Chapter 1: Situation of Child Labour in Uttar Pradesh:

In the 1971 census it was estimated that there were slightly over 13 lakh (13,26,726) working

children in the State of Uttar Pradesh. In the same year, among the States with the maximum

number of child workers, there

were more than 16 lakh (16,27,492)

working children in Andhra Pradesh,

around 11 lakhs (11,12,319) in

Madhya Pradesh, around 10 lakh

(10,59,359) in Bihar and just under

10 lakh (9,88,357) child workers in

Maharashtra. There were over one

crore child workers in India

(1,07,53,985) that year.

By the 2011 census, the number of

child workers in the country had declined marginally from 1971 levels to 1,01,28,663, but

compared to the all time high number of the 1981 census (1,36,40,870) or even the 2001

census (1,26,66,377), it had declined significantly. For the States mentioned above, the number

of child workers had declined significantly. In Andhra Pradesh it had come down to less than

seven lakhs (6,73,003), in Madhya Pradesh to just over seven lakhs (7,00,239) while for the

State of Maharashtra the corresponding figure was just over seven lakhs (7,27,932). In Bihar the

figure was almost constant at 10,88,509, but had declined from the 2001 levels.

In Uttar Pradesh, however, the number of child workers had shown an increase in every census,

and in 2011, it stood at an all time high, crossing 21 lakhs (21,76,706), with a child worker ratio

of 4.27.

A look at the 2011 census reveals that of the 21.77 lakh child workers, in the State,, 41% are

girls and 59% are boys. In Rural Areas, 28% of boys work as cultivators, while 35% work as

agricultural labour. In other words 63% work in the agriculture sector. 7% work in household

industries and 30% in other sectors. Similarly, 26% of girls work as cultivators, while 32% work

as agricultural labour. In other words 58% work in the agriculture sector. 9% work in household

industries and 35% in other sectors.

In Urban areas only 10% boys work in the agriculture sector, 11% in household industries and

79% in other works. Similarly, 8% girls in urban areas work in the agriculture sector, 14% in

household industries and 78% in other works. (Annexure 1)

Child labour in India is regulated largely in accordance with the provisions of The Child Labour

(Prohibition & Regulation ) Act

1986. The basis for this Act can be

found in the Constitutional

provisions. The Child Labour

(Prohibition & Regulation) Act

1986 prohibits employment of

children (defined as a person who

has not completed 14 years of

age) in 18 occupations and 65

processes called hazardous

occupation. The Act provides

penalty for employment of children that includes Imprisonment from 03 months to 01 year

and fine from Rs 2,000 to Rs 10,000.

For occupations and processes where children are not prohibited from employment, the Act

also provides for the Regulation of Conditions of Work of Children, including the Hours and

period of work , provision for weekly holidays, as well as provisions for the health and safety

of such children.

Article 39 of the Constitution enjoins that : “…..the tender age of

children are not abused and that citizens are not forced by

economic necessity to enter avocations unsuited to their age or

strength” and that

“ ….children are given opportunities and facilities to develop in a

healthy manner and in conditions of freedom and dignity and that

childhood and youth are protected against exploitation and against

moral and material abandonment”

Article 23, prohibits traffic in human beings and forced labour, and

Article 24, more specifically prohibits the employment of children

in factories etc. and states that “No child below the age of fourteen

years shall be employed to work in any factory or mine or engaged

in any other hazardous employment”

1.1 Background to the Study:

Given the alarming increase in the number of child labourers in the State, it was felt that it was

important to capture, at the micro level, the reasons underlying this increase and to devise an

effective strategy to combat the same.

The highest number of child workers in the State as per the 2011 census is in Allahabad

district, followed by Jaunpur district.

