4. Shirts $1544.30, hats $1008.75, Can coolies $268 out of gambling donation fund. Councilor Carl Krause accept the expenses out of the gambling donation, Mayor Ryland Eichhorst second; (discussion on getting approval before purchases going forward) all in favor, motion carried.

5. Received IBM grant for $2000 toward technology; waiting on the check. This will go into the relief association account. This is an FYI that purchases will be coming after the check is received.

6. Thank you to RFD who gave us some older but still usable fire hose. We would like to give a very big thank you to Rochester for thinking of us.

8. Congratulations to Eric Simon who is retiring effective 10/31 after 12 years. Adam Schaefer is taking over as treasurer.

9. Fire Safety USA; yearly maintenance $5967.49. Councilor Beau Hanenberger motioned to approve the yearly maintenance for $5967.49, Councilor Trish Shields second; all in favor, motion carried. (Discussion on ISO fire hydrant checks – checks will be done more frequently.)

C. FIRST RESPONDERS* ~ Jeff Allhiser, 1st Responder Director1. Runs: 14; 7 city & 7 township 2. Meeting Minutes: 3. New Member: Carmen Mallum. She helped during gold rush. We are happy to have her. Councilor Beau Hanenberger made a motion to approve Carmen as a new member for 1st Resp., Councilor Carl Krause second; all in favor, motion carried.

D. EOC ~ Pat McGovern, Director (October 1st the siren tests on Wend will change to the shorter test sound.)

E. PERSONNEL: 1. Council Response. Mayor Ryland Eichhorst explained that this was reviewed at personnel.

LMC has classes for a refresher. Would like to tie it in with a council meeting so everyone can be present – before the meeting starts. (Discussion on dates available.) Mayor Ryland Eichhorst motioned to schedule for training on Monday Oct 30th at 6:30pm by LMC, Councilor Beau Hanenberger second; all in favor, motion carried. Mayor Ryland Eichhorst motioned to switch the date to Monday, Oct 2nd at 5:30pm. All in favor. Motion passed.

F. ORDINANCES & RESOLUTIONS1. Resolution 17-15 Hazard Mitigation Plan. Mayor Ryland Eichhorst motioned to approve

Resolution 17-15 Hazard Mitigation Plan, Councilor Beau Hanenberger second; voice vote all ayes. Motion approved.

2. Resolution 17-16 Preliminary Tax Levy. Councilor Beau Hanenberger motioned to accept Resolution 17-16 Preliminary Tax Levy, approving tax collectable 2018, (the lax levy can go down. It is preliminary. Tax rate is the same as last year. Increase in tax capacity that allowed us to stay at the same level.) Councilor Carl Krause second; voice vote all ayes. Resolution 17-16 passed.

3. Resolution 17-17 Setting Public Hearing on Proposed Assessment Zumbro Hills Roads (set before next council meeting on October 17th at 6pm). Councilor Beau Hanenberger motioned to approve Resolution 17-17 Setting Public Hearing on Proposed Assessment Zumbro Hills Roads and set the public hearing for the 17th of Oct. at 6pm for 30% ($29,844.15), Mayor Ryland Eichhorst second; (Discussion: Engineer Joe Palen commented about the items in the packet regarding a draft of the assessment hearing handout. He then went over the background of the project and costs. We received very good bids. Joe went on to explain the assessment. He advised council to assess what the City can, suggesting at least 25%. Now is the time to make decisions, not next month. This will be a 7 year term. Discussion continued about the differences in percentages.) Voice vote all ayes, Resolution 17-17 passed.

4. Resolution 17-18 Easement Vacation at 830 Norman Lane SE. Mayor Ryland Eichhorst motion to approve Resolution 17-18 Easement Vacation, Councilor Trish Shields second; voice vote all ayes, Easement Vacation for 830 Norman LN SE approved.

