TENDERING PROCEDURE: 2.1. Blank Tender Forms. 2.1.1 Tender Forms can be downloaded from the e-Tendering portal of Maharashtra Tourism

As per the Tender Schedule. 2.1.2 The tender submitted by the tenderer shall be based on the clarification, additional

facility offered (if any) by the Department.Tender shall be unconditional. Conditional

tenders will be summarily REJECTED. 2.1.3 All tenderers are cautioned that tenders containing any deviation from the contractual

terms and conditions, specifications or other requirements and conditional tenders will be

treated as non responsive. The contractor should clearly mention in forwarding letter that

Guidelines to Bidders 2.2. Special Instructions to the Contractors/Bidders for the e-submission of the bids

online through this tender site : https://maharashtratourism.gov.in

(1) Bidder should do the Registration in the tender

site https://mahatenders.gov.in using the option available. Then the Digital Signature registration has to be done with the e-token, after logging into the site. The e-token may be obtained from one of the authorized Certifying Authorities such as SIFY/TCS / nCode/MTNL/eMudhra.

(2) Bidder then login to the site giving user id / password chosen during registration.

(3) The e-token that is registered should be used by the bidder and should not be misused by

others.

(4) The Bidders can update well in advance, the documents such as certificates, purchase order details etc., under My Documents option and these can be selected As pre tender requirements and then attached along with bid documents during bid submission.

(5) After downloading / getting the tender schedules, the Bidder should go through them

carefully and then submit the documents as asked, otherwise, the bid will be rejected.

(6) If there are any clarifications, these may be obtained online through the tender site, or through the contact details. Bidder should take into account of the corrigendum published before submitting the bids online.

(7) Bidder, in advance, should get ready the bid documents to be submitted as indicated in

the tender schedule and they should be in PDF/xls/rar/dwg formats. If there is more than one document, they can be clubbed together.

Any delay / non-submission of tender due to this shall be attributable to the bidder only and MTDC shall not be responsible for this.

(14) The bidder may submit the bid documents by online mode through the site

(https://mahatenders.gov.in) as indicated in the tender.

(15) The tendering system will give a successful bid updating message after uploading all the bid documents submitted & then a bid summary will be shown with the bid no, date & time of submission of the bid with all other relevant details. The documents submitted by the bidders will be digitally signed using the e-token of the bidder and then submitted.

(16) The bid summary has to be printed and kept as an acknowledgement as a token of the

submission of the bid. The bid summary will act as a proof of bid submission for a tender floated and will also act as an entry point to participate in the bid opening date.

(17) Bidder should log into the site well in advance for bid submission so that he submits the

bid in time i.e. on or before the bid submission end time. If there is any delay, due to other issues, bidder only is responsible.

(18) The bidder should see that the bid documents submitted should be free from virus and if

the documents could not be opened, due to virus, during tender opening, the bid is liable to be rejected.

(19) The time settings fixed in the server side & displayed at the top of the tender site, will be

valid for all actions of requesting, bid submission, bid opening etc., in the e-tender system. The bidders should follow this time during bid submission.

(20) All the data being entered by the bidders would be encrypted using PKI encryption techniques to ensure the secrecy of the data. The data entered will not viewable by unauthorized persons during bid submission & not be viewable by any one until the time of bid opening. Overall, the submitted tender documents become readable only after the tender opening by the authorized individual.

(21) The confidentiality of the bids is maintained since the secured Socket Layer 128 bit

encryption technology is used. Data storage encryption of sensitive fields is done.

(22) The bidders are requested to submit the bids through online e-tendering system to the TIA well before the bid submission end date & time (As per Server System Clock).

(23) The bidder should logout of the tendering system using the normal logout option

available at the top right hand corner and not by selecting the (X) option in the browser.

