CONDITIOJSrS OF SALE.

I. The highest bidder to be the buyer; and if any dispute arise between bidders, the lot so disputed shall be immediately put up again, provided the auctioneer cannot decide the said d^ispute.

IL No person to advance less than Is.; above five pounds 2s. 6d., and so on in proportion.

III. In the case of lots upon which there is a reserve, the auctioneer shall have the right to bid on behalf of the seller.

IV. The purchasers to give in their names and places of abode, and to pay down 10s. in the pound, if required, in part payment of the purchase-money; in default of which the lot or lots purchased to be immediately put up again and re-sold.

V. The sale of any lot is not to be set aside on account of any error in the enumeration of the numbers stated, or errors of description.

VI. The lots to be taken away, at the buyer’s expense, imme¬ diately after the conclusion of the sale; in default of which Messrs. SOTHEBY, WILKINSON & HODGE will not hold themselves responsible if lost, stolen, damaged, or otherwise destroyed, but they will be left at the sole risk of the purchaser. If, at the expiration of Two Days after the conclusion of the sale, the lots are not cleared or paid for, they will then be catalogued for immediate sale, and the expense, the same as if re-sold, will be added to the amount at which it was bought. Messrs. SOTHEBY, WILKINSON & HODGE will have the option of re-selling the lots uncleared, either by public or private sale, without any notice being given to the defaulter.

VH. Upon failure of complying with the above conditions, the money required and deposited in part of payment shall be forfeited, and if any loss is sustained in the re-selling of such lots as are not cleared or paid fo7', all charges on such re-sale shall he made good by the defaulters at this sale.

A General in the Army, and Colonel of the 31st Eegt., he raised the German Legion, and served with distinction in the War with France. At Waterloo he commanded the 5th Infantry Brigade, and w^as severely wounded. Sir Colin was Governor of Jersey, and afterwards Commander-in- Chief at Bombay. He died 24th September, 1856, being then Governor of Chelsea Hospital.

Only three clasps were granted for the ‘^Speedy.'’ “ Being received next, as Master’s Mate, on board the Speedy, of 14 guns and 60 men, Capt. Jahleel Brenton, he was present in that vessel, 6th Novr. 1799, when she singly defeated near Gibraltar, and put to flight two Spanish schooners, each carrying two long 24-pounders and 50 men ; 10 other vessels of one 24-pounder and 40 men each, and a French xebec privateer of 8 guns. In April, 1800, Mr. Pedlar followed Capt. Brenton into the Genereux 74. After the surrender of the Genoa he rejoined Capt. Maitland on board the Camelion sloop, commanded subsequently by Capt. Edward O’Bryen. On 20th March, 1801, having assisted at the debarkation of the troops in Aboukir Bay, he removed on promotion to the Foudroyant 80.” —vide 0’Byrne 889.

*** “Chas. Friend entered the Navy, 2 Dec. 1805, as Fst.-cl. Vol., on board the Camel store-ship, Capt. John Joyce, from which, after visiting Gibraltar and the Rio de la Plata, he was transferred, as Midshipman, in Novr. 1807, to the Grampus 50, Capt. Jas. Haldane Tait, then at the Cape of Good Hope. In the boats of the Active of 46 guns, Capt. Jas. Alexr. Gordon, whom he joined 22nd July, 1809, Mr. Friend on the 29th June, 1810, contributed to the capture of a convoy in the harbour of Groa. He next, on 12th Feb. 1811, assisted in bringing out another from Orton although encountered by the most fearful obstacles; and on 27th July, in the same year, he was officially reported in the highest terms for his instrumentality, as Master’s Mate, in capturing and destroying 28 sail of merchantmen, defended in a creek of the island of Ragosniza, by three gun-vessels and a body of 300 troops. On 13th March, 1811, Mr. Friend was further present in the memorable action off Lissa, when a British squadron, carrying in the whole 156 guns and 879 men, completely routed, after a conflict of six hours, and a loss to the Active of 4 killed and 24 wounded, a Franco Venetian armament, whose force amounted to 284 guns and 2,655 men; and, on 29th Novr. ensuing, he shared in a hard-fought combat of an hour and a half, which, in rendering the Active captor of the Pomone, of 44 guns and 332 men, 50 of whom were killed and wounded, occasioned her a loss of 8 killed and 27 wounded, including Capt. Gordon who lost a leg. As a rev^ard for his conduct off Lissa, Mr. Friend, on his passing certificate reach¬ ing the Admiralty, was promoted to the rank of Lieutenant by commission dated 12th June, 1812; and, on 5th Octr. following, he was appointed to the Eclipse 18, Capt. Henry Lynne in the West Indies.”—vide 0^Byrne 381.

