UNDERTAKING OF THE TENDERER

I/We have read carefully and examined the notice inviting tender, schedule, General Rules

and terms and conditions of the contract, special conditions, Schedule of Rates and other

documents and Rules referred to in the tender document for the work.

I/We hereby tender my rates for the execution of the work for R.O. Bilaspur CREDA as

specified within the time stipulated in the schedule in accordance with all aspects with the

specifications, designs, drawings and instructions with such conditions so far as applicable.

I/We agree to keep the tender open for Ninety (90) days from the due date of submission

thereof and not to make any modifications in its terms and conditions.

A sum of Rs. 20000/- is hereby forwarded as earnest money in the form of crossed demand

draft. If I/We, fail to commence or complete the work ordered in specified time I/We agree that

the CREDA, R.O. Bilaspur shall, without prejudice to any other right or remedy, be at liberty to

forfeit the said Earnest Money absolutely. The said Earnest Money shall be retained by CREDA,

R.O. Bilaspur towards security deposit to execute all the works referred to in the tender documents

upon the terms and conditions contained or referred to therein and to carry out such deviations as

may be required by CREDA, R.O. Bilaspur

I/We hereby declare that I/We shall treat the tender documents, drawings and other records

connected with the work as secret/confidential and shall not communicate information derived

there-from to any person other than a person to whom I/We have authorized to communicate the

same or use the information in any manner prejudicial to the safety of CREDA/the State Govt.

GST, duties, levies and other Govt. dues etc. to the appropriate Govt.

ELIGIBILITY CRITERIA

Intended bidder must be CREDA Registered Supplier.

Intended bidder must not be black listed

Documentary evidence for meeting the eligibility criteria must mandatorily be

submitted along with offer.

Intended bidder should have GSTIN and PAN.

Intended bidder must be experience for CREDA Work.

PART -A

SCOPE OF WORK

The scope of work is to supply cables of various specifications, supply of

Electrical & Electronics items, Luminaries, Fixtures, electrical and

electronic hardware & accessories and all other related items of

specified specifications, as per requirement of CREDA to District Places

Korba which shall be consumed in the Power Distribution Network of

Solar Photovoltaic Power Plants in the State of Chhattisgarh.

All material is to be delivered either in district head quarter or site as per

the instruction of CREDA.

Material supplied should be as per ISI mark and if the item does not

come in the category specified in the ISI then also the quality of those

items shall be of best available in the category, with due approval of

CREDA, R.O. Bilaspur All the material shall match with the requirement of

the purpose of installation at site.

All the material shall be warranty for two years from the date of supply

for any manufacturing defect. Luminaries shall bear warrantee for Two

year from the date of installation.

PART -B

General Terms and Conditions

1. Item rate/tenders are invited on behalf of the Executive Engineer, CREDA for

Supply of Cables, wires, electric and electronic items required for AC/DC for

SPV Power Plant at the District offices of CREDA R.O. Bilaspur.

1.1 The total work is estimated to cost Rs. 297271 lac to be carried out under

district Office Korba of CREDA, However the total estimated cost shown in

the NIT is worked out on the basis of presumptive division of the work among

the district offices. This estimate, however, is given merely indicative and

cannot be taken as final and binding.

1.2 The tender papers shall be issued only to such tenderers who fulfill the

following criteria on production of documentary proof from Govt.

deptt/reputed firms.

(i) Reregistered Suppliers of PDN Material of SPV in CREDA.

Earnest money should be deposited in the form of demand draft/Pay order (Cash

shall not be accepted) in favor of Executive Engineer RO Bilaspur, CREDA,

payable at Bilaspur or valid competency certificate issued by competent authority

should be submitted. Only those tenderers shall be exempted from depositing EMD

in whose name the certificate has been issued by competent authority. The tenders

without Earnest Money in the prescribed manner shall be summarily rejected.

2. The Qualified tenderers who has quoted lowest rates as per the clause of the tender

& who accept the rates approved by CREDA shall be required to enter into an

Agreement with CREDA, R.O. Bilaspur on a non-judicial stamp paper of Rs. 100/-

in the prescribed format appended hereto. Tenderer shall quote his rates as per

various terms and conditions of the tender documents, which will form part of the

agreement.

