REGULAR COUNCIL MEETING October 19, 2021

Mayor Cicirello called the regular council meeting to order at 7:00 p.m. with the following members present: Matt Stamm, Chris Evans, Paul Davis, Gina Gregory, Dale Kerstetter, Robert Wilson, and Ronald Colbert. Members Absent: Ben Anderson Staff Present: Lloyd Newman, Public Safety Director

Press present: The Ark Valley News APPROVAL OF AGENDA Davis moved to approve the agenda as presented, seconded by Evans. Vote yea: unanimous. Motion carried. ADMINISTRATION AGENDA – OCTOBER 5, 2021, REGULAR CITY COUNCIL MINUTES- Gregory moved to approve the minutes of the October 5, 2021, regular City Council meeting as amended, seconded by Stamm. Vote yea: unanimous. Motion carried. PRESENTATIONS/PROCLAMATIONS – PROCLAMATION IN SUPPORT OF HOME RULE Mayor Cicirello read a proclamation for Vietnam Moving Wall Week, October 21-25, 2021. Many local veterans and moving wall committee members were in attendance to accept the proclamation. A. 3RD QUARTER FINANCIAL REVIEW City Treasurer Koehn reported on the financial status for the 3rd quarter. He stated that donations are the Moving Wall donations received. Stamm moved to accept and file the 3rd quarter financial report. Motion seconded by Evans. Vote yea: Unanimous Motion carried.

Mayor Cicirello questioned about a curve and installing signs on Kessler Street. Staff will investigate installation of signage. GOVERNING BODY REPORTS – COUNCILMEMBER COLBERT Thanked the Mayor for the proclamation for Moving Wall Week. Installation will occur on October 21st. Colbert moved to adjourn, second by Wilson. Proclamation WHEREAS the freedom and security that citizens of the United States enjoy

today are direct results of the bloodshed and continued vigilance given by the United States Armed Forces over the history of our, great nation; and

WHEREAS the sacrifices that such members of the United States Armed Forces

and of the family members that support them, have preserved the liberties that have enriched this nation making it unique in the world community; and

WHEREAS, we are celebrating November 11, 2021, Veteran’s Day we are calling

on all Americans to remember those who gave their lives in defense of freedom and to honor the men and women of all of our Armed Services who have served and are now serving our Country, together with their families; and

WHEREAS, we celebrate Victory in Europe (VE) Day, Military Spouse Day, Loyalty

Day, Armed Forces Day/Week, National Day of Prayer, Memorial Day, Navy Day, Army Day, and Flag Day; Therefore, I call upon all citizens to display the Flag of the United States and to participate in actives in the community. I therefore, call upon all Americans, including civic and fraternal organizations, place of worship, school, to support this day with commemorative expressions and programs.

Proclamation WHEREAS the history and culture of our great nation have been significantly

influenced by American Indians and indigenous peoples; and WHEREAS the contributions of American Indians have enhanced the freedom,

prosperity, and greatness of American today, and WHEREAS their customs and traditions are respected and celebrated as part of a

rich legacy throughout the United States. WHEREAS Native American awareness Week began in 1976 and recognition was

expanded by Congress and approved by President George Bush in August 1990, designating the month of November, as National American Indian Heritage Month; and

WHEREAS, in honor of National American Indian Heritage Month, community

celebrations as well as numerous cultural, artistic, educations and historical activities have been planned.

NOW, THEREFORE, I, Lou Cicirello, Mayor of the City of Valley Center, KS hereby proclaim the month of November 2021 as

NATIONAL AMERICAN INDIAN HERITAGE MONTH

and urge all citizens to observe this month with appropriate programs ceremonies and activities.

Final Plat Approval for Hidden Valley Subdivision Plat (SD-2021-04)

Art Marquez, pursuant to Section 16.04., is petitioning the City of Valley Center Planning and Zoning Board to

approve a final plat for the land (outlined in red in the map below) located north of Ford Street and west of Craig

Street, currently addressed as 2740 E. Ford Street, Valley Center, KS 67147.

Applicant's Reason for Platting:

Art Marquez owns this land and plans to build a new single-family residential development on this site. This plat

will create 62 new single-family residential lots for development.

