The federal definition of living in poverty is low. For a mother and two children—a family of three—it is $20,090. Because of the great need for legal assistance, the six providers supported by the Campaign really have to focus their services on the very neediest. Their clients average 90% of the federal poverty rate, which is $18,810 or less.

Last year my daughter, Liza, married Adam, a young man from South Africa. Because I work in a law firm with an immigration practice, I was able to connect Liza and Adam with attorneys who could help them

through the bewildering process of obtaining for Adam a marriage-based work authorization and green card. It was a long process, but with legal assistance, the process went relatively smoothly for them. They are now both living and working in the Portland area. They have a bright future ahead of them.

Throughout this past year, I have often thought about how scary, confusing and frustrating the process would have been if they had not had access to good legal advice —a situation those we help face constantly. The potential consequences for not having adequate legal assistance can be a matter of life or death. We are lucky that the six providers supported by the Campaign help fill that void.

This year, I urge all of you to become, or continue to serve as, Voices for Justice. If you can, provide pro bono legal services directly to those in need. Give to the Campaign for Justice so that others will have access to justice. If you can’t provide pro bono legal services for whatever reason, give even more generously to the Campaign.

It was her first job after college and then trucking school. A newly graduated trucker, she was as-signed to take a semi from Georgia to Massachu-setts. She was young, short of cash, and no one had mentioned all the tolls she had to go through. Soon she was out of funds and unable to cross the only toll bridge that would get her to her desti-nation on time. “I came to understand firsthand what it meant to have your livelihood in jeopardy for the lack of very little money,” she says.

Maybe that early knowledge is why, eighteen years later, Attorney Kimberly Watson of Petruc-celli, Martin & Haddow is a new lawyer but a three-year member of the Katahdin Counsel.

“I remember Libby McCallum came to the Law School and gave a talk [about being a volunteer Court Appointed Special Advocate within Maine’s Child Protective system]. I thought ‘I can do that’,” she says, even though she had two small children at home and her wife also worked. She thus began a 2-year stint as an advocate that gained her entry to the Katahdin Counsel in 2013 and 2014 as one of its law student members.

In the fall of 2014, her new law firm was one of the volunteers at the Homeless Legal Clinic at Preble Street. Soon she found herself with a pro bono case that she is still working on at present—and with a 2015 Katahdin induction as well.

gal Aid Clinic, a Campaign beneficiary, helped her discover the impact that access to justice can have. She took the prison clinic and said “it was eye open-ing to see who these women were and rewarding to help them.”

She also did staff protection from abuse cases at Lewiston District Court. “I got to speak up for the underdog—mostly women—who didn’t have a

voice. They were trying to speak up and have the system work for them, so to help them have that voice felt really good.”

Watson also gave to the Campaign for Justice in the first solicitation she received after law school. Why, when she does so much already? “We don’t have a lot of extra funds; I have huge student loans and a family; so it isn’t much. But it is the right thing to do. People need help,” she pauses, perhaps remembering the story she told about her first job. “Someday I might need it.”

Clearly a new lawyer with an experienced perspective on the fragility of the human condition and a big heart. Voices for justice indeed.

Four-Year Katahdin Counsel Members

It is both intimidating and invigorating to in-terview five of six Bangor women who have been inducted into the Katahdin Counsel all four years of its existence.

First you have to succumb in amazement at their energy. All five reel off strings of civic and professional involvement as board members, volunteers or chairs: Orono Town Council, Bangor Target Area Development Corporation, Maine Municipal Executive Committee, Orono Land Trust, Human Rights Committee of Elizabeth Levinson Center, Maine Civil Legal Services, The Clubhouse, Visiting Nurses, Equality Maine, Maine Col-laborative Law Alliance, Abenaki Girl Scouts Council, For Kids Sake . . . OK, you get the point. These women have little free time.

Then you become impressed with their deep roots in their legal community. As other attorneys’ names come up, the genealogy, history, family members, and practice area of that person is clearly shared knowledge among them. Tenures in their firms range 20+ years for several.

Then you ask them how much pro bono work they do in a year, knowing that 50 hours is the threshold for Katahdin. Their guess of their collective hours is high enough to induct more than 20 more people. Two of the women—Roberta Winchell and

Angela Farrell—said they have ceased to count because it runs into the hundreds of hours annually. Then you wonder, do these amazing women even have a personal life?

A Joy for Life and Giving Back

Gathered around the table at Vafiades Broun-tas & Kominsky on March 7 were host Jane Clayton of Vafiades; Angela Farrell, Farrell, Rosenblatt & Russell; Kerry Jordan, Grif-fin and Jordan; Cynthia Mehnert, Hawkes & Mehnert; and Roberta Winchell, Winchell Law & Associates. Joy Trueworthy of Gross Minsky & Mogul ended up unable to com-plete the circle.

