(b) Compliance with the g/hp-hr limits is considered compliance with the lb/hr and TPY limits as long aseach engine is operated at or below its site-rated capacity.

(c) The permittee shall operate and maintain each engine, air pollution control equipment, and monitoringequipment according to good air pollution control practices at all times, including startup, shutdown, andmalfunction.

(F4) FUEL BURNING EQUIPMENT [WAQSR Ch 3, Sec 3]NOx emissions from the dehydration reboilers (DIb, D2b, and D3b) shall not exceed 0.20 Ib/MMBtuofheatinput.

(F5) COMMENCEMENT OF CONSTRUCTION[WAQSR Ch 6, Sec 2 Permit MD-I070MJ (Modified March 17,2014)(a) Approval to construct compressor engines E6 and E8 shall become invalid if constructien is not

commenced on or before September 6, 2014 and an extension is not obtained; or if construction isdiscontinued for 24 months or more. The Administrator may extend the period based on satisfactoryjustification of the requested extension.

(b) The date of commencement of constructionshall be reported to the Division within thirty (30) days ofcommencement.

(F6) TEMPORARY ENGINE REPLACEMENT [WAQSR Ch 6, Sec 3(h)(i)(I)](a) Should an engine break down or require an overhaul during the tenm ofthispermit, the permittee may

bring on site and operate a temporary replacement engine until repairs are made. Permanent replacementof an engine must be evaluated by the Division under Ch 6, Sec 2 ofWAQSR to determine appropriatepenmitting action and evaluate the need for additional requirements resulting from the permanentreplacement.

(b) The temporary replacement unit shall be identical or similar to the unit replaced with emission levels ator below those of the unit replaced.

(c) The penmittee shall notify the Division in writing of such replacement within five working days;providethe date of startup of the replacement engine; and provide a statement regarding the applicability of anyNew Source Performance Standards (NSPS) in 40 CFR Part 60 and the applicability of any NationalEmission Standards for Hazardous Air Pollutants (NESHAPs) in 40 CFR Part 63.

Testing Requirements

(F7) INITIAL PERFORMANCE TESTING [WAQSR Ch 6, Sec 2 Permit MD-I 070M and W.S. 35-1 I-II 0](Modified April 23, 2013) (Modified March 17,2014)(a) In accordance with WAQSR Ch 6, Sec 2G), performance tests shall be conducted on compressor engines

E6 and E8 within 30 days ofachieving maximum design rate bnt not later than 90 days after initial start­up. Ifmaximumdesign production rate is not achieved within 90 days of'start-up, the Administratormayrequire testing be done at the rate achieved and again when maximum rate is achieved. Prior to anyperfonmance testing required by this condition, a test protocol shall be submitted to the Division forreview and approval. Notification of the date for the initial performance test shall be provided to theDivision at least 15 days prior to testing.(i) For NOx, CO, and VOC emissions, the testing shall follow 40 CFR 60 Subpart JJJJ §60.4244,

except that §60.8 only applies to engines subject to 40 CFR 60 Subpart JJJJ. For the initialperformance test, testing shall not consist of Method 19 or ASTM methods.

(ii) For the lean burn Caterpillar G3512LE engine (E6), fonmaldehyde emissions testing willconsistof three (3) l-hour tests following EPA reference methods or an equivalent Division approvedformaldehyde test method. Fonmaldehyde emissions in terms oflb/hr shall be calculatedusingthemethodology in Sections 10.1.1.1 and 10.1.1.2 of the State of Wyoming's Portable AnalyzerProtocol. The monitoring protocol is available from the Division upoo request or can bedownloaded at http://deq.state.wy.us/aqll/operat/ng.asp.

(iii) Engine horsepower, inlet temperature to the catalyst, pressure drop across the catalyst and otheroperating conditions shall be monitored during each test run and submitted with the testreport.

(b) Unless otherwise specified, testing shall be conducted in accordance with WAQSR Ch 5, Sec 2(h).

(F8) ADDITIONAL EMISSIONS TESTING[W.S. 35-11-110] (Modified April 23, 2013) (Modified March 17,2014)(a) The Division reserves the right to require additional testing as provided under condition GI of'this permit.

