ARTICLE IFerry

§ A350-1. Resolve Granting a ferry from the landing in East Haddam to Haddam.

Passed May, 1811. (Special Law)

Resolved by this Assembly, that license and authority by, and the same is hereby granted toGeorge Lord of East Haddam, and Eber Rutly of Haddam, their heirs, executors, and assigns,to have, use and keep a ferry across Connecticut River from East Haddam Landing toHaddam, at the place where the same has been usually kept by said Lord and Rutly; andlicense and authority is hereby granted to said Lord and Rutly, their heirs, executors andassigns, to take and receive all the emoluments, profits and fares which may arise from thetransportation of passengers and other things across said river by said ferry to the sole use andbenefit of them, the said Lord and Rutly, their heirs, executors and assigns, during thepleasure of this Assembly, and subject to such alterations as this Assembly may in futureadopt.

And the said Lord and Rutly, their heirs, executors and assigns shall at all times during thecontinuance of this grant, keep a sufficient and suitable boat or boats in good repair for thepurpose of transporting passengers, horses, carriages and everything proper and necessary tobe transported in ferry boats across said river, and shall procure and keeping constantreadiness, a sufficient number of men as circumstances may require to manage said boat orboats in transporting passengers, and whatever else may be necessary to be transported asaforesaid.

And the fare of said ferry shall be and remain the same as is now established by law.

ARTICLE IIAnnexations

§ A350-2. Resolve annexing a part of the Town of Chatham (East Hampton) to EastHaddam.

Resolved by this Assembly, that that part of the Town of Chatham aforesaid, which adjoinsthe said Town of East Haddam, and is bounded northerly and westerly by Salmon River, socalled; and easterly by Westchester society, which said society is partly in the Town ofChatham aforesaid, and partly in Colchester in New London County, be, and the same ishereby annexed to the said Town of East Haddam. (Passed May 1830 by Special Law)

§ A350-3. Annexing Nathan Stark, in Lyme, to second school district, Millington Society,East Haddam.

On the petition of Nathan Stark, of Lyme, in the county of New London, praying to be set offto, and annexed to the second school district in Millington school society, in the Town of EastHaddam, and the county of Middlesex:

Resolved by this Assembly, that the lands of Nathan Stark, of Lyme, in the county of NewLondon, which are located in said Lyme, continuous to and adjoining the Town of EastHaddam, in quantity about one hundred and fifty acres, with the buildings thereon standing,be and they are hereby annexed to and made a part of the second school district, in the societyof Millington, and Town of East Haddam; and that said Stark and those that shall succeed himin the occupancy of said land and buildings, shall be members of said second school district,in Millington school society, in said Town of East Haddam, and entitled to all the rights andprivileges and subject to all the regulations and liabilities of members of said second schooldistrict, in Millington school society, in said East Haddam, and are released and dischargedhenceforth from all liabilities and obligations to the second school district of the secondschool society of Lyme. (Passed 1842 by Special Law).

§ A350-4. Annexing a part of Lyme to East Haddam.

Passed 1843 (Special Law)

Resolved by this Assembly, that all the inhabitants, and that part of the Town of Lyme in theCounty of New London, contained within the following limits, viz: beginning at a point ormonument near the dwelling of house of John Lee, there forming a boundary between thetowns of East Haddam, in the County of Middlesex, and Lyme aforesaid, and running southseventy-three and three-fourths degrees, east ten chains and forty-four links; thence southeighty-five and a half degrees, east ten chains and forty-five links; thence north sixty-nine anda half degrees, east fifteen chains and twelve links, to a monument forming a boundarybetween said towns of East Haddam and Lyme; that is to say, all that part of said Town ofLyme lying within and between said described lines and the southerly line of the Town ofEast Haddam, aforesaid, as hitherto existing, be and the same are the same, with all the rights,duties, privileges and immunities appertaining to said Town of East Haddam.

ARTICLE IIICove Burying Ground Transfer of Title

§ A350-5. Empowering the Town of East Haddam to transfer title of the Cove BuryingGround.