Winchell and Jordan are Maine natives. Far-rell, from New York, began her law career clerking for Justice Elmer Violette in the County, and while she strayed south thereaf-ter, she says her two kids would like to move back to Caribou. Clayton came to Maine from Pennsylvania for college, met her wife Nancy, and stayed. Mehnert, originally from Rhode Island, went to college in Maine and returned to practice law in 1989.

Despite their different roots and different ar-eas of practice, all five attorneys speak with one voice when asked about why they do pro bono work. In fact, as the lively conversa-tion jumped back and forth, and laughter and

delight at each other’s responses filled the room, who said what was often unclear.

“My mentor said you should always have one ongoing pro bono case,” said Clayton. Heads nod. Farrell added, “When I started work, it was made clear to me as a new associate what was expected—pro bono work and community service.”

The Volunteer Lawyers Project is a major component in these women’s choices of which cases to take. They credit VLP’s Jim Mitchell with excellent screening. “If he says this case is OK, then it is,” someone voiced. Most therefore take, as Mehnert said, “what walks through the door.” Surely they say no sometimes? “I make sure I have time to do,” says Jordan—and we know already their concept of time.

Although, listening to them talk, their con-cept of the time spent seems to be a deep well of fulfillment. “It feels so good,” said Jordan, who also serves on the Campaign for Justice Steering Committee (see page 11). “We are so fortunate in so many ways. Our clients are so distressed and in an hour you can make them feel such relief, and it wasn’t that hard to even do.” Someone else at the table jumps in. “The reward for what you do? Look. You change lives.”

Impact of the Katahdin Voices Alone on Access to Justice Conducting this interview was the end of several steps to select Maine attorneys who are voices for justice, the 2016 Campaign theme. A good starting point seemed to be down-loading the inductees for all four years that the Katahdin Counsel has been in existence. That list is 307 names long and, yes, most of them give to the Campaign for Justice as well. Some of these have been inducted multiple years, and the minimum hours of pro bono work the entire group represents is over 28,000—if each of them gave only the 50 hours required a year. Clearly the Bangor area women in the accompanying story sug-gest that these 307 inductees represent far more hours than that. How many of the 307 have been inducted all four years? Thirty-seven (see sidebar for all 37 names). 76% of these are women, although women make up about a third of the Maine bar.

“I have been lucky, so I think it is important to give back,” says Carly Joyce, owner of Two Lights Settlement Services, when asked about her becoming one of the Campaign Founder Circle’s youngest members—giving every year since she graduated law school in 2004.

Her success is obvious, although one imagines hard

work should get far more credit than luck.

Within two years out of law school, working for an out-of-state title company, she caught the attention of

a Maine mortgage company with her hard work and quality of work. They offered to back her to start her own title company. She jumped at the chance but soon bought out the mortgage company’s share to be sole owner. She now has seven employees in two offices in Portland and Augusta handling commercial and residential work.

Her company’s website and name embrace her Maine roots and Portland location. A modern silhouette of a lighthouse beams over her TWO LIGHTS logo, and the mighty Atlantic pounding the Maine coast fills the web screen.

The pages provide succinct information over a matter-of-fact grid that any homebuyer would use in sketching out their dream house floor plan. Click on a side bar as a client and you might find a plain English glossary of the terms in those complicated processes and documents you need to sign to own it. The website feels friendly and professional at the same time—a lot like talking with Joyce herself.

“I like to donate to the Campaign for people to have access to help,” she says, noting her company’s management and growth means she can’t do pro bono work right now. She remembers her law school clinic well. “It was a great experience. I loved it. We worked with juvenile cases and it felt like we helped change paths in their lives.” Joyce gave her first Campaign gift of $15 one year out of law school—in 2005 when the Campaign itself was only one year old. In 2014 she earned Founders Circle status, and in 2015 she gave $500 to the Advocates level.

Perhaps that increase is a sign of her success, but in talking with Joyce, the real sign is clearly herself.

Young Company Owner: Giving Back, Moving Foward

Upholding Family Traditions Alistair Raymond is following a

family tradition – one of giving back and understanding the importance of access to justice. His mother, a native of Korea who came to Maine, was a single mom juggling multiple jobs, yet she remained very community-orient-ed. For many years she volunteered with Pine Tree Legal Assistance. To-day, Raymond sits on PTLA’s board of directors and chuckles that “my mom’s last contribution to Pine Tree was giv-ing me to the Board.”