G. DOWNTOWN ORONOCO GOLD RUSH DAYS* ~ Chair: Councilor Beau Hanenberger, 1. Meeting Minutes: September 11, 2017. Councilor Beau Hanenberger went over the meeting.

Requesting Sandy and Rebecca to send out notification that Gold Rush will be accepting donations from nonprofit organizations till the 7th of October. A volunteer dinner will be coming up in Oct as well.

H. PARKS & TRAILS* - Katie Dudley, Chair 1. Meeting Minutes: September 11, 20172. Tennis backstop: receiving updated bids with side fencing. (Council reviewed the bids during

the meeting). Councilor Trish Shields motioned to accept American Fence, option #2 at $5,963., to start as soon as possible, Councilor Beau Hanenberger second for discussion; (discussion on the amount of use at the tennis court. The parks are highly used. It will come out of our CIP fund.) All in favor, motion carried.

3. Signs: Allis park ($1150 plus $325 to install). Intent to have the sign be similar to the other park signs. Schad Tracy bid is lower. Councilor Trish Shields made a motion to accept the Schad Tracy bid for $275 for the sign only, Councilor Beau Hanenberger second; (discussion on if the signs all have white vinyl posts. This sign will need it. Garden Park’s sign does not match. Request to have Dan upgrade Garden Park to the white vinyl posts to make them the same and bring a quote back.) all in favor, motion carried.

4. Leash law / Ordinance: require leashes in park playground areas. It is a concern. The sign at the park said it is required but our ordinance is vague. Requesting Fred to update the ordinance to have animals leashed in the playground areas. This will be brought back for approval.

5. Request bids for electric @ Oronoco Park; (FYI) to accommodate for RVs for next season for 3 sites only. Councilor Beau Hanenberger asked if it will be sized accordingly so that it can be upgraded in the future. Councilor Trish Shields stated that they are still looking at options.

I. COMMUNITY CENTER

J. PUBLIC WORKS 1. Truck repairs: $1035 Discount Auto or $1048.08 Ron’s Auto Repair. Councilor Beau

Hanenberger made a motion for $1035 for discount auto to fix the truck. Councilor Trish Shields second; (Dan will schedule it.) all in favor, motion approved.

2. Tree work: $3066.25. This is a quote from Arborists. Trish asked for the date on the bid and wondered if an updated one was available. Dan stated that this was quoted before the 2 butternut trees came down, so the final bill will come in less. Discussion continued on the estimate about what else had been done and what could be down outside of Arborists. Councilor Trish Shields made a motion to review this bid with arborists and possibly with Roger involved as well, there is a bit Roger is willing to do free of charge in exchange for the wood, the elm trees listed at the driveway at oronoco park at $732 that might be done by Roger, and again, liability waiver and free. So the City can save almost $2000, just doing this. Mayor Ryland Eichhorst; so right now we’ll just come back with a new quote. Dan will be advised. Councilor Beau Hanenberger asked if anything is in need of removal before the next council meeting, if that would slow anything down. Dan said he could work with whatever