Should testing be required, test methods found at 40 CFR 60, Appendix A, shall be used as follows:(i) For visible emissions, Method 9 shall be used.(ii) For the engines (EI-El7), testing for NOx, CO, and VOC emissions shall be conducted as

specified in F7(a)(ii) of this permit,

CATALYST MONITORING [WAQSR Ch 6, Sec 2 Permit MD-! 0706AHModified March 17,2014)The pennittee shall follow the monitoring requirements as follows for the compressor engines equipped with anoxidation catalyst or NSCR catalyst.'<a) Install a thermocouple to measure the temperature at the inlet ofthe catalyst. The inlet temperature shall

be monitored and recorded at least monthly. If the temperature is outside the range listed below,corrective action shall be taken,

(b) Install a device to measure the pressure drop across the catalyst.

(i) The pressuredrop across the catalyst shall be monitoredand recorded at least monthly. If thepressurechangesby morethantwoinchesofwaterat 100% load, plus or minus 10%, from thereference pressuredrop,corrective action shall be taken.

(ii) Reference pressure drop for each engine shall be established during the initial performance test.When a catalyst isreplaced, thereference pressure dropshallbere-established forthatengine duringthefirsttest required incompliance withcondition FI0 which occurs afterthecatalyst replacement.

Recordkeeping Reguirements

(F12) TESTING AND MONITORING RECORDS[WAQSR Ch 6, Sec 3(h)(i)(C)(Il)and Ch 6, Sec 2 PermitMD-I0706AJ(a) For any testing or monitoring required under conditions F7, F8 and FlO, other than Method 9

observations, the permitteeshall record, as applicable, the following:(i) The date,place, and time of samplingor measurements;(ii) The daters)the analyseswereperformed(iii) The companyor entity that performedthe analyses;(iv) The analytical techniques or methodsused;(v) The results of such analyses;(vi) The operatingconditions andparameters as theyexistedat the timeof samplingormeasurement;

and(vii) Any corrective actions taken.

(b) For the initiaiperformance testing required undercondition F7 and the emissionsmonitoring requiredundercondition FlO, the enginehorsepower, inlettemperature to the catalyst, and pressure drop acrossthe catalyst,shallbe recorded duringeach test run.

(c) For themonitoringandmaintenance requiredunderconditionFii, thepermittee shallrecord thecatalystinlet temperature, pressure drop, any maintenance and/or corrective action triggered, and thereferencepressuredrop for eachengineat the timeof the monitoring. The permitteeshallalso recordthedatesofcatalystreplacement for each engine.

(d) For visibleemissions monitoring requiredunderconditionF9, recordkeeping shallverify thatnatural gasis the sole fuel source for these units.

(e) The permitteeshallretainon-siteat the facility the recordsof eachtest,measurement, orobservation andsupport information for a period of at least five years from the date of the test, measurement, orobservation.

Reporting Requirements

(FI3) NOTIFICATION OF START-UP, SHUTDOWN AND REMOVAL, AND TESTING[WAQSR Ch 6, Sec 2 Permit MD-l0706Aand 40 CFR 60 SubpartJJJJ] (Modified March 17,2014)(a) In accordance with WAQSR Ch 6, Sec 2(i), the permittee shall provide written notification of the

anticipated dateofinitial start-up ofenginesE6 and E8. Written notification ofthe actual dateof initialstart-up is required within 15 days after start-up. Such notification shall be submitted on a completeEngineInstallation/Removal form. Theformcanbe downloaded fromthe Air Quality Division websitehttp://deq.state.wy.us/aqdor obtained from the Air QualityDivision. Withthe start-up notification foreach enginethe permittee shall address the applicability of 40 CFR 60 SubpartJJJi.

(b) Prior to any monitoring required by condition FlO:(I) For enginessubject to the requirements of 40 CFR 60 SubpartJJJJ, the permittee shallprovide

test notification as specified in §60.8 of 40 CFR 60.(ii) For other engines and sources, notification of the test date shall be provided to the Division at

least 15 days prior to testing.(c) Uponshutdownandremoval of an engine fromthe facility, written notification isrequired within 15 days

ofremovai. Such notification shall be submitted on a complete Engine Installation/ Removal form.

(FI4) TEST REPORTS [WAQSRCh 6, Sec 3(h)(I)(C)(1II) and Ch 6, Sec 2 Permit MD-I0706AJ(a) The permittee shall report the results of the emissions tests required under condition F7, and any

additional testing required by the Division under condition F8, within 45 daysof completing the tests.

However, if testing for any engine shows operationout of compliance, the Divisionmust be notifiedwithin24 hours as indicatedunder condition FIO(c).

(CI) (a) The permittee shall submit by January 31 of each year a certification addressing compliance with therequirements ofthis permit. The certification shall be submitted as a stand-alone documentseparatefromany monitoring reports required under this permit.

