Policy Summary

• contingency motor liability – this doesnot replace or include ordinary motorinsurance and it does not cover the motorvehicle or its contents. It does provide coverif you use someone else’s vehicle (with theirpermission) on childminding business andmotor accident occurs for which you arelegally responsible, but the vehicle ownerdoes not have the necessary business coverin place.However, you must take all reasonableprecautions to ensure that any vehicle usedhas the appropriate motor insurance.

• anywhere in Great Britain, Northern Ireland,the Isle of Man or the Channel Islands.

• liability for accidental bodily injury to anyminded child not in your direct andimmediate personal care, custody or control(except in an emergency)

Public Liability Insurance

Limit of Indemnity £5,000,000If, as a registered childminder, you are held legallyresponsible for an injury (including death) to achild or third party, or for damage to a third party’sproperty then you will be required to pay damages.Public Liability insurance covers these damages upto the limit of indemnity.

Employers’ Liability Insurance

Limit of Indemnity £10,000,000(£5,000,000 if arising out of terrorism)If you are an employer, you are required by lawto have Employers’ Liability insurance. Thiscovers you in case an employee suffers anaccident at work for which you are held legallyresponsible. Employees include paid or unpaidsupervisors, students, work experience students,trainees and volunteers.

• legal costs incurred in the defence ofcriminal proceedings in respect of a breachof the Health and Safety at Work etc Act1974 – limit £10,000 in any one period ofinsurance

• legal defence costs and expenses incurredwith the written consent of Sterling.

Property

Limit £1,000 any one occurrenceWhere no legal liability attaches to you, you willbe reimbursed for costs and expenses incurred byyou, with the company’s consent, in respect ofaccidental loss of or damage to:

• the property of a minded child

• any other person’s property caused bya minded child

• any other person’s property caused byyou as a registered childminder

• toys and play equipment on loan to youfrom a toy library.

• terrorism, war and similar risks.

Legal ExpensesLimit £50,000 any one eventCover, which is provided by DAS Legal ExpensesInsurance Company Limited (DAS), will pay yourlegal costs including solicitors’ and barristers’ fees,court costs, expenses for expert witnesses,attendance expenses and accountants’ fees.

Automatically Included• a legal representative to support you if you are

asked to go to the police station for matterrelating to your childminding work

• legal defence in the event of a prosecution arisingfrom your business activity such as alleged childabuse of the children that you mind

• taxation disputes with HM Revenue and Customs

• legal expenses required to appeal to Ofsted, orother registering authority, if your registration asa childminder is cancelled, suspended or yourrenewal refused

• supporting contract disputes of over £100, if aparent breaks with your contract terms

• supporting the recovery of a debt of over £100,if a parent fails to pay for your services

• employment disputes and compensation awardsthat might arise with your assistant childminder.

Main Exclusions• costs and expenses incurred before the written

acceptance of a claim by DAS

• costs and expenses in connection with a contractdispute or debt under an agreement entered intoprior to the inception of this section, if thedispute arises or if the debt is due within the first90 days of this section commencing

• civil claims which do not offer reasonableprospects of success.

Helplines, provided by DAS, that giveprofessional advice and support areautomatically included with your policy. They areavailable 24 hours a day, 365 days of the year.

Advice is given on:

• Tax: including VAT, self-assessment, incometax and HM Revenue and Customs audits.

• Health and medical information: includingfood allergies, medication, childhoodillnesses, vaccinations, nutrition and exercise.

• Legal matters: including employmentand contract disputes. The legal helplinecan provide guidance on childmindingissues such as registration, inspections byOfsted (or other registering authorities) andsafeguarding children. You can also getadvice on the legal issues involved whenpreparing for your risk assessment.

Help is provided through:

• Emergency repair support: giving accessto approved contractors for plumbing,electrical, gas and roofing repairs (you willbe responsible for the cost of the repair).

• Confidential counselling: a valuable supportservice to help you through those difficulttimes whether because of stress, anxiety,depression, relationships, bereavement orhealth problems. It includes onwards referralto relevant voluntary and/or professionalservices where appropriate.

Household Insurance

Motor InsuranceIf you carry children in your car, you must make surethat you have adequate motor insurance cover inplace. Some insurers will charge an additionalpremium for this. Morton Michel’s motor policyautomatically allows you to use your car inconnection with your childminding business at noextra cost.

We believe that it is the only motor policy tospecifically state on your certificate of insurance thatyou are covered for: “social, domestic, pleasure andbusiness use in connection with childcare activities”.

Frequently Asked Questions

How many children am I covered for?You will be covered for a maximum of 12 childrenwhen working alone, or 18 when working withanother registered childminder.The number of children minded under 8 years ofage must be in accordance with your registerednumbers (under 12 years of age if in Scotland).

Am I covered for children aged over 8 years?Yes, the ChildMinder policy will allow you, as aregistered childminder, to mind children aged0-15 years.

Am I covered if I take the children on outings?Yes, the ChildMinder policy will cover youanywhere within the UK – whilst carrying outyour childminding activities.

Is my assistant covered by this insurance?Yes, the ChildMinder policy gives automatic coverfor registered or approved helpers to assist you,if they are stated on your registration certificate.Provided that you have written permission fromOfsted or your registering authority, the policy alsocovers them for sole charge care for short periodsof time.