However, Bahraich district was identified as

the most critical district for trafficking of child

labour since an over whelming majority of

children rescued from and repatriated from

other States hailed from this district. In fact

the district of Bahraich and the adjoining

districts of, Gonda and Shravasti accounted

for the bulk of the children rescued from other States. These were children who had been

found working out of the State , without families. These districts can, therefor be said to exhibit

the most extreme cases of child labour in the State. The districtwise details of children from

Uttar Pradesh rescued from other States in the last three years can be seen at Annexure 2. It

was therefore decided to conduct the survey in Bahraich.

The purpose behind the study was to capture the underlying socio economic factors that led to

these children migrating for work to other States, without their families as well as the

modalities through which they were recruited and to examine the efficacy of the rescue and

rehabilitation process in order to devise more effective strategies to combat child labour. Based

on reports available with the Department, it was clear that both Bahraich and Shrawasti

districts were the source districts for child labour and Delhi, Maharashtra and Rajasthan are

common destination states for child labour. A list of 258 children from Bahraich rescued from

the States of Maharashtra, Rajasthan and Delhi in the last three years is available with the

Department.

Based on this list, the Department conducted a field level study from the 18th to the 21st of May

2015 covering 49 villages in 12 blocks of the districts of Bahraich and Shravasti . Three teams

were formed which conducted the survey in different areas based on the lists of rescued

children sent from the States from where the children were rescued. A total of 81 children and/

or their families were interviewed as a part

of this study. The teams went to the villages

and tried to locate the child or his family. In

some cases, the addresses were clearly

wrong and the teams were unable to

contact the child or his family. In some

instances it was possible to interact with

either the child or his/her family member.

In all the study has been based on interactions with 81 children or their family members.

We also held discussions with the members of the Child Welfare Committee, persons from the

district Childline as well as the District Magistrate.

Before the commencement of the survey, a basic socio economic study tool had been designed,

which is at Annexure 3. This study tool formed the basis of the study, however, it was also

decided that any other relevant facts that came to the notice of the surveyors would also be

captured.

Chapter 2: Socio economic background of Children:

2.1 Family Details: In almost all cases where children or their families were interviewed, there

were healthy adult family members, that is father, mother or elder brother who were capable

of earning. In only one case we found that the father

had passed away and in another case that the father

had a mental health issue.

In only 1% case we found that the father had died.

Mothers of all the children surveyed were reported to

be alive. In other words 99% of the children surveyed

had both parents alive and capable of working.

Families and other villagers were unanimous on the lack

of employment opportunities in the area covered by the

study. The landholdings were small, there were very

few industries in the area, and reportedly little work

available under MNREGA. There was also a lack of any special skills or training facilities. Most

of the family members had no skills and could only find work as unskilled labour.

Most parents did not report any regular profession or earning, though they said that the father

did seasonal or sporadic work. A common profession in many villages of this area was the

migration of male members to Delhi for 3 to 4 months a year to set up juice stalls. They said

that depending upon the season this could fetch them between Rs. 25,000 to Rs 40,000 each

season. Some of them reported that such men were accompanied by a young son who helped

them at the stall. None of the women were engaged in wage labour of any kind.

They also reported that these villages were very far from the main Roads and there were no

transportation facilities, making it difficult and expensive to commute daily for work.

2.2 Availability of agricultural land: Most of the families interviewed were landless. Those who

had some land pointed out that after generational sub division, their share of plots were were

very tiny and did not yield any worthwhile income.

2.3 Families of 54% of the children surveyed were residing in their own

pucca house, while 37% were staying in kuccha houses and 9% families

were residing in jhopras.

The teams also saw evidence of mobile phones, gas stoves, hens etc.

in some of these houses.

2.4: Educational Status: 57% of children surveyed reported being

enrolled in schools, or attending schools or Madaras before going off for work. But almost none

of them could read or write. Children who reported that they were studying in Madaras could

not read or write in either Urdu or Arabi. The study teams met only a handful of children who

could read a sentance in Hindi or could write their name in Hindi, who would possibly have

continued to study, incase they had not been sent to work.

After their rescue, also very few children were found to be attending school regularly. Either

they had gone back to work, or were reportedly attending madarsas. As has been stated earlier,

we found that the so called Madarsas were not

proper schools, but attached to the village

mosque with a single, possible part time teacher.

