    (iii) Public Realm

    David Wilson (Public Realm Inspector) attended the meeting to report on current issuesand to answer questions from Councillors and members of the public in relation to publicrealm issues within the area represented by the Cheadle Area Committee.

    The following comments were made/issues raised:-

    In the absence of litter bins at the car park at Heald Green Village Hall, rubbish wasbeing dumped and this needed to be monitored until the new bins were installed.

    The grass verge on Queens Drive, Cheadle Hulme needed maintaining.

    A Member enquired who had responsibility for clearing playing fields of rubbish leftby spectators after fooball matches.

    The unsafe fencing on Daisy Bank Lane, Heald Green in the vicinity of a nearbystream needed to be investigated.

    Graffiti on footpaths in Heald Green and Gatley which had been put there by a

    company should be removed. The pedestrian refuge at the junction of Turves Road and Wilmslow Road needed

    maintaining.

    Work was scheduled to cut back the trees and bushes obstructing the pavement ona section of St. Anns Road, Heald Green,

    RESOLVED That David Wilson be thanked for his attendance.

    Executive Business

    6. HIGHWAY MAINTENANCE AND LOCAL INITIATIVES SCHEME - RESURFACING

    OF CARRIAGEWAY ON DRAYTON DRIVE, HEALD GREEN

    A representative of the Democratic Services Manager submitted a report of the CorporateDirector for Place Management and Regeneration (copies of which had been circulated)regarding a proposal to resurface part of the carriageway on Drayton Avenue, HealdGreen.

    RESOLVED That approval be given to resurfacing the carriageway on Drayton Drive,Heald Green, from Mendip Close to New Hall Avenue, at an approximate cost of 16,500to be funded from the Area Committees Delegated Budget (Heald Green Ward allocation).

    7. HIGHWAY MAINTENANCE AND LOCAL INITIATIVES SCHEME - RESURFACINGOF FOOTWAY ON FINNEY LANE, HEALD GREEN (FROM THE BARGAIN BOOZESHOP TO THE CHRIST CHURCH CATHOLIC CHURCH)

    A representative of the Democratic Services Manager submitted a report of the Corporate

    Director for Place Management and Regeneration (copies of which had been circulated)regarding the proposed resurfacing of part of the footway on Finney Lane, Heald Green,from the Bargain Booze shop to the Christ Church Catholic Church.

    RESOLVED That approval be given to the resurfacing of the footway from the BargainBooze shop to the Christ Church Catholic Church on Finney Lane, Heald Green at anapproximate cost of 8,500 to be funded from the Area Committees Delegated Budget(Heald Green Ward allocation).

    8. HIGHWAY MAINTENANCE AND LOCAL INITIATIVES SCHEME - RESURFACINGOF FOOTWAY ON FINNEY LANE, HEALD GREEN (NORTH SIDE FROM PROPERTY

    NUMBERS 186-192)

    A representative of the Corporate Director for Place Management and Regenerationsubmitted a report (copies of which had been circulated) regarding the proposedresurfacing of part of the footway on Finney Lane, Heald Green, from property numbers186 192.

    RESOLVED That approval be given to the resurfacing of the footway on the north side ofFinney Lane from property numbers 186-192 at an approximate cost of 5,000 to befunded from the Area Committees Delegated Budget (Heald Green Ward allocation).

    9. COMMUNITY ENGAGEMENT (CONTINUED)

    (i) Petitions

    A representative of the Democratic Services Manager reported on the receipt of an e-petition signed by ten signatories requesting the Council to permanently resurface OakRoad, Cheadle and the side roads leading off it.

    RESOLVED That the e-petition be referred to the Corporate Director for PlaceManagement and Regeneration for investigation.

    (ii) Open Forum

    In accordance with the Code of Practice no organisation had indicated that they wished toaddress the Area Committee as part of the Open Forum arrangements.

    Non-Executive Business

    10. DEVELOPMENT APPLICATIONS

    Development applications were submitted.

    The Chair outlined the procedure approved by the Council for public speaking on planningapplications.

    (i) DC055946 - 161 Stanley Road, Heald Green

    In respect of plan no. 55946 for a single storey extension to the rear and two storeyextension to the side; internal alterations at 161 Stanley Road, Heald Green

    a representative of the applicant spoke in support of the application.

