaturesanalyzed,howthesefeatures were weighted and then how these products were scored and then ranked, there was no way for DCIG to predict at the outset how individual products would end up scoring or ranking.
DCIG wants to emphasize that no vendor was privy to how DCIG did the scoring and ranking of the products. In every case the vendor only found out the scores and rankings of its product after the analysis was complete.
Inclusion and Exclusion CriteriaAs part of the research to produce this Buyer’s Guide, DCIG interviewed vendors, users and potential users of ECA software to better understand the market’s current definition of Early Case Assessment and develop a set of objective and verifiable criteria for including, excluding and ranking ECA software.
Please note that although DCIG attempted to take into consideration as many of these criteria as possible, it likely failed to account for all of them. While this may have resulted in a specific ECA product either being excluded or included but not represented in a way that the ECA vendor would prefer, DCIG will address these minimal shortcom-ings in subsequent Early Case Assessment Buyer’s Guides.
The criteria and subsequent rationale that DCIG used to determine the inclusion and exclusion of specific ECA vendors and associated ECA software in this Buyer’s Guide is as follows:
• It had to be marketed as stand-alone ECA software.
As ECA migrates into the enterprise, there are a variety of enterprise class email systems, archiving system and content management systems that claim support for eDiscovery ECA functionality. DCIG excluded these products from this Buyer’s Guide.
• It had to provide functionality through original
propriety software as opposed to licensed software
and services. There are literally thousands of litigation service providers and consultants that offer ECA through a combination of licensed best-in-class eDiscovery and ECA software and associated services. DCIG excluded these vendors and consultants and their respective ECA offerings from this Buyer’s Guide.
• It had to support requested features through software
and not services. Based upon the evolution of the eDiscovery and ECA software market, it is not unusual for ECA vendors to provide support for a specific feature through services as opposed to software. As an

example, some ECA vendors will rely on services to collect specific types of ESI or build custom connectors to these specific data types as they are requested by users. Although DCIG does acknowledge this capability in the Guide, it did not give these vendors ranking points for supporting those features.
•There had to be sufficient information available to
DCIG to make meaningful decisions. DCIG made a good faith effort to identify, reach out and obtain information from as many ECA vendors as possible by providing access to an online survey for them to complete. However in a few cases ECA software had to be excluded due to lack of response and/or coopera-tion from certain ECA vendors and/or lack of reliable publically available information.
•The product had to be shipping as of March 1, 2012. A cutoff date had to be put in place or this Buyer’s Guide would never be published. Some allowances were made for feature or product enhancements that were made in early April 2012 that did not positively or negatively affect the rankings for any one vendor in developing this Buyer’s Guide.
The 8-Step Process Used to Score and Rank ProductsDCIG went through an eight step process to score and rank each ECA product to arrive at the most objective conclusion possible.
1. DCIG developed a list of all of the features available
of all of the products. Prior to selecting the features that were included in the final evaluation in the Buyer’s Guide, DCIG went through and quantified what functionality and features each of the products possessed. As part of this process, DCIG ‘normalized’ the list of features available on products such that a common name for each feature was established.
2. DCIG established an objective vetting process. DGIC only included the functionality and features that could be objectively and authoritatively analyzed. DCIG did not take into account subjective input such as user satisfaction nor did it take into account quantitative input such as annual revenue, installed base and pricing.
3. DCIG assigned a weighting factor to each feature. Based upon input from ECA vendors, users, potential users and lead analyst for the Buyer’s Guide, DCIG assigned a “weighting factor” to each question and/or feature. This weighting was a combination of whether the ECA software supported the feature and its level of importance. As an example, DCIG gave more consid-eration to ECA software that included its own native Legal Hold management as opposed to ECA software that relied upon interfacing with a third party product for Legal Hold management.
4. DCIG organized the features into 5 general catego-
ries. In pursuit of accurately highlighting the strengths and capabilities of each ECA vendor, DCIG organized the features into 5 categories, including; (1) Search; (2) Management; (3) Operating Environment; (4) User Experience; and, (5) Support.
5. The DCIG ECA software Buyer’s Guide survey was
sent to each vendor. DCIG sent each ECA vendor an online survey that listed questions for each feature analyzed. The survey also provided the opportunity for each of the vendors to add additional comments and capability information. DCIG gave each vendor several weeks to complete the survey and provided telephone and live meeting support as required. Please note that the survey did not provide ECA vendors with any information about how DCIG weighted individual features. For those vendors that did not complete and submit the survey, DCIG filled out the survey for them based upon information from their websites and other publically available sources.
6. All vendors were given the opportunity to
review surveys before the final scores and rankings
were determined. To ensure the information presented in this Buyer’s Guide is up-to-date and reliable, DCIG provided each vendor a copy or copies of their completed surveys to validate the information and correct it before DCIG moved on to the scoring and ranking phase.
7. DCIG scored each vendor based upon the informa-
tion that was gathered. DCIG scored each vendor based upon the information from the survey with the weighting that was done before the survey was sent to