None of the children said to be attending

madarsas had any books or copies, or could read

or write, either in Hindi or Urdu or Pharsi.

The younger siblings of rescued child labourers were in a similar situation, and did not seem to

be receiving education, although it is possible that their names were on the rolls of the school.

2.5 In conclusion, after visiting and talking to rescued child laboureres, their families,

neighbours and other villagers, the following emerged:

1. In most villages, we felt that the adult male members migrated for work to Mumbai or

Delhi, either full time or seasonally. Once the male child reached the age of around 12,

they were sent out for work and the adult member would stop going out permanently for

work, although some still went out for seasonal work as mentioned above. With a regular

income of around Rs 1500 to Rs 2000 per child coming from the child’s work, they

obviously did not feel the need to migrate for work any more. So the child is being looked

upon as a substitue for the father’s work. The father then took up sporadic work as

available near the village.

2. When traffickers are on the look out for children to recruit, they could easily have

recruited the adults from these families instead, who report that they are unable to find

work.

3. A possible reason for this is that work in hotels in Mumbai, which seemed to be a

favoured place of work, was obviously very difficult, with long and irregular hours of

work, no decent accomodation and low wages. Adults would find it difficult be able to do

this work for many years.

4. At the same time, children are more convenient for employers, since they would work for

extremely low wages, for long periods without the need for housing or other benefits,

and being more vulnerable, would be unable to complain. Many would also be

brainwashed into feeling that they needed to work to feed younger siblings.

5. Talking to the villagers, it was clear that they knew that children were rescued because

they were too young to work and so that they could be put into schools. Despite this

almost no child was attending school.

Chapter 3: The Recruitment of Children for Work

3.1 Method of Recruitment:

3.1.1. On talking to the children or their families, it was found that the rescued children had

been sent out for work with the consent of their parents.

3.1.2 The modus operandi was similar in most cases. Most children were usually recruited by

persons known to the family, someone whom they ordinarily refered to as a family member, or

by influential persons of the village. However, the

fact that some names were being mentioned

repeatedly, by the children and by the local childline

members shows that they were not immediate family

members but persons who gained the trust of the

families through kinship ties or through persons close

to the families.

These persons would then take the children with

them to Mumbai, Jaipur or Delhi and would also be in

touch with their families and often be the medium of

transfer of the child’s wages to the parents.

4% of the children surveyed told us that they had gone on their own, while no child reported

that he had gone with either of his parents. 15% reported that they had gone with a relative,

14% said that they had gone alongwith other boys of the village. An overwhelming 67%

reported that they had gone with the prospective employer or his agent.

Discussions with the local Child Welfare Committee members and the Childline members

revealed that the transportation was done mainly on the small train line, with ”Gokul Express”

being a favourite. We were told that Gonda railway station is also used as a transit point.

Steps:

1. Someone close to the family or through someone

close to the family will contact the family

2. Will convince the family that either the child is

getting spoilt or that he will learn some trade, to

send the child

3. Initially the child is accompanied by this person so

that the family feels secure

4. Often that person then comes back

5. The same names was mentioned in different

villages as the recruiter

6. After release, many children went back to work,

often with the same employer

7. There was a process for getting age certificates for

underage children in place

8. Villagers and neighbors often tried to deny the

existence of child labour

3.2: Reason for sending children to Work:

The most common method of recruitment by these traffickers appears to be to tell parents that

boys of around 12 years were getting spoilt or fighting a lot and that they would go astray if

they stayed in the village and would improve if they went out to work. This was the reason

given by most families when asked why the children were sent so far to work.

Our study shows that 26% of the children surveyed, were in the age group of 9 to 11 at the

time when they were sent to work, 20% were in the age group of 11 to 12, while 34% children

were in the age group of 12 to 13 while the rest were in the 13 to 14 age group.

