CALIFORNIA WATER SERVICE COMPANY (U 60 W)

To The Public Utilities Commission of the State of California:

California Water Service Company (“Cal Water”) hereby transmits for filing a new tariff Schedule AA-4, Private Fire Protection Service, applicable to all tariffed areas except Grand Oaks. Cal Water also requests that the existing private fire protection tariffs for individual areas be eliminated. A list of the changes to Cal Water’s tariff sheets is provided as Attachment A to this advice letter. Hard copies of this filing will follow.

Summary

Cal Water requests approval to implement a new company-wide tariff, Schedule AA-4 for Private Fire Protection Service, and to eliminate all existing, district-specific tariffs for Private Fire Protection Service in all of Cal Water’s tariffed areas except Grand Oaks.

This advice letter is submitted as a Tier 1 filing consistent with Water Industry Rule 7.3.1(3). Cal Water requests an effective date of January 1, 2018.

Discussion

Private fire protection service is for on-site fire sprinklers, stand pipes, fire hydrants, and any other fire protection system not owned and maintained by Cal Water that is on governmental or privately-owned property, and that is connected to the public water system. Cal Water currently has tariffs for private fire protection that vary by ratemaking area, with service charges that range from $6.43 to $13.69 per inch (diameter of the service connection).1

In Cal Water’s 2015 General Rate Case (“GRC”), the parties agreed that the area-specific tariffs could be replaced with one, company-wide tariff for fire protection, as well as the elimination of public fire hydrant:

RESOLUTION: Parties agree to … consolidate all other Fire Protection Tariffs under a single Schedule. … Cal Water agrees to create a new tariff, applicable to all areas, for fire protection service that applies to all fire protection services for governmental and privately owned properties receiving service for on-site fire sprinklers, stand pipes, fire hydrants or any other fire protection system not

owned and maintained by Cal Water but connected to the water system for fire protection purposes only.

A universal rate of $8.50 per month per inch diameter of service connection shall be assessed under the new tariff. This rate was developed by evaluating existing district-specific private fire protection service tariffs. Across all districts, the rates range from approximately $6.48 to $13.69 per month, per inch diameter of service connection. The average is $8.64 and the median is $8.45. Given the restrictions imposed by the special conditions, a universal rate of $8.50 per month, per inch diameter of service connection, appears reasonable. Cal Water should be authorized to file a Tier 1 advice letter to revise/add its tariffs for Public/Private Fire Protection that is substantially similar to the draft provided in Attachment 6 of this Agreement.2

The Commission authorized Cal Water to implement a uniform private fire protection tariff in Ordering Paragraph 21 of D.16-12-042:

California Water Service Company is authorized to implement a new tariff, applicable to all areas, that applies to all fire protection services, for governmentally and privately owned properties receiving service for on-site fire sprinklers, stand pipes, fire hydrants, or any other fire protection system that is not owned and maintained by the utility, but are connected to the water system for fire protection purposes only, which eliminates the Public Fire Hydrant Tariffs and consolidates all other fire protection tariffs under a single Schedule.

Extensions for Implementation

Cal Water requested and received two extensions to implement the uniform fire protection service tariff and the elimination of the fire hydrant tariffs. See the letters dated February 16, 2017 (Attachment B) and October 19, 2017 (Attachment C) from CPUC Executive Director Timothy J. Sullivan.

This advice letter does not address elimination of the fire hydrant tariffs referenced in D.16-12-042. As indicated in Attachment C, the Commission has extended the deadline for compliance regarding fire hydrant tariffs to January 1, 2019 because Cal Water has determined that there were customers on the tariffs.

Modifications to Draft Tariff Contained in Settlement Agreement

A draft version of Schedule AA-4 was included in Attachment 6 to the Settlement Agreement with the intention that a “substantially similar” would be implemented. This advice letter proposes modifications to the draft Schedule AA-4, as discussed below, and also expands the tariff to two pages for greater legibility.

Under “Applicability,” a parenthetical has been added to clarify the difference between this additional fee for service to fire protection systems and the “fire sprinkler discount” that residential customers can benefit from if a larger meter was installed solely to ensure proper service to an indoor fire sprinkler system.

Under “Territory,” the description is revised to explicitly apply the tariff to all regulated areas except for Grand Oaks. While Grand Oaks is a regulated Cal Water district, it is not part of the consolidated general rate case cycle for Class A water utilities, and therefore was not addressed in D.16-12-042.

In Special Condition #4, the first sentence, “the minimum diameter for the private fire protection service will be four inches” has been deleted because this requirement was originally intended for fire hydrants, but the tariff now applies to other “fire protection services” as well.

Special Condition #7 and Special Condition #10 have been re-worded for greater clarity, but the original meaning has been retained in both instances.

Requested Effective Date

This advice letter is submitted as a Tier 1 submission consistent with Water Industry Rule 7.3.1(3). Cal Water requests an effective date of January 1, 2018.

Customer Notice: This is a Tier 1 compliance filing under Water Industry Rule 7.3.1(3) of General Order 96-B. Water Industry Rule 3.2 indicates that this kind of Tier 1 filing does not require customer notice.

(1) The utility did not properly serve or give notice of the advice letter; (2) The relief requested in the advice letter would violate statute or Commission order, or

omissions; (4) The relief requested in the advice letter is pending before the Commission in a formal

proceeding; or (5) The relief requested in the advice letter requires consideration in a formal hearing, or

is otherwise inappropriate for the advice letter process; or (6) The relief requested in the advice letter is unjust, unreasonable, or discriminatory

(provided such a protest may not be made where it would require relitigating a prior order of the Commission.)