3. The time allowed for carrying out the supply will be one month from the day of the

date of written orders to commence the supply.

The Technical and Price bids shall be submitted in separate sealed covers mentioning

clearly on the envelop whether it contains EMD and other Technical information,

catalogues, all supporting Income /Commercial GST clearance certificates and other

relevant supporting documents. Fill Tender form as per following instruction.

Envelope “A” In this envelope keep bank draft of EMD and documents for eligibility &

tender document fee in DD format.

Envelope “B” In this envelope keep complete Tender document & rate list duly signed by

Tenderer & sealed it properly.

Envelope “C” In this envelope keep “A” & “B” and sealed it properly.

The envelope containing EMD and Technical details will be opened on . 12.06.18 at

3.30 p.m in the office of Executive Engineer, CREDA, Bilaspur by a committee

constituted by CREDA, in the presence of intending tenderers. Price bids of the

tenderers qualifying on the basis of "Envelop A" will be opened later on, in the

presence of tenderers.

2 Tender, which should be placed in sealed envelopes, with the name of work and due

date written on the envelopes, should be dropped in the tender box at the office of

Executive Engineer, CREDA, R.O. Bilaspur up to 3.00 PM. dt 12.06.18 and will be

opened by a committee on 12.06.18 at 3.30 P.M.

3 Tenderers should inspect and examine the site and its surroundings and satisfy

themselves before submitting their tenders as to the nature of the ground and sub-soil

(so far as is practicable), the form and nature of the site, the means of access to the site,

the accommodation they may require and in general shall themselves obtain all

necessary information as to risks, contingencies and other circumstances which may

influence or affect their tender. A tenderer shall be deemed to have full knowledge of

the site whether he inspects it or not and no extra charges consequent upon any

misunderstanding or otherwise shall be allowed. The tenderer shall be responsible for

arranging and maintaining all materials at his own cost, tools & plants, water electricity

access, facilities for workers and all other services required for executing the work

unless otherwise specifically provided for in the contract documents. Submission of a

tender by a tenderer implies that he has read all the terms and conditions of the

tender and all other contract documents and has made himself aware of the scope

and specifications of the work to be done and of conditions and rates at which

stores, tools and plant, etc.(including the GST, duties, levies and other obligations

as may be enforceable from time to time) will be issued to him by the government

and local conditions and other factors having a bearing on the execution of the

work.

4 Tendreres should give samples if required by CREDA, R.O. Bilaspur before orderes.

5 CREDA, R.O. Bilaspur reserves full rights to accept or reject all or any tender partially

or fully without assigning any reason thereto. All tenders, in which any of the

prescribed conditions is not fulfilled or the tenderer puts forth any condition including

that of conditional rebate, shall be liable to be rejected.

PART - B (B)

GENERAL CONDITIONS OF CONTRACT

1. VARIATION, ADDITIONS & OMMISSIONS: CREDA, R.O. Bilaspur shall have the right to alter,

amend, omit, or otherwise vary the quantum of work, by notice in writing to the contractor. The

contractor shall carry out such variation in accordance with the rates specified in the contract so

far as they may apply and where such rates are not available, those will be mutually agreed

between CREDA, R.O. Bilaspur and the contractor.

2. FORCE MAJEURE: The contractor shall not be liable for any penalty for delay or for failure to

perform the contract for reasons of FORCE MAJEURE such as of God, acts of public enemy, acts of

government, cyclone fires, floods, epidemics, quarantine restrictions, strikes, freight embargoes

provided that the contract, shall within 10 (ten) days from the beginning of such delay notice the

CREDA in writing of the cause of delay. CREDA, R.O. Bilaspur shall verify the facts and grant such

extension as facts justify.