    RESOLVED That the Planning and Highways Regulation Committee be recommendedto grant planning permission, subject to the conditions contained in the report and theremoval of relevant permitted development rights relating to extensions to the property.

    (ii) DC056122 - The Malt Shovels, Councillor Lane, Cheadle Hulme

    In respect of plan no. 56122 for the demolition of a vacant and derelict former public houseto provide a new-build convenience store (net trading area approximately 280 square

    metres) including ATM and associated car parking at The Malt Shovels, Councillor Lane,Cheadle Hulme

    a representative of the applicant spoke in support of the application.

    RESOLVED That planning permission be granted, subject to the planning conditionscontained in the report except the condition relating to hours for deliveries being amendedto 7.00am 9.00pm Mondays to Saturdays and no deliveries being permitted on Sundays,and the payment of a commuted sum of 1,000 to provide waiting restrictions across the

    site frontage.

    11. APPEAL DECISIONS CURRENT PLANNING APPEALS AND ENFORCEMENTS

    A representative of the Corporate Director for Place Management and Regenerationsubmitted a report of the Deputy Chief Executive (copies of which had been circulated)listing any outstanding or recently determined planning appeals and enforcements within

    the area represented by the Cheadle Area Committee.

    RESOLVED That the report be noted.

    12. POST DEVELOPMENT WORKS - RESIDENTIAL DEVELOPMENT AT THEDEMMINGS (NOW NAMED WENTWORTH GARDENS), CHEADLE

    A representative of the Corporate Director for Place Management and Regenerationsubmitted a report (copies of which had been circulated) providing an update on the issuesregarding the residential development at The Demmings (now named WentworthGardens), Cheadle.

    The report set out the current situation with regard to:-

    Planning conditions that were required to be adhered to;

    The restoration of the adjacent bridleway to its previous condition;

    Re-instatement of the grass verge on Oakmere Drive;

    Repairs on Old Wool Lane to ensure that the road was brought up to an acceptableand sustainable standard; and

    A review of trees and landscaping.

    Applications seeking to discharge relevant planning conditions had been submitted to theCouncil prior to the commencement of the development. It was confirmed that all pre-commencement conditions had been agreed by the Council.

    RESOLVED That the report be noted.

    13. DEDICATION OF BRIDLEWAY ON A SECTION OF FOOTPATH 40 CHEADLE ANDGATLEY, OVER LAND OWNED BY THE COUNCIL, ON SCHOLES PLAYING FIELD,GATLEY

    A representative of the Democratic Services Manager submitted a joint report of the

    Corporate Director for Place Management and Regeneration and Deputy Chief Executive(copies of which had been circulated) regarding a proposal to dedicate a bridleway on asection of Footpath 40, Cheadle and Gatley over land owned by the Council.

    The funding for the access improvement project in Gatley was from Transport for GreaterManchester as part of the Cycle City Ambitions Grant. The access improvement projectwould guarantee the implementation of a 20mph zone between Beech Avenue to GatleyStation. A significant obstacle in linking the use by horse riders and cyclists betweenFoxland Road and Hawthorn Road would be removed through the dedication to abridleway, and there would be additional benefits to pupils attending Kingsway School bybicycle and as an additional cycle route to Gatley Station.

    RESOLVED That approval be given to dedicate a bridleway over the route betweenpoints A-B on the plan attached as Appendix 1 to the report and as detailed in paragraph3.1 of the report.

    14. CYCLE LINKS TO GATLEY RAILWAY STATION

    A representative of the Corporate Director for Place Management and Regenerationsubmitted a report (copies of which had been circulated) seeking the Area Committeescomments regarding the proposed cycle links to Gatley Railway Station following thesuccessful bid for funding from the Department for Transport via the Cycle City AmbitionGrant to provide cycle safety improvements on/off the highway within the Borough.

    It was also proposed to introduce a 20mph speed limit within the residential areas on bothsides of Gatley Road.

