Introduction Conduct of tours advertised in this brochure isgoverned by Scenic Tours Pty Limited (Scenic) in accordance withthe following terms and conditions. It is important that you carefullyread the terms and conditions as you will be bound by them. Paymentof the reservation deposit or tour price represents your acceptance ofthese terms and conditions.2. Must Read Important Information You acknowledge and agreethat there are general risks associated with travelling, which arebeyond Scenics control and therefore Scenic cannot be legallyresponsible for any loss or damage you may incur as a result of thesegeneral risks.     3. Travel Insurance You are urged to arrange comprehensive travelinsurance to cover any unforeseen circumstances that may occurduring the tour.4. Booking Deposit & Tour Payment(a) Booking Deposit You must pay the Booking Deposit within 7 days of making your

    Booking. Deposits stated are correct unless otherwise stated in promotional

    offers. Any accommodation, sightseeing or ights booked by you

    separately to those stated in your itinerary will not be included inthe Booking Deposit and are payable separately.

    Your Booking will be automatically cancelled if your Booking Depositis not received by Scenic by the due date.

    Booking Deposits are non-refundable and non-transferable (Referto the Book with Condence Plan).

    (b) Final Payment The balance of the tour price must be paid no later than 75 days

    prior to the tour departure date. It is your sole responsibility to effect payment of the tour price by

    the due date. You must pay the tour price immediately in full if your reservation is

    made within 75 days of the tour departure date.5. Cancellation Fees You will be liable for cancellation fees, calculatedas follows:Days of Notice Prior Cancellation ChargeTo Tour Commencement (per person)75 days and over Loss of deposit74 to 46 days 30% of tour price45 to 22 days 50% of tour price21 days or less 100% of tour priceCancellation notices must be issued to Scenic in writing during ofcehours.     airlines and other third parties. Any changes to your tour departuredate will be deemed a cancellation and the applicable cancellationfees will apply.6. Credit Card Fees A surcharge may apply for credit cardtransactions.7. Tour Price Scenic reserves the right to vary the tour price at anytime, in its absolute discretion, to account for any increase in costsincluding airfares, fuel, government taxes and charges, exchange rateuctuations or other tour related costs or tariffs. All tour prices arequoted in Australian dollars.8. Airfare Conditions Air/Land prices quoted are based on Air Canadawinter Earlybird airfares and are booked in S class. All airfares are subject to routing restrictions. Airfaresand applicable taxes may be subject to increase without notice due tofactors outside Scenics control. Please contact your travel agent forapplicable rules and regulations relating to your air travel.9. Tour Variations Scenic may, in its absolute discretion and withoutnotice, change or vary your tour itinerary. Whilst Scenic will makereasonable efforts to operate the tour as close as possible toyour tour itinerary, changes or substitutions may be necessary forreasons outside Scenics control. These circumstances may include,

    but are not limited to: road, river or weather conditions; nationalor local holidays affecting the closure of public buildings andattractions; strikes, civil disturbances and advices by governmentsor other Force Majeure Events10. Special Diets You must advise Scenic in writing of any and allspecial dietary needs at the time of booking. Scenic will make everyreasonable effort to accommodate your dietary requests but cannotguarantee that such requests can be met.11. Young Passengers Passengers under the age of 18 years (as atthe departure date) must be accompanied by an adult and share theiraccommodation with an adult. Children under the age of 8 years arenot encouraged (with the exception of Christmas tours and cruises)and are accepted or rejected at the sole discretion of Scenic.12. Airport Transfers Are only available on the rst and last dayof your tour and at times designated by Scenic. Transfers outsidethese times will be at your expense and must be secured by yourown arrangements. Passengers who have purchased Scenics pre andpost tour hotel accommodation and airfares will be provided airporttransfers to/from their hotel in tour start or end city only, on the dayof the pre or post accommodation booking. If your airline booking isnot made by Scenic, you must ensure your ight details are provided