council decided. Councilor Carl Krause; I mean, something for discussion, I mean I hear it all the time from all the people in town that burn wood, but… “where this guy get wood from, where this guy get wood” …I mean if we are going to start giving wood, giving away oak trees, we can’t just say, just, “well, councilmen’s boyfriends can have it”, because I mean we got other people burning wood, you know, Dolan’s hollering about it, and…there’s other ones hollering. Councilor Beau Hanenberger; they’re not coming in here asking to ripe it down. Councilor Carl Krause; huh? Councilor Beau Hanenberger; no one has come in here asking to take it down for free. Councilor Carl Krause; no, but we got to advertise and let them, I mean we can’t just up and, ya know, I mean, if it’s something we’re going to do…I mean it’s fine with me, but I mean… Councilor Trish Shields; I never heard of anyone else request the wood, the trees, any part of it. Councilor Carl Krause; ok, I’m just saying what I heard, I’ve heard complaints from people, Dolan gets his from Hathaway, Cain got a lot of it from the City when he worked for the City. Councilor Beau Hanenberger; if we are saving the City money, I don’t see the big deal. Councilor Carl Krause; But I mean, we can, I can say, we can say, save the City money. There’s many people who’d want to take that tree down. How do we just decide to pick, um… Councilor Beau Hanenberger; At this point, I don’t see anybody else here right now, so I say we go ahead and let it fly, and if anybody else wants to show interest they can show interest next time. Mayor Ryland Eichhorst; I do think there is a fairness. We haven’t advertised to the general public. Councilor Trish Shields; I do have inside knowledge and that’s obvious, I get that. Mayor Ryland Eichhorst; Right. But then I turns out we have 6 people coming here wanting free wood, how do we determine? Councilor Beau Hanenberger;”I’ll pay you $50, I’ll pay you $100 or I’ll pay you $300”, uh, oh geez. Mayor Ryland Eichhorst; So, then were back to, what’s the right thing. Councilor Trish Shields; Are they going to take all the junk along with the one good wood? There is one good tree. The rest of it is junk. The other problem you have is with the Dutch elm disease in the elm trees. It can’t leave the City. Mayor Ryland Eichhorst; that’s true. Councilor Trish Shields; they are required to stay within the City. So, I don’t care what city member gets it, but it has to stay within the City. Councilor Carl Krause; I don’t think you can give City property away to somebody else, cause it’s ya know... Councilor Trish Shields: We’ll you’d have to if you’re going to advertise it. You’re going to advertise it to everybody, not just the City. You’re going to advertise it to everybody. Everybody that’s out there can come in and say “I’m willing to take it”. Councilor Carl Krause; well if they can’t take it out of the City, it don’t matter if they come. They can’t have it. Ya know. Mayor Ryland Eichhorst; It’s open to City residents. Well um…well there is no doubt, we appreciate Trish and Roger’s wiliness to take the trees down at no cost to the City, but I’m not sure what the right answer is that is fair in the eyes of our residents, granted there is nobody else here asking for it, but there is no body probably aware of it either. Councilor Trish Shields; was anybody aware of it when Cain was taking wood? And no one complained about it. No one complained about it. But, suddenly because it’s Trish, it’s getting complained about. That is the only reason it is getting complained about, is because it’s me. I can withdraw my offer. The $451 has been saved already, and the other $2000 and whatever can be spent. Moving on. Mayor Ryland Eichhorst; well let’s come back with, let’s approach John and um… Dan Howard from Public Works asked what Council would like to approach John with. (Council talked options.) Councilor Carl Krause; why wouldn’t we want to put that tree out, I mean if someone else wants that tree down, I mean if Trish don’t want it, I mean we got to be fair to the people. There was many many complaints about Cain taking it but it don’t matter. Councilor Beau Hanenberger; Where, where are the complaints? Councilor Carl Krause; huh? Councilor Beau Hanenberger; I didn’t see any complaints. I never heard of a complaint ever. Councilor Carl