    RESOLVED That the Executive Councillor (Communities and Sustainability) be

    recommended to approve the proposals shown on drawing 0251/005 REV B, the cycle linkbetween Springfield Road and Beech Avenue through William Scholes Playing Fields (seedrawing 0251/008), the cycle links between the proposed toucan crossing and BrentwoodDrive (subject to consultation with affected residents and Ward Councillors) and theproposed Traffic Regulation Orders detailed in paragraphs 4.2 4.5 inclusive of the report.

    15. COUNCILLOR LANE - ROAD SAFETY IMPROVEMENTS

    A representative of the Corporate Director for Place Management and Regenerationsubmitted a report (copies of which had been circulated) setting out proposals to improvethe levels of safety and reduce the potential risk for road traffic incidents in the vicinity ofthe puffin crossing on Councillor Lane.

    The main aim of the scheme was to improve visibility of the puffin crossing for bothpedestrians and road users, together with improving pedestrian crossing facilities acrossthe service road. The proposals also included formalising the parking arrangementsincluding alterations to the waiting restrictions on the south side of the service road nearthe junction with Councillor Lane.

    RESOLVED That the Executive Councillor (Communities and Sustainability) berecommended to approve the proposals set out in the report and the proposed No Waiting

    At Any Time/No Loading 8.00am 6.00pm Traffic Regulation Order detailed in paragraph6.2 of the report.

    16. EAST AVENUE, HEALD GREEN - TRAFFIC REGULATION ORDER

    A representative of the Corporate Director for Place Management and Regenerationsubmitted a report (copies of which had been circulated) in connection with the findings ofa consultation exercise following concerns expressed regarding parked vehicles causingsafety issues on roads in the vicinity of Etchells Primary School, Heald Green.

    RESOLVED That approval be given to the following Traffic Regulation Order at anapproximate cost of 800 to be funded from the Area Committees Delegated Budget(Cheadle and Gatley Ward allocation):-

    RESOLVED That approval be given to the installation of an A-Frame on MotcombeRoad, Heald Green at an approximate cost of 850 to be funded from the AreaCommittees Delegated Budget (Heald Green Ward allocation).

    19. APPLICATION TO HOLD A MAKERS MARKET ON HALL STREET GREEN,CHEADLE - 4 OCTOBER AND 1 NOVEMBER 2014

    We depend very much on our mini bus for transporting our volunteers, staff & foodand equipment. Our minibus needs some extensive mechanical work to make itroad worthy and without this work taking place we could not function and so manypeople rely very heavily on our emergency services.

    1. The Objects of the Partnership are to:1.1. Provide a forum for communication between bodies interested in and making decisions

    relating to Cheadle Village and to promote the reputation of the Partnership amongst those

    bodies in order that the Partnership is informed.1.2. To provide a platform for a unified multi-interest response to issues of all types which arise

    in relation to Cheadle Village both in the local and broader geographical context.

    1.3. To provide a platform for any opportunities for funding applications for the benefit ofCheadle Village.

    As a not for profit umbrella group, one of the projects we are supporting and co-ordinatingis the Cheadle Victorian Christmas Market Day which takes place on the 6th December2014 (10am to 8pm).This application is from Village Partnership in line with objectives 1.2& 1.3 stated above, on behalf of the Cheadle Christmas Planning Group, which along withthe umbrella group of the Village Partnership also comprises the Cheadle Business and

    Traders Association, Cheadle Civic Society and Cheadle Parish Church. This applicationis for for the provision and promotion of events on the day of the Market to encouragecommunity cohesion and promotion of Cheadle as a vibrant district centre with a widerange of retail outlets, other businesses and recreational spaces to which end we have thehave the support of the Councils Employment and Economic Development Team.To be as fully inclusive as possible this event is free, with easy access for those with adisability and activities for all ages.The event, with a Victorian theme, will run in conjunction with the monthly CommunityMakers Market which will be hosted on the refurbished Cheadle Green site and, assumingpermission for road closure is granted, to extend the event throughout the village anadditional range of stalls will be situated on Old Rectory Gardens. In addition there will be