2.3. Pre-bid Meeting: (Deleted) 2.4. Manner of Submission of tender and its accompaniments:

Technical Bid/Cover:

The Technical Bid/Cover shall contain the following documents (to be uploaded) along with documents mentioned in the tender notice

2.4.1 Earnest Money Deposit of Rs.50,000/- 2.4.2 Proof of Railway Approved Original Electrical Spares Manufacturer in form of copy of

certificate/ document duly attested by competent authority from Railways or Govt. Authority. Original to be presented at the time of opening of tender.

2.4.3 Scanned copy of Sales Tax Registration Certificate 2.4.4 Warranty: Bidder to give warranty period of not less than 24 months for the tender items

manufactured by him.

2.4.5 Scanned copy of Details of work of at least one similar type carried out by the contractor. 2.4.6 If in case of Partnership firm, scanned copy of certified copy of Partnership Deed and

Power of Attorney, in case of a firm tendering for work. (True copy attested by a Gazetted Officer.)

2.4.7 The contractor shall submit an affidavit in original (as per format given) to the Tender accepting Authority on due date as per tender schedule regarding completeness, correctness and truthfulness of documents submitted.

2.4.8 Scanned copy of Undertaking of contractor that he had studied all tender documents, conditions and especially work methodology.

2.4.9 Copy of PAN(Permanent Account Number) Card

2.4.10 Scanned Copy of all the documents from Sr.No.2.4.1 to 2.4.12 shall be given by contractor in Technical Bid.

Even though the Bidder meets the above qualifying criteria they are subject to be disqualified if they have made: Misleading or false representations in the forms, attachments submitted in proof of the qualification requirement

and / or

Record of poor performance such as abandoning the works, not properly completing the contract, inordinate delays in completion, litigation history or financial failures etc.

2.4.11 All corresponding par as pertaining to the tender related subject to Maharashtra P.W.

Manual shall be applicable to this tender.

2.4.12 QUALIFICATION CRITERIA

1. The Bidder should submit Tender Fees of Rs.3000/- + 13% VAT) = Rs. 3390/- (Rupees Three Thousand Three Hundred and Ninety only.) through online transaction only.

2. The Bidder should submit Earnest Money Deposit amounting to Rs.50,000/-( Rupees Fifty Thousand only) through online transaction only.

3. The Bidder should be/have Registered Proprietorship or Registered Partnership Firms or Registered limited Companies.

4. The Bidder should have minimum 3 years of work experience of Providing Railways Electrical Item and should be Railway Approved Original Electrical Spares Manufacturer.

5. The bidders should have achieved average annual turnover of at least 75% of the estimated cost during last three financial years (2013-14, 2014-15, 2015-16) average annual turnover. (Audited balance sheets with I.T. Return shall be submitted).

6. The Bidder should have satisfactorily completed (from start to finish), at least one similar type of work

7. Warranty: Bidder to give warranty period of not less than 24 months for the tender items manufactured by him

8. The Bidder shall submit Sales Tax Registration Certificate Note -1 : The necessary certificates as mentioned in qualification criteria from Sr.No.

(1) to (8), shall be put in Technical Bid/Cover only. In absence of these certificates, Financial Bid/Cover shall not be opened except those mentioned in affidavit.

2.5. Financial Bid/Cover

The Tenderer should quote his offer only through online bidding process in terms of estimated rates. He should not quote his offer where directly or indirectly. The contractor shall quote for the work as per details given in the main tender. This tender shall be unconditional and made available to him on e-Tendering portal of Maharashtra Tourism Development Corporation Ltd.

2.6. SUBMISSION OF TENDER :

Refer to Section "Guidelines to Bidders" Tenderers are required to submit scan copy of all technical documents mentioned in Technical bid/ cover. Note: -Tender form fee and EMD can be submitted through SBI/ Net Banking

Transactions only.

2.7. OPENING OF TENDERS

On the date, specified in the Tender Notice, following procedure will be adopted for opening of the Tender. (A) TECHNICAL BID/COVER.

First of all Technical bid/cover will be opened to verify its contents as per requirements. If the various documents contained in this cover do not meet the requirements of the Department, a note will be recorded accordingly by the tender opening authority and the said tenderer’s Financial bid/cover will not be considered for further action and the same will be recorded.