Krause; well, I got lots of them Beau. Councilor Beau Hanenberger; Well that’s irrelevant now. Councilor Carl Krause; Right, right. Councilor Beau Hanenberger; There is no proof of complaints. Councilor Carl Krause; exactly. Why didn’t, I mean if somebody wants that tree, they’ll sign a waiver and they live in town, I mean there is more, there is a lot of people that burn wood in this town. I mean, if we can save tax dollars, that’s great. Mayor Ryland Eichhorst; well, Trish is here now willing to take it. Councilor Carl Krause; It’s in inside bid. I mean, no one knew we were going to talk about trees tonight. Mayor Ryland Eichhorst; It was on the agenda. It’s published on the website. It’s public information. Councilor Beau Hanenberger; I say we go ahead. We can discuss it more in length coming up with a policy afterword. Those trees need to come down. It’s getting close to winter. We need to take care of it. We keep dragging this out months and months, we are going to be dealing with it next year. What’s next, we let it fall on the garage…We have enough information to act on it tonight rather than delay it. Mayor Ryland Eichhorst; ok. So what, proceed with taking the one item off? Councilor Beau Hanenberger; I say we take it off, let them sign the agreement and save the City a couple thousand bucks. Mayor Ryland Eichhorst; ok. Councilor Beau Hanenberger; that’s my two cents. That’s a lot of cash. Mayor Ryland Eichhorst; Yes it is, I agree. Councilor Beau Hanenberger; I thinks it’s in the best interest of the City, let it go now, we will deal with it next go round and have a plan in place. Councilor Trish Shields; Rebecca, let the minutes reflect that I am stepping down on this subject. Mayor Ryland Eichhorst; so, where is our current motion at? Rebecca advised them to start with a new motion. Mayor Ryland Eichhorst motioned that we proceed with requesting a new bid from John at Arborists to remove line item #6, on his 7-27 quote for $451 and 25 cents; and then line item #3, removal of large oak behind the garage at Oronoco Park, have him give us a quote for removing the one limb that is hanging over the garage; and line item #4, removal of elm on the east right of way at the entrance of Oronoco Park. Amend to 2 elms and to take the stumps out. Councilor Beau Hanenberger second; Councilor Carl Krause naye. The rest of Council aye. Motion passed.

K. STREETS & ROADS* 1. Zumbro Hills Road Project: request for final payment $10,294.45. $400 under the contractor

amount. This is the final payment. Councilor Trish Shields motioned to make final payment of $10,294.45 per contractors request, Councilor Beau Hanenberger second; it looks nice. All in favor, motion carried.

2. Pavement Management. Engineer Joe Palen stated that the plans are useful for planning long-term operation maintenance and how you go through that budget process. It’s kind of your road map. Stantec’s work is done on an hourly basis. This City has a lot of road way compared to its size. It’s a little disproportionate. (Discussion on when you use fog seal.) It does not address bridges. County inspects those at no cost to the City. We have talked about having County maintain them at the City cost; we would be money ahead rather than having a contractor do it. Mayor Ryland Eichhorst had concerns about the timing of it with sewer. Engineer Joe Palen said not to spend money on streets that might be torn up. (Discussion on certain roads in the City.) Mayor Ryland Eichhorst asked about maybe waiting to do this after sewer comes in because it may impact the schedule. (Discussion on accommodating for that.) Mayor Ryland Eichhorst discussed cost with Engineer Joe Palen. Will this come out of CIP? This is a one-time fee. Councilor Trish Shields looked at the CIP budgeting. I would like us to hold off till 2018 when the CIP is budgeted and we have a clearer idea on the sewer. It’s not a sealcoat year next year. Engineer Joe Palen said he would be fine with that decision. It’s not a winter project anyway. It make sense to run it with the 2018 CIP budgeting. (More discussion

on roads.) Mayor Ryland Eichhorst; the plan itself establishes a base line for our streets. Agreement was to bring it back for 2019 budgeting.

L. PLANNING & ZONING*1. Meeting Minutes: September 14, 2017. Councilor Beau Hanenberger went over the meeting. They discussed including a public forum. It was passed to hold it at the end of the meeting.

There was discussion with the storage broker to get clarification on the Cold Storage. Nothing has gone through. Nothing has been proposed to the City. All we have had are some rough site plans. The land has not actually been sold even though there is a sold sign. There is a purchase agreement but it is not technically sold. There are still a lot of unknowns with all of this. It was basically an FYI to go over options before a purchase and plan is set. Nothing is set with the Cold Storage facility.

There was discussion about Noble RV. The landscaping map doesn’t match the Watershed map.Councilor Beau Hanenberger touched base on the rest of the P&Z meeting.