3. REJECTION OF WORKS: In the event of any of the material supplied/ work done by the

contractor is found defective in material or workman ship or otherwise not in conformity

with the requirement of this contract specifications, CREDA, R.O. Bilaspur shall either

reject the material and/ or work and advise the contractor to rectify the same. The

contractor on receipt of such notices rectify or replace the defective material and rectify the

work, free of cost. 4. EXTENSION OF THE TIME: If the completion of supply of material is delayed due to any

reason beyond the control of the contractor, the contractor shall without delay give notice to the

CREDA in writing of his claim for an extension of time. CREDA, R.O. Bilaspur on receipt of such

notice may agree to extend the contract/delivery date of the material as may be reasonable but

without prejudice to other terms and conditions of the contract.

5. GUARANTEE PERIOD: The material supplied by the contractor specifications should be guaranteed

for satisfactory operation and against any defect in material and workmanship for a period of 2

(two) years. The above guarantee certificate shall be furnished in triplicate to the purchaser for

his approval. Any defect noticed during this period should be rectified/replace by the supplier

free of cost to CREDA, R.O. Bilaspur upon written notice provided such defects may be due to bad

workmanship or bad materials used.

6. PENALTY FOR DELAY IN COMPLETION OF CONTRACT: If the contractor fails to complete the order

within the phased delivery schedule specified in the work order or any extension granted there to,

CREDA, R.O. Bilaspur will recover from the contractor as penalty a sum of one percent of the

contract price for each calendar month of delay. The total penalty shall not exceed 10% (Ten

percent) of the contract price of work.

7. PAYMENT TERMS: The following terms of payment shall apply against this tender:

a) 90% of the total value of the order value after completion of supply to the full

satisfaction of CREDA, R.O. Bilaspur.

b) 10% after one year or on submission of a bank guarantee of equivalent amount valid

for one year, after execution of the work order.

8. INSURANCE: The supplier shall arrange insurance coverage for the material for the transit period

plus on month for onward transportation on the site and installation.

9. LAWS GOVERNING CONTRACT: The contract shall be constituted according to and subject to the

Laws of India and jurisdiction of the District Court of Bilaspur.

10. SECRECY: The contractor shall treat the details of the specifications and other documents as pri

GSTe and confidential and they shall not be reproduced without written authorization from

CREDA, R.O. Bilaspur.

11. AGREEMENT: The successful contractor shall have to enter into an agreement with the concerned

Engineer in charge in the approved contract agreement form within 15 days of the receipt of the

individual work order.

12. JURISDICTION OF THE HIGH COURT OF BILASPUR: Suits, if any, arising out of this contract shall be

filed by either party in a Court of Law of which the jurisdiction of the High court of Bilaspur

extends.

13. ARBITRATION:

i. If at any time any question, dispute or difference whatsoever arises between CREDA and the contractor upon or in relation to or in connection with this contract either party may herewith give to the other a notice in writing of the existence of such question, disputes or difference and the same shall be referred to the adjudication of three arbitrators, one to be nominated by CREDA, R.O. Bilaspur the other by the contractor and the third by the President of the Institution of Engineers, India. If either of the parties fails to appoint its arbitrator, within sixty (60) days after receipt of notice for the appointment of its arbitrator then the President of the Institution or Engineer, India, shall have the power at the request of either of the parties to appoint an Arbitrator. A certified copy of the "President" making such an appointment shall be furnished to both parties.

ii. The arbitration shall be conducted in accordance with the provision of India arbitration

Act, 1940 or any statutory modification thereof and shall be held at such place and time of

India as the Arbitrators may determine. The decision of the majority of Arbitrators shall

be final and binding upon the parties here to and the expenses of the arbitration shall be

paid as may be determined by the Arbitrators.

iii. Performance under the contract shall reasonably possible continue during the

arbitration proceedings and payments due to the contractor by CREDA, R.O.

Bilaspur shall not be withheld unless they are the subject matter of the arbitration

proceedings.

PART -C

TECHNICAL SPECIFICATIONS

Wires and Cables

1. All cables & wires shall be as per ISI specifications.

2. All copper cables and wires used shall be of copper conductors of

suitably cross-section with cross-linked polythene or polyvinyl

insulated with polyvinyl sheath. Stranded and flexible cable shall be

used. Non-stranded cables shall not be acceptable except otherwise

mentioned and permitted.

3. Exposed cables, wherever, used, shall preferably have UV resistant

jacket besides being water resistant.