Many of them said that the children went with relatives who were working outside. In some

cases, on being asked whether the relative was still working it was reported that the relative

had now come back. It is therefore possible that this was a confidence building ploy, to

convince the parents to send the child.

Another possible reason could be the complete lack of importance given to education. Most

brothers and sisters of children who had gone out to work were also found to be not attending

school. The most common reason given was either that the quality of education in the

Government school was bad or that they were

attending at the Madarsa.

However, our study also shows that 43% of the

children surveyed were actually going to school at

the time when they were sent out of the State to

work.

This was again possibly an excuse being given, since

on enquiry, we found that the Madarsas referred to were not proper schools, but attached to

the village mosque with a single, possible part time teacher. None of the children had any

books or copies and could not read or write even at the ages of 10 or more when they were

said to be attending the madarsa for a few years. Sending children to madarsas appeared to be

an excuse to not send children to school. Since children were not attending school, parents

possibly felt that they would be better off employed/ working.

3.3: Attitude of families and villagers towards Child Labour

It was clear that the villagers were aware that sending children out to work was wrong and they

tried to supress the facts when asked. Neighbours and villagers came up with comments like

the child has gone to Mumbai to study”” or that they were above the age of 18, to mislead the

team. Most of what they had to say in justification of the child’s migration to another place

were attempts to justify the children’s migration from the village. On the third day of the study,

some villagers who were apparently aware that such a study was in progress, questioned the

team members about what they were doing and who they were, even in interior villages. It was

evident from this that information about the teams work had been passed on to them and they

had already been told to not give information.

In one family where children had been rescued from a hotel in Mumbai, for example the family

members told us that the boy was playfully counting plates at a relative’s hotel when he was

caught. There was no reason given however, why such a small child was sent all the way to

Mumbai without any accompanying family member. The child’s sister admitted that he has

once again returned to the same hotel to work, but quickly added that he is now above 14,

while neighbours told us that he had gone to Mumbai to study. From the response of the boy’s

sister it seems fair to conclude that family members like her have a fair idea of the law – what it

disallows and what it allows – and they try to use it to their advantage to circumvent the

processes of the law/enforcement.

The survey and discussions with children and their families, reveals that there is a well oiled

machinery in operation in the districts for the export of child labour, with the villagers and

families supporting it, either as a source of easy money, or under the influence of the

traffickers.

This is also borne out by the fact that many families mentioned getting an age certificate with

pride. Such age certificates referred either to doctors’ certificates or to class 8 certificates. In

most of these cases it appears that the child had not completed 14 years of age or completed

class 8, but this was being done to circumvent the law.

It was also found that many adult males from these villages went to Delhi for 3 to 4 months of

the year where they would put up Juice stalls. They were often accompanied by a young child

to help them there.

As the teams travelled around the district, the large number of child laboureres in all

professions, whether it is road side vending, agriculture, working in shops or ferrying loads

could be seen. It was clear that children were finding work or were undertaking self employed

work, while adults in the families were claiming that they were not able to find work.

Children above the age of 12 were being looked at as an easy source of income by their

families. To justify this families offered us various reasons like adults not getting work under

MNREGA or a lack of other employment opportunities. The situation is being exploited by

middlemen/ traffickers in the district who convince parents to send their children for paid work,

where they provide cheap labour, working for long hours at minimal rates, vulnerable to

exploitation and unable to complain like adults.

Chapter 4: Employment of Children and conditions of work

4.1 Areas of employment of children:

The pattern of employment of the 81 children interviewed from the district who had been

rescued in other States was found to be as follows:

31% of the children surveyed were found to be working in the zari/ zardozi factories, while

32% were working in the hotel/ dhaba catering sector. 30% were working in embroidery/

garment sector and 6% in other sectors. Most children who went to Mumbai went to work at

”Bassi” or hotels/ Dhabas/ catering, while those rescued from Jaipur were working at zardozi

factories. Children rescued from Delhi were working either in garments manufacturing or in

hotels. It is importent to note that all of these occupations are classified as hazardous work.

