8.0 ACTION REPORT – DIRECTOR, DEVELOPMENT & REGULATION

SECTION 30 REVIEW PLANNING CONSULTANT: ACCESS PLANNING

Council endorsed the amended Strategic Directions Report for referral to the Minister on 17 February 2010. Director, Development & Regulation met with Donna Ferretti, DPTI on 23 May 2012. Section 30 Review and Strategic Directions Report have been endorsed. The preparation of the BDP has commenced and the first draft is with officers of DPTI. The Statement of Intent has been endorsed by the Minister with some conditions. Further consultation with DPTI has been continuing and current work plan is to put DPA out for public comment in January 2017.

This action is now considered complete as the new development plan was consolidated by the Minister in October 2017.

RURAL LIVING ZONE PRINCIPLE OF DEVELOPMENT CONTROL(PDC 10)

Resolution CDAP78/11 (7/12/11):

The Development Assessment Panel recommend to Council, that in preparing the next Development Plan Amendment, it consider the modification of Principle of Development Control (PDC) 10 for the Rural Living Zone to include a measure of outbuilding size as a percentage of the site size, alongside a square metre size. Jensen Planning and Design have been appointed to undertake a Housing Land Availability Assessment to support any DPA. Report was received from Jensen Planning and this Report was presented to the February 2016 Council Meeting.

This action is now considered complete as the new development plan was consolidated by the Minister in October 2017.

PLANNING HISTORY:

A review of Council records indicates that the allotment has been the subject of another Development Application set out below: • Development Application 354/102/08 (lodged 6 February 2008) for the extension of the

existing shed. This application was granted Development Approval on 9 April 2008, subject to three conditions.

PROPOSAL:

The proposal comprises the construction of an additional retail showroom on an existing warehouse and showroom, with associated signage. The retail showroom is to be established at the north-west corner of the site and will be for the display and sale of firearms and ammunition. A more thorough description of the application is discussed within the assessment of this report. The proposal plans are attached (refer to ATTACHMENT D).

NATURE OF THE DEVELOPMENT:

The proposed development is neither a complying or non-complying form of development but a consent use requiring consideration on merit. The proposal has been considered on merit, pursuant to section 35(5) of the Development Act 1993. SITE AND LOCALITY:

Legal Description

The subject land is described as Allotment 1, Filed Plan 11914, Certificate of Title Volume 5496 Folio 611 in the area named Port Pirie South, Hundred of Pirie. The property is more commonly known as 54 Esmond Road, Port Pirie.

SITE AND LOCALITY: (Continued) Physical Description and Land Use

The subject site is a regular shaped allotment with an area of 1,009 square metres and single 21.20 metre road frontage to Esmond Road. The site is considered relatively flat with a slight fall from the rear of the site to the road frontage. An existing single storey building occupies the site, containing a warehouse and showroom with air-conditioners and refrigerators, as well as an associated freestanding sign pole, which is adjacent the front boundary. The building has a total area of 223.65 square metres and a wall height that is largely 3 metres with a front extension of 3.6 metres. The building is made with Colorbond materials (cream walls and maroon gutters, fasciae and roof). Vehicular access to the site is directly off Esmond Road at the site frontage and is accessible by a single driveway located in the south west corner of the site. The surface treatment of the driveway and parking area is currently sealed with a road base crusher dust. The site is vegetated with established trees and bushes to the front and east side of the existing car parking area. The proposed development is on the periphery of three zones and as such contains a mixture of commercial, industrial and residential development. To the east is primarily residential development with Bedford Industries within the residential area. To the north, west and south contains primarily commercial and industrial activities, such as Northern Refrigeration Service, Bedford Industries, Rock Solid Renovating, Cruisers Car Wash, AR Kent Group, Spencer Gulf Coaches, trailer hire and sales. Further to the north and north east is vacant land.

The subject site and land immediately adjacent to the north and west is identified in an Industry Zone. Land immediately adjacent the site to the east is identified in a Residential Zone and land to the south is identified in a Commercial Zone. The zoning of the area is shown on Map PtPi/7 of the Port Pirie (RC) Development Plan (refer to ATTACHMENT C).