Raymond majored in chemistry as an undergraduate and started out in industrial manufacturing, eventually getting his MBA and moving into marketing. But he had long wanted to go to law school, and when he was 27, he and his wife agreed that he just needed to do it. He graduated from the Univer-sity of Maine School of Law, summa cum laude in 2006, followed by a clerkship with the Maine Law Court.

For the first seven years after his clerkship, Raymond worked at Verrill Dana. The culture of the Firm was very clear, he says, “Even as associates you were strongly encouraged to do pro bono work and to give to the Campaign for Justice.” Raymond didn’t need any persua-sion. “We have been very fortunate,” he says, broadly sweeping in the legal profession, himself, and his family. “Pro bono work and finan-cial contributions to supporting agencies are the least we can do.”

Raymond has practiced that belief every year. With a gift in 2016, Raymond will become another one of the youngest members of the Campaign’s Founders Circle.

“I remember how scared I was as a business lawyer doing my earliest pro bono cases in court,” he recalls, “but I always walked out of court feeling like a million bucks.”

Raymond now works for Avangrid, Inc. in New Gloucester, special-izing in corporate compliance, governance, and ethics. Avangrid is a diversified energy and utility company with $30 billion in assets in 25 states. Central Maine Power is a subsidiary of Avangrid.

Raymond believes that doing pro bono work is good for transac-tional lawyers. “Pro bono, especially time in court, helps you exercise muscles you don’t flex every day. You are interacting with people who need your help in a difficult environment, away from your com-puter. It is an important reminder of the kinds of issues many people in our community are facing.”

Charles Katz-Leavy of Jensen Baird Gardner & Henry has done quite a few pro bono cases related to his area of practice, real estate. He recalls one particular case where he helped an elderly woman save her water well by negotiating with her town about how it could more thoughtfully take a portion of her property by eminent domain to widen a road.

But the pro bono case he remembers most distinctly is that of a young Russian orphan with serious birth defects. “This case was so rewarding to do,” says Katz-Leavy. It was a step outside his comfort zone, but he is clearly proud of the “tangible impact” he was able to have on a young life.

“There is so much one can do,” he says about aiding access to justice. He believes there are many types of cases outside one’s own area of specialization that any motivated lawyer can effectively handle if willing to put in a little extra time.

He mentions being a lawyer of the day at Volunteer Lawyers Project as an example—where one calls colleagues to ask them to consider taking a VLP case that is either within their practice area or similar to other VLP cases they have done. “When I’ve done the lawyer for a day, on good days I have been able to place three to four cases,” he says. Placing pro bono cases with experienced attorneys to take on these matters helps move access to justice many steps forward.

Katz-Leavy, who is one of the Campaign’s youngest Founders Circle members, feels strongly about giving to the Campaign.“It is very appealing to give charitably within my own profession,” he says in rapid succession. “I also like that the campaign aggregates a number of legal aid providers, so I don’t have to pick and choose among them. It feels nice to make one significant donation rather than several small ones. I also like that such a large percentage of my gift reaches the need.” Finding it easy to help expand access to justice seems to be Katz-Leavy’s forte.

During the past year as Campaign Chair, I spoke with hundreds of Maine lawyers about the importance of access to justice in our state. Although most of us don’t like to ask friends and colleagues for money, asking them to support the Campaign was a pretty easy sell. What amazed me week after week was the willingness of so many people to support legal aid in Maine—whether it was the new lawyer donating for the first time, or a senior member of the bar giving at a leadership level. Maine lawyers are a generous and caring group.

As we close the books on last year’s Campaign, not only did we set a new record for total dollars raised ($567,439), we achieved a number of milestones of which we can all be proud.

•We retained 84% of donors from the prior year, well above the national average of 43%.•A total of 1,653 Maine lawyers contributed to the Campaign, including 381 new and

lapsed donors.•We now have 500 members in the “Founders Circle” (donors who have given for 10

consecutive years).•The percentages of lawyers giving at Maine’s largest and mid-sized firms and from in-

house legal departments increased by 5 to 15 percent.

In my letter to the Maine Bar at the start of 2015, I asked my fellow lawyers to be ambassadors for the Campaign. Clearly, the above statistics show that we accomplished that goal!

Thank you to the many volunteers who helped make the 2015 Campaign a success. It was an honor to raise money for our six phenomenal legal services providers. As we embark on the 2016 Campaign, let us help our new chair, Meg LePage, surpass last year’s numbers!