Mayor Ryland Eichhorst had questions on public forum during P&Z. Did you make sure that there will be a 3 minute rule and following the guidelines established? Councilor Beau Hanenberger; yes and we will make sure it is recorded and typed close to verbatim as we can. I stressed my concern over it. I was the one naye on the committee. I felt there was a lot of issues with the City with them doing this and I have more concerns than positives coming out of it because I told them anything brought up that night can’t be forwarded to the public hearing, so it is irrelevant anyway. In my mind I don’t want to say it’s a waste of time, it’s not, I believe the public should be heard, but I think there is a right place for it. Before it’s even here, why is there discussion? Mayor Ryland Eichhorst; I want to make sure I understand what you’re saying. The comments made during public forum at P&Z, your saying that those comments will not be reread or revisited at the public hearing? Councilor Beau Hanenberger; I was told that comments during public forum cannot be brought back up during the public hearing. It’s a catch 22. Mayor Ryland Eichhorst; I can appreciate all the comments, ones I have received as well, but there is a process for all the public comments to be heard in a public hearing. Councilor Beau Hanenberger; correct. It’s just a lot of unnecessary work that wouldn’t have to be completed. Councilor Trish Shields: I would be concerned as well that the public is going to feel that they have spoken at a public forum, and they’re not recognizing that those same comments aren’t going or forwarded to a public hearing, therefore they are going to feel they have been heard and spoken, and such is not the case. The other concern I had is that this is completely out of the norm of how our City has traditionally run. Our City has a process which includes a public hearing for that reason, so that the public can be heard. The committee meetings are for discussing their business. I’m concerned because it could potentially really bog down the committee meeting unnecessarily. Councilor Beau Hanenberger: Oh, it will. Councilor Trish Shields; I think this will deceive the public. I think that’s going to create a lot of frustration with the public because they are not recognizing what this has just done. Councilor Beau Hanenberger; I also brought up the fact that it doesn’t mean that somebody can’t be heard if they have a vacation issue, or something else that relates to P&Z, etc. That doesn’t mean that Steve, being the chair, can’t call on someone just as Ryland can call on someone during a meeting. Mayor Ryland Eichhorst; communication is very important, especially on highly emotionally charged issues, rightfully so for various good reasons, my concern is that when people make these comments at public forum with P&Z, and they don’t