(Substitute for House Joint Resolution No. 264 Special Law 232)

Resolved by this Assembly: that the Town of East Haddam, at any legal meeting hereaftercalled for that purpose, may by a majority vote transfer and convey to The Cove BuryingGround Association, a Corporation located in said Town, all its right, title and interest in andto the ancient public burying ground known as the Cove Burying Ground, situated nearSalmon River Cove in said Town of East Haddam; and thereafter said Association shall, uponaccepting such conveyance, have power to prefer complaints under section 4053 and 4115 of

the general statutes for the purpose of quieting and settling the title to said burying groundand for the purpose of enlarging the same as occasion may require. But in the event of thedissolution of said Association or the failure of the Association and its successors in title forthe space, of three years to properly care for and maintain said burying ground, all its rights,title and interest derived from said Town shall revert thereto. (approved May 11, 1903)

Voted, that the report of the Burying Ground Committee on the Cove Burying Ground beaccepted, and the Selectmen instructed to sign a resolution of the General Assembly approvedMay 11, 1903, special laws of Connecticut of 1903, page 173 the Town transfer and conveyall its right, title and interest in and to the Cove Burying Ground to the Cove Burying GroundAssociation, a corporation located in East Haddam and that the Selectmen are herebyauthorized and directed to execute a proper conveyance of the same. (Town meeting October3, 1904)

ARTICLE IVBridges

§ A350-6. Bridge Commission.

(House Bill, Substitute for House Joint Resolution No. 93, Special Law 440)

AN ACT RAISING A COMMISSION FOR THE PURPOSE OF THE CONSTRUCTION OFA BRIDGE OVER THE CONNECTICUT RIVER BETWEEN THE TOWNS OF EASTHADDAM AND HADDAM.

Be it enacted by the Senate and the House of Representatives in General Assembly convened:

Sec. 1. The Governor is hereby authorized to appoint a commission consisting of threepersons, with full power to contract for and in the name of the State, and to construct andwholly complete, in accordance with plans and specifications to be secured by it, at a cost notexceeding two hundred and twenty-five thousand dollars, ($225,000) a bridge, with piers anda suitable draw for the passage of vessels of all kinds, over the Connecticut River between thetowns of East Haddam and Haddam, at or about the location of Goodspeed's Landing,together with suitable approaches to said bridge.

Sec. 2. Said Commission is hereby authorized to purchase such land as it may considernecessary for the construction of such bridge and the approaches thereto; and, in case it isunable to agree with the owners thereof, it is authorized, through the Attorney-General, tocondemn the same in the name and on behalf of the State; and in the event that the AttorneyGeneral shall find it necessary to institute proceedings to condemn such lands, including thefee, he shall proceed in the manner provided in sections 4103 and 4104 of the general statutes.

Sec. 3. Said bridge, when completed, shall be maintained and operated by the State as a tollbridge, and said commission shall have charge of such maintenance and operation includingthe power to fix the rates of toll or charges to be made for travel over such bridge, for theperiod of twenty years from and after the time that this Act shall go into effect.

Sec. 4. Said commission is hereby authorized to construct, on said bridge, a track andnecessary equipment for street railway purposes, and wires and other equipment fortransmitting electricity, and to lease the use of said track and equipment to any street trailway

company or companies desiring to operate cars over said bridge, and to lease the use of saidwires and other equipment to any company or companies desiring to use the same, upon thepayment of an adequate annual compensation for such use.

Sec. 5. Should any vacancy occur in said commission for any cause, the Governor is herebyauthorized to fill such vacancy, and he shall also have power to remove any commission forcause.

Sec. 6. The commissioners shall receive payment for their necessary personal expense inperforming the duties hereinbefore specified.

Sec. 7. All moneys expended under the authority of this Act shall be paid on vouchers drawnby the commissioners and approved by the comptroller.