Am I covered to take in a work experience student?Yes, the ChildMinder policy covers you to takein work experience students. Work experiencestudents cannot be left in sole charge of yourminded children.

Am I covered if one of my own children injures oneof my minded children?Your ChildMinder policy will cover your legalliability for this eventuality, as long as the childrenare under your supervision at the time of injury.

Am I covered for using a trampoline, climbingframe, garden swimming pool, bouncy castle orsimilar inflatable equipment in my garden?Yes, in accordance with policy conditions.

Will I receive a policy document telling me exactlywhat I’m covered for?Yes. When you take out a ChildMinder policywith Morton Michel you will receive a Scheduleof Insurance detailing your cover limits and apolicy booklet detailing all the policy cover andconditions so you can refer to them at any time.This gives you the peace of mind of knowingexactly what you are covered for.

Am I covered if I provide babysitting services?Yes, you are covered to mind up to six childrenin their own home at any one time, providingyou comply with the following policy conditions:i) you must have a note of the parent’s contact

details;ii) you must visit the home(s) where you are to

babysit beforehand, identify any associatedrisks, advise the parent of any such risks inwriting and take/recommend any appropriateaction;

iii) you must obtain the medical details andpermissions for emergency treatment inrespect of each child to be looked after;

iv) you must obtain the parent’s signatureconfirming the above information.

Am I covered if I work in a crèche?We are able to provide you with cover whilstworking as a childminder in a crèche, provided thatyou have advised us of this and we have agreed tothis in writing. You will also need to comply withthe following policy conditions:i) you must be working on a self-employed basis;ii) you must not work at the crèche for more than

2 hours per day;iii) the children you mind as a registered

childminder must not be with you whilst youare working in the crèche;

iv) you must have been asked to carry out thiswork by an authorised representative of alocal authority, Sure Start or children’s centre;

v) the adult to child supervision ratio at the crèchemust be at least one adult to six children andmust comply with any restrictions stated inOfsted’s, or your registering authority’s,guidelines.

Am I covered for taking minded children in my car?Your ChildMinder policy will not cover you forusing your car in connection with yourchildminding business. You will need to check withyour current motor insurers to arrange adequatecover. Morton Michel’s motor policy is speciallydesigned to cover you in connection with yourchildminding business. So, what is contingent motor liability then?Contingency motor liability does not replace yourordinary motor insurance and it does not cover themotor vehicle or its contents. It provides cover ifyou use someone else’s vehicle (with theirpermission) on childminding business and a motoraccident occurs for which you are legallyresponsible, but the vehicle owner does not havethe necessary business cover in place. However, youmust take all reasonable precautions to ensure thatany vehicle used has appropriate motor insurance.

What happens if I have to replace damagedproperty?Unlike some other insurance companies, you arecovered under the Public Liability section of thepolicy up to the limit of £5,000,000 any oneoccurrence if you are legally liable for the damageand it occurred in connection with yourchildminding activities.

Even if the damage to someone else’s property wasnot your legal responsibility, you are stillcovered under the Property section of this policy,for costs and expenses incurred, with theCompany’s consent, up to £1,000 any oneoccurrence.

Is my own property insured?No. Property belonging to you and yourhousehold should be covered under a householdinsurance. If you would like Morton Michel toprovide a quotation for your household insurance,please call freephone: 0800 975 4898.

Supposing a child has an accident duringthe period of my insurance policy but doesnot bring a claim against me until monthsor years later, when I no longer have a policyin force?By law, a claim can be brought against achildminder up to a child’s 21st birthday – longafter they have left your care. Our insurance willcover you if you had a policy in place at the time ofthe accident and are legally liable for theaccident. Some other companies only offerpolicies that cover you during the time that you arepaying for the insurance so, as soon as you stoppaying, so does the cover. However, anyincident that could result in a claim being madeshould be reported to Morton Michel.

Does Morton Michel provide business stationery –such as contracts and child record forms?Yes. Morton Michel offers a complete range of topquality products to support your business needs atvery competitive prices. Each item canbe purchased individually or as the completeEasyMind package (see pages 10 to 12 for moredetails). Many childminders who qualify for a startup grant use part of their grant to take out theEasyMind package. Ask your Early Yearsdepartment if you are able to do this in your area.If your local Early Years department does not offerEasyMind as part of the start up grant, let MortonMichel know so that Early Years can be contactedon your behalf.

5. Promise of satisfaction and serviceWe are confident that your ChildMinder policy willbring you complete satisfaction. We undertake torefund the premium in full if you are not satisfiedwith the cover provided by your policy if it isreturned within 14 days of issue, but if there hasbeen an incident which has resulted or could resultin a claim you must reimburse the Company for anyamounts we have paid or may be required to pay,in respect of that incident.

6. Duration of contractThe first period of insurance under yourChildMinder policy will be 12 months unlessotherwise requested by you and agreed by theCompany.

7. Financial Services Compensation SchemeWe are covered by the Financial ServicesCompensation Scheme (FSCS). You may beentitled to compensation from the scheme if wecannot meet our obligations.
