PREAMBLE

In the name of the beneficent God of all, we who have or are now honorably serving our country in the UNITED STATES MARINE CORPS, or other U.S. military service who are now or have served in direct support of U.S. MARINES under conditions specified by the NATIONAL MARINE CORPS LEAGUE, for the common good of this Nation, and all Nations and people of our world, and in order that the fundamental rights and the freedom of every person may be preserved, to foster interest in the affairs of the UNITED STATES MARINE CORPS, to protect and advance the welfare of wounded and disabled Marines and their dependents, and for the further purposes set forth hereinafter, do solemnly and firmly associate ourselves together in a nonprofit corporation known as the "MARINE CORPS LEAGUE CAPT. JOHN YANCEY DETACHMENT" and order and establish these Bylaws and administrative Procedures.

ARTICLE I

NAME, PURPOSE & RESOLVE

Section 100: NAME, PURPOSE AND RESOLVE The name of the body corporate shall be the "CAPT. JOHN YANCEY DETACHMENT' of the Marine Corps League, being a nonprofit corporation incorporated by the Texas Secretary of State. The purposes for which the Detachment is formed are:

a) To preserve the traditions and to promote the interest of the United States Marine Corps;

b) To band together those who are now serving in the United States Marine Corps and those who have been honorably discharged from the Corps, and those of the other military service who are now or who have served in direct support of the U.S. Marines under conditions specified by the NATIONAL MARINE CORPS LEAGUE;

c) To fit its members for the duties of citizenship and to encourage them to serve as able citizens as they have served the Nation under arms;

d) To hold sacred the history and memory of the men and women who have given their lives to the Nation;

e) To foster love for the principles which they have supported by blood and valor in honor since the founding of the Republic;

f) To maintain true allegiance to American institutions; g) To create a bond of comradeship between those in service and those who have

returned to civilian life; h) To aid voluntarily and to render assistance to all Marines as well as to their widows

and orphans; i) To perpetuate the history of the United States Marine Corps and by fitting acts to

observe the anniversaries of historical occasions are of particular interest to Marines.

Section 105: LOCATION The meeting place and principal office of the CAPT. JOHN YANCEY DETACHMENT of the Marine Corps League shall be at the local American Legion Hall, Post 453, located 2755 Bachman Drive Dallas, Texas 75220. The meeting is second Saturday of each month at 1300 or at such other time or places as directed by the Detachment Commandant with the advice and consent of a majority of the membership at a regularly convened meeting. Section 11 0: CORPORATE SEAL The corporate seal shall be round in shape, containing in the center thereof, a replica of the United States Marine Corps Emblem and surrounded by the words CAPT. JOHN YANCEY DETACHMENT. The seal shall remain in the custody of the Commandant or the Adjutant as convenient circumstance may require. Section 115: POLICY

a) The supreme power of the CAPT. JOHN YANCEY DETACHMENT of the Marine Corps League shall be vested always in the membership, functioning through its' Officers who shall also be known as its' Corporate Board of Directors.

b) The CAPT. JOHN YANCEY DETACHMENT of the Marine Corps League shall never take part in a labor or management dispute or issue, and it shall be ever nonsectarian, non-political and nonpartisan; nor shall it be biased on the grounds of race, color, creed, nationality, or sex; nor shall it be used as a medium of political ambition or preferment; nor shall former or present military rank or present civilian position be used as a basis for special consideration or preferment.

c) Nothing in the preceding paragraph shall prohibit the Detachment from participating in political issues affecting the welfare of the United States Marine Corps League, the National Security of our Nation, or a veteran's claim for justice arising from service in the Armed Forces of the United States of America.

d) Detachment members may individually attend sectarian or political rallies from time to time and express their views as they see fit. However they are prohibited from wearing the Marine Corps League uniform or conducting themselves in a manner that would suggest that they represent the Capt. John Yancey Detachment or the Marine Corps League.