4.2 Pay and Wages received by child labourers:

The study showed that none of the children were receiving anything close to prescribed

minimum wages for adults in these occupations. 4% of the children surveyed reported that

they were paid less than Rs 500 per month, 17% were receiving between Rs 500 to Rs 1000,

37% reported receiving wages between Rs 1000 to Rs 2000, 15% reported wages between Rs

2000 to Rs 3000 and 15% reported that they were receiving wages above Rs 3000 per month.

Children working in the Zardozi factories were receiving the least wages. Parents reported that

they had been told that after training they would receive Rs 3000 per month, but that they

were rescued before their training was completed. Employers were responsible for giving them

food and a place to stay.

In atleast one case the family told us that the child was getting Rs 4000 per month, but when

we questioned how much he was sending home, it was reported to be around Rs 1500 per

month and the rest of the amount was spent on his expenses of food, living, etc

Efforts were made to understand who received the payment on behalf of the children for

transferring to the families of the children. The teams were were told that the wages would

normally be deposited in the account of some agent of the employer, residing near the families,

who would give the money to the parents.

4.3 Conditions of Work

4.3.1 Hours of Work:

12% of the children surveyed reported that they used to work for 8 to 10 hours, while 23%

reported working for 10 to 12 hours, 25% children surveyed reported that they were working

for 12 to 14 hours and 37% reported working for 14 to 16 hours. 2% children reported that

they were working for more than 16 hours daily.

4.3.2 Provisions made for stay of child workers:

Almost all children said that they would stay at the workplace. At the factories, they would stay

in the same rooms in the factory premises where they worked. Similarly, children rescued from

hotels/ dhabas said that they slept anywhere on the premises. It was clear that employers did

not have to spend any money on the accommodation or transport of the children, and that

they were available for work at their beck and call at any time. Most children reported that they

were not allowed to leave the premises.

99% of the children surveyed reported that they were staying at the worksite, and 1 child

(1%) that he was staying with relatives. None reported staying at rented premises.

4.3.3 Arrangements for Food: Children working in factories reported that food was prepared

for them on the factory premises, while those working at dhabas and hotels said that they ate

food prepared at the hotel/ dhaba.

4.3.4: Holidays: Many children working in the factories reported receiving a weekly holiday, but

also said that incase there was extra work, they would have to forsake their weekly holiday.

Children working in hotels and dhabas reported that they received no holidays and had to work

on all days of the week.

4.3.5: Physical and Mental exploitation: While most children denied any physical or mental

exploitation, they admitted that they were scolded or even beaten if they committed any

mistakes.

Chapter 5: Rescue and Rehabilitation

5.1 Process of Rescue:

Process of Rescue of child labourers followed in Rajasthan-

5.1.1 The study teams were informed that a joint team consisting of labour

department, police and NGOs raided the factory premises in Rajasthan. After

rescue, the children were sent to a children’s home for about 20-25 days. The

authorities in the destination States did not hand over the children to local

guardians or parents, some of whom had gone to bring back the children after

reports of their rescue. The State Government handed over the children only to

officials of the UP Government who went to Rajasthan to bring the children.

5.1.2 They were issued release certificates as bonded labour which were issued by the

concerned SDM of Rajasthan Government.

5.1.3 Once the children reached Bahraich, they were handed over to their families

after full verification by the District authorities.

5.1.4 The amount of Rs 20,000 to be recovered from employers as child labour has not

been received. The further sum of Rs 20,000 which should have been given to

them as rescued bonded labour has also not yet been received.

Process of Rescue of child labour followed in Maharashtra-

5.1.5 A joint team consisting of labour department, police and NGOs raided the

employers premises in the destination State. After rescue the children were kept

in a home. Parents reported that they were informed of the rescue by the

employers and not through Government. Parents reported going to Mumbai to

bring back/ receive the children, some also claimed that they spent Rs 10,000 to

Rs 20,000 in bringing back the child (excluding transportation). Only one family

could show us a copy of an FDR of Rs 10,000 received by them. Others told us

that they have not yet received any amount as compensation or for

rehabilitation.

