STATE OF NORTH DAKOTA PUBLIC SERVICE COMMISSION Dakota Access, LLC Dakota Access Pipeline Pump Station – Emmons Cnty Siting Application Case No. PU-19-204 NOTICE OF HEARING August 21, 2019 A Public Hearing on the ap- plication in Case No. PU-19-204 is scheduled to begin November 13, 2019 at 9:00 a.m. CST, at the Emmons County Courthouse Auditorium, 100 4th Street NW, Linton, ND 58552. On June 20, 2019, Dakota Access, LLC filed a combined application to amend Certificate of Corridor Compatibility 179 and to amend Route Permit 191 for the addition of a pump station to its existing Dakota Access Pipeline. The pump station will be located in the South 1/2 Southeast 1/4 of Section 5, Township 132 North, Range 77 West, in Emmons County, North Dakota. The pump station will consist of five 6,000 horsepower electrically driven motors and pumps, which will allow for pipeline transportation of up to 1,100,000 total barrels of crude oil per day. Also on June 20, 2019, Dakota Access, LLC filed an applica- tion to waive the requirements to hold a separate hearing for the waiver application, to waive any hearing requirements and instead proceed by virtue of a notice and opportunity for hearing procedure. The issues to be considered in the application for waiver of procedures and time schedules include: 1. Are the proposed facilities of such length, design, location, or purpose that they will produce minimal adverse effects and that adherence to applicable proce- dures and time schedules may be waived? 2. Is it appropriate for the Com- mission to waive any procedures and time schedules as requested in the application? The issues to be considered in the applications for an amended certificate of corridor compatibility and an amended route permit are: 1. Will the location and op- eration of the proposed facilities produce minimal adverse effects on the environment and upon the welfare of the citizens of North Dakota? 2. Are the proposed facilities compatible with the environmen- tal preservation and the efficient use of resources? 3. Will the proposed facility lo- cations minimize adverse human and environmental impact while ensuring continuing system reli- ability and integrity and ensuring that energy needs are met and fulfilled in an orderly and timely fashion? Roll was called. Paulette Foss (P), Alfred Schumacher (P), Bob Schumacher (P) and Devin Deile (P). The minutes from the last meeting were read. Deile made a motion to approve the minutes from the last meeting, seconded by B. Schumacher. All (Aye). Motion carried. The financial reports were presented by the auditor. A. Schumacher made a motion to approve the financial reports and payment of the following claims, seconded by Deile and carried unanimously to approve. L. Boschee $1,448.42; J. Scherr $369.40; IRS $426.38; MDU $1,018.97; MCB $4.39; Trash $2,000.00; Zeeland Oil LLC $289.01; Emmons County Record $125.50; ND Health Dept. $16.00; WEB $1,213.08; Wishek Electric $346.95. All (Aye). Motion carried. Old Business: Mayor Lacher and A. Schumacher went to look at the payloaders. They are military payloaders and look to be in good shape. Price is a bit high. We will need to consider something as the city payloader has numerous issues. Council will keep checking for now. City received the Water Tower Inspection report which the coun- cil reviewed. New Business: Mayor Lacher told the council that the city hall needs fuel. He will order 100 gallons. Council also discussed tables at the city hall and future events. Auditor will look at prices. Café has requested if the café is not sold as a business they would like their water rates dropped from commercial to resi- dential rates. Council discussed and then tabled the matter. Water project is not complete. Other Business: Post Office air conditioner needs a cover. Mayor Lacher has been trying to take care of the Post Office issues . The regular city council meet-ing was called to order at 7:00 p.m. at the Zeeland Public School by Mayor Lacher. Roll was called. Paulette Foss (P), Alfred Schumacher (P), Bob Schumacher (P) and Devin Deile (P).

The minutes from the last meeting were read. Deile made a motion to approve the minutes from the last meeting, seconded by B. Schumacher. All (Aye). Motion carried.

The financial reports were presented by the auditor. A. Schumacher made a motion to approve the financial reports and payment of the following claims, seconded by Deile and carried unanimously to approve.

L. Boschee $1,448.42; J. Scherr $369.40; IRS $426.38; MDU $1,018.97; MCB $4.39; Trash $2,000.00; Zeeland Oil LLC $289.01; Emmons County Record $125.50; ND Health Dept. $16.00; WEB $1,213.08; Wishek Electric $346.95. All (Aye). Motion carried.

Old Business: Mayor Lacher and A. Schumacher went to look at the payloaders. They are military payloaders and look to be in good shape. Price is a bit high. We will need to consider something as the city payloader has numerous issues. Council will keep checking for now.

City received the Water Tower Inspection report which the coun-

cil reviewed.New Business: Mayor Lacher

told the council that the city hall needs fuel. He will order 100 gallons.

Council also discussed tables at the city hall and future events. Auditor will look at prices.

Café has requested if the café is not sold as a business they would like their water rates dropped from commercial to resi-dential rates. Council discussed and then tabled the matter.

Water project is not complete. Other Business: Post Office air

conditioner needs a cover. Mayor Lacher has been trying to take care of the Post Office issues .

Next council meeting will be November 12, 2019, at 7:00 p.m. at the Zeeland Public School.

No further business. Deile made a motion to adjourn, sec-onded by A. Schumacher and carried unanimously to approve.