    a funfair and community stalls in the White Hart Car park, and a craft fair at Trinity Church.In addition St Marys and the village partnership will coordinate activities in both thechurchyard and inside the church and along Cheadle High street. Activities include aCharity Market in the churchyard supporting both local and international charities withconnections to Cheadle residents, inside a programme of live music, entertainment,children's crafts, history tours and bell ringing culminating in a Victorian Family Christmasand a Silver Band concert featuring Stockport Silver Band, whilst along the High Streetthere will be street entertainers, Victorian characters, musical performers and a Nativity-style treasure hunt. In addition to this there will also be stalls with a charity slant within theSt Marys churchyard. All local businesses have been encouraged to make the most of theopportunity and participate by dressing their windows and displaying a Victorian style

    lantern - with some featuring a Nativity sheep character for the treasure hunt, considermarketing measures to attract business not only on the day but to encourage people backinto the village on future occasions, as well as 'going Victorian' for the day. Thisapplication supports the need for further promotional activities including the High Streetentertainers who will signpost when and where activities are taking place, the provision ofa programme of events and the furnishing of a Victorian themed environment to enhancethe ambience and enjoyment of the day by the local community. To ease congestion inthe village Park and Ride facilities have been provided by two community groups(Kingsway School and The Together Trust) and a local bus company (Bullocks) all ofwhich needs signage and stewards. We would expect to approach Solutions SK regardinghelp with road closure & Park & Ride signs etc.

    Cheadle Victorian Christmas Market Day6thDecember 2014 10am-8pm

    Background

    Cheadle Victorian Christmas Market Day is a joint initiative of Cheadle Village Partnership,

    Cheadle Business and Traders Association, Cheadle Civic Society and Cheadle Parish Church

    in association with the Makers Market and Niche Event Hire. The event is open to the

    general public and is free at the point of access with no restrictions on age, sex or disability.

    Last years inaugural event was very successful with a busy, well attended and thoroughly

    enjoyable day.

    What a fabulous day on Saturday for the Victorian market. Though just out of hospital Icouldnt miss it and have to thank every body concerned who made it a complete success.

    We called in the village Green then through the village to the Church, finishing with theWhite Hart for the grandchildren to enjoy the rides etc there. We really enjoyed it all and,having lived in Cheadle for nearly forty years, I have never seen anything like this in the

    village; it was truly wonderful and everyone was buzzing and really enjoying it all. I

    hope this is a start of bigger and better things to come. Thank you to everyone who

    worked hard on the day to make it such a success - also the church looked beautiful andreally informative about the history of the church. Many thanks to you all.

    In keeping with the intentions of last year the purpose of the event is to enhance community

    cohesion through a full programme of all-age community events and activities creating a

    vibrant Victorian-style Market atmosphere throughout the village focussed round six

    locations:

    Cheadle Green Makers Market (showcasing the very finest local food, drink, art and

    craft and artisan stalls), Christmas tree Switch on, live music, carolling and a dance

    display.

    St Marys Churchyard and building Charity style Market in churchyard including hot

    food, live music, old fashioned games, craft stalls with both a local and worldwide

    charity appeal. This is combined with activities throughout day inside church including

    an interactive Church History tour, puppets, live music, dance and, at 5pm, a Victorian

    Family Christmas presentation followed by a Brass Band Concert at 6:30pm

    The White Hart Car Park funfair rides and games for children & a few Market style

    stalls mainly local groups eg Civic Society.

    Old Rectory Gardens (Service Road) Market Stalls provided by Makers Market

    themed so as to not clash with local businesses

    Trinity Church Traditional Annual Craft fair inside (10am-2pm), Marquee outside,

    childrens activities and music along with the successful Toy collection for disadvantaged

    families.

    The Gallery Upper Room (above Tescos) Display of entries to Art Competition run in

    conjunction with the Market Day in a Victorian themed Parlour atmosphere with

    childrens activities and live music.

    This event plays a significant part in promoting Cheadle Village as both a vibrant and varied

    shopping centre and as a place that has a distinct identity and strong community spirit. The

    Victorian Market Day is intended to contribute to this via:

    Increased footfall through the village through a well planned programme of promotion

    for the event

    Promoting access and involvement for all-ages through a range of activities

    Increasing awareness of both local residents and visitors to the wide range of local

    amenities and resources available in Cheadle

    Increasing

    awareness of local businesses, many of whom are participating in the eventvia advertising in the programme, themed shop window displays and staff dressed in

    Victorian attire.