PROCESSING:

The proposed development has been identified as a Category 3 development in accordance with section 38(2)(c) of the Development Act 1993. The application was placed on public notification between 11 and 24 January 2018. Adjoining owners and occupiers were notified in writing, and an advertisement placed in the local newspaper. Four representations were received during this period (see ATTACHMENT E). Three of the four representations have objected to the development, and one is in favour. Comments from the applicant’s planning consultant Access Planning are included to address these objections (see ATTACHMENT F). In regards to the objections, it should be noted that only relevant planning aspects are discussed within the report below. Concerns such as cost of insurance and potential loss of participants and employees will not be discussed within the report given they fall outside the scope of this

PROCESSING: (Continued) assessment. Further, please note that pursuant to the Development Act the sale of goods is what is being assessed within this application, and not the sale of firearms. The sale of firearms is addressed by the Commissioner of Police in accordance with the Firearms Act and Regulations, and not by the Development Act. While the application did not require mandatory referral, the Council has liaised with the Firearms Operations unit within SAPOL and they have not expressed any objections to the proposed development. Principles of Development Control 1 As previously stated, the proposed application is for the additional development of a retail showroom on an existing site, comprising a warehouse and ancillary showroom within the Industry Zone and Light Industry Policy Area 16. The Industry Zone is intended to accommodate industrial, storage and warehouse development. The Light Industry Policy Area further details that development within the Area should include industries which manufacture on a small scale and should not produce nuisances such as appreciable noise, smoke, smell or other nuisance or generate heavy traffic. While the proposed development is not industrial and does not achieve the prescribed land use guidelines of the Area, overall the proposal is for an additional use creating a mixed-use site comprising of both industrial and commercial development. It is notable that the locality encourages the development of similar land use types, which is evident along Esmond Road and Wandearah Road. Following a site inspection, it is considered the localities current non-residential activities coexist with the surrounding sensitive land uses without significant adverse impact on the character of the area. Given this, the proposed land use is considered to be appropriate. The site is located on the periphery of where the Commercial Zone, Industry Zone and Residential Zone meet. The site is adjacent mixed land use, including industrial, commercial and residential development. The development is designed to operate within the proposed facility to minimise its impact on existing and potential future land uses considered appropriate for the locality. Furthermore, the site is adjacent existing industries and a higher order road that carries large volumes of traffic. As such, the road environs provide a high amount of background noise. The proposal does not involve any heavy machinery and does not generate noise that would exceed that generated by the existing activities or traffic in the locality. Notwithstanding the above, to ensure that the noise amenity of the area is maintained, it is considered appropriate that a condition is attached to any approval relating to the sound onsite not be in contravention with the Environmental Protection (Noise) Policy. Given the hours of operation (8.00 am – 4.30 pm Monday to Friday) and limited clientele and staff on site (approximately 4 and 1 per day respectively), the facility is considered small in scale in comparison to the existing operations in the area. The proposed use of the premises is considered unlikely to have any significant detrimental impact on nearby properties including residents in terms of noise and disturbance. It is not considered that any of the activities undertaken on site could cause nuisance in the form of emission of airborne pollutants, electrical

interference, vibration, light spill, glare, hours of operation or otherwise. On this basis, it is concluded that the proposal represents an orderly development and is consistent with the Development Plan provisions that regulate the interface of land use with the area. The proposal is well-designed and proportioned, and contributes to the creation of cohesive and attractive streetscape through high standards of design, responding to its context through building height, form and scale. In fact, the scale and height of non-residential structures within the locality and onsite are considered to be greater by comparison. The development site has an existing building with a floor area of 223 square metres and wall height of up to 3.6 metres. It is noted the new building has a floor area of 59.2 square metres and will only cover 5.86 percent of the site area, with overall building coverage of 28 percent. The proposed building height of 3 metres will match the building line of the back portion of the existing building. Overall, the development is considered to provide an appropriate visual transition between the different land uses, given the context of the mixed use of the area. The building is to be made of Colorbond materials, matching the colours and finishes used on the existing building, including cream walls and maroon gutters, fasciae and roof. The building material finishes are consistent with the surrounding industrial, commercial and residential structures. On this basis, the Colorbond materials are considered appropriate to blend with the character of the area and are not expected to detrimentally impact adjoining properties. The building is to be located within the north-west corner of the property, set back 37 metres from the Esmond Road property boundary, 1.7 metres from the western side boundary, 2.9 metres from the rear boundary and connected to the existing building to the east. The development achieves the set back distance required by the Development Plan. The siting and design are expected to minimise visual impact and potential overshadowing that could be experienced by neighbouring properties. The set back is in accordance with the existing and future character of the area and as such, the location of the development is considered appropriate for the site. The building is designed so that the façade faces the primary street to provide observable and direct access to the development, and avoid uninterrupted walling being exposed to public view, by providing an access door and signage. The proposed printed sticker plastic sign is to be affixed to the external wall of the proposed showroom, facing Esmond Road. The sign measures at 1.2 metres high and 2.4 metres wide. The signage will include the name of the business, items for sale, and a contact number written on a scenic picture background. The signage will not be internally illuminated or move, flash, blink or rotate in any manner. The sign is expected to complement other signage in the locality in terms of siting, size, shape, scale, and finishes, including those associated with the existing business on site. The sign is simple in form and provides easy recognition so as not to cause nuisance to adjacent road users or cause any adverse impact on the locality. Landscaping on site is considered appropriate to enhance the appearance of the parking area, create a visual barrier to development and improve the amenity of the locality. The applicant has established vegetation at the front and east perimeter of the car park, which is considered acceptable given the nature of this development. Colorbond fencing along the eastern boundary adjacent the residence, and well as vegetation will assist in establishing and maintaining a visual and acoustic buffer and ensure privacy is maintained to the neighbouring residential property.