Sec. 8. Said commission is hereby authorized to draw upon the treasurer for the purposesherein specified to an amount not to exceed two hundred and twenty-five thousand dollars,and said sum is hereby appropriated for the purpose of this Act, and the treasurer is herebyauthorized to issue for the purpose of providing such funds, bonds of this State, not to exceedtwo hundred and twenty-five thousand dollars, upon the same terms and conditions as thoseprescribed in the Act approved April 14, 1909, or any amendments made thereto at thepresent session of the General Assembly, so far as the same may be applicable. (approvedAugust 24, 1911).

§ A350-7. Location study for a New Connecticut River Bridge.

(Substitute Senate Bill No. 1042 (125))

Sec. 1. The commissioner of Transportation shall make a location study for a new ConnecticutRiver bridge to replace the bridge presently located across the Connecticut River between thetowns of Haddam and East Haddam and shall submit a report of his recommendations to the1973 session of the general assembly on or before January 10, 1973 (approved July 2, 1971)

Sec. 2. The sum of twenty thousand dollars is appropriated from the highway fund to carryout the purpose of this act. (Vetoed July 2, 1971).

ARTICLE VAssessments

§ A350-8. An act concerning taxation in the Town of East Haddam.

(House Bill No. 904, Special Act 95)

Be it enacted by the Senate and House of Representatives in General Assembly convened:

As long as the state tax commissioner shall approve, individual assessment list of the Town ofEast Haddam need not contain a complete description of real property subject to taxationwithin said Town, provided such lists shall contain references to maps and other data on filein either the office of the assessors or in the office of the Town Clerk of said Town,containing such a complete description. (Approved April 14, 1937)

§ A350-9. An act providing for an assessor in the Town of East Haddam and abolishingthe Board of Assessors.

(Senate Bill No. 413, special Act 102)

Sec. 1. The Board of Assessors of the Town of East Haddam is abolished.

Sec. 2. There shall be a single assessor in said Town who shall be appointed as hereinafterprescribed and shall have all the powers, duties and rights conferred or imposed upon saidBoard of Assessors, except as hereinafter provided.

Sec. 3. Appeals may be taken from assessments made by said assessor in the same manner asfrom assessments made by the former Board of Assessors.

Sec. 4. Said assessor shall be appointed by a majority vote of the Board of Finance of saidTown within thirty days after the adoption of this act as hereinafter prescribed, and shall holdoffice until the first Monday of October, 1948. Within a period of thirty days preceding thefirst Monday of October, 1948, and biennally thereafter, said Board of Finance, by a majorityvote, shall appoint a successor to the assessor whose term expires on such first Monday ofOctober. Any vacancy shall be filled in the same manner by a majority vote of the Board ofFinance of said Town within thirty days after the occurrence of such vacancy, and the personappointed to fill such vacancy shall hold office for the unexpired portion of the term of hispredecessor. In the event of the temporary incapacity or inability of said assessor, the Boardof Finance, by a majority vote, may designate any person employed in the office of saidassessor, and if there be no such employee, any other person, to act in his place during theperiod of his incapacity or inability to act, but for a single period of not more than threemonths. The person so designated during the period of appointment shall have and perform allthe powers, duties and rights of said assessor.

Sec. 5. Any incumbent of said office may be removed by a majority vote of the Board ofFinance of said Town after a hearing upon written charges of dishonesty or incompetencepreferred by a member of the Board of Selectmen or Board of Finance.

Sec. 6. Said assessor shall have power to appoint and to remove at pleasure such number ofassistants, clerical, engineering, appraisal or otherwise, as may be authorized by the Board ofFinance and for which appropriations have been made. The assessor shall make such rules andregulations for the conduct of his office as may be approved by the Board of Finance. Allrecords and maps of said assessor shall be open to public inspection at reasonable times.

Sec. 7. The salary of said assessor and such assistants as he may be authorized to engage shallbe fixed by a majority vote of the Board of Finance of said Town in the same manner as allother requests for appropriations and shall be included in the Town budget and acted upon ata Town meeting in the same manner as all other appropriations recommended by the Board ofFinance.