    All local businesses have been encouraged to participate by dressing their windows,

    displaying a Victorian style lantern and themed bunting - with some featuring delightful

    bespoke Victorian style Nativity figures whilst others will feature a sheep named by the shop

    and be part of a childrens treasure hunt. A programme of events will be produced and

    distributed to approximately nine thousand homes as well as being available in all

    participating shops & businesses.

    The overall timing of the event is 10am-8pm although the final two hours are focusedaround the Church where there will be two free family events to round off the day, with the

    Victorian Family Christmas at 5pm and the Brass Band Concert at 6:30pm.

    The organizing group are aware that parking was difficult last year and have arranged with

    grounds to create additional parking facilities. This is also being supported by local coach

    firm Bullocks who are providing a free shuttle service between the two parking areas and

    the Village centre.

    Application for Cheadle Green states numbers above 250 this is in recognition of the

    numbers expected throughout the day rather than at any one time in any one location.

    Recognising the potential for a large crowd spread throughout the day stewards in High Vis

    Jackets will be in place at all times at all 6 key locations as well as on the High Street and atthe Park and Ride centers to help manage crowds and ensure safety and order is

    DESCRIPTION OF DEVELOPMENTRetrospective application to retain the change of use of land from open countryside/woodlandto use as a dog day care centre. The application relates to a 0.1 hectare split level site which isn part at a higher roadside level and in part at a lower land level at the bottom of a steepembankment adjacent with the railway track. Alongside the change of use the applicationncludes operational development. Operational development consists of a timber fence andgate at the site entrance and portacabin all situated on the higher roadside level. A long runstaircase leading down the embankment side gives access to a large shed structure used forhousing dogs, small decking area and steps at the lower ground level (railway line level).Beyond the large shed the site extends in a easterly direction to provide a dog run/exercisearea. This wider area is enclosed by 2m high "herras" type fencing. The outdoor run area is inpart surfaced in chippings. The site is accessed via a vehicular access point off ManchesterRoad. Car parking and vehicle turning has been provided to either side of this access howeverthese facilities are currently located outside the application site boundary.

    The operation is run as a business by "Muttley Crew Dogs Ltd" and is essentially a dog day

    care centre for people who require their dog looking after during the working day. Hours ofoperation are specified as Monday to Wednesday 8am until 6pm, Thursday 8am until 9pm,Friday 8am until 6pm, Saturday closed, Sunday 11am to 4pm. The business employs 3 fulltime and 2 part time members of staff.

    SITE AND SURROUNDINGSThe application relates to a former area of open countryside land and woodland situated to theeast of Manchester Road between the M60 and railway within a wider area of open countrysideand between Cheadle and East Didsbury forming part of the wider Mersey Valley. Theapplication site has two land distinct land levels with and upper section level with ManchesterRoad and a lower level adjacent to the railway track divided by a steep embankment. The land

    s currently in use as a dog day care centre as described above on a unauthorised basis.

    To the north beyond the railway track lies further open countryside land occupied by CheadleWood Farm. To the east further open land continues towards the sewage works. Abney Hallies in extensive open grounds to the south beyond the M60. Other open land lies on theopposite side of Manchester Road to the west. A Garden Centre and public house lie on theopposite side of Manchester Road.

    CONSULTEE RESPONSES

    Planning Policy:

    DC/056489: 90 MANCHESTER ROAD, STOCKPORT, SK8 2NZ: Retention of use ofwoodland / agricultural land for dog care day facility including siting of portacabin andtimber barn, creation of timber steps and erection of temporary fencing.

    The site falls within Green Belt and River Mersey Landscape Character area. It is 0.1ha in sizeand the applicants state it is owned by Stockport Council.

    UDP Review (2006) Policy GBA1.2 (Control of Development in the Green Belt) states there is a

    presumption against the construction of new buildings unless it is for, inter alia

    (ii) essential facilities for outdoor sport and outdoor recreation, for cemeteries, and for otheruses of land which preserve the openness of the Green Belt and which do not conflict with thepurposes of including land in it;

    The GBA1.2 policy wording is retained in paragraph 89 of the NPPF (bullet point 2) apart fromthe word essential facilities being replaced by appropriate facilities

    This however is a dog care business where the buildings are not specifically appropriate tooutdoor recreation but are used for and form an integral part of the business for the exercise ofdogs during the day and which do not in themselves require a Green Belt location.