ASSESSMENT: (Continued) The relevant utility provisions are met as the development can be serviced with water, power and telecommunication facilities without impacting on the services provided to existing developments within the area. The stormwater management system will ensure protection of the site and adjoining properties by immediately capturing stormwater on site through water tanks and directing overflow to the Esmond Road drainage network to prevent overland stormwater floods, damage and nuisance flows. Conditions have been imposed to ensure stormwater is appropriately managed on site and directed offsite. Further, the site is not prone to inundation or flooding. The development is designed to protect against inundation and avoid degradation of the land. The level of traffic movement is anticipated to be slightly greater than would ordinarily be associated with the site’s activity, increasing vehicle movements per day from approximately 12 to 16. It is considered that the key issue in association with the assessment relates to determining the level of impact that may reasonably be envisaged and accepted versus the level which is unacceptable, taking into account the relevant provisions contained within the Development Plan. The level of traffic is not expected to be greater than that of existing non-residential uses within the locality. Nor is it expected to be greater in impact that than anticipated by the range of commercial uses listed in Industry Zone and Policy Area. The site is adjacent to Esmond Road, which is known as a highly active road capable of carrying large volumes of traffic. As a connector route it comprises commercial and industrial traffic. As such, it is considered that Esmond Road would be capable of accommodating any additional traffic generated by its operations. Table PtPi/2 (off street vehicle parking requirements) of the Development Plan specifies that a rate of 1 space per 150 square metres of total floor area is required for a showroom and 1 space per 75 square metres of total floor area for a warehouse or 1 parking space per 3 employees (whichever is the greater). Under the Development Plan, this would require up to 4 parking spaces. The applicant’s plan shows 6 car parking spaces on the site, which is greater than the minimum number specified. Please note that the size of the car parks are for illustration purposes only and the applicant has agreed to comply with the Australian Standards, which can accommodate the specified 6 spaces. This would be included as a condition of approval. It is considered the demand associated with the proposal would have minimal impact on the existing car parking area. The development does not restrict access to the all-weather public road. The size and location of the parking area is expected to ensure that vehicles have the ability to exit and enter into a forward direction, avoid backing onto public roads and maintain clear sightlines for the safety of pedestrians and vehicle movements. Also, the development provides a clearance of over 11 metres for vehicle manoeuvrability and has sufficient provision for the loading, unloading and turning of all traffic generated onsite. The development is not expected to inhibit or interfere with the safe and convenient traffic movement to neighbouring properties or the site.

ASSESSMENT: (Continued) The construction of a 3 metre internal concrete driveway and the existing compacted gravel parking area is designed to withstand vehicular traffic in all weather conditions as well as commercial vehicle movements to, from and within the site. These surfaces will minimise soil erosion, dust and drainage problems and ensure vehicles can manoeuvre in a safe, efficient and convenient manner. Overall, the proposed development is considered to be able to satisfy the provisions of the Development Plan relating to the movement of people and goods. In order to limit opportunities for criminal activities, the development maximises surveillance opportunities by orienting building entrances toward the public street and car parking area, avoids using fences, walls or landscaping that may obscure direct views to public areas and has arranged 24 hour surveillance cameras. The development is expected to provide a safe and secure environment that is resistant to criminal behaviour. Furthermore, firearms are to be held in a strong room contained within the showroom in accordance with the Firearms Act and Regulations. As previously mentioned, the proposal was referred to SAPOL to consider matters of crime prevention and they have not identified any concerns with the development. CONCLUSION:

The proposed showroom is not expected to result in an unacceptable loss of character in the locality and would provide an acceptable alternative use in the area. It is not considered that the amenity of the locality will be impaired by the appearance of the development. The development is considered of a good standard in terms of design with particular emphasis on the external appearance and siting of the building so as to blend with and preserve the character and amenity of the area. The development is designed and located, in respect of its height, size, colour, form, siting, style and materials of construction, to harmonise with the predominant character of other development in the locality. The development is not significalty at variance with the Council Development Plan Provisions and therefore has sufficient merit to be issued Development Plan Consent.