Sec. 8. Any provision of the General Statutes or the Special Acts inconsistent with theprovisions of this Act shall have no force and effect so far as it relates to the assessment ofproperty for taxation in the Town of East Haddam.

Sec. 9. This Act shall take effect upon its approval by a majority vote of the electors of theTown of East Haddam voting at a Town meeting to be held on the eighth Monday after theapproval of this act by the governor. The selectmen of said Town shall warn a Town meetingto be held on said day for the purpose of voting upon the approval of this act, it shallthereupon take effect and a certificate of approval signed by the Town Clerk, shall be filed inthe office of the Secretary of the State. (Approved, May 21, 1947)

Voted, that the Town of East Haddam be permitted to conform with the progressive actiontaken by other cities and towns by obtaining a single Assessor to replace the present system ofAssessors as provided by Senate Bill No. 413, State of Connecticut. (Town Meeting, May 12,1947).

§ A350-10. An act concerning the filing of assessment lists in the Town of East Haddam.

Sec. 1. All persons required to file lists of property subject to taxation with the assessors ofthe Town of East Haddam shall file such lists not later than November first in each year, or ifNovember first shall be a Sunday or a legal holiday, then not later than the next business dayfollowing. Such lists shall not include real estate or motor vehicles.

Sec. 2. The assessors of said Town shall provide a form approved by the state taxcommissioner to be used by property owners in said Town for listing property as required bysection 1 of this act. (Approved June 2, 1955).

§ A350-11. Open space reimbursement.

A SPECIAL ACT SIGNED INTO LAW MAY 28, 1980.

An Act enabling East Haddam to reimburse or adjust for property taxes related to pen spaceland on the 1978 Assessment List in excess of the amount correctly determined for such land.Special Act No. 80-63.

Be it enacted by the Senate and House of Representatives in General Assembly convened:The Town of East Haddam, having used a certain assessment procedure in preparing the 1978assessment list related to assessment of parcels of land classified as open space land, whichprocedure was found to result in inequities and in respect to which certain owners, havingpaid taxes levied on such parcels as assessed in said 1978 assessment list, were reimbursed bysaid Town to the extent that taxes paid in excess of the amount which would have beenpayable but for said assessment procedure, in which total acreage in each such parcel althoughqualified for classification as open space land was not so assessed in its entirety, or in respectto any such owners who had not paid such taxes and for whom the amounts of such taxes duewere adjusted accordingly, which reimbursement or adjustment has been implemented inaccordance with a stipulated judgment agreed to by said Town and said owners who wereparties to the action in response to which said stipulated judgment was entered, is herebyauthorized, notwithstanding he requirements in section 2-1 of the general statutes, to makesuch reimbursement or adjustment for any owner of a parcel of land qualified forclassification as open space land who was not a party to said stipulated judgment and whichland was assessed and any such reimbursement for taxes paid or adjustment for taxes due asauthorized by this act is hereby validate.

ARTICLE VIElections

§ A350-12. An act providing for biennial elections in the Town of East Haddam

(Substitute for House Bill No. 753, Special Act 418)

Be it enacted by the Senate and House of Representatives in General Assembly convened:

Sec. 1. The terms of office of all Town officers of the Town of East Haddam shall expire onthe first Monday of October, 1939, except the term of office of the Town Clerk which shallexpire on the first Monday in January, 1940.

Sec. 2. At the annual Town election of the Town of East Haddam to be held on the firstMonday of October, 1939, and biennially thereafter, there shall be elected three selectmen, aTown treasurer, an agent of the Town deposit fund, two auditors, six grand jurors, a taxcollector, seven constables and two registrars of voters, each of whom shall hold office fortwo years from the date of his election. There shall be elected at said election and bienniallythereafter, a Town Clerk, who shall hold office from the first Monday in January nextsucceeding his election.