(b) (i) For visible emissions the permittee shall assess compliance with condition F2 of this permit byverifying natural gas was the sole fuel source used for the units listed in condition 19.

under Chapter 5, Section 2 or Chapter 6, Section4 of the WAQSRand the changes do not exceed theemissionsallowedunder the permit (whetherexpressedthereinas a rate of emissionsor in termsoftotalemissions); and

(c) The permitteeprovides EPA andthe Divisionwithwrittennotificationat least 14days inadvanceoftheproposed change. The permittee, EPA, and the Division shall attach such notice to their copy of therelevant permit. For eachsuch change,the writtennotificationrequiredshall includea brief descriptionof the change within the permitted facility, the date on which the change will occur, any change inemissions,and any permit term or condition that is no longer applicable as a result of the change. Thepermit shield, if one exists for this permit, mall not apply to any such change made.

Transfer of Ownership or Operation: [WAQSRCh 6, Sec 3(d)(v)(A)(lV)]

Reopening for Cause: [WAQSRCh 6, Sec 3(d)(vii)] [W.S. 35-11-206(1)(ii) and (iv)]

(G7) The Division will reopen and revise this permit as necessary to remedy deficiencies in the followingcircumstances:(a) Additional applicable requirementsunder the CleanAir Act or the WAQSRthat become applicable to

this source ifthe remainingpermitterm is three or more years. Such reopeningshallbe completed notlater than 18 months after promulgationofthe applicablerequirement. No reopeningis required if theeffective date of the requirementis later than the date on which the permit is due to expire, unless theoriginal permit or any of its terms and conditions have been extended.

(b) Additional requirements (including excess emissions requirements) become applicabie to an affectedsource under the acid rain program. Upon approval by EPA, excess emissions offset plans shall bedeemed to be incorporated into the permit.

(c) The Divisionor EPA determinesthat the permit containsa materialmistakeorthat inaccurate statementswere made in establishingthe emissionsstandards 01' other terms or conditions of the permit.

(d) The Division or EPA determinesthat the permit must be revised or revoked to assure compliance withapplicablerequirements.

Annual Fee Payment: [WAQSR Ch 6, Sec 3(1)(i), (il), and (vi)] [W.S. 35-11-211]

(G8) The permitteeshall, as a conditionof continuedoperations,submitan annualfee to the Divisionas establishedin Chapter 6, Section 3 (1) of the WAQSR. The Division shall give written notice of the amountof fee to beassessedand the basis for such fee assessmentannually. The assessedfee is due on receipt ofthe noticeunlessthe fee assessmentis appealedpursuantto W.S. 35-11-211(d). Ifanypart of the fee assessmentisnotappealedit shall be paid to the Division on receipt of the written notice. Any remaining fee which may be due aftercompletion of the appeal is immediately due and payable upon issuance of the Council'sdecision. Failure topay fees owed the Division is a violationof Chapter 6, Section3 (1) and W.S. 35-11-203andmaybe causeforthe revocation of this permit.

(017) The permittee may seek to establish that noncompliance with a technoiogy-based emission limitation under thispermit was due to an emergency, as defined in Ch 6, Sec 3(1)(i)of the WAQSR. To do so, the permittee shalldemonstrate the affnm~tive defense of emergency through properly signed, contemporaneous operating logs, orother relevant evidence that:(a) an emergency occurred and that the permittee Can identity the causers) of the emergency;(b) the permitted facility was, at the tillle, being properly operated;(c) during the period of the emergency the permittee took all reasonable steps to minimize levels of

emissions that exceeded the emissions standards, or other requirements in this permit;

(018) No person shall cause or permit the installation or use of any device, contrivance, or operational schedulewhich, without resulting in reduction of the total amount of air contaminant released tothe atmosphere, shalldilute or conceal an emission from a source, This condition shall not apply to the control of odors,

Unavoidable Equipment Malfunction: [WAQSR Ch 1, Sec 5]

(G 19) (a) Any source believing that any emissions in excess ofestablished regulation limits or standards resultedfrom an unavoidable equipment malfunction, shall notify the Division within 24 hours of the incidentviatelephone, electronic mail, fax, or other similar method, A detailed description of the circumstances ofthe incident as described in paragraph 5(a)(I)(A) Chapter I, including a corrective program directed atpreventing future such incidents, must be submitted within 14 days of the onset of the incident, TheAdministrator may extend this 14-daytime period for cause.