The decision of the tender opening authority in this regards will be final and binding on the contractors.

(B) FINANCIAL BID/COVER.

This cover shall be opened after opening of Technical bid/ Cover, only if contents of Technical bid/ Cover are found to be acceptable to the Department. The tendered rates in percentage above/below to the estimated rates shall then be read out.

2.8. EARNEST MONEY :

EMD can be submitted through SBI/ Net Banking Transactions. The earnest money will

be refunded in due course in case of bidders whose tenders are not accepted. In case of

successful bidder the Earnest money will be refunded after recovering initial security

deposit and completion of contract documents by the tenderer. In case the successful

contractor does not pay the amount of initial security deposit within specified time limit,

the amount of Earnest Money will be forfeited.

2.9. SECURITY DEPOSIT

The successful tenderer shall have to pay half the security deposit in approved security

form of Demand Draft (DD)Name of Maharashtra Tourism Development Corporation

Ltd. payable at Mumbai from any Nationalised/ Schedule Bank and balance Security

Deposit will be recoverable through the bills at the percentage as shown in item(s) of the

Memorandum in printed B-1 form or as may be decided by the General Manager & Chief

Project officer (Deccan Odyssey),MTDC during course of execution of the work looking

to the position and circumstances that may prevail, whose orders will be final and binding

on the contractor.

Fifty percent of the security deposit will have to be deposited within seven days

(including Government holidays) of the acceptance of the tender and the remaining fifty

percent will be recovered from the Running Bills at the rate as specified in the tender

form. Amount of total security deposit to be paid shall be 4% of the cost of work. Initial

Security Deposit shall be in terms of Demand Draft (DD) from any Nationalised or

Scheduled bank. Note that initial security deposit shall not be accepted in any other

form. Not submitting the initial security deposit in stipulated time and form may

result in forfeiture of the Earnest Money Deposit (EMD) and black listing of the

tenderer, etc.

2.10. Condition for payment of additional security deposit, if offer quoted by the tenderer

is lesser than 10% below the cost put to tender. Tenderer quoting lower than10% of estimated cost put to tender shall have to pay

additional security deposit in the form of Demand Draft. The intending tenderers shall draw the Demand Draft (DD) (in favour of ‘Maharashtra Tourism Development Corporation Ltd.’, payable at Mumbai, valid for 90 days from the date of issue, for the amount calculated as per formula given below:

Additional Security Deposit = (Rs.) [% below quoted by the Contractor-10] x (Estimated Cost put to tender by MTDC). (Rs.) 100

The DD shall be drawn at the time of or before to uploading the E-Tender by the

tenderer and the tenderer shall submit the information of DD in Annexure – I, attached on page no. 36 of this tender document. (Kindly note that do not quote the amount of demand draft anywhere on the Annexure – I). The Annexure – I shall be on A4 size paper with signature, address, etc. of the applicant and the page shall be scanned and uploaded in the Technical cover / Bid.

Kindly note that, any tenderer found submitting his offer more than 10% below, without uploading Annexure – I (i.e. details of Demand Draft for additional security deposit), the bid shall be summarily rejected.

After MTDC gives the letter of intent to the successful bidder regarding submitting the Additional Security Deposit, the successful tenderer shall submit the Demand Draft (having number, date & bank as mentioned in the Annexure – I uploaded in Technical Bid) within 5 working days. Kindly note that, if any false / wrong information in this regard is found, (including the change in demand draft details) the offer of the tenderer shall be summarily rejected, including forfeiture of EMD and barring the tenderer for one year from taking part in MTDC’s bidding process.