    Thus the proposal constitutes inappropriate development within the Green Belt and as statedunder paragraph 87 of the NPPF

    .inappropriate development is, by definition, harmful to the Green Belt and should not beapproved except in very special circumstances.

    Paragraph 88 of the NPPF goes on to state:

    Very special circumstances will not exist unless the potential harm to the Green Belt by reasonof inappropriateness, and any other harm, is clearly outweighed by other considerations.

    The applicants contend (paragraph 9.6 of their submission) that the harm to the Green Belt isvery limited and the benefits to the business amount to very special circumstances whichoutweigh any harm.

    Very Special Circumstances

    The applicants refer to case law R. (on the application of Basildon DC) v First Secretary ofState 2004 EWHC 2759 Admin and 2005 JPL 942 Basildon which confirmed that a number of

    ordinary factors , may , when combined together result in something very special Theapplicants very special circumstances are gathered together under the numbering below.

    1. The key very special circumstance put forward is by the applicant is paragraph 81 of theNPPF covering Green Belt which states local planning

    authorities should plan positively to.. provide opportunities for (outdoor sport and)

    recreation.

    However for the reason stated above it is not considered the dog care buildings are specificallyappropriate to outdoor recreation and thus this does not form a very special circumstance.

    n addition, Paragraph 81 of the NPFF also requires local authorities to retain and enhanceandscapes, visual amenity and biodiversity. As stated, the site falls within River MerseyLandscape Character area where under UDP Review (2006) Policy LCR1.1 (LandscapeCharacter Areas)

    development in the Countryside will be strictly controlled and will not be permitted unless it

    protects or enhances the quality and character of the rural area.

    t is considered the introduction of new development here (two new buildings, informal carparking at the entrance to the site-not covered under the application- and fencing off of the siteusing Herras fencing) is not consistent with requirements for Landscape Character Areas underthis Policy; in particular that development should:

    (ii) be accommodated without adverse effect on the landscape quality of the particular characterarea.

    (iii) protect or improve existing recreational land, so as to maintain or enhance thepredominantly informal recreational role of the countryside around Stockport;

    (iv) not impede, and where possible, improve public access for all to the countryside;

    The site has been fenced off from the Strategic Recreation Route running alongManchester Road and protected under UDP (2006) Review Policy L1.8.

    (v) protect or enhance the natural environment

    Policy CS8 of the Core Strategy also requires that the landscape and character of theboroughs Countryside will be preserved and enhanced.

    2. The applicants state that it is a successful business which requires an area of outdoorspace to allow the dogs to exercise. The site is accessible and safe

    for the dogs and is unsuitable for grazing land and is unusable for agriculture or otheruses appropriate in the Green Belt due to its topography and woodland.

    These issues in themselves do not provide very special circumstances for the developmentproposed to be located in the Green Belt.

    3. The applicants also contend the business provides and important local service toresidents of Stockport and nearby areas that provides

    employment and education and training in dog handling and that there is no suitableland that meets those requirements that is not designated Green Belt or is public openland. The sites considered were Houldsworth Mill and industrial premises at Higher Bury

    Street which were rejected as they had no secure outdoor area and because ofacoustics and builders merchants (site unidentified) which was contaminated.

    t is not considered however that these normal business considerations or the limited trawl ofsites provide sufficient very special circumstances to justify development of this site in theGreen Belt.

    4. The temporary nature of these structures

    The applicants state the buildings are described as not fixed to the land and thus notpermanent structures and once no longer needed, can be easily moved, yet they are still

    considered by the applicants to be essential to the use of the site as a dog care day facility.

    However the structures still constitute development which is by definition inappropriate in theGreen Belt and would set a precedent if approved. Moreover the applicants infer in paragraph9.24 of their statement that future expansion of the site is being considered.

    Conclusion

    To conclude the harm to the Green Belt in this location from the development, which also formspart of the River Mersey Landscape Character area, is not considered to be outweighed by thevery special circumstances put forward and thus should not be approved.