Staff Comments:

The final plat has been reviewed by the City Staff Review Team, which has provided several comments/revisions

that have been incorporated into the final plat documents, which are included as a separate attachment to this staff

report. The final plat meets all the requirements listed in the required contents section (16.05.02) for final plats

submitted to the City of Valley Center for approval.

Earlier this year, the applicant requested and received waivers for the following:

1. A waiver from the use of curb and gutter roadways with underground storm water sewer, instead, using

the open ditch, asphalt paved roadway described above.

2. A waiver from the requirement of placing a sidewalk through this development.

3. A waiver to allow the use of on-site alternative sanitary sewer systems in lieu of the extension of public

sanitary sewer.

The Valley Center City Council voted to approve these waivers at their April 20, 2021 meeting. It should be

noted that the open ditches will be maintained by the future Hidden Valley homeowner’s association and will not

be the responsibility of the City of Valley Center.

Once the final plat is approved by the Planning and Zoning Board, it will be reviewed by City Council and, once

approved, will be filed with the Sedgwick County Register of Deeds Office. This property is currently zoned A-1

(Agricultural District), so a rezoning application will also be submitted for approval at the October 26, 2021 board

meeting to change the zoning of this property from A-1 to RR-1 (Suburban Residential District).

A public notice was published in The Ark Valley News, along with letters sent to all property owners within 200

feet of the boundary of the proposed final plat. As of the date of this report, there have been no written responses

received in protest to this proposed preliminary plat.

Staff Recommendation:

City staff recommends approval of this final plat application.

Applicant's Reasons for Rezoning: The applicant is requesting a rezoning from A-1 to RR-1 in conjunction with the

development of a new single-family residential subdivision. Prior to the review of this application, the Planning and

Zoning Board will review the final plat application for this proposed subdivision, which is called Hidden Valley. The

proposed development will create 62 new single-family residential lots. The applicant has written a formal request letter,

which has been attached to this staff report.

Review Criteria for a Zoning Amendment per 17.11.01.H (criteria in italics)

1. What is the character of the subject property and the surrounding neighborhood in relation to existing uses and their

condition?

The subject property is currently a mostly vacant piece of land with one single-family home (which is owned by the

applicant) and a few accessory buildings. This property has been identified on the City of Valley Center’s Future Land

Use Map as single-family residential use. The surrounding neighborhood is a mixed-use neighborhood with several

single-family homes, some commercial and industrial properties to the east, and land that is currently used for agricultural

purposes.

2. What is the current zoning of the subject property and that of the surrounding neighborhood in relationship to the

requested change?

The current zoning of the subject property is A-1 (Agricultural District). The surrounding zoning and land uses are as

follows:

• North: A-1 (Agricultural District)

• South: RR-1 (Suburban Residential District)

• East: I (Industrial District)

• West: RR-1 (Suburban Residential District)

3. Is the length of time that the subject property has remained undeveloped or vacant as zoned a factor in the consideration?

No

4. Would the request correct an error in the application of these regulations?

No

5. Is the request caused by changed or changing conditions in the area of the subject property and, if so, what is the nature

and significance of such changed or changing conditions?

The rezoning request is the direct result of the proposed plat and residential subdivision that the City is reviewing

concurrently with this application.

6. Do adequate sewage disposal and water supply and all other necessary public facilities including street access exist

or can they be provided to serve the uses that would be permitted on the subject property?

The proposed subdivision will have public water provided by the City of Valley Center and private septic systems for

wastewater. The use of private septic systems, along with open ditches for stormwater management, have been

approved by City Council. After platting is completed, work will begin on installing the water and street

infrastructure to serve the new subdivision.

7. Would the subject property need to be platted or replatted or in lieu of dedications made for rights-of-way, easements,

BACKGROUND Over the past 19 months, society has realized the importance of being flexible as well as providing a healthy work/life balance in the workplace. Many industries have reexamined how day to day operations impact the daily lives of their employees and their families. The City of Valley Center is no different in that regard. The idea of changing the hours of work schedules and operations has been reviewed in the past with nothing formally approved. The addition of Section 9.12 in the Handbook Outlining General Personnel Policies and Guidelines would do just that. Currently, we do have some employees that work various schedules, and this will allow for a more unified approach for department heads and administration.