the vendors and completed. DCIG did not change any of the weighting based upon any of the answers submitted from the ECA vendors.
8. DCIG ranked each vendor using standard scoring
techniques. One of the goals of this Buyer’s Guide is to establish clear lines of differentiation between products with comparisons that are arrived at objec-tively. To accomplish this goal, DCIG first normalized the overall scores, next calculated the average (mean) score for each classification and then calculated a standard deviation to assign each ECA vendor into a particular category.
Using the mean of the scores from all of the products from which the standard deviation was calculated, DCIG devel-oped a ranking for each product based upon the following in each category:
• Thoseproductsthatwerewithin1.5orgreaterstandarddeviations below the mean were given the rank of “Basic.”
• Thoseproductsthatwerewithin.75standarddeviationsbelow the mean were ranked as “Good.”
• Thoseproductsthatwerewithin.75standarddeviationsabove the mean were ranked as “Excellent.”
• Thosemodelsthatweregreaterthan1.25 standard deviations above the mean were ranked as “Recommended.”
Please note that the DCIG scoring and ranking method results in placing multiple ECA software products into the same ranking category. However, this may not be a strong indicator that these products have similar capabilities in regards to any individual buyer’s unique requirements.
DCIG Comments and Thoughts on …Considering the speed at which technology introduction, vendor consolidation and user assimilation is moving within the eDiscovery market, the term “Early Case Assessment” has become a nebulous term. Expansion of features to almost every software component throughout the entire eDiscovery life cycle has further served to blur the lines of what constitutes “Early Case Assessment."
Historically, the task of eDiscovery was accomplished by litigation service providers and law firms through a combi-nation of manual data collection, computer forensics and
a variety of different best-in-class software programs at different phases of the eDiscovery life cycle. As an example, most litigation service providers and law firms utilized legacy Electronic Data Discovery (EDD) software to process and normalize ESI so that it could be loaded onto document review software.
The problem with this approach was that users did not really know what ESI was relevant until after the data was collected, processed and reviewed. Service providers simply processed all ESI based on simple criteria such as custodi-ans and date ranges. Processing ESI based on two criteria lacked analytics required to identify relevant content.
It was this lack of analytics before document review that drove the demand for ECA software to perform addi-tional culling, rudimentary search and analytics after EDD processing and before document review. Over time, ECA software added the functionality of EDD processing and simple document review. Now ECA software occupies a much larger footprint within the entire eDiscovery life cycle.
Currently responsibility for eDiscovery is naturally migrat-ing to the enterprise due to ESI volume and complexity. Complexity and volume drive sophisticated enterprise IT users in to the buying process. They are requiring ECA software vendors to include tighter integration with enter-prise systems. Buyers require a single-holistic-platform addressing information governance, improved search and support for a larger percentage of the eDiscovery life cycle.
DCIG is not indicating that litigation service providers and law firms are no longer buying ECA software. In fact, our research indicates some Vendors consider the litigation service providers and law firms to be their target customer. We are indicating ECA software requirements are evolving. Sophisticated enterprise IT buyers are driving ECA soft-ware requirements along with litigation service providers. Following are DCIGs thoughts and comments regarding some of these evolving requirements:
Data Mapping
With the increased volume and complexities of ESI combined with the distributed IT infrastructure of most enterprises, Data Mapping has quickly become an ECA software requirement for enterprise buyers. In pursuit of fulfilling the Federal Rules of Civil Procedure (FRCP), data preservation and Legal Hold Management, DCIG research