    Highways Engineer:

    have no concern from a highway perspective about the principle of this use in this location.The scale of development is not such that it generates significant levels of traffic and I amsatisfied that the existing site access is appropriate and suitable for the proposed use.However, I note from the submitted drawings that no provision is made for car parking,manoeuvring and servicing space within the application site. This gives rise to risk of vehiclesstopping on the highway with potential harm to highway operation and safety. Whilst Iacknowledge this issue could be addressed by inclusion of additional land within the application

    site, the application must be assessed as submitted and as such I can only recommend refusal.

    ANALYSISThe application requires assessment in respect of the following areas for consideration:

    1. Landuse/Principle of Development

    The application site is located within the Green Belt, as defined on the UDP Proposals Map.

    Saved UDP policy GBA1.2 states that within the Green Belt, there is a presumption against theconstruction of new buildings unless it is for the following purposes :

    (i) Agriculture and forestry (unless permitted development rights have been withdrawn);

    (ii) Essential facilities for outdoor sport and outdoor recreation, for cemeteries, and for otheruses of lands which preserve the openness of the Green Belt and which do not conflict with thepurposes of including land in it;(iii) Limited extension, alteration or replacement of existing dwellings (in accordance with policyGBA1.5); or

    (iv) Limited infilling or redevelopment of Major Existing Developed Sites identified on theProposals Map, in accordance with Policy GBA1.7.

    The explanatory text to saved UDP policy GBA1.2 indicates that forms of development whichmay be permitted by this policy are appropriate in the Green Belt; all other forms ofdevelopment are inappropriate development which is, by definition, harmful to the Green Belt.

    Advice within the National Planning Policy Framework is also highly relevant. Paragraph 79 ofthe NPPF states that the Government attaches great importance to Green Belts. Thefundamental aim of Green Belt policy is to prevent urban sprawl by keeping land permanentlyopen; the essential characteristics of Green Belts are their openness and their permanence.

    Paragraph 80 of the NPPF states that the Green Belt serves five purposes :

    To check the unrestricted sprawl of large built-up areas;

    To prevent neighbouring towns merging into one another;

    To assist in safeguarding the countryside from encroachment;

    To preserve the setting and special character of historic towns; and

    to assist in urban regeneration by encouraging the recycling of derelict and other urbanland.

    Paragraph 87 of the NPPF states that as with previous Green Belt policy, inappropriatedevelopment is, by definition, harmful to the Green Belt and should not be approved except invery special circumstances. Paragraph 88 of the NPPF states that when considering anyplanning application, Local Planning Authorities should ensure that substantial weight is givento any harm to the Green Belt. 'Very special circumstances' will not exist unless the potentialharm to the Green Belt by reason of inappropriateness, and any other harm, is clearlyoutweighed by other considerations'.

    Paragraph 89 of the NPPF states that a Local Planning Authority should regard the constructionof new buildings as inappropriate in Green Belt. Exceptions to this include :-

    Buildings for agriculture and forestry; Provision of appropriate facilities for outdoor sport, outdoor recreation and for cemeteries,

    as long as it preserves the openness of the Green Belt and does not conflict with thepurposes of including land within it;

    The extension or alteration of a building, provided that the new building is in the same useand not materially larger than the one it replaces;

    Limited infilling in villages and limited affordable housing for local community needs underpolicies set out in the local plan; or

    Limited infilling of the partial or complete redevelopment of previously developed sites(brownfield land), whether redundant or in continuing use (excluding temporary buildings),which would not have a greater impact on the openness of the Green Belt and the purposeof including land within it than the existing development.

    Paragraph 90 of the NPPF states that certain other forms of development are also notnappropriate in Green Belt provided that they preserve the openness of the Green Belt and donot conflict with the purposes of including land in Green Belt. These are :

    Mineral extraction; Engineering operations;

    Local transport infrastructure which can demonstrate a requirement for a Green Beltlocation;

    The re-use of buildings provided that the buildings are of permanent and substantialconstruction; and

    Development brought forward under a Community Right to Build Order.

    n response to the above national and local planning policy framework the application claimsthat the existing use and buildings is not inappropriate development on the basis that theexercising of dogs is an outdoor recreational use (an appropriate use in the Green Belt) andthat the structures and facilities that have been added to the site are essential facilities for thecontinued enjoyment of this outdoor recreational use (which is one of the approved categoriesof development in the Green Belt as outlined above).