5.1.6 Only 5% of the children surveyed

reported receiving financial assistance,

while an overwhelming 95% of children

reported not receiving any financial

assistance.

5.1.7 The names and addresses that were recorded in the release certificates issued

by the Maharashtra Government, were in many cases found to be incorrect. It

appears that this has happened because of different reasons. In some cases, it

would appear that the child, his employer or maybe the guardian, deliberately

gave the wrong names to the authorities. It was possible for the study teams to

locate some of these children through their father’s name. Names of villages

given were at times found to be similar to the real names, so the error could

have been a result of differences in pronunciation. In some cases it was not

possible to locate the children because the village could not be located.

5.2.1. Educational Rehabilitation: As has been stated earlier in the report, after their rescue,

also very few children were found to be attending school regularly. Either they had gone

back to work, or we were told that they were attending madarsas, which we found were

not proper schools qualifying under RTE, but attached to the village mosque with a

single teacher. None of the children said to be attending madarsas had any books or

copies, or could read or write, either in Hindi or Urdu or Pharsi.

5.2.2. Economic Rehabilitation: As part of the economic rehabilitation, adult members of the

family should be covered under programmes like MNREGA, or self employment

programmes so that the income of the family is augmented and children are not forced

to work. However, there was little evidence of the adult members getting either wage

employment or help for self employment.

5.2.3 While we could not ascertain exactly how many children had gone back to work, it was reported

that of the 81 children interviewed, 54 were present in the village. It can therefore be presumed

that the rest had gone back to work.

Chapter 6: Recommendations for Action:

6.1 Prevention of trafficking: Since it is clear that a well established mechanism for trafficking

of children for work to other States exists in the district studied, and in adjoining districts, it

would be necessary to have a system in place that could prevent children from being trafficked.

This could include the following steps:

6.1.1 Vigilance at the village level: This can be ensured by two different mechanisms:

6.1.1.1 One is through the Integrated Child Protection Scheme. The village level committees

child protection committees envisaged under this scheme should be constituted and if

constituted, be made functional. An effective step can be the maintenance of a village level

register at the Panchayat level, which could function as a movement register for children. So

incase of any child going out of the village is entered in the register with the purpose for which

the child is going (incase the migration is related to education of the child the details of the

school and place of stay and local guardians should be maintained), the person accompanying

the child should also be recorded. When the child returns, this can be mentioned in the

register.

6.1.1.2 Through the Sarva Shiksha Abhiyan: The school management committee needs to

monitor attendance very closely in vulnerable villages. The SMC register in use in UP has a

provision of tracking children’s attendance through listing the children who were absent for five

days or more in the previous month that is shared and discussed for follow up action by the

SMC members at the monthly SMC meetings. In case children are irregular to school their

families should be contacted and counseled.

6.1.1.3 Since the areas where such trafficking is taking place is known, the police/ beat

constables during their visits to such places, can also make enquiries about any children leaving

the village. The village chowkidar could also be asked to report

6.2. Vigilance at the thana, sub division: Based on village level reports, the SHO, the Block

Resource Centre of the Education Department and the Project Officers of the Department of

Women and Child review this periodically and submit reports at the district level

6.3 Vigilance at the district level : The anti trafficking units at the district level need to follow

up trafficking of children at the district level. This needs to be done through various

methodologies such as:

6.3.1 Identification and watch over Transit points: As has been stated earlier in the report,

Discussions with the local CWC members and the Childline members pointed out that the

transportation was done mainly on the small train line, with ”Gokul Express” being the most

preffered, but also that Gonda railway station is also being used as a migration point. Personnel

at such transit points like GRP personnel or Bus stand officials, or highway patrols need to be

sensitised to look out for tell tale signs of trafficking, like a group of children being transported.

Periodic campaigns at such transit points could also have a deterrent effect.