A protest shall provide citations or proofs where available to allow staff to properly consider the protest. Cities and counties requiring Board of Supervisors or Board of Commissioners approval to protest should inform the Water Division within the 20-day protest period so a late-filed protest can be entertained. The advice letter process does not provide for any responses, protests or comments, except for the utility’s reply, after the 20-day comment period.

Dear Ms. Wales:

In your letter dated February 7, 2017, you requested an extension of time to September 1, 2017, pursuant to Rule 16.6 of the California Public Utilities Commission's Rules of Practice and Procedure, for California Water Service Company (Cal Water) to meet the deadline to file Tier 1 advice letters to implement tariff changes relating to "Private Fire Protection Service" and "Construction and Temporary Metered Service" set forth in Ordering Paragraph (OP) 4 of Decision (D.) 16-12-042.

The Settlement Agreement adopted in D.16-12-042 allows Cal Water to standardize its tariff for service to Private Fire Protection Systems and to eliminate legacy tariffs relating to public fire hydrants. You stated that currently, each of Cal Water's ratemaking areas has a separate tariff for service to approximately 9,000 private fire protection systems, and that some tariffs simply identify a dollar amount per inch (diameter of the service connection) while others establish a specific dollar amount per connection. In order to clean-up Cal Water's legacy data to ensure that there are no customers on the tariffs identified for elimination and to effectively communicate this change in pricing and structure to the approximately 9,000 affected customers, Cal Water proposes to take more time to roll out the Private Fire Protection replacement tariff in stages throughout the company.

The Settlement Agreement also allows Cal Water to apply a new tariff for customers engaged in temporary activities such as construction, including the collection of a deposit for a hydrant meter with backflow assembly. You stated that implementing this new tariff requires an unusual amount of coordination across multiple departments and districts because effective rollout requires active involvement in personnel from operations, water quality and IT as well as the Department of Drinking Water. Users of construction meters will also have to be educated about the terms and conditions of the new tariff, and proper maintenance of the backflow assembly, and Cal Water requests additional time to implement the new construction meter tariff.

For good cause shown, your request is granted. Pursuant to Rule 16.6, you must promptly inform all parties to Application 15-07-015 of the extension of time to comply with D.16-12-042, OP 4 until September 1, 2017, and must state in the opening paragraph of the document that the Executive Director has authorized the extension.

The maximum diameter shall not be larger than the diameter of the water main to

which the private fire service facilities are connected.

If a water main of adequate size is not available adjacent to the premises to be served,

then a new main from the nearest existing main of adequate size will be installed by

the utility at the cost of the customer. Such cost shall not be subject to refund.

The private fire service facilities will include a detector check valve or other similar

device acceptable to the utility which will indicate the use of water. The facilities may

be located within the customer’s premises or within public rights of way adjacent

thereto. Where located within the premises, the utility and its duly authorized agents

shall have the right of ingress to and egress from the premises for all purposes related

to said facilities. In the event the installation is solely for a private fire hydrant facility,

the requirement for a detector check valve or other similar device may be waived.

This schedule applies to all fire protection services for governmental and privately-owned

properties receiving service for on-site fire sprinklers, stand pipes, fire hydrants, or any other

fire protection system not owned and maintained by Cal Water but connected to the water

system for fire protection purposes only. (This tariff is not related to the "fire sprinkler"

discount for which certain single-family residences with indoor fire sprinklers may qualify under

a residential or general metered service tariff.)

The customer will pay, without refund, the entire cost of the private fire service

facilities.

The private fire service facilities shall be installed by the utility or under the utility’s

direction and shall be the sole property of the applicant but subject to the control of

the utility, with the right to alter, repair, replace and the right to remove upon

discontinuance of service.

The utility will supply only such water at such pressure as may be available from time to

time as a result of its normal operation of the system. The customer shall indemnify the

utility and save it harmless against any and all claims arising against the utility for any loss

or damage resulting from service under this schedule. Section 774 of the Public Utilities

Commission Code limits the liability of the utility resulting from a claim regarding

adequacy of pressure or supply for fire protection service.

The customer shall be responsible for the periodic testing of any backflow prevention

devices as required by public authority or the utility. Any repair or replacement of such

devices or of any other facilities installed to provide private fire service shall be done at

the customer’s expense. Any refusal to comply with the above requirements may be

grounds for the utility’s discontinuing private fire service without liability to the utility.

The customer will be responsible for any damage to the private fire service facilities

whether resulting from the use or operation of appliances and facilities on customers’

premises or otherwise. No structure should be built over the private fire service facilities

and the customer shall maintain and safeguard the area occupied by the private fire

service facilities from traffic or other hazardous conditions.

Subject to the approval of the utility, any change in the location or construction of the

private fire service facilities as may be requested by public authority or the customer will

be made by the utility following payment to the utility of the entire cost of such change.

The customer’s installation must be such as to separate effectively the private fire service

facilities from that of the customer’s regular domestic water service. Any unauthorized

use of water from the private fire service facilities will be charged for at the applicable

tariff rates and may be grounds for the utility’s discontinuing private fire service without

liability to the utility.

There shall be no cross connection between the private fire service facilities and any other

source of supply without the specific approval of the utility. The specific approval, if given,

will at least require at the customer’s expense a special double check valve installation or

other backflow prevention device acceptable to the utility. Any cross-connection may be

grounds for immediately discontinuing private fire service without liability to the utility.