Big 8Maine’s eight largest legal groups provide bedrock support to the Campaign. Because of their efforts with internal committees, the Campaign can concentrate on expanding support for access to justice in other ways. In 2015, 41% of the Campaign, or $233,991, was raised by the 588 members of the Big 8 firms and provided the base upon which the remaining 59% of the Campaign was then built. Everyone starts talking at once again, with the gist that this alchemy of changing lives is perpetual. Clayton runs to her office and brings back an overflowing stack of Christ-mas and other holiday cards, some sent every year by grateful clients and which she can’t bear to throw away. They share specific stories of the small gifts they have received and still receive from long-ago clients—from cookies to homey handmade objects. “Kids come in with hand-drawn cards!” exclaimed one of the women as if it were a sweepstakes prize arriving.

In fact, when Winchell was inducted into Ka-tahdin in 2013, she brought a quilt made by a family grateful for her representing pro bono, over three years, their 90-year-old mother who was a victim of financial theft. Winchell was quoted in the Bangor Daily News as say-ing the quilt was “worth more than anything

What would they say to other attorneys about being a voice for access to justice? “If you perceive that you don’t have the time and money [to support access to justice], you have to change that,” said Winchell.

Maybe doing pro bono or giving to access to justice is as easy as a change of perception. But after spending a couple hours with these five, it is way beyond perception adjustment with them. I lean more toward something Mehnert said at one point, “It is a calling.”

Listening to the high and clear soprano voices pouring out of Bangor certainly makes one want to do more, to match even a tenth of their giving of self. They are the ones call-ing.

In December 2015, the Campaign for Justice took the next step in its evolution—from a great idea in 2004 to an organization that passed its 10th milestone in 2013 by raising $500,000 an-nually,

Starting in 2013, the Campaign’s Steering Committee, which had served up to then mostly as a sounding board for the campaign chair and its staff coordinator, began a two-year process of evaluating itself, the Campaign, and best non-profit practices.

Most fundamentally in its evaluation, the Steering Committee realized that its members and structure needed to become an integral part of the Campaign, to serve as a work group with institutional memory for each new chair, and to function as an extension of and partner to the staff coordinator.

This realization led to an expansion of the Steering Committee from 7 permanent mem-bers to 21 members with 3-year terms and the formation of four working committees, with each Steering Committee member assigned to one. Those committees are:

•Campaign Cabinet. This committee organiz-es, leads and recruits the volunteers who each year ask colleagues to support the Campaign by phone, emails and mail. Prior to the reorgani-zation, each new chair had to form this group anew from prior volunteers and any colleagues the chair could recruit. Now a permanent Cabi-net of nine Steering Committee members awaits each new chair, who can add up to five ad hoc members as needed.

•Campaign Stewardship. Because the chair changes each year, this committee will focus on thanking and keeping the Campaign’s loyal donors informed over the long-term. It has four permanent members and up to four ad hoc ones.

•Campaign Marketing. This new commit-tee of four permanent and up to three ad hoc members will examine how the impact of the Campaign can be better shared and how social media can be used more effectively in a mostly all-volunteer organization.

The Campaign for Justice and Rising Tide Brewery (co-owner attorney Heather Sanborn) sponsored the MSBA New Lawyers Section on September 16 in hosting an informational event for access for justice. Featuring a raffle based on the correct answers to basic questions about access to justice and comments from new law-yers about pro bono work, the event attracted about 40 lawyers on a pleasantly warm September evening. Many thanks to Rising Tide for raffle prizes and a dona-tion to the Campaign. Thanks to the committee headed by Caroline Jova including Carina Cilluffo, Isabel Ekman, Kaela Jalbert, Christopher Marot, Melissa Martin, Joel Moser, Anna Polko and Melanie Stevens.

Of the Needs A single intake paralegal handles in excess of 10,000 calls annually for help on Legal Services for the Elderly’s Helpline. That is about one call every ten minutes.s Portland and Lewiston officials estimate over 1,000 asylum seek-ers in just those two cities; Immigrant Legal Advocacy Project (ILAP) was able to assist only 193 seekers statewide in 2015.s Volunteer Lawyers Project (VLP) and Pine Tree Legal Assistance (PTLA) can take only one case for every 6-7 requests received.

Of the Maine Bar’s Generosity of Times In 2015, over 140 ILAP pro bono attorneys donated 3,167 hours of their time representing asylum seekers.s Legal services donated by pro bono attorneys under the auspices of VLP exceeded $2 million in value in 2015.

Of the Clientss Over 60% of the households receiving direct services from VLP in 2015 had income from employment or employment-based benefits.s 47% of all client households served by PTLA had a child. 44% included at least one person with a disability.

Of Some Successess Pine Tree Legal Assistance secured more time for about 1,000 families to find alternative housing before they became homeless, potentially saving the state more than $1.4 million in emergency shelter costs (assuming a low $50/day cost for shelter).s In 2015, Immigrant Legal Advocacy Project (ILAP) had a 99% approval rate for full representation cases.