E-Tendering website upon providing the details of the payment of cost as detailed in the

N.I.T. 2.12. TIME LIMIT

The work is to be completed within time limit as specified in the N.I.T. which shall be

reckoned from the date of written order of commencing the work. 2.13. TENDER RATE

No alteration in the form of tender and the schedule of tender and no additions in the

scope of special stipulation will be permitted. Rates quoted for the tender shall be taken

as applicable to all leads and lifts. 2.14. TENDER UNITS

The tenderers should particularly note the unit mentioned in the Schedule “B” on which

the rates are based. No change in the units shall be allowed. In the case of difference

between the rates written in figures and in words, the correct rate will be the one, which

is lower of the two. 2.15. CORRECTION

No corrections shall be made in the tender documents. Any corrections that are to be

made, shall be made by crossing the incorrect portion and writing the correct portions

above with the initials of tenderer.

2.16. TENDER’S ACCEPTANCE

Acceptance of tender will rest with the Managing Director, M.T.D.C.,Mumbai, who

reserves the right to reject any or all tenders without assigning any reason therefore. The

tenderer whose tender is accepted will have to enter in to a regular

B-1 agreement within 10 days of being notified to do so. In case failure on the part of

the tenderer to sign the agreement within the stipulated time, the earnest money paid by

him shall stand forfeited to the MTDC and the offer of the tenderer shall be considered as

withdrawn by him.

2.17. CONDITIONAL TENDER

The tender who do not fulfil the condition of the notification and the general rules and

directions for the guidance to contractor in the agreement form or are incomplete in any

respect are likely to be rejected without assigning any reason therefore. (a)

The tenderers shall be presumed to have carefully examined the conditions and

specifications of the work and have fully acquainted themselves with all details of the

site, the conditions of rock and its joints, pattern, tidal pattern and condition, whether

characteristics, labour conditions and in general with all the necessary information

and data pertaining to thework, prior to tendering for the work

(b) The data whatsoever supplied by the Corporation, along with the tender documents is

meant to serve only as guide to the tenderers while tendering and the Corporation ,

accepts no responsibility whatsoever either for the accuracy of data or their

comprehensiveness.

(c) The rates quoted should therefore be for all leads and lifts from wherever the materials

are brought at site of work and inclusive of royalty to be paid to the Revenue

Department by the Contractor

2.18. POWER OF ATTORNEY

If the tenderers are a firm or company, they should in their forwarding letter mention the

names of all the partners together with the name of the person who holds the power of

attorney authorising him to conduct all transactions on behalf of the body, along with the

tender As per scanned copy uploaded in Technical Bid/Cover

2.19. The tenderer may in the forwarding letter, mention any points he may wish to make clear but right is reserved to reject the same or the whole of the tenders if the same become conditional tender thereby.

2.20. The contractor or the firms tendering for the work shall inform the Department if they appoint their authorised agent on the work.

2.21. No foreign exchange will be released by the Department for the purchase of plants and machinery for the work by the Contractor.

2.22. All scanned pages of tender documents, conditions, specifications, correction slips etc. shall be initialed by the tenderer. The tender should bear full signature of the tenderer, or his authorized power of Attorney holder in case of a firm.

2.23. The Income Tax at prevailing rate including surcharges or percentages in force from time to time or at the rate as intimated by the competent Income Tax authority shall be deducted from bill amount whether measured bill, advance payment or secured advance.

2.24. VALIDITY PERIOD

The offer shall remain open for acceptance for minimum period of 90 days from the Date

of opening of Financial Bid and thereafter until it is withdrawn by the contractor by

notice in writing duly addressed to the authority opening the tender and sent by

Registered Post, acknowledgement due.

PERCENTAGE RATE TENDER AND CONTRACT FOR WORKS DEPARTMENT : MAHARASHTRA TOURISM DEVELOPMENT CORPORATION LTD. NAME OF WORK: “Providing Electrical Item for Deccan odyssey Luxury Train at

MTDC office Mumbai.