RECOMMENDATION:

A. That the Council Assessment Panel, having considered Development Application 354/172/17, resolve that the proposed development is not seriously at variance with the Port Pirie (RC) Development Plan.

B. That the Council Assessment Panel, pursuant to the provisions of the Development Act

1993, grant Development Plan Consent for Development Application 354/172/17, for a Firearms retail showroom and associated signage at 54 Esmond Road, Port Pirie, subject to the following conditions and notes: Conditions 1. The proposal shall be developed in accordance with the details and plans lodged with

the applicant, except when varied by the following conditions of consent.

RECOMMENDATION: (Continued) 2. The construction of the drainage system and the position and manner of discharge of a

stormwater drain must not: a) Result in the entry of water into a building; or b) Affect the stability of a building; or c) Create any unhealthy or dangerous condition on the site or within the building; or d) Flow or discharge onto land of an adjoining owner; and not flow across footpaths or

public ways. 3. That surface water is not to be discharged over the footway or the vehicle-crossing

place. Stormwater discharge from the property shall be directed to the kerb and channel at the site frontage in accordance with the requirements of Council's Department of Infrastructure.

4. Sound shall not be emitted from any machinery, equipment or device, or from any other source, including amplified noise, on the subject land in such a manner as to contravene the Environmental Protection (Noise) Policy established under the Environment Protection Act.

5. The hours of operation of the facility shall not exceed 8:00am-4:30pm Monday to Friday

inclusively.

6. Driveways, car parking spaces, manoeuvring areas and landscaping areas shall not be used for the storage or display of materials or goods including refuse.

7. Signage shall not be internally illuminated and must not move, flash, blink or rotate in

any manner. No signage additional to that forming part of the herein endorsed plans shall be established.

8. All car parking spaces must comply with the Australian/New Zealand Standard for

Parking Facilities (Part 1: Offstreet Car Parking (AS/NZS 2890.1:2004).

Advisory Notes

1. Any works that are to be undertaken on Council land, including but not limited to the construction of driveways, crossovers, footpath reconstruction, laying of stormwater pipes, relocation of infrastructure, removal or relocation of street trees, and/or the temporary obstruction of the road or footpath, shall not be undertaken without the prior permission of Council. The cost of rectifying any conflict with or damage to existing Council infrastructure arising out of this development will be borne by either the developer or the owner of the subject land.

2. The applicant is reminded of its general environmental duty, as required prescribed within the Environment Protection Act 1993, to take all reasonable and practical measures to ensure that the activities on the whole site, including during construction, do not pollute the environment in a way which causes or may cause environmental harm.

3. Prior to the commencement of construction of the development herein approved, it is strongly recommended that you employ the services of a licensed Land Surveyor to carry out an identification survey of the subject land and to peg the true boundaries, to ensure that building work will be either on the true boundaries or the specified distance from the true boundaries of the subject land, as the case may be. Failure to correctly site the development on the land in accordance with the plans approved herein would constitute a breach of the Development Act 1993. Any amendments required to the approved plans as a result of the survey are to be submitted to Council for approval prior to works commencing.

4. That the development hereby approved must be:

a) Substantially commenced within twelve (12) months from the date of the decision of this Consent or Approval, otherwise this Consent or Approval will lapse at the expiration of twelve (12) months from this date (unless Council extends this period), and a new development application shall be required;

b) Substantially or fully completed within three (3) years from the date of the decision of this Approval, otherwise this Approval will lapse at the expiration of three (3) years from this date (unless Council extends this period), and a new development application shall be required; and

c) Any request for an extension of time must be lodged with the Council prior to the above mentioned periods.

d) Pursuant to Section 86(1)(a) of the Development Act, 1993, you have the right of appeal to the Environment, Resources and Development Court against any condition(s) which have been imposed on this consent. Any such appeal must be lodged with the Court within two (2) months from the day on which you receive this notification or such longer period as may be allowed by the Court.
