Mr. Sixtos-Gomez was turned over to Immigration and Customs Enforcement (ICE) officials in April 2014 after being detained on an outstanding warrant for driving without a license by the Orange County Sheriffs Department (OCSD). His prolonged detention was a clear violation by the OCSD of the TRUST Act, which prohibits county jails from detaining a person based on an immigration detainer after they would otherwise be released except in circumstances not present in Mr. Sixtos-Gomez case. Recently, the OCSD has also publicly stated that their department acted improperly and in violation of the TRUST Act in its handling of Mr. Sixtos-Gomez case. This admission of error does little to appease Mr. Sixtos-Gomez and his family, as he is still detained and is being considered for deportation. Notwithstanding how Mr. Sixtos-Gomez came into ICE custody, he is a prime candidate to be released on a positive exercise of prosecutorial discretion as he is absent a major criminal record and is not a flight risk or a public threat. He has been in the country since he was eight years old and is a loving father to a U.S. citizen child, and a father figure to his younger U.S. citizen siblings. Mr. Sixtos-Gomez also has deep ties and a devotion to our country that has provided him and his family great opportunities, and once he

    completes his G.E.D. he would be eligible to apply for the Deferred Action for Childhood Arrivals (DACA) program.
