For and on behalf of the PRESIDENT of INDIA, the Medical Director, Central Hospital, Lallaguda invites sealed tenders for hiring the services of Ambulance AC/NON-AC (Tempo Traveler or similar make)-2 nos. for a period of two years (i) for shifting patients of Central Hospital, Lallaguda to other hospitals within Hyderabad/Secunderabad area and (ii) for transportation of serious cases of accidents or sickness employees from Carriage Workshop, Lallaguda to Central Hospital or other referral hospitals. CARRIAGE & WORKSHOP TO OTHER HOSPITALS IN HYDERABAD/ SECUNDERABAD AREA FOR A PERIOD OF TWO YEARS FROM THE DATE OF

AGREEMENT

CHAPTER I

PREAMBLE 1.0 NAME OF WORK: Contract for Hiring of Ambulance AC/Non-AC (Tempo Traveler or 1.0 NAME OF WORK: Contract for Hiring of Ambulance AC/Non-AC (Tempo Traveler or similar make)-2 Nos (i) for shifting patients of Central Hospital, Lallaguda, Secunderabad and (ii) for transportation of serious cases of accidents or sickness employees from Carriage Workshop, Lallaguda to Central Hospital or other referral hospitals for a period of two years from date of agreement. 2.0 SCOPE OF WORK: Central Hospital, Lallaguda is a 300 bedded hospital having tie-up with other hospitals for referring the patients for Secondary/ tertiary care treatment. This tender is to enter into the rate contract with the agency for hiring the services of an Ambulance AC/Non-AC (Tempo Traveler or similar make) for the round the clock for shifting the patients of Central Hospital, Lallaguda to other hospitals and vice-versa. The Rate Contract will be operated by Hospital authorities from the date of entering into agreement for a period of two years. Type of Vehicle: Tempo Traveler or Similar make Round the clock, 365 days

The tenderer should have adequate service personnel (Driver, Motor Mechanic etc).List of personnel in the Organization available on hand and proposed to be engaged for this work should be submitted along with the tender. The service personnel deputed for the subject work must have an experience and thorough knowledge of emergency repairs etc.

List of contracts, if any or regular services rendered to a fixed hospital in the last three financial years and approximate value of the contract at the time of award, date of completion of the services should be given along with the offer as per format given in Chapter-VI. Otherwise total turnover for the last three years must be furnished.

Performance: The tenderer must provide details of similar projects executed earlier as per proforma given in Chapter - VI. The tenderer must also attach all necessary documentary evidence.

CHAPTER-II INSTRUCTIONS TO TENDERERS GENERAL INSTRUCTIONS,

SUBMISSION OF OFFERS, RATES, SPECIAL CONDITIONS, PERFORMANCE GUARANTEE AND SECURITY DEPOSIT OF THE CONTRACT.

I. GENERAL INSTRUCTIONS 1.0 Tenders are invited on behalf of President of India from established and reliable Tenderers for Hiring of Ambulance AC/Non- AC (Tempo Traveler or similar make)-2 Nos (i) for shifting patients of Central Hospital, Lallaguda, Secunderabad and (ii) for transportation of serious cases of accidents or sickness employees from Carriage Workshop, Lallaguda to Central Hospital or other accidents or sickness employees from Carriage Workshop, Lallaguda to Central Hospital or other referral hospitals FOR ROUND THE CLOCK SERVICE, 365 DAYS FOR A PERIOD OF TWO YEARS FROM THE DATE OF EXECUTION OF CONTRACT. 1.1 Any clarifications required by the tenderer may be obtained from the office of the Medical Director, Central Hospital, Lallaguda, Secunderabad. 1.2 All information in the tender must be in English. Information in any other language must be accompanied by authenticated translation in English. Failure to comply with this may render the offer liable to be rejected. In the event of any discrepancy between the offer in a language other than English and its English translation, the English translation will prevail.