ARTICLE II MEMBERSHIP

SECTION 205: MEMBERSHIP

a) Only persons who are serving or who have served honorably in the United States Marine Corps, “ON ACTIVE DUTY”, for not less than ninety (90) days and earned the Eagle, Globe and Anchor; or who are serving or have served in the United States Marine Corps Reserve and have earned no less than ninety (90) Reserve Retirement Credit Points; U.S. Navy Corpsmen who have trained with Marine FMF Units in excess of ninety (90) days and earned the Marine Corps Device (clasp) worn on the Service Ribbon and those who earn the Warfare Device authorized for FMF Corpsmen; and U.S. Navy Chaplains, having earned the FMF Badge, serving with Marines, shall be eligible for Regular Membership in the Marine Corps League. Additionally, some Korean War Era Marines who were ordered to active duty prior to completion of Recruit Training or Officers Training, and subsequently received an honorable discharge prior to completion of ninety (90) days active or reserve duty, shall be deemed eligible for Regular Membership. (“Honorable Service” will be defined by the last DD Form 214 or Certificate of Discharge the applicant received. General Discharge under Honorable Conditions is acceptable.)

b) Regular. Associate, Honorary, Life and Dual Members may be accepted as provided in the National Bylaws.

c) Membership cannot be denied on the basis of Race, Religion, sex, creed or national origin. As long as all other membership requirements are meet.

SECTION 206: APPLICATION

a) The applicant must take serious the committed duties associated with Signature and Sworn Oath taken upon acceptance as a Member of the Marine Corps League.

b) Member in good standing leads by example. This is not limited only to attending meetings and keeping current with annual dues, but being proactive in development of ideas to strengthen the Detachments charitable presence of those needs within our MCL adopted communities.

c) Dues disbursement includes Department and National Headquarters with sufficient Detachment funds to partially cover administrative and operating expense.

SECTION 220: DELINQUENT MEMBER

a) If a member's dues are not paid and transmitted, on or before expiration date show on members card, membership shall be retained in delinquent status for a maximum (1) one year. Delinquent status can be erased by making all payments of arrear and current dues. Should the affected member remain in delinquent status in excess of (1) one year, he/she shall be dropped from a membership roll of good standing status.

b) Reinstatement of membership can only be restored through a Standard Application

Form submitted as a new member paying initiation fees and dues. If the delinquent member wishes to retain continued membership status, he/she must pay all past dues and assessments, which have accrued over entire delinquent period.

c) No delinquent member may be transferred.

ARTICLE Ill OFFICERS & DUTIES

SECTION: 300 OFFICERS

a) The elected Officers of the CAPT. JOHN YANCEY DETACHMENT shall be its Board of Trustees. The immediate Detachment Past Commandant is not elected or appointed to the BOARD OF Trustees, but Bylaws seated offering the Board of Trustees seasoned experience.

b) All Officers whether elected or appointed must be Members in good standing of the Detachment and shall serve (1) one year term.

SECTION: 301 ELECTED OFFICERS shall be: a) DETACHMENT COMMANDANT b) DETACHMENT SENIOR VICE COMMANDANT c) DETACHMENT JUNIOR VICE COMMANDANT d) DETACHMENT JUDGE ADVOCATE Seated,

ELECTED OR APPOINTED OFFICERS shall be:

e) JUNIOR PAST COMMANDANT (Seated) f) DETACHMENT ADJUTANT (Elected or Appointed) g) DETACHMENT PAYMASTER (Elected or Appointed) h) SERGEANT at ARMS (Elected or Appointed) i) CHAPLIN (Elected or Appointed]

SECTION: 302 BOARD of TRUSTEES The BOARD of TRUSTEES shall be composed of a minimum (4) four elected Officers with the (1) one seated Junior Past Commandant. This number can increase with the possibility of any Commandant appointed Officers to serve on the Board of TRUSTEES. Each member may be elected or appointed to serve in a specific Office for a (1) year term. An Officer can be re-elected or appointed the subsequent year for another (1) one year term for a maximum total of (2) two consecutive years served in the same Office. The Board of Trustees is to provide some additional continuity when there is change in the administration. They do not take part in the everyday administration of Detachment business. The Trustees act as an advisory_ panel to the Commandant, when there are concerns about a decision that will have major, or or long term, impact on the Detachment. SECTION: 303 DUTIES of OFFICERS Commandant duties are to preside at all Detachment and Board of Trustees meetings; to observe and enforce the rules and regulations of the Constitution and Bylaws of National, Department and Detachment and all respective committees. He/she shall promulgate all orders and regulations necessary for proper administration of Detachment affairs and seek