Bartholomew George Smith Day entered the Navy, 27th Novr. 1804, as Fst.-cl. Vol., on board the Amsterdam frigate, Capt. Wm. Ferris, employed in the West Indies; and, on next joining the Revenge 74, Capt. Robt. Moorsom, took part, as Midshipman, in the battle of Trafalgar, 21st Octr. 1805. Until Nov. 1808, he afterwards became attached in succession, on the Channel and Halifax stations, to the Medusa 32, Capt. Hon. Duncombe Pleydell Bouverie, Leopard 50, flagship of the Hon. George Cranfield Berkeley, and Chibucto and Bream schooners, both commanded by Lieut. Geo. Gover Miall. Being then appointed Acting-Master of the Superieure sloop, Capts. Wm. Ferrie, Humphrey Feming Senhouse, Henry Conyngham Coxen, and Robert Russell, he assisted, in com¬ pany with the Horatio and Latona, at the capture, on 10th Feb. 1809, of the French 40-gun frigate La Junon, after a contest in which the Superieure figured very conspicuously ; and, in the same and following year, he was also present at the reduction of the islands of Martinique, Guadaloupe and St. Martin. Between Octr. 1810, and his promotion to the rank of Lieutenant,—which took place 11 Feb. 1815, three years after he had passed his examination,—Mr. Day appears to have been next employed—in the Royal Sovereign yacht, in the river Thames — the Dominica sloop, Capt. Robt! Hockings, and Queen 74, flagship of Sir Fras. Laforey, both on the West India station—and the Cyrus 20, Capt. Wm. Fairbrother Carroll, off the coast of France. From April to Sepr. 1815, he afterwards served in the Slaney 20, Capt. Geo. Rose Sartorius; but since the latter date he has not been afloat. Lieut. Day, when in the Bream, in Chesapeake Bay, had the good fortune to suppress a mutiny which had broken out on board that vessel.—vide 0^Byrne, p. 272.

Attached to four guns, which kept the enemy at bay as they retired, was a sergeant named Patrick Mullane. This brave soldier saw one of the drivers attached to his gun struck from his horse while in the act of limbering up. He noticed that the man yet lived as he lay on the ground. “ Badly wounded,’' thought he, “ but they shall not hack him to pieces.” The enemy was within a few yards only, yet the gallant sergeant ran back in face of them, and with strong arms lifted up the

Lot 321—continued. wounded driver and placed him upon the gun limber, mounted the wounded man’s horse, and helped to bring the gun out of action. A second time did Sergeant Mullane distinguish him¬ self—this in the retreat to Kandahar. Many in this retreat were wounded even when after the first few miles the pursuit had slackened. Parties of the enemy still hovered about, cutting off stragglers and destroying all who could not well defend themselves; in addition to which the inhabitants of the villages through which the weary soldiers made their way to Kandahar, turned out and murdered all they could. Parched with fearful thirst, the wounded died in numbers as they went along. At one particular village, a large number of soldiers lost their lives in efforts to obtain water with which to moisten their lips. Louder and louder became the cries for water of the helplessly wounded men, when Sergeant Mullane volun¬ teered to go alone into this very village to procure that which would alleviate his comrades’ sufferings. He accomplished this task at the risk of his life, for he was fired at repeatedly ; yet he succeeded, and earned the grateful thanks of his dis¬ tressed brother soldiers.