(b) The burden of proof is on the owner or operator of the source to provide sufficient information todemonstrate that an unavoidable equipment malfunction occurred,

method, the use of which conceals an emission which would otherwise constitute a violation of anapplicable standard, Such concealment includes, but is not limited to, the use of gaseous dilutants toachieve compliance with a visible emissions standard, and the piecemeal carrying out ofan operation toavoid coverage by a standard that applies only to operations larger than a specified size,

(b) All owners and operators conducting an asbestos abatement project, including an abatement project on aresidential building, shall be responsible for complying withFederal requirements and State standardsforpackaging, transportation, and delivery to an approved waste disposai facility as provided in paragraph(m) ofCh 3, Sec 8,

(c) The permittee shali follow State and Federal standards for any demolition and renovation activitiesconducted at this facility, including:(I) A thorough inspection of the affected facility or part of the facility where the demolition or

renovation activity will occur shall be conducted to determine the presence of asbestos, includingCategory I and Category II non-friable asbestos containing material. The results of the inspectionwill determine which notification and asbestos abatement procedures are applicable to the activity,

(ii) The owner or operator shall follow the appropriate notification requirements ofCh 3, Sec 8(1)(li),(iii) The owner or operator shall follow the appropriate procedures for asbestos emissions control, as

specified in Chapter 3, Section 8(i)(lii),(d) No owner or operator of a facility may install or reinstall on a facility component any insuiatingmaterials

U) Anystandardor otherrequirement ofthe regulations promulgatedtoprotectstratosphericozoneundertitleVIof the Act, unless the EPAhas determined that such requirements need not be contai~e4 in a title V permit;

(k) Any nationalatnbientair qualitystandardor increment or visibilityrequirementunderpart C of title [of theAct, butonly as it wouldapply to tempcrary sourcespermitted pursuantto Section 204(e) of the Act; and

(I) Any state ambientair quality standardor increment or visibility.requirementof the WAQSR.

(m) Nothing under paragraphs (A) through(L) aboveshall be constflledasaffbctil1gthballowance programandPhase II complianceschedule under the acid rain provision of Title IV of the Act.

"BACT" or "Best available control technology" meansanemission limitation (including visibleemission standard)basedonthe maximum degreeof reduction of eachpollutantsubjectto regulation un4"r!heWAQSR orregulation underthe Federal CleanAir Act, whichwouldbe emittedfrom or whichresults for any proposedmajor emittingfacility ormajor modificationwhichthe Administrator, on a case-by-case basis, taking into accountenergy,environmental, andeconomic impacts and other costs, determines is achievable for such source or modificationthrough application orproductionprocessesandavailabie methods, systems, andtechniques, includingfuelcleaningor treatroent or innovativefuelcombustiontechniques for controlof suchpollutant. If theAdministrator determines thattechnological oreconomiclimitations on theapplication ofmeasurementmethodology to a particularclassof sourceswouldmaketheimposition ofan emissionstandardinfeasible, hemayinsteadprescribea design,equipment, workpracticeor operational standardorcombination thereofto satisfytherequirement ofBestAvailable ControlTechnology. Suchstandardshall, tothe degreepossible, set forth the emissionreduction achievable by implementation of such design,equipment, work practice, oroperationandshallprovidefor compliance bymeanswhichachieve equivalentresults -. Application of BACTshallnotresult in emissions in excess of those allowed under Chapter5, Section 2 of the WAQSR and any other new sourceperformance standard or national emission standards for hazardous air pollutants promulgatedby EPA but not yetadoptedby the state.

"Department" means the Wyoming Department of Environmental Quality or its Director,

"Director" means the Director of the Wyoming Department of Environmental Quality,

"Division" meansthe AirQuality Divisionof the WyomingDepartmentof EnvironmentalQualityor its Administrator,

"Emergency" means any situationarising from sudden and reasonablyunforeseeableevents beyond the control of thesource, includingacts of God, whichsituation requires immediatecorrectiveactionto restore normaloperation, andthatcauses the source to exceed a technology-based emission limitation under the permit, due to unavoidable increases Inemissions attributable to the emergency, An emergency shall not include noncompliance to the extent caused byimproperly designed equipment, lack of preventative maintenance, careless or improperoperation, or operatorerror,

"EPA" means the Administratorof the U,S, Environmental Protection Agency or the Adninistrator'sdesignee,