Sec. 3. At said Town election there shall be elected three assessors, one of whom shall holdoffice for two years, one for four years and one for six years from the date of his election. Atthe biennial Town election to be held on the first Monday in October, 1941, and bienniallythereafter, the Town shall elect one assessor for the term of six years.

Sec. 4. At said Town election there shall be elected three members of the board of relief,1 oneof whom shall hold office for two years, one for four years and one for six years from thedate of his election. At the biennial Town election to be held on the first Monday of October,1941, and biennially thereafter, the Town shall elect one member of the board of relief2 for aterm of six years.

Sec. 5. At said Town election there shall be elected six members of the board of finance, threeof whom shall hold office for two years and three for four years from the date of theirelection. At a biennial Town election to be held on the first Monday in October, 1941, andbiennially thereafter, the Town shall elect three members of the Board of Finance for a termof four years.

Sec. 6. At said Town election there shall be elected nine members of the board of education,three of whom shall hold office for two years, three for four years and three for six years fromthe date of their election. At the biennial election to be held on the first Monday in October,1941, and biennially thereafter, the Town shall elect three members of the board of educationfor a term of six years.

Sec. 7. At said Town election there shall be elected eighteen library directors, six of whomshall hold office for two years, six for four years and six for six years from the date of theirelection. At the biennial Town election to be held on the first Monday in October 1941, andbiennially thereafter, the Town shall elect six library directors for a term of six years.

Sec. 8. All officers to be elected under the provision of this act shall hold office until theirsuccessors shall be elected and shall have qualified.

Sec. 9. This act shall take effect upon its approval by the electors of the Town of EastHaddam at a special Town meeting warned and held for such purpose on or before August 15,1939. (approved June 9, 1939)

To vote on the referendum, in connection with Biennial Elections as provided in Special Act.No 418.

Voted, that the Town adopt Biennial Elections.

§ A350-13. An act concerning property of the East Haddam Free Public Library andReading Room Association.

House Bill NO. 2141(51)

Section 2 of the number 199 of the special acts of 1889 is repealed and the following issubstituted in lieu thereof: Said corporation shall be located in said East Haddam and shall becapable in law to accept, receive, purchase and hold any and all gifts, transfers and bequestsof money or any other kind of property, real or personal, for said purposes. (Approved April22, 1959)

Sec. 1. The Southern Connecticut Gas Company is authorized to supply gas, and to do allthings necessary and incidental thereto, to and in the towns of Lyme, Old Lyme, East Lyme,Haddam and East Haddam and to the inhabitants thereof for all public and domestic purposesof light, heat and power, in the same manner in which and with the same powers as TheSouthern Connecticut Gas Company is authorized on the effective date of this act to supplygas under its charter, provided the public streets, ways and grounds of any such Town shallnot be injured thereby but shall be left in as good condition as before, and that The Southern

Connecticut Gas Company shall make al its locations and constructions in such streets, waysand grounds, and shall repair all damage and injury to the same caused thereby or by the usethereof to the satisfaction of the authority in such Town charged with the maintenance of suchstreets, ways and grounds.

Sec. 2. This amendment to the charter of the Southern Connecticut Gas Company shall notrequire acceptance by the corporation. (Approved May 22, 1969)

§ A350-15. Opera House Dock

Substitute House Bill No. 80-64, Special Act 73-675

Sec. 40. Section 13a-253 of the 1971 noncumulative supplement to the general statutes isrepealed and the following is substituted in lieu thereof;

(a) the commissioner may repair, maintain and operate . . . and the dock on the east bank ofthe Connecticut River, known as the "Opera House Dock", in the Town of East Haddam,as public conveniences and may expend funds from the "highway" TRANSPORTATIONfund for this purpose. The commissioner may make regulations, consistent with thewelfare, safety and convenience of the public, for the use of said docks and mayestablish and from time to time revise, rates for dockage fees, and may collect such feesand deposit the same in the (highway) TRANSPORTATION fund.

(b) Any person who violates any regulations established as provided in this section shall befined not more than fifty dollars (Public Acts, 1973 Session).
