Would a trust benefit you?
A Life Interest Trust or Immediate Post Death Interest in
Possession Trust as it is also known will allow the first spouse who
dies’s share of their property and / or money to be loaned to the
surviving spouse through the inclusion of the trust. When the surviving
spouse dies, the assets in the trust are guaranteed to pass to the
family of the first spouse and the assets of the surviving spouse pass
to their family.
A Discretionary Trust may be an appropriate inclusion in your Will if
your beneficiaries are going through a period of misfortune, such as
bankruptcy, divorce or poor state of mind or are in receipt of means tested benefits. The discretionary trust will enable
the inheritance to be managed by trustees on behalf of these beneficiaries.
Couples who are not married can include a Discretionary Trust with IOU provision in their Will to maximise their
inheritance tax allowances and therefore minimise (or eliminate) inheritance tax due on their estates.

Lasting Power of Attorney (formally known as an Enduring
Power of Attorney)
If there comes a time in your life when you are no longer able to look
after your affairs due to a sudden accident, illness or gradually
advancing age, you may wish for a close relative or friend to assist
you in paying your bills, to manage your bank accounts or to speak
on your behalf on medical matters.
None of us know what the future holds for us, but we can be
prepared. By taking out a Property and Affairs Lasting Power of
Attorney (PALPA) and/or a Heath and Welfare Lasting Power of
Attorney (HWLPA) you would be appointing somebody who you trust to look after you should the need arise. An LPA is
a legal document that can only be completed whilst you have the mental capacity to do so. So putting it off now might
mean that it cannot be done later.
A Property and Affairs Lasting Power of Attorney allows your attorney(s) to look after all or just some of your
financial and property affairs. This may include paying your bills, collecting your income and benefits.
A Heath and Welfare Lasting Power of Attorney allows your Attorney(s) to make decisions on your behalf about
your personal welfare. This may include where you live, your diet, daily routines, whether to give or refuse consent to
medical treatment. At all times the attorney is expected to have your best interest at heart.
What would happen if you lost your mental capacity and needed to appoint an attorney? If you became unable to
manage your affairs and didn’t have an LPA your relatives would need to apply to the Court of Protection so that a
Deputy could be appointed to look after your property, affairs and/or personal welfare. It is the court who would make
the choice of Deputy. This is a far more costly and a more lengthy process.

Do you know …….. The first £325,000, the nil rate band allowance
for year 2014/2015 will be free of IHT to pass to your beneficiaries.
Any assets left in your estate in excess of this amount will be
charged at 40%.
Although there is an exception, under the Transferable Nil Rate
Band legislation introduced in Oct 2007 married couples and civil
partners can pass their entire estate to the surviving spouse without
incurring any inheritance tax. On second death they are eligible to a
combined total of £650,000 in 2014/2015 before attracting an
inheritance tax liability.
However for an application to be successful you need to be prepared; In order to gain benefit from this transfer of
assets your claim would need to be supported by all relevant documents, including your original Will, any Codicils or
Deed of Variation, a copy of the Grant of Probate, death certificate, tax documents and details of any gifts that may
have been given out of the first deceased estate in order to prove what IHT allowance may already have been used
up.
There are many ways in which your IHT liability can be reduced. Some of the options that Christie Munro
would discuss with you to reduce or avoid IHT entirely are:

Are you familiar with the Intestacy Rules (dying without a Will) – this is why at Christie Munro Will Writers we
advise that you should have a professionally drafted Will.
Many people die without leaving a Will believing their close family will inherit their estate. Sadly, intestacy law may not
allow your estate to be distributed as you may expect.
If you die leaving a husband, wife or civil partner (“the Spouse”) and you have children your Spouse will take all your
personal belongings/chattels and your spouse will receive a legacy of £250,000 from your estate. Anything above this
is divided into two. Your Spouse gets a life interest in half – i.e the income made on half of the residue– not the half
share itself. The other half, and the surviving Spouse’s half when they die, goes to your children and, if your children
die before you, to your grandchildren. This legacy is held on trust for minor beneficiaries until they attain 18 or
marry under that age.
If you die leaving children or grandchildren but no Spouse, your children, or grandchildren if your children die before
you leaving children, take your entire estate.
If you die leaving a Spouse and parents or siblings, your Spouse will take the personal belongings and a lump sum of
£450,000, plus half of the rest of your estate. The other half goes, in equal shares if more than one to your parents, or
if both have died before you on statutory trust to your surviving brothers or sisters of the whole blood and if none to
your nephews and nieces.
Your Spouse receives everything if there are no children, grandchidlren, parents, or siblings of the same parents …..
and the rules of intestacy go on benefitting remoter relatives and if nobody is eligible your estate will pass “bona
vacantia” to the Crown.

Important matters to consider and why you should have a will.
If you were to die intestate could your spouse survive on £250,000 and the interest on half of the rest of your estate –
not the capital?
Cohabiting partners are not automatically eligible to inherit anything from their partners estate.
Your children and grandchildren would receive from your estate at age 18. Would you want them to have access to all
that money at such a young age? Would you not prefer that they were 21 or even 25?
Your friends and charities who you may have supported in your life will never receive from your estate.
It should be noted that if the family home is held jointly and not as Tenants in Common then the house will pass
automatically by survivorship and so will not form part of the £250,000/£450,000 legacy.

Many people think that Lasting Powers of Attorney are only for the elderly. This simply is not the case, having a
Lasting Powers of Attorney is equally important to have incase of accident or sudden illness. Any person from the age