With Fusion Genome® from Exterro leading the way, several of the Vendors covered in this Buyer’s Guide offer native support for Data Mapping. Other Vendors have chosen to address these requirements by integrating with Data Mapping software from third party providers.
Analysis of enterprise ESI before collections
DCIG research indicates that ECA buyers are now requir-ing ECA software to analyze ESI before it is collected and provide information about the volume and potential cost of proceeding through the eDiscovery life cycle. As mentioned earlier, it is important to note that it was not that many years ago that this type of analysis was not available until the document review phase. Several of the Vendors covered in this Buyer’s Guide offer support for analysis of enterprise ESI before collections.
Integration with enterprise archiving systems
Many enterprises today are utilizing one of the well known ESI archiving systems such as Commvault Simpana, EMC SourceOne, HP Integrated Archive Platform, IBM Common Store or Symantec Enterprise Vault. With the mission to integrate enterprise systems, DCIG research indicates that ECA buyers are now requiring ECA software to integrate and exchange ESI with these archiving systems. Several of the Vendors covered in this Buyer’s Guide offer support for integration with enterprise archiving systems.
Ability to process social media ESI
Corporate users are now increasingly relying upon social media ESI from Facebook , LinkedIn, Twitter and various other social media platforms. As a result, social media ESI now potentially relevant evidence and therefore must be considered as part of the eDiscovery ECA process. With this requirement in mind, DCIG research indicates that ECA buyers are now requiring ECA software to support the identification, collection and processing of social media ESI. Led by NexPoint through their Cloud Preservation™ module, several of the Vendors covered in this Buyer’s Guide offer support for collecting, preserving, processing and reviewing Social Media ESI.
Legal Hold
Legal Hold has historically been managed by the enterprise legal department through email and Excel spreadsheets. Over the past 5 years there have been several stand-alone Legal Hold software solutions available. However, driven by the increase in volume and complexity of ESI, enterprise buyers are now requiring ECA software to provide native support for ESI preservation and Legal Hold. With Fusion®

Workflow Management
ECA is basically a business process and benefits from operational and productivity increases afforded by work-flow management. Workflow management like software is not a stranger to the eDiscovery process as some basic workflow is now incumbent in many of the document review software platforms. As an example, many document review software platforms have workflow management that queue documents, automatically assigns them to specific reviewers based upon defined criteria and then tracks the productivity of those reviewers.
Enterprise IT management is expecting the same workflow management for ECA software, because IT management has reaped the benefits of workflow management. Several vendors offer native support for workflow management. Other vendors have chosen to address these requirements by integrating with workflow management software from third party providers.
Project Management
ECA is essentially a business process that would benefit from the operational and productivity increases afforded by project management. As an example, ECA software users could benefit from integrated calendars that listed milestones for the ECA project along with task assign-ments, collaboration tools, and Gantt charts to project relationships between tasks, project completion dates and resource allocation. However, with the exception of some rudimentary project sizing and cost projections, the ECA market has been a stranger to the benefits of ECA software with project management.

Enterprise IT management has experienced the benefits of mature project management. Because ECA is migrat-ing to the enterprise, managers expect ECA software to include project management. As such, several vendors offer native support for project management. Other Vendors have chosen to address these requirements by integrating with project management software from third party providers.
Next Generation Search
Searching ESI to identify potentially relevant ESI has always been at the forefront of what the market expected ECA soft-ware to accomplish. Historically, standard Boolean keyword search technology has dominated the ECA software market.
Concept search techniques were developed because of limitations imposed by classical Boolean keyword search technologies when dealing with large, unstruc-tured collections of text as commonly found in ESI during ECA. Keyword searches often return results that include many non-relevant items (false positives) or that exclude too many relevant items (false negatives) because of the effects of synonymy and polysemy. Synonymy means that one of two or more words have the same meaning, and polysemy means that many individual words have more than one meaning.
Polysemy is a major obstacle to effective identification of relevant keywords and associated documents for ECA software. For example, ECA software utilizing keyword search that was looking for documents with the word fire in the context of terminating employment, would also find documents about burning “fires” and documents about launching or “firing” a rocket.
In addition to the problems of polysemous and synonymy, keyword searches can exclude inadvertently misspelled words as well as the variations on the stems (or roots) of words (for example, strike vs. striking). Keyword searches are also susceptible to errors introduced by optical char-acter recognition (OCR) scanning processes, which can introduce random errors into the text of documents (often referred to as noisy text) during the scanning process.
Concept search can overcome these challenges by employ-ing word sense disambiguation (WSD), and other tech-niques, to help it derive the actual meanings of the words,
and their underlying concepts, rather than by simply match-ing character strings like keyword search technologies.
As the legal community has taken pause to completely understand the effects of utilizing concept search technol-ogy, adoption has been slow. And, the debates continue to this day regarding the appropriate algorithms and method-ologies. Regardless, conceptual search has become a major buyer requirement for ECA software.
Autonomy leads the conceptual search category with its patented IDOL pattern-matching technology and many of the Vendors covered in this Buyer’s Guide offer native support for conceptual search. Other Vendors have chosen to address these requirements by integrating with next generation search software from third party providers.
First Pass Review
eDiscovery life cycle has required EDD software to pass the processed ESI to document review software. Document review software enabled lawyers and paralegals to quickly and easily “review” the ESI in preparation for their case.
The emergence and maturation of ECA software, buyers want to perform a “first pass review” of the ESI before it is passed to document review software. First pass review is mini review done during ECA. It is a well-accepted practice performed prior to using a full blown review platform.
ECA software buyers are demanding more functionality from first pass review. Improved functionality is blurring the lines between expectations for document review from ECA software and traditional document review software.
As such, most of the Vendors covered in this Buyer’s Guide offer native robust support for First Pass Review. DCIG believes that the functionality of document review software is being absorbed into ECA software. For example, in February 2012, Guidance Software acquired CaseCentral. CaseCentral offers a document review soft-ware product. At acquisition, Guidance announced integra-tion of CaseCentral with Guidance EnCase eDiscovery as a holistic eDiscovery solution.
Information Dashboards
Driven by the explosion of web based applications and now mobile applications residing on smart phones and iPads, ECA software buyers have quickly developed an expectation