General Rules and Directions for the Guidance of Contractors. 4.1. This form will state the work to be carried out as well as

the date for submitting and opening tenders, and the time allowed for carrying out the work, also the amount of earnest money to be deposited with the tender and the amount of security deposit to be deposited by the successful tenderer, and the percentage, if any, to be deducted from bills. Copies of the specifications, estimated rates, and any other documents required in connection with the work shall be signed by the General Manager& Chief Project Officer (Deccan Odyssey), MTDC for the purpose of identification and shall also be open for inspection by contractors at the office of the General Manager& Chief Project Officer (Deccan Odyssey), MTDC during office hours.

4.2. In the event of the tender being submitted by a firm, it must

be signed by each partner thereof, and in the event of the absence of any partner, it shall be signed on his behalf by a person holding a power of attorney authorising him to do so.

4.2.1 Tender form fee and EMD can be submitted through SBI/ Net Banking

Transactions only. 4.2.2 In the event of his tender being accepted, , the said amount of earnest money shall be

appropriated towards the amount of security deposit payable by him under conditions of General Conditions of Contract.

4.2.3 If, after submitting the tender, the contractor withdraws his offer, or modifies the same or if after the acceptance of his tender the contractor fails or neglects to furnish the balance of security deposit without prejudice to any other rights and powers of the MTDC hereunder, or in law, MTDC shall be entitled to forfeit the full amount of the earnest money deposited by him.

4.2.4 In the event of his tender not being accepted, the amount of earnest money deposited by the contractor shall, unless it is prior thereto forfeited. Further same will be refunded to him on his passing receipt therefore.

4.3. Receipts for payments made on account of any work, when executed by a firm, should also be signed by all the partners except where the contractors are described in their tender as a firm, in which case the receipt shall be signed in the name of the firm by one of the partners, or by some other person having authority to give effectual receipts for the firm.

4.4. Any person who submits a tender shall fill up the usual

printed form stating at what percentage above or below the rates specified in schedule 'B' (memorandum showing items of work to be carried out) he is willing to undertake the work. Only one rate or such percentage on all the estimated rates/Schedule rates shall be named. Tenders who propose any alteration in the works specified in the said form of invitation to tender, or in the time allowed for carrying out the work, or which contain any other conditions, of any sort will be liable to rejection.

4.5. The officer competent to dispose of the tenders shall have

the right of rejecting all or any of the tenders. 4.6. No receipt for any payment alleged to have been made by a

contractor in regard to any matter relating to this tender or the contract shall be valid and binding on Government unless it is signed by the competent Authority

4.7. All work shall be measured net by standard measure and

according to the rules and customs of the Department and without reference to any local custom.

4.8. Under no circumstances shall any contractor be entitled to

claim enhanced rates for items in this contract. 4.9. Every registered contractor should produce along with his

tender valid certificate of registration as approved contractor in appropriate class mentioned in Tender.

4.10. All corrections and additions or pasted slips should be initialled.

4.11. The measurements of work will be taken according to the

usual method in use in the Department and no proposal to adopt alternative methods will be

accepted. The Executive Engineer's decision as to what is the usual method in use in the Department will be final.

4.12. The tendering contractor shall furnish a declaration along

with the tender showing all works for which he has already entered into contract, and the value of work that remains to be executed in each case on the date of submitting the tender.

4.13. The contractor shall comply with the provision of the

Apprentices Act 1961 and the rules and orders issued there under from time to time if he fails to do so his failure will be breach of contract and Managing Director, MTDC may in his discretion cancel the contract. The contractor shall also will be liable for any pecuniary liability arising on account of any variation by him of the provisions of the Act.

5. Eligibility Criteria For Bidding

1. The Bidder Should be a Approved Railway original Electrical spares manufacturer.

2. The bidders should have achieved average annual turnover of at least 75% of the estimated

cost during last three financial years (2013-14, 2014-15, 2015-16) average annual turnover.

(Audited balance sheets with I.T. Return shall be submitted).

3. The Bidder should have satisfactorily completed (from start to finish), at least one similar

type of work.

4. The Bidder should have minimum 3 years of experience of providing/ supplying similar

Electrical Spares to Railways.