    The applicants submission is however not considered to be the correct interpretation of GreenBelt policy and therefore cannot be supported. The Council Planning Policy Officer commentsare enclosed above which confirm this. In summary the primary use of the proposal is acommercial business for the day care of dogs whilst the animals owners are at work. In thatsense the use is similar to a children's day nursery. In respect of the proposed use the dogsneed to be secure, have shelter and room to exercise (just like a children's nursery needs the

    appropriate facilities) however this use does not require a Green Belt location and contrary tothe applicants claim the development is not considered to be an outdoor sport or recreationaluse. The dogs may need exercise facilities whilst they are on site but this is only because theyare there to be cared for in the first instance as a result of a business activity. The proposaltherefore does not justify the need for either a Green Belt location or the structures proposed tosupport it. Indeed it should be noted that Council has granted planning permission for similarfacilities recently on industrial sites in the borough. In addition the development is notconsidered to fall into any of the other categories of appropriate development or use set outabove.

    n terms of impact on openness the proposal adds a commercial business to the site which was

    previously unused open and wooded countryside. The location of the site is important in GreenBelt terms as it forms part of the wider band of Green Belt land with the Mersey Valley thatprovides a visual and physical break between Stockport and Manchester (Cheadle and EastDidsbury) and therefore these two densely populated areas merging together. This is one ofthe principle aims of Green Belt Policy as set out within paragraph 80 of the NPPF. The useencroaches into this open countryside location with a large fenced off and partly hard surfacedarea, two significant sized buildings, fencing, a car park area (that currently is not included inthe application) and significant run of metal and timber steps. The use introduces vehiclemovements to and from the site on a commercial scale and the associated visual impact , noiseand disturbance of vehicles that the site would otherwise not generate. The visual impact ofthe proposal is therefore significant and has a negative impact on the previous open character

    of the site and openness of the Green Belt. On this basis the development is clearly harmful tothe Green Belt and represents inappropriate development.

    Despite the applicants initial claim regarding the proposals Green Belt Status the applicant hasalso submitted very special circumstances to outweigh the harm to the Green Belt by thedevelopment. The application claims weight should be given, in their view, to the unsuitabilityof the land for any other use, to the proposed buildings which are non permanent in nature and

    the benefits the proposal offers in terms of employment and education (both now and in thefuture). As outlined by the policy officer above none of the submitted special circumstancesare considered to carry weight individually or cumulatively to out weigh the harm of thedevelopment to this Green Belt location.

    n view of the above, the proposal is considered to represent inappropriate development withinthe Green Belt, contrary to saved UDP policy GBA1.2 and the NPPF.

    2. Landscape Character AreaThe site is also allocated as lying within a Landscape Character Area. Saved UDP policyLCR1.1 and LCR1.1a specify that development in the countryside, urban fringes and river

    valleys will be strictly controlled and will not be permitted unless it protects or enhances thequality and character of the rural areas. In principle development that does not meet thesebasic criteria and make a positive contribution to the surrounding landscape should not besupported. As outlined above the proposal is considered to represent a significant visualntrusion into this countryside setting. The proposal introduces a commercial business activityto the setting, does not improve access for the general public and has a overall negative impacton the landscape quality of the designation. On this basis the proposed development is notconsidered to comply with the above policies.

    3. HighwaysThe application identifies a single access point off Manchester Road which leads to theentrance gate of the development. The submitted plans show the access within the red edgesite boundary. Site inspection reveals that car parking/vehicle manoeuvring provision has alsobeen provided either side of the access but the plans do not include for this . The highwaysengineer has been consulted on the application and whilst no objections are raised to thenature of the use in highways terms the submitted plans currently do not reflect the situation onsite and therefore do not provide adequate car parking or manoeuvring facilities. The facilitiesprovided are therefore outside the application site and not controllable under this application.On this basis the highways engineer cannot support the submission in its current format.

    SUMMARY

    n summary the application is not considered to be acceptable in respect of Green Belt Policyts impact on the Landscape Character Area and in highways terms and is accordinglyrecommended for refusal.