PROPOSAL The proposed addition of Section 9.12 – Work Schedules & Hours of Operations will authorize the flexibility for department heads and administration to provide exceptional services to the citizens of Valley Center. All City Buildings would open at a unified time at 7:00am which would streamline the opportunity for people to conduct their business with the city. Currently, only the Public Works Building is open from 7:00 a.m. to 4:00 p.m. The proposal will allow for the department heads and administration to establish various work schedules that are more flexible for the employee’s work/life balance, as we continue to strive to attract and retain extraordinary employees. BACKGROUND

As part of the recent ongoing roadway improvements and the desire to beautify the City Entrances, the City has determined the need for new entry monument signage to enhance the experience of residents and visitors, make our city boundaries known and identifiable, as well as update current signage to reflect consistent, City/School branding. The overall project would include installation of three (3) monument signs, lighting, irrigation, and landscaping. Signs will be generally located at the following entry points of town:

• Northeast Entry Sign – near the intersection of East 5th/85th Street North and Broadway located at the southwest corner of the intersection.

• East Entry Sign – near the intersection of East Ford Street/77th Street and Broadway located at the northwest corner of the intersection.

• South Entry – near the intersection of Meridian Avenue and 69th Street North located at the northwest corner of the intersection.

FINANCIAL CONSIDERATION

• This project has a budgeted CIP expenditure allocation of $200,000 for all three (3) signs for the total project.

• This project is consistent with strategic plan goal 3.1 B for enhancing community spaces as outlined in the 2021 strategic plan.

The three (3) new signs will be situated in the general vicinity of the following locations. See attached maps.

History Valley Center is a community of approximately 7,500 located in northern Sedgwick County just west of Interstate 135. Located on the border of the Wichita metropolitan area, Valley Center is home to many small and medium-sized businesses, has an excellent school system, and housing stock ranging in age from the late nineteenth century to brand new. Valley Center has a small-town, historic atmosphere with access to the amenities of a major city. The population of Valley Center has been steadily growing over the past few decades. The City has recently completed or is in the process of completing numerous improvement projects, such as construction of a new community center/library, replacement of major sections of antiquated water lines, and significant improvements to the City’s stormwater infrastructure and wastewater treatment plant. The City has also updated to the bicycle and pedestrian master plan and strategic plan and are now looking forward to construction of a new Recreation/Aquatics facility slated to begin construction in late 2022/early 2023.

Currently, the City is working on construction of major roadway infrastructure projects at key arterial streets within the City. As part of these ongoing improvements, the City has determined the need for new entry monument signage to enhance the experience of residents and visitors, make our city boundaries known and identifiable, as well as update to signage to reflect consistent, City/School branding. Contractor Responsibilities

1. Each bid must be submitted on the Bid Forms provided. All blanks in the Bid Form must be filled in and the total cost must be stated in both words and figures. It is the sole responsibility of the bidder to see that the bid is delivered to the proper place and received at the proper time. Any bid received after the scheduled closing time for receipt of bids will be returned to the bidder unopened.

2. The bidder to whom award is made shall execute a written contract with the City

within thirty (30) calendar days after notice of the award has been sent by email to the email address provided in the proposal. The contract shall be made in the form adopted by the City and incorporated in these specifications. The bidder warrants that they possess, or have arranged through subcontracts, all capital and other equipment, labor, and materials to carry out and complete the work hereunder in compliance with all applicable Federal, State, City laws, ordinances, and regulations.

3. The Contractor will be responsible for procuring the correct and necessary licenses and permits to perform the necessary work to complete this project. Licenses/Permits include but are not limited to the following: Right-of-Way Permit; Sign Permit, Business License. All local permit fees will be waived.

4. It shall be the responsibility of the Contractor to locate all existing utilities and protect them from damage.

5. Contractor shall repair at his own expense, any damage, whether inside or

outside of the project limits, to utility systems, surface pavements, fixtures, structures, or vegetation that is not specifically indicated to be modified or removed. All damaged items shall be repaired to their original condition, as acceptable to the City.