1.13 Tenderer shall specify the official mailing address and fax numbers to which all correspondences shall be sent by Hospital Administration. 1.14 The tenderer shall keep the offer open for a minimum period of 180 days from the date of opening of tender. Within that period, the tenderer cannot withdraw his offer subject to the period being extended further if required by mutual agreement from time to time. 1.15 If the tenderer/s deliberately gives/give wrong information in his/their tender, creates/create circumstances for the acceptance of his/their tender, the Railway reserve the right to reject such tender at any stage. 2. 3.2 All the rates should be clearly written both in figures and words. The rates should be filled in the required format in the evaluation sheet. Tenderers in their own interest should avoid alterations/ corrections in the rates, submitted by them. However, if alterations /corrections in rates are inescapable each alteration /correction should be indicated both in figures and words and also duly attested under the full signature of the Tenderer. 3.3 The rates quoted shall be in INR (Indian Rupees) and shall remain firm throughout the period of the validity of the offer and subsequently during the currency of the contract and shall not be subject to any variation. 3.4 The tenderer shall quote service tax and other duties as applicable. No price variation is permissible during the contract period. However, taxes as applicable from time to time during the permissible during the contract period. Drivers should be physically fit to drive the vehicle, possess the valid driving license to drive Ambulance and bears uniform (White & White) and behave courteously with the patients and companion and also with the staff of this administration. The contract is not transferable and subcontracting in part or full will not be permitted. The tenderer shall not assign in whole or part of its obligation to perform under the contract to others. 15. Railway reserves the right to require the contractor to deploy his personnel to work as and when required for repairs and maintenance. 16. the performance of the contract shall be referred to the General Manager/South Central Railway/ Secunderabad or to his nominee, who will be the sole arbitrator and his decision is final and binding on both the parties. 23. Any dispute or difference arising out of this contract shall be within the jurisdiction of courts in Secunderabad only. 24. Payment will be made once in a month. 25. Acceptance of tender will be communicated by Electronic mode, Express Letter or formal acceptance of tender. In case where acceptance is indicated by Electronic mode, express letter, the formal acceptance of tender will be forwarded to the Contractor as soon as possible but the Electronic mode or Express letter should be deemed to effect the acceptance of the Contract. Execution of Agreement: The successful tenderer shall be required to execute an agreement for executing the works according to the conditions of tender/contract, accepted rates, specifications, schedule of prices and time schedules. The cost of the stamp duty on the agreement shall be borne by the successful tenderer. The terms and conditions of the agreement shall be in accordance with General Condition of contract of Rly and special Conditions of this tender document. If any discrepancies arises between these two, special condition of contract will prevail. 27. The powers conferred upon the President of India and all directions, discretions, and approvals to be given by him may, unless otherwise expressly provided by these conditions, be exercised and given by Medical Director, Central Hospital, Lallaguda, Secunderabad for the time being or any other officer deputed by the Medical Director. 28. The Tenderer, whose tender is accepted, is hereinafter called the CONTRACTOR. 29. Any notice to be served on the Contractor shall be deemed to be sufficiently served, if 29. Service of Notice on the Contractor: The contractor shall furnish to the Railways, the name, designation and addresses of his authorized agent at Secunderabad and all complaints, notices, communications and references shall be deemed to have been duly given to the contractor if delivered to the contractor or his authorized agent or left at or posted to the address so given and

34. During the course of the execution of works under the contract, contractor shall adhere to the extant procedures for operating the ambulances from and to the Railway Hospital premises. 35. The documents, drawings and information etc., which the CONTRACTOR would have come across in the normal course of the execution of this contract, will not be divulged to any other party without the written consent from the Railways. 36. No Battas or any other compensation will be paid by Railways for the drivers of the Contractor for performing work covered under this contract. 37. Railways shall not be responsible for providing accommodation to the Drivers. 38. The contract document shall be signed in by Railways and the CONTRACTOR. The documents comprising this agreement consisting of the agreement between the parties hereto, shall supersede and cancel all previous negotiations, writings, commitments or agreements as provided herein. This agreement may not be released discharged, abandoned, changed or modified in any manner orally or otherwise except by an instrument in writing, signed by duly authorized Officers of representatives of each of the parties hereto. 40. Income Tax: Income tax will be deducted at source by the Railway as per the extant rules. 41. The Tender shall support service directly and shall not do through franchisee or other third party. 42. The contractor shall be responsible to see that the work executed by him does not if any way infringe or damage the existing structures or other works in the area. The contractor is liable to take responsibility and rectify for the damage if any caused to the Railways property during the execution of their work. 43. Railways administration shall not be responsible for the accident caused by the driver of the 43. The tenderer shall be required to deposit appropriate EMD as prescribed in the Tender Notice to keep the offer open till the acceptance/rejection thereof is communicated by the Railway Administration or till 180 days from the date of receipt and opening of tenders, whichever is earlier. The tender without EMD will be rejected summarily. The earnest money deposit should be in cash or in any of the following forms. i. The earnest money deposit must be remitted either in cash for Rs. 55680/- (2% of approximate value of the contract) to the Sr. Divisional Cashier/South Central Railway, Secunderabad--500071 and cash receipt to be enclosed with the tender or may also be remitted in the Form of Demand Draft drawn in favour of FA&CAO / SC, South Central Railways, Secunderabad-500071. The deposit in any other form other than stipulated will not be accepted. ii. Deposit Receipts / or Demand Drafts. These forms of earnest money could be from any