    to Scenic (this can be entered by Tour Personaliser at www.scenictours.com.au). No refund will be given for unused transfers. Transfers cannotbe routed to other pick-up points or destinations. If you miss thepre-booked transfer you will be responsible for making your own wayto the airport, at your own expense. Transfers must be booked andights advised to Scenic no less than 60 days prior to travel, otherwisetransfers cannot be guaranteed. Airport transfers may be grouptransfers scheduled to coincide with multiple ight arrival times.13. Maps or tour depictions contained in this brochure or any otherbrochures issued by Scenic, are intended as an indication only andshould not be relied upon as the actual route taken during the tour.Scenic is not liable to you for any variation to the tour.14. Amendments to Terms and Conditions These terms and conditionsmay be subject to amendment from time to time. Amendments willbe posted on Scenics website.

    15. Responsibility You acknowledge and agree that Scenic acceptsno responsibility and will not be liable to you or any third partyfor any loss, cost or damage (including loss of enjoyment) suffereddirectly or indirectly in connection with: (1) any tour risks or otheraspects of the tour notied to you in these terms and conditions;(2) any change to your itinerary or delays in departure or arrivaltimes of aircraft or otherwise during the conduct of the tour; (3)any loss or damage to your baggage; (4) any personal injury ordeath resulting from the acts or omissions or negligence of any third

    parties providing goods or services to you during the tour, includingair carriers, hotels, shore excursion operators, restaurateurs,transportation providers and medical personnel; or (5) any loss ofenjoyment by you due to circumstances outlined in these terms andconditions or otherwise beyond Scenics control.16. Total liability Despite any other provision of these terms andconditions, and to the extent permitted by law, Scenics maximumliability to you or any third party (including any claims of negligenceon the part of Scenic) is limited to the tour price actually paid by you.17. Consequential loss Scenic will not be liable for any loss ofenjoyment, opportunity, prot, savings, revenue or interest orany other consequential or indirect, incidental, special or punitiveloss, damage or expenses even if Scenic has been advised of theirpossible existence and even if such loss, damage or expense iscaused by Scenics negligence.18. Waiver and Variation Scenic may only waive a right or remedycreated under these terms and conditions in writing. Our delay inexercising a right or remedy does not constitute a waiver of thatright or remedy, nor does any waiver by Scenic (either wholly orin part) operate as a subsequent waiver of the same or any otherright. We reserve the right to amend these terms and conditions

    from time to time without prior written notice to you.19. Governing Law These terms and conditions are governed by thelaws in force in the State of New South Wales. The parties submit tothe non-exclusive jurisdiction of the courts of New South Wales andany courts competent to hear appeals from those courts.20. Survival Any term which is, by its nature, intended to survivetermination of these terms and conditions survives termination.21. Brochure Validity The Tour Brochure and these terms andconditions are valid for the departure date 16 December 2010 onlyand supersedes previous brochures.USEFUL INFORMATION Scenic Freechoice All Scenic Freechoice activities are to bebooked prior to travel and are subject to availability, seasonal andoperational factors. Some activities require a minimum number ofparticipants to operate. Scenic FreeChoice dining options are to bebooked on tour with your Tour Director. Scenic Enrich It may not always be possible to offer everybrochured Scenic Enrich activity on tour. Suitable alternatives will beprovided to ensure your overall tour enjoyment.Scenic Club Loyalty Program The program was launched in 2008and replaces the previous program. Details of the benets and

    qualication for membership etc for Australian and New Zealandresidents are available on www.scenictours.com.au. At this stageonly residents of Australia, New Zealand and the United Kingdomare eligible for memberships. Each country has their own version ofthe program which are subject to their own terms and conditions. Book with Condence Plan The Deposit Protection Plan feeis $55 per person (including GST). The fee is non refundable andmust be paid at the time of booking your tour. Where you cancela tour, and the Deposit Protection Plan applies, Scenic Tours willhold the deposit paid by you for Scenic Tours products only (i.e. notproducts provided by third parties e.g. air travel) and will credit thatportion of the deposit on alternative Scenic Tour products bookedwithin 24 months of the cancellation, after which time the amountwill be forfeited. The Deposit Protection Plan does not replacetravel insurance which we strongly advise be obtained at the timeof booking.