the advice of Trustees when necessary. The ability to lead by example, delegate and monitor results will be critical to time management- getting assigned tasks accomplished through others and achieving desired results. To effectively promote the Detachment and the League will develop a positive community image and attract new members. SECTION: 304 DUTIES of OFFICERS The Senior Vice Commandant (SVC) is the (2) second ranking Officer in the Detachment and a member of the Board of Trustees. He/she should assist and support the Commandant to prepare as the logical Office successor, and in the Commandant’s absent, shall assume the duties of Detachment Commandant. The SVC’s duties are very similar to those of the Commandant in development and implementation of projects/committees targeted as necessary by the Membership. The Senior Vice Commandant’s role is critical to the Detachment in providing Officer Support and accepting major responsibility in meeting Detachment objectives.SECTION: 304 DUTIES of OFFICERS Junior Vice Commandant (JVC) is the (3) third ranking Officer and may be asked to fill in for the SVC in the latter's absence. The JVC will need to be familiar with current Detachment activities, projects and committees, being more specific to those under the Senior Vice Commandant. The JVC shall develop and maintain records on members and membership participation. The Junior Vice Commandant shall report to Trustees and Members a budget, defining goals with a submittal of programs and projects, to increase Detachment membership. Communicate consistently on ideas, suggestion and follow up on everything related to increased membership. SECTION: 305 DUTIES of OFFICERS Judge Advocate should possess a working knowledge of the National and Department Bylaws and a solid understanding of his/her Detachment Bylaws. The Judge Advocate is the keeper, protector and counselor of those laws, policies and procedures within the D e t a c h m e n t . He/she must be diligent in assuring conformance to these credentials that allow the legality of procedure within the League and Detachment to exist in an orderly manner. He/she enforces, through the Board of Trustees, and advises members and Officers of the Detachment, within the Marine Corps League organization. The Judge Advocate has the right and obligation to suggest meaningful change to the statutes from higher levels, and a p r o c e d u r e for being heard. SECTION: 306 DUTIES of OFFICERS Junior Past Commandant (JPC) is the immediate past Commandant of the Detachment. The role of the JPC is to provide guidance and council, plus bridge continuity between present and past Administrations. He/she should be considered a resource to be used by the Board of Trustees and Staff Officers in accomplishing their assignments. This Office is recognized by the Detachment as a seated Officer, not being elected, nor appointed. The Detachment, within the criteria of Article V of Detachment Bylaws, has the right to remove and/or replace a member seated in the Past Commandant Office. A replacement can be

appointed by the Detachment Commandant, with a Detachment Member of good s t a n d i n g . SECTION: 307 DUTIES of OFFICERS The Adjutant may be an appointed or elected Officer. He/she transposes Detachment verbal communication into accurate written hard copies and/or email, for distribution to all membership, with copies retained in a permanent record file. The Adjutant plays an important role in Detachment operations providing records of decisions and programs, which assist the Officers in communication activities. In addition to the fact minutes and records are legal documents, both for the Marine Corp League and the Department, the information can be extremely valuable for determining why courses of action were chosen and what positive and negative similarities resulted. The Adjutant will distribute and briefly report, in a concise format, on prior meeting activities, highlighting motions, resolutions and calendar of events related to goals. The only motions that will be received from the floor concerning change, before approval of prior meeting minutes, must be based on content only. This Office may be consolidated with the Paymaster Office (ADJUTANT/PAYMASTER), based on similarities in responsibilities and duties of both Offices. SECTION: 308 DUTIES of OFFICERS The Paymaster can be an elected or appointed Officer. Should the Detachment desire the position be filled by election, the candidate must be a Regular Member. An appointed person may be either a Regular or Associate Member in good standing. The elected Paymaster is a member of the Board of Trustees, while an appointed member is not. He/she serve as a treasurer for the Detachment which receives and deposits all monies in federally insured accounts maintained in the name of the Detachment. The Paymaster assists in the annual audit and surrenders all records and other property to the duly elected or appointed successor. At the end of each Quarter, the National Adjutant/Paymaster sends to the Detachment an audit with a roster of their members. This provides valuable information to favorably positioning the Detachment voting verification, membership retention and dues status. Member dues are collected, deposited and recorded by the Paymaster. These funds are forwarded as required distribution on Dues Transmittal Forms to National and Department Headquarters. The Paymaster has the responsibility for all Detachment financials; Budget-Dues-Donations -Expenditures. This Office may be consolidated with the Office of Adjutant (Adjutant/Paymaster), which is based on similarities in responsibilities of both Offices. SECTION: 309 DUTIES of OFFICERS The Sergeant-at-Arms is responsible for the organizational procedures necessary to maintain order at ceremonies and business meetings. Arrange in advance proper seating, placement of Colors, Bible and podium, plus access to any other program necessity. He/she greets guests with intent to introduce them to Detachment Members and Officers in effort to make them feel at home. Secures quarters providing order to begin meeting and then continues to participate in abiding to his/her ritual of Officer in opening through closing ceremonies. Upon conclusion of meeting the responsibility to return quarters and property back to original state of order.