for information dashboard with graphically presented infor-mation about literally every aspect of the application that they are using. A such, and led by some of the most recent entrants into the market such a Equivio’s Zoom, many of the Vendors covered in this Buyer’s Guide offer native support for information dashboards. Other Vendors have chosen to address these requirements by integrating with information dashboard software from third party providers.
Cloud Computing
Cloud computing is changing the entire IT industry. The ECA software market is no exception as ECA software buyers now expect Vendors to offer a SaaS delivery model option. Led by online document review software, SaaS application is not a stranger to the eDiscovery market. However, the requirement of the ECA market to move massive amounts of ESI has presented a challenge to Vendors and reluctance on the part of ECA users to move ECA software completely to SaaS. The interim architectures from early ECA software leaders such as Autonomy and Clearwell physically located the processing engine components of its ECA software on centralized servers and provided SaaS based access to users for search and first pass review once the ESI had been loaded and processed.
ECA buyers are evaluating SaaS only cloud offerings. Increases in available bandwidth and success of Cloud Service Providers (CSPs) such as Amazon Web Services (AWS) are encouraging ECA software buyers to consider the cloud offerings.
NextPoint and X1 Discovery both offer ECA software that resides completely in the AWS cloud. NextPoint enables users to move ESI to their AWS ECA software and X1 Discovery enables users to move the X1 Rapid Discovery ECA software to where ever the ESI is located within the AWS data store. Based upon the success of NextPoint and X1 Discovery, DCIG predicts that buyers will demand that all Vendors offer the option to house their ECA soft-ware with one of the CSPs.
DCIG Observations and Recommendations by RankingAs indicated, as part of the research to produce this Buyer’s Guide, DCIG interviewed vendors, users and potential users of ECA software to better understand the market’s current definition of Early Case Assessment and develop a set of objective and verifiable criteria for ranking the ECA software
included in this Guide. The details of these criteria and the steps that DCIG followed has been covered in previous sections of this Guide. Following are DCIG’s observations and recommendations for each of the ranking categories including “Recommended," “Excellent," “Good” and “Basic.”
Please note that in general, the higher the ranking, the closer that particular ECA software is to meeting the feature and functionality criteria that DCIG set as the standard for excellence in ECA software. The ECA software that DCIG ranked as “Excellent” in this Buyer’s Guide share many of the characteristics with the ECA software ranked as “Recommended." However, ECA software with an “Excellent” ranking may not support as large a variety of data types and devices, may not integrate with all required enterprise systems and may not provide the same advanced level of integrated support for Data Mapping and Legal Hold Management.
Recommendation
DCIG recommends the ECA software in the “Excellent” rank-ing category for enterprises, large litigation service providers and law firms with large eDiscovery practices where it meets specific user required features and functionality. The ECA software that DCIG ranked as “Good” in this Buyer’s Guide also share some of the characteristics

However, the ECA software ranked as “Good” may not have the full complement of feature and functional-ity to completely meet DCIG’s criteria for excellence in ECA software. In addition, please note that some ECA software ranked as “Good” and “Basic” are single components from Vendors that offer other components (also listed in this Guide) that users can combine to support a larger percent-age of the eDiscovery life cycle and come closer to meeting their specific criteria for excellent in ECA software. As an example users can combine the various individual product offerings from Kroll or AccessData into robust ECA software offering that collectively score much higher than any of the individual ECA software from these Vendors.

The ECA software that DCIG ranked as “Basic” in this Buyer’s Guide focuses on processing very specific types of ESI with a more limited set of features and functionality. This basic ECA software may prove adequate in specific scenar-ios where broader features and functionality to support the entire eDiscovery life cycle of the rigors of a large enterprise are not required.
Please note that as is the case with some ECA software in the “Good” ranking category, some of the ECA software in the “Basic” ranking category by design only support a narrow piece of the eDiscovery life cycle.