6. Contractor shall leave site and surrounding areas clean and free of any debris or other unsuitable materials.

7. All traffic control will be the responsibility of the contractor.

Contractor shall be responsible for all damages to persons or property that occur as a result of its fault or negligence in the performance of this contract and shall be responsible for the protection of the project site until final acceptance by the City. Contractor shall take all necessary precautions for the safety of workers on the project and shall comply with all applicable federal, state, local and other safety laws, standards, orders, rules, regulations, and building codes to prevent accidents or injury to persons on, about, or adjacent to the premises where work is being performed and to provide a safe and healthful place of employment.

Questions Regarding the RFP

If a prospective bidder is in doubt or has any questions as to the true meaning or intent of any part of the Bid package, or discovers discrepancies, errors, or conflicts, or omissions, he/she may submit, to the City, a written request for an interpretation or a correction thereof. Interpretations or corrections shall be made only by addendum duly issued by the City. A copy of such addendum will be posted on the City website and such addendum shall be considered a part of, and incorporated in, the Bid documents. Telephonic requests will not be taken. Any interpretation or correction of the Bid documents will be made only by a written Addendum. No oral interpretation of any provision in the Bid documents shall be binding. Questions must be received in writing no later than December 1, 2021, 5:00 p.m. Questions received after this date will be deemed not received. No persons other than those noted above, including elected official or professional advisers, should be contacted during the solicitation process unless you are specifically directed to do so. The City reserves the right to reject the proposal of any respondent failing to comply with this provision. The risk of receipt of misinformation that could result from a respondent contacting any unauthorized person will be borne solely by such respondent. All questions received, and their answers, will be provided in writing to each institution known to be in receipt of this request for proposals in accordance with the calendar stated.

Description/Scope of Work

1. The successful proposer, as Contractor, will furnish all labor and materials, tools, equipment, facilities, transportation, storage, and services necessary to complete the procurement and installation of three (3) entry monument signs as shown/specified.

2. The Contractor will be required to submit shop drawings, material and color

samples, and submittals and Site Plan for City approval.

3. Timing is anticipated for this project to begin February 1st, 2022, with 60 calendar days for completion from issuance of Notice to Proceed.

4. All work will be done between the hours of 7:00 a.m. and 5:00 p.m. local time,

Monday through Friday. No work will be allowed on Saturday or Sunday, or City Holidays without approval.

5. Sign materials used to construct the sign will be at the discretion of the

contractor, but the sign must appear as shown in Attachment 1 below. The City of Valley Center will have final approval of materials used to construct the signs. The sign must contain a stone or stone like base and column with concrete or concrete like accent caps. The sign must have the State of Kansas outline shape and accent sign painted as shown with incorporated graphics (exact colors TBD). City to provide Hornet artwork logo.

6. The selected sign company will coordinate with the city selected electrical

contractor for rough in conduit for lighting and electrical outlets as required. Each monument sign will have a total of 3 - 20amp, 2 gang electric outlets (locations TBD) and one recessed, single gang outlet located behind each Hornet emblem.

7. The Contractor will be responsible for site demolition, grading, leveling, and

preparation of the surfaces for construction.

8. Contractor will also be responsible for the installation of concrete monument foundations.

9. Decorative Hornet emblems will be furnished by the City of Valley Center and

installed by the Contractor. Hornet emblems will need to be installed with standoff hardware spaces. Hornet emblem will be back lit with purple LED strip lighting to illuminate from behind the emblem. Recessed electric receptacle to be located behind emblem.

10. The approximate location of each sign to be installed or demolished is shown in

the attachments below. All installation locations will require additional review to determine exact monument sign orientation and placement. The City will work with the Contractor and field-locate each location prior to installation. However, bidders are to verify conditions at each site prior to bid submission to make themselves familiar with each location, its surrounding area, proximity to right-of-ways, and other factors which may affect project costs, permitting and schedules. No allowances for cost adjustments will be made if a Bidder fails to adequately examine the project sites before submitting a bid.