"Fuel-burning equipment" meansany furnace,boiler apparatus,stack,or appurtenancestheretoused inthe process ofburning fuel or other combustiblematerial for the purpose of producing heat or power by indirect heat transfer,

"Fugitive emissions" means those emissionswhich could not reasonablypass througha stack chimney,vent, or otherfunctionally equivalent opening,

"Insignificant activities" meansthose activitieswhichare incidentalto thefacility'sprimary business activity andwhichresult in emissions of less than one ton per year of a regulated pollutant not included in the Section 112 (b) list ofhazardous air pollutants or emissions less than J000 pounds per year of a pollutant regulated pursuantto listing underSection I 12(b) of the Act provided,however, such emissionlevelsof hazardousair pollutants do notexceedexemptionsbased on insignificantemissionlevelsestablishedby EPAthrough rulemakingfor modificationunder Section 112 (g)ofthe Act.

"MACT" or "Maximum achievable control technology" means the maximumdegreeof reduction inemissions that isdeemed achievablefor newsources in a categoryor subcategorythat shallnotbe less stringentthan the emission controlthat is achieved inpractice bythe best controlledsimilarsource, as determinedbythe AdminIstrator, Emission standardspromulgated for existingsourcesIna categoryor subcategorymaybe less stringenttbanstandardsfor newsources inthesame category or subcategory but shall not beless stringeut, and may be more stringent than:

(a) the average emission limitationachieved by the best performing 12percent ofthc existingsources (forwhichthe Administrator has emission information), excluding those sources that have, within 18 monthsbcfore theemissionstandard is proposedor within30monthsbefore such standard ispromulgated, whichever islater, firstachieved a level of emission rate or emission reduction which complies, orwould comply if the source is notsubject to such standard, with the lowest achievable emission rate applicable to the source category andprevailingat the time, in the categoryor subcategoryfor categoriesand subcategorieswith 30 or moresources,or

(b) the average emissionlimitationachievedby the bestperforming fivesources(forwhichtheAdministrator hasorcould reasonablyobtain emissionsinformation)in the categoryor subcategoryfor categoriesor subcategorieswith fewer than 30 sources,

"Modification" means any physical change in, or change in the method of operation of, an affected facility whichincreases the amount of anyair pollutant(to whichanystate standardsapplies)emitted bysuchfacility orwhich results illthe emission of any such air pollutant not previously emitted,

"Permittee" means the person or entity to whom a Chapter 6, Section 3 permit is issued,

"Potential to emit" means the maximumcapacity of a stationarysource to emit any air pollutantunder its physical andoperational design, Any physicalor operational limitationon the capacityofa sourceto emitan air pollutant,includingair pollution control equipmentand restrictionson hours of operation 01' on the type or amountof material combusted,stored or processed, shall be treated as part of its design if the limitationis enforceableby EPA and the Division, Thisterm does not alter or affect the use of this term for any other purposes under the Act, or the term "capacity factor" asused in title IV of the Act or the regulations promulgatedthereunder,

"Regulated air pollutant" means the following:

(a) Nitrogen oxides (NOx) or any volatile organic compound;

(b) Any pollutant for which a national ambient air quality standard has been promulgated;

Any pollutant that is subject to any standard established in Chapter 5, Section 2 of the WAQSR or Section IIIof the Act;

Any Class I or II su?stance subject to a stand~rd promulg,~ted under or established by title VI of the Act; or

Any pollutant subject to a standard promulgated under Section 112 Of other requirementsestablished underSection 112 ofth:~ct, including~:ctionsI 12(g),U), and (1') of the Act, including, the following:

(i) A~y P?llut ll11tstibjectto requirements under Sectiollll2U) of the Act. IfEPAfails to promulgate asta~clard b~ the date ~siablish"dpilrsua~ttoSection 112(e) ofthe Act, anypoll~tantforwhicha subjectsource would ~e 111~j?r shall beconsidered to be regulated on the date 18months after the applicable dateestablished pursuant to Section 112(e) ofthe Act; and

(ii) Any pollutant for which the requirements of Section I 12(1',)(2) ofthe Act have been met, but only withrespect to the in~i~i~ual so~rce subject toSe~tionl )2(1',)(2)requireme~t.

"Renewal" means the process by which a permit is reissued at the endofits term.

"Responsible official" means one of the following:

(a) For it corporation:

"WAQSR" means the Wyoming Air Quality Standards and Regulations promulgated under the Wyoming EnvironmentalQuality Act, W.S. §J5-11-IOl, et seq.