5. Warranty:- Bidder to give warranty period of not less than 24 months for the tender items

manufactured by him.

6. The Bidder should be/have Registered Proprietorship or Registered Partnership Firms

Registered limited Companies.

7. The Bidder shall submit Sales Tax Registration Certificate.

6. TERMS AND CONDITIONS

1. The transit risk shall be borne by the supplier, which includes loading, transportation, unloading charges, etc.

2. No Advance Payment shall be made by the office. 3. Samples should get approved from Sr.DEE (Cog) BB, Central Railway, Divisional Office,

Electrical Branch, CST, Mumbai before the bulk supply. 4. Any additional supply made by the supplier without approval of Managing Director, MTDC

will not be paid. 5. For delay in supply of any/all mentioned electrical item as per work schedule attributes the

contractor, a penalty of Rs.1,000/- per day shall be levied. 6. The Initial Security Deposit shall have to be deposited within 7(seven) days (including

Government holidays) of the date of receipt of acceptance letter from the MTDC, unless otherwise extension of time limit granted by the MTDC in writing. The remaining security deposit will be recovered from the Running Bills at the rate as specified in the tender document.

7. The Security Deposit will be released only after the expiry of guarantee period, if any. 8. The Corporation has the power to terminate the contract at any time, if found unsuccessful, or the

material supplied is found not as per the specification stipulated and/or as per samples given. 9. The applicant/Bidder shall execute the said work at the agreed rates against the tender received

from Bidder. The payment will be made only on satisfactory supply/Provision/ of approved mentioned electrical item.

10. Bids shall remain valid for a period not less than 90 days after the deadline date for bid submission.

11. Time limit to complete the work is 02 (Two) Months from the date of issue of Work Order.

12. Under no circumstances shall any Contractor be entitled to claim enhanced rates for items in this contract.

13. The Bidder should stand minimum 24 Months of warranty (from the date of all items supplied) for every electrical item supplied to MTDC for Deccan Odyssey Luxury Train. Any defect occurred/found to any or all items shall be replaced within 07(seven) days on intimation of Competent Authority.

14. The successful Bidder shall have to submit the initial security deposit in form of Demand

Draft amounting to 2% of accepted cost of project, within a 07 (seven) days from date of issue

of written acceptance of the offer by MTDC Ltd. Initial security deposit with the MTDC a

sum 2% of the probable value (Accepted cost) of the contract, rounded off to the nearest

multiple of ten rupees. Remaining 2% shall be deducted from running bill, i.e total security

deposit being 4% of total cost of work (Accepted cost of project).

15. 100% of security deposit will be retained upto warranty period.

16. Payments will be made on satisfactory supply of materials duly certified by Sr.DEE (Cog) BB, Central Railway, Divisional Office, Electrical Branch, CST, Mumbai. Supply of electrical items mentioned in schedule should not get affected due to delay in partial payments if any

17. The contractor should follow all rules of Railways. 18. Required permission from Railways for specific material shall be obtained by the successful

bidder for utilization of said material For Deccan Odyssey Luxury Train. 19. Bill can be submitted by contractor only after Supply of All/every electrical item mentioned

in tender to MTDC for Deccan odyssey Luxury Train. 20. “MTDC Ltd” shall be entitled to deduct taxes as per government norms from the bills of contract. 21. All the material supplied/provided by the Approved Railway original Electrical spares

manufacturer shall be in good quality. i.e free from any damages, deviations etc.

22. The MTDC Ltd. Shall not be responsible for the loss in any material required for execution of

above said work, during the transit to work site/ MTDC office.

23. In the event of any dispute, difference concerning any matter including interpretation of this transaction the same shall be referred to the Managing Director, MTDC Ltd and his decision, shall be final and binding on both the parties.

24. Procedure for Evaluation of the Bids:- finalization of the bid must be on L-1 basis (i.e Lowest quoted rates). The successful bidder may be required to enter in to further negotiation, if asked by the competent authority of MTDC.