6.3.2 Standard procedures need to be finalsed/ notified, including ensuring that such children

have authority letters, verifying the identity of adults accompanying them and recording these

in the register kept a the station/ bus stand etc. Nodal persons could be designated at such

transit points who would need to be trained adequately.

6.4: Action against traffickers: During our discussion with children and their families, a few

names came up repeatedly as being the persons who recruited/ took the children for work.

These names will be shared separately with Government for follow up action as may be

deemed appropriate. However, strict action against these persons may deter others from

trafficking in children.

6.5 Streamlining the rescue process: From observations and discussions, it was clear that the

process followed by the Rajasthan Government in handing over the children directly to district

authorities in Bahraich, and the action of district authorities in stringently verifying the identity

of guardians before handing over of children had a clear deterrent effect on families, since most

of the children were found at their villages. This process needs to be followed in future cases.

For this purpose the following steps would need to be taken:

6.5.1 Signing an MOU with destination States , especially Maharashtra, Delhi and Rajasthan, on

protocols to be followed for release and rehabilitation of children. A mechanism for the

pursuing the release of the financial assistance to the children from destination States need to

be built into the MOU.

6.5.2 Creation of a fund which can finance transportation of children, TA for staff to bring the

children, and funds for their stay and for food etc incase there is a delay in locating their

families, either in the place of rescue, transit or final destination . This should be in the form of

a revolving fund which can recouped, so that there is no delay in the process.

6.6 One issue which came up was the certification of age of children. As has been stated earlier

in the report the study teams were informed that the child has now got an age certificate or

been issued a certificate for class 8 as proof that he has completed 14 years of age. This

practice seriously hampers the rescue of child labour. Even in the case of rescue of children

within the State, this has been found to be an issue. This needs to be tackled on two levels:

i. At the level of the Education Department to ensure that such false certificates are not issued

by private institutions, without creating unnecessary red tape for genuine cases (as has been

mandated in the Right of Children to Free and Compulsory education Act 2009). A possible

solution would be a compulsory sampling of certificates that are issued by a team, through a

random computer generated sample, and black listing of institutions that are indulging in

such dubious practices.

ii. An appellate medical board, or possibly more than one, where cases can be referred incase

of doubt of the veracity of the age certification. The board could also do some random

sampling apart from cases of appeal.

6.7 Rehabilitation of Children would need to be done on a more concerted basis. While the

education Department is mandated to follow up educational rehabilitation and a core

committee under the chairmanship of the Chief Development officer in each district is

mandated to ensure rehabilitation of the rescued child labour and economic rehabilitation of

their families, the protocols for rescue and rehabilitation need to be strengthened.

6.7.1 Educational rehabilitation would need to go beyond enrolment of children. For a

specified period, which should be atleast one year, a regular report on the child should be sent

to the BSA, so that it can be ensured that the child is attending school and has not gone back to

work. This work can be entrusted to the VEC or the NPRC. To adjust such children in age

appropriate classes, they may be taken through special training (similar to bridge courses) with

sensitive handling given their experiences as child labour, through SSA or be kept in mind for

the revised NCLP of Government of India.

After their rescue, very few children were found to be attending school regularly and we were

almost univeraslly told that they were attending madarsas. Since the type of Madarsas being

mentioned as the excuse for not sending children to school do not qualify as schools under RTE,

it should be ensured that children go to regular schools for their formal education and to any

other school like the Madarsas only on weekends, holidays, or after school hours. Only

modernised Madarsas qualifying under RTE should be accepted as a school substitute.

6.7.2 Similarly for economic rehabilitation, meetings of the core committee should be held

regularly. Apart from wage employment and self employment, skill building could also be

introduced as a part of the economic rehabilitation package. Follow up reports could be given

to the core committee on the progress made by the family. Special efforts will also need to be

made to link families with social protection schemes for which they may be eligible.

6.8 An information campaign also needs to be designed to educate parents and children on the

need for education and the ill effects of such work on the health, safety and future of children.

Introduction of these recommendations could help to stem this steady movement of children

for work to other States.