Proposal Information Your response to the RFP should address the following items: Sign Design & Construction Services 1. Site & Construction Services. Provide a brief summary of your businesses approach to this project including site preparation and construction services.

2. Organizational Capacity: Provide brief descriptions, including other signage and monumentation experience, of the principal personnel who would work with the City and describe their responsibilities for this project.

3. Timing: Provide a proposed timetable for the project, including your company’s availability to begin the project to completion.

4. Pricing: Provide a total price for the requested services in an itemized format, including, sign, materials, site preparation, construction, clean-up, etc. Explicitly note any items that are on a reimbursement basis. 5. Potential Conflicts of Interest: Indicate if there is any litigation or regulatory action or any current or historical engagement or relationship with any public or private party that could potentially create a conflict of interest with the City or that would adversely affect your firm’s ability to participate in this project. Deliverables 1. Schematic Design Packet – Two 11” x 17” hard copies and an electronic set submitted to the City for review and approval. 2. Submit to the City as-built documents of each completed sign by the Contractor Selection Process An evaluation panel consisting of representatives from the City will review the proposals upon receipt. The proposal submitted will be the primary document on which each respondent will be evaluated. Proposals will be evaluated by the panel considering the factors, which are listed below, and which are listed in no particular order of significance:

6. Conformance with this RFP. The City reserves the right to select or reject any or all proposals submitted, to waive any formal proposal requirements, to investigate the qualifications and experience of any Respondent, to reject any provisions in any proposal, to obtain new proposals, to negotiate the requested services and contract terms with any Respondent, or to proceed to do the work otherwise. The City reserves the right to retain all proposals and information submitted and to use in the project any idea or concept contained in any submitted information, regardless of whether that firm is selected. PLANNING AND ZONING BOARD/BOARD OF ZONING APPEALS MEETING MINUTES CITY OF VALLEY CENTER, KANSAS

TUESDAY, OCTOBER 26, 2021, 7:00 P.M.

CALL TO ORDER: Vice Chairperson Paul Spranger called the meeting to order at 7:00 P.M. with the following members present: Mike Boyd, Brian Shelton, Rick Shellenbarger, and Steve Conway. Members Absent: Chairperson Janzen, Toby Meadows City Staff Present: Brent Clark, Ryan Shrack, and Angie Basden Audience: Jeff Ray, Taylor Bliss AGENDA: A motion was made by Board Member Shellenbarger and seconded by Board Member Boyd to set the agenda. Motion passed unanimously. APPROVAL OF DRAFT MINUTES: Board Member Shelton made a motion to approve the September 28, 2021 meeting minutes. The motion was seconded by Board Member Conway. Motion passed unanimously. COMMUNICATIONS: None PUBLIC HEARINGS BEFORE THE PLANNING AND ZONING BOARD/BZA:

1. Review of SD-2021-04, application of Art Marquez, pursuant to Section 16.04., who is petitioning for approval of a final plat for the land located north of Ford Street and west of Craig Street, currently addressed as 2740 E. Ford Street, Valley Center, KS 67147.

Shrack shared his staff report with the board regarding this final plat. The platted area will include a residential neighborhood that will consist of 62 single-family homes, on public city water, and septic. There is a waiver for open ditches that will be maintained by the HOA (Homeowners Association). Jeff Ray representing the applicant reiterated what Shrack said and added that all roads will be paved. At this time, the builder will be Art Marquez and it is still undecided on house plans and pricing, but it is estimated that housing would start at the $300K range. Vice Chairperson Spranger opened the hearing for comments from the public: 7:03 PM No comments from the public. Vice Chairperson Spranger closed the public hearing: 7:11 PM Based on the City Staff recommendations and discussion by the Planning and Zoning Board, Board Member Shellenbarger made a motion to approve SD-2021-04 for final plat for the land located north of Ford Street and west of Craig Street, currently addressed as 2740 E. Ford Street, Valley Center, KS 67147. Motion was seconded by Board Member Boyd. The vote was unanimous.