v. The tenders will not be considered unless the EMD is deposited in accordance with the stipulation of this para No. 8 of the General Conditions of tender failing which the tender will summarily be rejected. vi. The EMD deposited by the successful tenderer will be adjusted against the security deposit payable by the successful tenderer. The EMD of the unsuccessful tenderer will be refunded as soon as the tender is finalized. 45. PERFORMANCE GUARANTEE: 45.1 The successful bidder should give a Performance Guarantee amounting to 5% of the work order value in any of the following forms:- order value in any of the following forms:- (i) A deposit of cash; (ii) Irrevocable Bank Guarantee; (iii) Government Securities including State Loan Bonds at 5% (per cent) below the market value; (iv) Deposit Receipts, Pay Orders,Demand Draft and Guarantee Bands. These forms of Performance Guarantee could be either of the State Bank of India or of any of the Nationalised Banks; (v) Guarantee Bonds executed or Deposit Receipts tendered by all Scheduled Banks; (vi) A Deposit in the Post Office Saving Bank; (vii) A Deposit in the National Savings Certificates; viii) Twelve Years National Defence Certificates; (ix) Ten Years Defence Deposits; (x) National Defence Bonds; and (xi) Unit Trust Certificates at 5% (per cent) below market value or at the face value (xi) Unit Trust Certificates at 5% (per cent) below market value or at the face value whichever is less. 45.2. The performance guarantee should be furnished by the contractor on obtaining written communication from Medical Director, Central Hospital, Lallagguda, Secunderabad and on issue of letter of acceptance. The performance guarantee should be valid up to expiry of the Rate Contract period. The successful bidder shall have to submit a performance Guarantee (PG) within 30 (thirty) days from the date of issue of Letter of Acceptance (LOA). Extension of time for submission of PG beyond 30 (thirty) days and upto 60 days from the date of issue of LOA may be given by the Authority who is competent to sign the contract agreement. However, a penal interest of 15% per annum shall be charged for the delay beyond 30 (thirty) days, i.e., from 31st day after the date of issue of LOA. In case the contractor fails to submit the requisite PG even after 60 days from the date of LOA, the contract shall be terminated duly forfeiting EMD and other dues, if any payable against that contract. The failed contractor shall be debarred from participating in re tender for that work. 45.3. Performance guarantee shall be released after satisfactory completion of the work. The procedure for releasing should be same as for security deposit. The contractor shall submit the

46. SECURITY DEPOSIT : 46.1. Security deposit for each work should be 5% of the value of the work order. This sum will be for the due and faithful fulfillment of the contract by the contractor. 46.2. CHAPTER-III SCHEDULE OF WORK

1. SCOPE OF WORK: The Ambulance should be available for round the clock, 365 days at Central Hospital including Sundays and Holidays. The Ambulance should have Current fitness certificate, Road Tax and Comprehensive insurance self-loading folding stretcher, Oxygen, IV Line holder, First Aid Kit/ Proper linen, Pillow and other basic requirement. CLAUSE OF PENALTY Since the service is required in an emergency situation, the denial of service of vehicle during the required time will be seriously viewed. No Advance Payment will be made; Payment will be made at the end of every month on submission of the bills duly certified by MCM & Medical officer in-charge with regard to the satisfactory execution of maintenance contract during the period for which the bill is claimed. The Log book will be maintained by authorities at Dispensary for each and every trip of operation of ambulances and the bills will be certified after the verification with log books, Log Sheets as well as registers. 2.2. The contractor should take all precautionary measures in order to ensure the protection of his own personnel moving about or working on the railway premises, and should conform to the rules and regulations of the Railway. 2.