SECTION: 310 CHAPLIN The term "Chaplin" implies the proving of support to individuals and groups for spiritual or religious guidance. This permeates through every aspect of league objectives, purposes, initiations, ritual, and reference to God. It is expected that the Chaplin will supply support to those in need and provide prayer with words of the Ritual or offer other appropriate prayer for meetings and ceremonies. The Chaplin needs to respond to members and/or their family needs and wishes, with the offer of comfort, to provide advice and counsel where needed. He/she is responsible to provide notification of deceased members to the Department and National Marine Corps league Headquarters Offices. Providing service, as a Chaplin, is to live the "Golden Rule" - "Do unto others as you would have them do unto you".

ARTICLE IV

ELECTION OF OFFICERS SECTION 400: ELECTION OF OFFICERS

a) National Bylaws state the election of officer must be held between October 1 and May 15.

b) The CAPT. JOHN YANCEY DETACHMENT election of officers shall be held during the regular scheduled Membership meeting in April of each year. Elected Officers term is (1) year with installation in May.

SECTION 405: ELECTIVE OFFICERS

a) The Detachment Officers to be elected at each year election shall be the; Commandant, Senior Vice Commandant, Junior Vice Commandant, Judge Advocate. Appointments or elected officers will be Adjutant/Paymaster, Sergeant-at-Arms and Chaplin.

SECTION 410: NOMINATIONS

a) The Detachment Commandant shall name a Nominating Committee in March. Recommendations by the Nominating Committee and all other nominations for elective officers shall be made from the floor on the day elections are to be held. Each nominee must be a member in good standing in the Marine Corps League at the time of his/her nomination. Each nominee, when called upon, shall rise, unless restricted by physical impairment, and state to the Chair that if elected will accept the office and serve loyally, faithfully and to the best of his/her ability during the term which elected.

SECTION 415: ELECTION

a) The election of DETACHMENT OFFICERS will be the last order of business of the meeting.

b) No person shall hold more than (1) one elected Detachment Office at the same time.

SECTION 420: VOTING

a) Before voting begins, the Detachment Commandant shall select (2) two Past Detachment Commandants, or other Detachment Officers to act as Judges and Tellers.

b) When Judges and Tellers have informed the Chair that they are ready and prepared to supervise the election, the Chair shall than call for the "ELECTION of OFFICERS". Upon such announcement by the Chair, it shall not accept or entertain any issue, question or subject, which is not strictly related to voting being conducted. Without explicit permission from the Chair, a voting member shall not be allowed to enter or leave meeting until the voting in process is concluded. The method of voting process shall be secret ballot or recorded roll call.

c) A majority of votes cast is required to elect Detachment Officers. When a simple majority is not obtained on the first ballot, a second balloting will immediately commence, after a caucus (not to exceed (5) minutes).

d) The official count and verification of votes shall be recorded and certified by Tellers SECTION 425: INSTALLATION of OFFICERS

a) The installation of elected and appointed Officers of the Detachment shall be conducted within (30) thirty days subsequent of the election.

b) An Installing Officer must be requested from the Department of Texas Commandant Office that should arrangement for a formal installation ceremony. The Junior Past Commandant, upon completion of the ceremony, will present to the incumbent Commandant all Detachment records and documents. The information shall include, but not limited to all Financial, Administrative and Bylaws.