4. Buried underground cables shall be armored. .

5. Conductor sizes of cables and wires shall be selected based on efficient

design criteria such that the overall electrical energy loss in any section

of cable or wire is not more than three (3) percent under the designed

operating conditions. Conductor sizes of less than 1.5 mm shall not be

accepted.

6. Cable/Wire connections shall be soldered, crimp-on type or split-bolt

type. Wire nut connectors shall not be used.

7. All cables shall be adequately supported. Outside of the

terminal/panels/enclosures shall be protected by conduits. Cables shall

be provided with dry type compression glands wherever they enter

junction boxes/panels/enclosures.

8. All cables shall be suitably marked or color coded for easy

identification. The marking of length of the cable should clearly marked

on the cable

9. Cables and wires shall confirm to the relevant standards. Tenderers to

specify the specification, for any additional features.

10. Cables should in a packing of at least 100 m each.

Electrical & Electronics

1. Electronic circuits in use shall be modular in design to allow for ease

of service, maintenance and replacement.

2. All electronic circuits shall be housed in suitable packages or panels

or enclosures so as to conceal them from general public. However,

these shall be easily accessible to trained technicians for

maintenance.

3. Suitable number of protective fuses shall be included. Safe

accessibility for easy replacement, if required, shall be ensured.

4. The control circuit shall provide for an emergency shut down for the

system and manual reconnect facilities.

5. Power Factor of all types of Electronic Ballast should be> 0.90.

6. Only mercury displacement relays or equivalent shall be used in the

power circuits. Mechanical relays are not acceptable.

7. The electronic circuitry shall be rated at least for an operating

temperature of 0°C to 48°C and a storage temperature - 10°C +

55°C.

Hardware

1. The hardware material shall be of ISI specification wherever

mentioned in the Price Bid. If mentioned items does not come in the category of specified in ISI then also the quality of those items shall be of best available in the category.

2. All the material shall match with the requirement of the purpose of installation at site.

___ on one hand and Chhattisgarh State Renewable Energy Development Agency-CREDA registered under Societies Act having its Registered office at ----------------------) (hereinafter called as

“CREDA” the term which includes its successors, assigns and legal heirs) through Shri Vijay Kumar,

Executive Engineer CREDA, resident, Bilaspur (C.G.) , on the other hand on the following terms

and conditions:-

1. Whereas, the “CREDA” R.O. Bilaspur intendsto purchase for works _________________________________________________________________ (hereinafter called as “ Work”) for the purpose of installation of Power Distribution Network System for Solar Photovoltaic Power

plants to be installed in the villages in the State of Chhattisgarh had floated tender No/ ……………………………………………. for Supply of Cables, Electrical & Electronic Items, Luminaries,

Fixtures, Hardware & Accessories required for AC/DC for SPV Power Plant at the Regional offices CREDA, R.O. Bilaspur The “Tenderer” had submitted their rates and agreed to supply/perform the “ Work “ to CREDA on the rates appended hereto in Annexure No. 1, as per the terms and conditions of the tender already agreed upon, and,

2. Whereas, the rates quoted by the “Tenderer” are inclusive of all GST, duties, levies, transport and all

other incidental expenses F.O.R. at site but excluding GST/CST. The “Tenderer” shall not increase the rates of

the “ Work “ up to one year from the date of agreement and the rates mentioned in Annexure -1 shall be valid

for a further period with mutual agreement, and,

3. Whereas, the “Tenderer” is committed to execute the “ Work “ at the ordered site, on the rates

already agreed upon, within the schedule mentioned in the Work/Supply orders that shall be issued

from time to time, and,

4. Whereas, it has been also agreed upon that during any disputes regarding interpretation of any of the

clauses of this agreement, the decision of the “Superintendant Engineer, CREDA, Z.O. Bilaspur” shall

be final and binding on both the parties,

5. Whereas, it is agreed upon that all the terms and conditions of the tender and work/ supply orders

which have already been agreed upon shall form part of this agreement, and,

6. Whereas, it has also been agreed that for any disputes arising, the jurisdiction shall be the Courts of

Bilaspur,
