laxei DueA five year controversy over tax assessments was partially concluded when the Property
Appraisal Adjustment Board ruled the Ringling Bros. Barnum & Bailey Shows, Inc., must paySarasota (Fla.) County Taxes on its property in Venice and an apportion of its tangible personalproperty for the traveling shows.
However, the Board decided not to rule on putting the circus trains on the tax roll until anappeal from last year's taxes is resolved in the Leon County Circuit Court.
The Board determined that since the circus Blue Unit was in the county for 73 days andthe Red Unit was in the county for 28 days, the circus should pay for respective assessments of$36,520 and $7,700.
Ringling attorney Granville Crabtreelargued thetrains are not permanently located in the countySarasota County Property Appraiser
John Mikos contends the circus trains shouldbe fully assessed and taxed as being perman-ently located in the county. Such taxes wouldgo into the county funds. Mikos has agreednot to send tax bills to the circus until the lo-cal court resolves the issue.
and should be assessed only by the state. Trainsthat are determined private for tax purposesare centrally assessed by the state and themoney is then distributed to various counties

Despite some bad weather Circus Vargas hasbeen drawing consistently good crowds duringits Canadian tour. Gusty winds at Quebec Cityblew down the side show/menagerie top, how-ever there were no injuries and no damage.

SHE IS HOMEA runaway girl - 14 year old Maureen McCar-thy - was reunited with her family in Randolph,N. J., last week. The youngster left her home onJuly 13th and was found working with a westcoast circus by a San Francisco TV reporter.Although a routine missing person report hadbeen filed there seemed to be no trace of Mau-reen. Then late last month her mother sent outan urgent plea for her return because a brotherwas dying of cancer and had only a short timeto l ive .A few hours after Maureen arrived home herbrother died. The family joined together intheir grief and Maureen's mother told newsmen"I hope she's here to stay now."

BILLY BARTONNEW, VICIOUS RUMORS are being circulated aboutRUDY JACOBI - this time with an extra fillip: I amaccused of having started them! Part of the rumors in-volve the Fall Tour, which I am reported to have saidwould never transpire, when I have been writtingabout its eventuality throughout the summer (CircusCarol resumed Sept. 9th at Joplin, Mo. So, thatknocks the underpinnings from THAT silly rumor. Theother parts of the rumors are so patently preposter-ous I won't even dignify them by comment!
THE LAKE GEORGE (NY) resort area featuringStorytown USA and the Gaslight Village, had block-buster seasons with record crowds. Both parks arewell kept and beautifully framed. Storytown featuredthe Tommy Hanneford Summer Circus and the WorldChampionship High Divers. Gaslight Village spotlight-ed Kay Rosaire and her lions, the Hermine Midgets, and a small ice revue produced by illusionist Ron Ur-ban.
NEWSMAKERS: The September issue of Celebrityfeatured a great profile on CLIFF VARGAS and hisfabulous Circus Vargas While it is perfectly OK forPAUL BINDER, leader of the new non-pro "Big Ap-ple Circus", which appeared for the summer in Man-hattan in affiliation with the New York School forCircus Arts (whatever that is), to toot his horn, hiscomments need modifying. (See US Magazine, Sept.20th issue). Comments Binder: "The mammoth com-mercial enterprise that the American Circus has be-come has almost destroyed the subtle artistry of theindividual performs" The ONLY THINGS that des-troy the "subtle artistry" of the performer, Mr. Bin-der, are a lack of Polish, Skill AND Talent. Further-more, NO amateur group will ever create from the"outside" that which has been handed down by gen-erations of thoroughbreds. Circus Artists are not"manufactured" like Rock and Movie Stars.
After 32 yrs. in the biz, the BUMPY FAMILY, retireat the end of this season. Two members of the showtroupe will be married to non-professionals so theyvedecided to quit while still "going strong" and try pri-vate business for a while. See you back on the circuitby 1979, kids!

This reporter would like to correct an error in arecent column in reference to EARL ALLENof Sikeston, Mo. That report should have readthat Earl furnished a copy of a story and NOTAUTHORED it on the two Universities thatkeep the circus alive. The story was authored bya reporter of the St. Louis Globe. That articlebrought back fond memories to CHARLESKOEHLER, who was raised in Cairo, 111., just afew miles from the schools. Mr. Koehler is theformer owner of the Dixiana Circus.C. P. FOX has sent out a mailer to all CFA StateChairman asking for their help in compiling anEducational book for educators. In his bulletinFox asks each state chairman to send in any in-form ition on circuses, owners, etc., who live intheir state. The book "The Circus - A Tool forTeaching" will be compiled by the EducationalDept. of Ringling-Barnum. Wonder if this is aresult of the slide presentation made by JACKPAINTER, an engineer professor at LouisianaTech, at the '76 Dallas Convention. The demon-stration of how the circus helps him teach hisclasses was most impressive. The fall season is on its way and now the circusmust compete with football and the world ser-

ies, plus the annual fair season in the south. Butto us Southerners the circus is a part of the har-vesting season. Those interested in Cole Bros.Circus should read JOE BRADBURY's excel-lent article in the Bandwagon, a report of the1942 season. This reporter was especially inter-ested as he enlisted in the Air Force and didn'tsee another circus until after his World War IIreturn in 1946. The "Bandwagon" for July-Aug. 1977 is available for $2.40 by writing to:Fred Pfening, 2515 Dorset Road, Columbus,Ohio 43221.Speaking of the above Cole Bros, the show on-ly made two stands in Louisiana that year. Oct.8 at Lake Charles and Oct. 9 at Monroe. If Ihad known that I could have delayed my enlist-ment for a month and thus enjoyed the show. But, such is life.Well, Barbara, the Carson & Barnes did it onceagain. For the second time in three weeks sheran off from the show lot leaving a trail of da-mage and concern. "Everyone was chasing herand that made it worse," said circus owner D.R- Miller. _ _ M^ L^ DUPONT

TAXES DUE (Continued)for the amount of time the train spent in eacharea.
The circus did not appeal the assessment onthe property it owns in Venice, saying the landis fully ultilized and the $47,000 value for theland established by the property appraiser iscorrect.
Crabtree, however, argues that Sarasota CircuitJudge Lynn Silvertooth's decision last yearthat Ringling property was not permanentlylocated in the county and the tax should onlybe an apportion of the number of days in thecounty indicates the position the board shouldtake on the appeal.
Mikos' attorney says that since the ruling bySilvertooth is on an appeal, it is not bindingand should not be accepted as permanent.
Crabtree objects to a 25% penalty on the assess-ment, placed by Mikos, because the circus filedita return in Tallahassee under the central as-sessment for private trains. He said the penaltywas "absurd . .. one of the most offensive typethings I've seen." Later Mikos agreed to dropthe penalty.
According to Crabtree Mikos is using the Ring-ling assessments to inflate the tax roll and saidthe courts have decided the trains should notbe assessed by the county.
In the meantime arguments continue by bothsides and the Board says it does not have thepower to remove property from the tax roll, but simply to grant exemptions from beingtaxed. Even if the property is granted a 100%exemption, said one official, it must remain onthe tax rolls.