ARTICLE V RESIGNATION, DEATH or IMPEACHMENT of an OFFICER

SECTION 500: REMOVAL or REPLACEMENT When a Detachment elective or appointed Officer fails to attend (3) three successive regular monthly meetings, the Commandant shall request by mail an explanation for failure to attend meetings and apparent lack of interest on part of such officer. If an explanation is not received within (10) ten days after such request is sent to the last known address, or if the explanation is unsatisfactory, the Detachment Board of Trustees may declare such office is vacant. SECTION 505: VACANCY in OFFICE

a) In the event of a vacancy in the office of the Commandant or Senior Vice Commandant, the officer next in line shall automatically succeed to the office vacated.

b) In the event of a vacancy in any other elected or appointed office, the Commandant shall appoint a member in good standing from the membership roster of the Detachment for the remainder of the term office so vacated. The appointment must be approved by a majority of the membership vote at a regular scheduled Detachment meeting.

SECTION 510: AUTHORITY The CAPT. JOHN YANCEY DETACHMENT Marine Corps League shall be Governed by Membership, elected Officers, Board of Trustees and be subordinate to the Department and National Marine Corps League Constitution and Bylaws of those bodies.

ARTICLE VI

Meetings SECTION 600: MEETINGS The CAPT. JOHN YANCEY DETACHMENT Marine Corps League meets the (2) second Saturday of each month at, 1300 hours, at the American Legion Post Hall, 2755 Bachman Drive, Dallas, Texas 75220 unless otherwise directed by the Detachment Commandant with the advice and consent of a majority of members at a regular scheduled meeting. SECTION 605:

a) A Quorum of the CAPT. JOHN YANCEY DETACHMENT shall be no less than (12) twelve Regular members, of which (3) three are Elected Officers, all in good standing, or, if circumstances dictate, a lesser number. Those present, representing a lesser number in a meeting, must include a minimum of (3) three elected Officers. Elected Officers have to be Regular members, in order to conduct Detachment business. Associate Members, as appointed Officers, are not considered as part of a DETACHMENT Quorum. Associate Member are not permitted to vote on member applications, elections of Officers, or hold elective office. A Detachment or a Department may, by provision of Bylaws and/or Administrative Procedures, allow an Associate Member to vote on internal affairs, unless such policies affect Marine Corps League Bylaws and Administrative Procedures.

b) The Detachment's membership meetings should constitute current business and actively initiated problem solving, constantly keep members informed of progress directed toward current objectives and goals, stressing importance for positive Committee growth on reporting, especially new membership and fund raising. Informed, encouraged and motivated members creating new ideas, solve problems.

c) A strong communication link must be sustained through Officers, between Staff, Project Chairman and Membership, that provides the teamwork necessary in success.

SECTION 610: BOARD OF TRUSTEES Meet quarterly or as business dictates, with place, time, and purpose, designated by the Commandant, with a minimum of (3) Board Officers present to form a voting quorum. SECTION 615: STAFF-PROJECT MEETINGS Proactive meetings by the Staff and Project Chairman, under additional guidance from the Board of Trustees, are to assess progress relative to timeline and realistic goals. All meetings should constitute a minimum of a (3) three-member forum, in case voting is necessitated or those members present not voting. SECTION 620: RULES OF ORDER

ARTICLE VII Committees

SECTION 700 COMMITTEES The Commandant and Board of Trustees may appoint committees at their pleasure. They shall appoint, but are not limited to, the following Committees;

Each Committee will comply with the Detachment, Department and National Bylaws and Administrative Procedures. The Board of Trustees may appoint, at any time, a Committee for purpose deemed necessary. All Committees are responsible to the Board and Membership, which has the authority to amend, add changes or eliminate any committee.