2. Review of RZ-2021-04, application of Art Marquez, pursuant to Section 17.11, who is petitioning for a rezoning of land that is currently zoned A-1, which is the City's designation for an agricultural district, to RR-1, which is the City's designation for a suburban residential district. The land is currently addressed as 2470 E. Ford St., Valley Center, KS 67147.

Shrack shared with the Board regarding this rezoning of land that this will go along with the final plat. Shrack explained that RR-1 supports larger lot sizes and City staff feels this is the best use of the land. Vice Chairperson Spranger opened hearing for comments from the public: 7:13 PM No comments from the public. Vice Chairperson Spranger closed the public hearing: 7:15 PM Based on the City Staff recommendations and discussion by the Planning and Zoning Board, Board Member Shellenbarger made a motion to approve RZ-2021-04 for rezoning the land from A-1 to RR-1 to support the larger residential lots. Motion was seconded by Board Member Shelton. The vote was unanimous.

3. Review of RZ-2021-05, application of Robert Davis, pursuant to Section 17.11, who is petitioning for a rezoning of land that is currently zoned RR-1, which is the City's designation for a suburban residential district, to C-2, which is the City's designation for a general business district. The lot is currently unaddressed but located on the northeast corner of the intersection of 5th Street and Seneca Street, Valley Center, KS 67147.

Shrack advised the Board that the applicant Mr. Davis had a prior engagement and was unable to attend tonight but appreciated the Board’s review of his rezoning application. The applicant/owner has been approached by someone wanting to buy the property to put commercial offices on the property. The applicant agreed to go through the rezoning process before the sale of the land. This request is for a property currently zoned RR-1 to C-2. Shrack explained that the only item the Board will be approving tonight is just the rezoning of this property. He noted that this area is already a mixed development of commercial and residential properties. Public notices were submitted to the paper and to surrounding property owners. There was no public opposition. Vice Chairperson Spranger opened hearing for comments from the public: 7:18 PM No comments from the public. Vice Chairperson Spranger closed the public hearing: 7:20 PM Based on the City Staff recommendations and discussion by the Board of Zoning Appeals, Board Member Shellenbarger made a motion to approve RZ-2021-05 for the rezoning from RR-1 to C-2. Motion was seconded by Board Member Conway. The vote was unanimous.

4. Review of V-2021-04, application of Kristin Bliss, pursuant to City Code 17.10.08., who is petitioning for a side yard building setback variance of one (1) foot to allow for the construction of a building addition to the existing house at 634 N. Abilene Ave., Valley Center, KS 67147.

Shrack explained this property is zoned R-1B and the side yard setback, per zoning code, is 6 ft. The applicant’s family is growing and they would like to add an addition to the house and solar panels. The Board is only approving the variance, not the actual building permit. Public notices were submitted to the paper and to surrounding property owners. There was no public opposition, however, a neighborhood homeowner contacted Shrack inquiring the reasoning for the letter he received. The variance is to go from 6 ft. to 5 ft. for a 1 ft. variance. Vice Chairperson Spranger opened hearing for comments from the public: 7:22 PM No comments from the public.

Vice Chairperson Spranger closed the public hearing: 7:25 PM Based on the City Staff recommendations and discussion by the Board of Zoning Appeals, Board Member Conway made a motion to approve V-2021-04 for a side yard building setback variance of one (1) foot. Motion was seconded by Board Member Conway. The vote was unanimous. NEW BUSINESS:

Shrack provided an update on a previous item the Board had approved, LS-2021-01. At the time of this request, the property owner was pursuing a commercial opportunity and applied for a lot split of the property. This went before the Planning and Zoning Board and was approved, however the owner never submitted the paperwork to the Sedgwick Co. Register of Deeds Office, and the property was sold. The new owners were not told of the lot split and rezoning of the property. After consultation with the City Attorney, since the documents were never filed with the Register of Deeds Office, the lot split can now be considered null and void. The new lot from the lot split was also rezoned to C-2. The new homeowner will be coming before the board at the November Board meeting to have it rezoned from C-2 back to A-1.

OLD BUSINESS: None STAFF REPORTS: Shrack informed the Board that the next meeting will take place on Tuesday, Nov. 23, 2021, and there will be four applications to review at that time.