recognize that these comments are not be put into the public hearing records, I can see that being a big concern of “I didn’t realize that” for obvious reasons of not fully understanding that. It’s not that we don’t want you input; it’s just the timing of the comments that is the issue. Councilor Beau Hanenberger; I explained that as well as one of the issues on the City side of things. People can still talk during the meeting (P&Z) if they are called on. Mayor Ryland Eichhorst; if we are recording them and collecting minutes, I feel like some of these subjects were, the one word – reviewed; obviously there were more comments that didn’t get put into the public record. Councilor Beau Hanenberger; Steve’s comments were not typed out in the minutes. Already, what I was afraid of for doing this, it’s already falling behind and it’s already not correct. I don’t know what to do. I spoke my peace. It was voted “yes”. Unless council has something to directly do with that…I don’t know if council has an say over that, if we can come back and say no because it’s in the interest of the City not to have it because there are public hearings. Mayor Ryland Eichhorst; I just don’t want to give our public a general false security that their comments at P&Z are going to be, it’s not the same thing as sending City Hall a letter because those are read at public hearings. That’s the vehicle that people can do vs. letters vs. participating at the public hearing. Councilor Trish Shields; I don’t want to shut the public down, I don’t want them to think that their comments don’t count but I want to make sure that they understand when those public comments are most effective and help the City make decisions. Unfortunately in this particular case, they aren’t helping, this might actually hinder. Councilor Carl Krause said that Steve did a good job, telling people we couldn’t carry nothing on. And people got to talk and they feel comfortable at. He told them nothing can go on to the public hearing, ya know. We can give them what we knew. You get a room of people, your community; it’s nice to let them say something. And Steve does a very good job runnin a meeting I think. He tells them right up, it’s not going no farther. And I think if Sandy or Rebecca would talk to Steve and tell him what he needs, he’s gladly will do the minutes he said. And they got to be more thorough. Mayor Ryland Eichhorst; It’s his first time. Councilor Carl Krause; I think the people were more comfortable to talk a little bit. Ya know. Councilor Beau Hanenberger; I truly believe all the intentions of P&Z were well established, I don’t think anybody meant anything, you know. I am looking at it as; I am on City Council and stuff, on the City side of things where they are sitting in more of the resident, the volunteer side of the committee. I agree, but there is a right time and a right place. Councilor Carl Krause; I think if we keep it to 3 minutes, I mean, they didn’t seem to think an extra half hour, ya know. Most of the time we are sitting here by ourselves looking at each other. There are issues going on if they want to be involved a little. Mayor Ryland Eichhorst; I think it’s important, hearing that, but this is a learning curve. I think we need to work with Steve to make sure documents are prepped. It’s the right thing to have at the end of the agenda; otherwise you are making it difficult to take care of the agenda. Councilor Beau Hanenberger; we did this because a lot of the questions could be answered during the meeting, so having it at the end of the meeting, It would per say be less questions. Mayor Ryland Eichhorst; I just think we need to continue to work with Steve on getting the detail in the minutes. Councilor Carl Krause asked if we got a sheet that can be handed out to make sure they understand. I mean, I don’t mind information. Councilor Beau Hanenberger; that’s a fine line though too. Sometimes we are giving out information we are not supposed to give out, that we are told in confidence. That’s a great question that is sometimes hard to figure out. What do we give them and what do we not. Certain things the public is required…Councilor Carl Krause; I mean, when we are talking up here, yah, no, right. I think Steve was a good listener and a good leader, I think. Mayor Ryland Eichhorst; let’s move on. Let’s note that we shared our concerns. As long as Steve continues to emphasize public forum and that the expectations are announced before each meeting for those

people that want to speak, he should do that. And continue to improve on the documentation and the notes.

M. WATER & SEWER* 1.Meeting Minutes: 2.Water looping soil borings: we reached out to American Testing. The borings will start

tomorrow. It’s been posted on the website and Facebook.3.Sunnyview & 3rd Ave SW final pay request water looping $4274. Councilor Trish Shields

4.Task Force; minutes. Commission study that Stantec is doing for us, Pine Island and Rochester. Both were good meetings. Work is in progress. We are meeting with Oronoco Estates tomorrow. The meeting at RCTC went really good. We were encouraged to come back with a decision and cost as soon as possible for the 2018 bonding bill. The project has been very well received.

needs to look at. Engineer Joe Palen stated that if there were one or two members that will look at the submitted policy, that would be a better approach to address it than all of Council discussing it at a meeting. Councilor Beau Hanenberger feels that the City should have one. Councilor Trish Shields said that there needs to be consistency on assessments. The citizens need to have an expectation. Mayor Ryland Eichhorst and Councilor Beau Hanenberger will work with Engineer Joe Palen on it to take it chapter by chapter and work through it and bring the policy back to council for approval.

X. NEW BUSINESS. 1. Set Final Tax Levy Public Hearing. Mayor Ryland Eichhorst motioned to set the final tax levy

hearing on Tuesday, December 19th at 6pm., Councilor Trish Shields second; all in favor, motion carried.

2. CEDA proposal. For grant program support. At no cost to the City. Looking at potentially 3 projects. One is a relocation of historical items in our park. Another is paving trails. And a backup generator for River Park well house. Councilor Beau Hanenberger asked about the well at River Wood Hills because that is where the controls are. (Discussion on which well would be better. Engineer Joe Palen requested quotes on both generators.) Councilor Beau Hanenberger made a motion to approve CEDA response to the program inquiry, Councilor Carl Krause second; all in favor, motion carried.