ARTICLE VIII FISCAL & FINANCIAL

BUDGET-DUES-DONATIONS-EXPENDITURES

SECTION 800: DUES Dues shall be determined by the Detachment Board of Trustees and approved or disapproved by the membership. Dues shall not be less than that amount set by the Department and National Headquarters. SECTION 802: DEPARTMENT AND NATIONAL DUES Dues for Department and National shall be forwarded to the Department Paymaster in an expeditious manner. SECTION 804: FUNDS DEPOSIT All funds received by Detachment Paymaster shall be deposited in the name of CAPT. JOHN YANCEY DETACHMENT Marine Corps League in banks or savings companies designated by the Membership. SECTION 806: ANNUAL AUDIT An audit shall be performed, annually, each April. The Commandant shall appoint an Audit Committee consisting of three (3) members, one of which shall be the current Judge Advocate. They shall review all records of receipts and expenditures kept by the Detachment Paymaster and present their report of audit at the next Detachment meeting. Prior to installation of Officers, the Audit Committee will present the audit findings to the Detachment. The Paymaster cannot be a member of this committee. SECTION 808: FUND RAISING Fund raising activity shall not violate Federal, State, Municipal Law or Ordinance, nor r e f l e c t discredit upon the Marine Corps League. SECTION 810: EXPENDITURES - ANNUAL BUDGET C O M M I T T E E

a) The Budget Committee shall write a budget each Fiscal Year. The budget shall be presented at the July Detachment meeting each year. The membership may reject or amend any part thereof. They may reject or approve the budget in it's entirely. Once ratified by the members present at that meeting, the Detachment shall be bound to stay within that budget as close as practically possible.

b) Any budget item of any amount may be disbursed at any time during that budget year without the need of an additional vote by the membership (assuming funds are available).

c) The Commandant is authorized to make unbudgeted expenditures as the need arise, not to exceed $250.00 each Quarter.

d) Any expenditures, not previously budgeted, in excess of $250.00 up to and including $500.00may be made with the approval of the members present at that meeting. Non-budgeted expenditures shall not exceed $750.00 during any one quater.

e) Any single expenditure, not previously budgeted, up to and including $500.00, may be made with the approval of members present at that meeting.

f) Any single expenditure in excess of $500.00, not previously budgeted, shall be deferred until all members have been notified and given adequate notice to attend the next scheduled Detachment Meeting. All members shall be given the opportunity to voice their opinion and cast their vote. Adequate notice is defined as a minimum of fifteen (15) days.

g) Any multiple of expenditures totaling more than $500.00, to be made within the same time frame, not previously budgeted, shall be deferred until all members have been notified and given the opportunity to voice their opinion and cast their vote. Adequate notice is defined as a minimum of fifteen (15) days.

SECTION 812: DONATIONS Donations made will be in accordance with the guidelines of the Internal Revenue Service for nonprofit organizations. All donations from the Detachment must be approved by a majority vote in a regular scheduled meeting. Members must be informed of the intention of making the donation by the Detachment. SECTION 814: SCHOLARSHIP FUND IN MEMORY OF DECEASED MEMBERS The Detachment will donate to the Detachment Scholarship Fund for deceased members of the Detachment and their immediate family (spouse and children). The amount is set at no more than $50 for deceased relatives of Detachment members, not to exceed $50. Relatives include mother, father, siblings, mother-in-law, and father-in-law. Fund contribution is dependent upon Quarterly Budget strength. SECTION 816: GIFTS FOR HOSPITALIZED MEMBERS The Detachment will purchase appropriate gifts for hospitalized members or their spouses, as appropriate (flowers, magazines, candy, etc.), to provide a cheerful recovery a t m o s p h e r e . These gifts shall not exceed $50 when, and if, funds are avai lab le . SECTION 820: DETACHMENT OPERATING BUDGET

a) The Detachment operating budget sets the maximum amount of funds that are authorized to be spent on any one budgeted item during that Fiscal Year.

b) Committee Chairman and Detachment members shall make themselves aware of the budgetary limits for that activity. Reimbursement, up to the limit of the budgeted amount for that activity, may be made to individual members, or COMMITTEE CHAIRMAN, upon presentation of receipts or other documentation to the Paymaster.

c) No additional expenditures shall be reimbursed once the budgeted amount for that Fiscal Year has been reached.

d) Expenditures in excess of the total budgeted for any activity or service are, by definition, unbudgeted items.

e) Reimbursement of unbudgeted items shall be made with the constraints outlined in Detachment Bylaws, ARTICLE VIII SECTION 810.

SECTION 825: VETERAN PROGRAM Veteran’s assistance or needs must not exceed $100.00 per individual, in the Fiscal Year a n d no more than what has been allocated for the Fiscal Year can be spent. Any funds, beyond the $100.00, must be presented to the Detachment Membership for approval, providing the funds are available. Once the allocated funds have been extinguished for the fiscal year, no more monies will be used for any additional requirements. SECTION 830: DETACHMENT MONTHLY VA HOSPITAL VISITS Funds allocated, for support of the veterans’ monthly visits, must be part of the annual operating budget. No more than the allocated monthly budgeted funds will be spent. SECTION 835: DETACHMENT HEALTH AND COMFORT The Detachment health and comfort activities will consist of a group gathering to participate in camaraderie and in celebration of Detachment and members’ significant events (birthdays-promotions-memberships-sports). The events will take place monthly, Quarterly, annually and as deemed necessary. Detachment expenditures should not exceed $3.00 per member present. Any funds spent above the $3.00 will be voted on prior to the event .

a) The budget and amount for this activity is subject to the constraints outlined in the expenditure and budgeted sections.

b) Detachment expenditures shall be limited to the amounts provided in the budget for this activity during anyone Fiscal Year, or can be added after Quarterly or annually as deemed necessary.

SECTION 840: DETACHMENT MARINE CORPS BIRTHDAY BALL The Marine Corps Birthday, celebrated on the 10th of November each year, will be celebrated by the Detachment on a day that will coincide with the Detachment meeting or on a date approved by the Detachment membership. The Detachment Commandant will appoint a Detachment Birthday Ball Committee comprised of a Ball Chairman and an assistant. The Detachment will not support any other celebration with Detachment funds without prior approval of the membership. SECTION 845: TOYS FOR TOTS The Detachment Toys for Tots Committee will be composed by a Committee Chairman, appointed by the Commandant, immediately after the Detachment installation of Officers, each year. The Detachment will make a commitment to support Toys for Tots, even if limited to only one location. The location is to be presented to the Toys for Tots Foundation in order to not be in conflict with any other organization. SECTION 850: JROTC SUPPORT PROGRAM The JROTC Committee will consist of a JROTC Liaison appointed by the Commandant. The JROTC Liaison will be responsible for coordinating with the respective JROTC Units.

Supported by the Detachment, with recommendations to the Commandant, there will be positive changes made in JROTC Units. The JROTC Liaison will also be responsible for, with the approval of the Commandant, assigning members to make awards, to supported JROTC Units, at the designated times and places. SECTION 855: DETACHMENT SCHOLARSHIP PROGRAM The Detachment Scholarship Program shall be composed of no less than 3 Detachment members. The Detachment Scholarship Committee will be governed by the available funds to be awarded. Each Scholarship shall be a one-time annual award of $250.00. The Scholarship application will establish the guidelines for qualifications. The awards will be available for dependent of active members for the Detachment such as Sons, Daughters, Grandsons, and Granddaughters. SECTIONS 860: VETERANS RESOURCE CENTER The VRC recently opened adjacent to the VA Hospital in Dallas. Volunteers are a much-needed service in preparing all veterans direction and means to overcome some of the adversity in their return to civilian life. Most of all to set defined lines of preparation for the unexpected and enable them to compete for the opportunity to have a vocation. This would provide the essential needs of life and position them to be a respected member of the community. Financial Budget Item Not Yet Funded. SECTION 865: VA HOSPITAL HEALTH AND COMFORT PROGRAM There are numerous jobs or services that are performed at VA Hospitals each day. These may be performed individually or as a group. It is the mission of the VAVS program to provide veterans served by the VA with a comprehensive range of services, which are supplemental to budgetary appropriations for the Department of Veteran Affairs. The Detachment will select a volunteer member to serve as Detachment VAVS Representative and a member to serve as Deputy VAVS Representative. These volunteers shall coordinate Detachment volunteer with the Volunteer Services Director at our local VA Hospital. There is a VAVS training guide for Representatives and Deputy Representatives available through the Volunteer Services Office. Our Rep and Deputy Rep are expected to obtain a copy and be guided accordingly. It is Department of Veteran Affairs policy that all regular volunteers be screened, fingerprinted and obtain a VA Volunteer ID card. Each regular volunteer must sign a volunteer release form and sign the Safety Procedures Outline. These forms are updated annually and kept in the volunteers file. Occasional volunteers are not required to complete this procedure. All Detachment volunteers are expected to follow the guidelines and instructions as directed. It is the intent of our Detachment to participate in VAVS effort to the extent of what is physically and financially possible.

Detachment volunteers are expected to place the comfort, health and well being of the patients first, in the course of performing our volunteer work. Any member of the Detachment who violates these Bylaws or the Bylaws of the Department of National Marine Corps League, or who performs, or allows to be performed, any act or deed that tends to bring discredit upon Marine Corps League shall be disciplined by the Detachment Board of Trustees, in a manner which, in their discretion, is just punishment for such violation. ARTICLE X AMENDMENTS

SECTION 100 AMENDMENTS

a) Detachment Bylaws may be revised, amended or repealed by the majority of the Detachment membership. There should be a motion and a second to approve/vote on the Bylaws. To amend the Bylaws may require a simple majority or some other percentage of membership voting.

b) Amendments or additions of any kind to the Bylaws must be resubmitted in writing to the Bylaw Committee or the Detachment membership convened one (1) month before the proposed changed is voted on at a regular schedule meeting and, then, only if the proposed change does not affect or conflict with Department or National Bylaws.

c) The Bylaw amendment does not take effect until the revision certification page is signed and approved at the State Level. Until this is complete the previous bylaws remain in effect.

d) Any issues not covered by Detachment Bylaws shall be referred to the Department and National Bylaws for compliance.

e) The Detachment membership approved copy of amended Bylaws will be submitted to the Department Judge Advocate for approval.

f) If the amended copy of Detachment Bylaws is not in compliance with Department and National Bylaws, the Department Judge Advocate will return the Bylaws with written requirements for compliance.

g) The Detachment will review, question or comply with Department revisions to their Bylaws. After membership approval of revision, a copy of the Detachment Bylaws will be resubmitted to the Department Judge Advocate as quickly as possible.

h) The Amendment date of approval is to be recorded by Detachment and Department on the cover or concluding page of Detachment Bylaws.

i) A copy of approved Detachment Bylaws should be given to all membership and, most important, new members.

EXCEPTIONS: " With the following exceptions, the Captain John Yancey Detachment shall incorporate and adhere to the National and Department Marine Corps League By-Laws as written." Article 2, Section 201- XYZ. Content of the exception. Article 6, Section 602 - ABC. Content of the exception. " All other Articles of the National and Department By-Laws are hereby incorporated by reference."

Amendments

Article X Section 200

Section 201: Amendment to handling and use of detachment funds.

a) When conducting a fund raiser, 20% of the funds collected are to be kept by the detachment and placed in the general funds. No exceptions are to be made for this rule unless the bylaws are amended to remove this rule.

b) The detachment must maintain a 2500$ operating minimum. This money may not be used for anything other than emergency operating costs of the detachment. These funds are not available for use on previous commitments, committees, equipment, or projects. A vote cannot be made to over write this rule.

c) Members who wish to fund a project or committee must also provide a method of helping to raise funds, and participate in the raising of those funds, for that project when requesting to use the detachments funds. The guidelines for the amount that must be raised are:

a. The fund raiser must provide 100% of the funds for expenses under 250$. b. The fund raiser must provide 80% of expenses for projects over 250$. c. If the fund raiser fails to provide adequate funds then the project, committee,

event, or participation in the event is nullified. Adequate funds are equal to the amount requested in the initial proposal. If the project goes over budget then those funds over the original proposed budget must be raised 100% by the fundraiser.

d. Proposals must also still meet Section B if they fall under the 80% category outlined above.

d) Members must have been present in a minimum of two meetings in an 11 month period to eligible to request funds for a committee, project, or any other event.

e) Members who wish to propose a committee, project, event, or participation in an event which will require the use of detachment funds must put forth a proposal which receives a motion and a second motion to be voted on at the next convened detachment meeting 1 month after the proposal is put forth to the membership. Including that this proposal follows Amendments Section 201 A-D. The initial proposal must include a Budget, and fund raising project (as outlined in Section C).

f) Sections A-E are not required of proposals which do not require or draw funds from the detachment.
